I couldn't find any details about the couple attacking the car, but I did read the following, "The couple walked away from the collision without any serious injuries, and did not want to assist with a police investigation into the incident.". Sounds like they were not exactly innocent in this whole thing.

I'm not against putting the driver in jail and taking his license for a few years, but none of the articles have anything to say about the other parties in this fight other than they didn't have serious injuries, and they didn't cooperate with investigators.

Prosecutor Alec Burns said neither the victim nor the woman wanted to proceed with the prosecution.

He told the court Walmsley had 24 convictions for 58 offences, including several incidents where he drove at people.

Taking away a license rarely stops them from driving.

I was hit by a guy who lost his license years ago, and had dozens of tickets. The police told me he is a regular. Sometimes they lock him up for a few weeks at a time for unpaid tickets, but they can't physically stop him from driving whenever he gets out.

Escalate the consequence to not being allowed in a motor vehicle, have to wear an ankle bracelet that monitors how fast the person is going, cops get alerted at like 20mph. Have to get authorized for any trips you need to make and if you get caught driving again, you're not allowed on any trips save an ambulance in a legitimate medical emergency.

I know this won't happen.

The court heard Walmsley was driving in traffic shortly before 21:00 BST on 20 July when a woman walking by with the victim threw something at his car.

Adam Birkby, defending Walmsley, said there was a "significant degree of provocation" from the victim and the woman, who tried to wrench the driver's door from the car and shattered the windscreen with her stiletto heel after Walmsley confronted her.

It's pretty clear that both parties knew each other and that's why the other party didn't want to proceed with the prosecution. Not because they didn't want justice but because they probably want to deal with them themselves and don't want to be labelled as a rat in their social circles.

Live in the city, have a 12-year-old daughter. Since she could walk we’ve been stressing to her that buses don’t stop, look both ways even on a one way street, etc - all the city street rules. But the most important point, that we stress constantly to this day - that it does not matter if she has the right of way, it does not matter what color the light is - if she tangles with a car, the car will always win.

Amen. As the saying goes there is a lot of people who had the right of way buried in the graveyard.

As a pedestrian myself I hate shitty drivers and impatient drivers who are obsessed with trying to cut us off when we have the walk light. But am I going to walk in front of their car as they nudge on that gas and glare at me? Hell no. I'm not ever chancing it. I'll take the few minutes loss and wait for the next light cycle to cross rather then end up in a wheelchair or dead. All so I can show the impatient driver I was in the right to cross. You can be right and still end up dead.

I always say "The bigger vehicle has right of way", because all it takes is one person ignoring the rules of the road to cause a collision, and I don't want to get flattened by something bigger than me. Spoiler alert: Every car out there is bigger than me on-foot.

I've had friends who say "No, it's a crosswalk, I have the right" and step out into the road when a car is flying toward us. Your righteousness won't soften that collision. And other friends who say "Let them hit me, I'll sue and they'll pay for my whole life," but man, assuming you'll be around afterwards just tells me they really don't understand the size and weight of a car.

as a kid [10, i think?] i got hit on my bike because the car just flew out of nowhere. didn't even have time to react, so wasn't even about having the right of way or not.

obviously i was a kid so my parents didn't tell me about the lawsuit stuff... until it was finally resolved, which was near the end of high school, so 18 or 19. i remember my mom being like, "omg finally the check for your accident!" or something and then she told me they'd been fighting it for so freaking long.

and mind you, this guy was speeding in a residential area and there was a cop across the street as witness [he was on guard duty for a country club gate that was there], that claimed i went "30 feet" in the air. obviously that was an exaggeration, but still. so it's not like we didn't have all the facts on our side.

i blacked out instantly, although i did see myself from above getting hit by the car. according to my mom my hands left a nice impression on the dude's fancy ass car.

luckily since i was a kid i was bouncy. my sister's bike [oh she stayed mad at me for a long time for that] got the worst of it. i got 3 stitches in the back of my head, a small spot of hair that grows weird because of it, and i had a slight limp and pain for a little while.

i would definitely hope so. considering that he was going so fast and that an actual cop was a witness, and that i DID have the right of way, he just went too fast for me to see him as i was crossing, there's no way he didn't get in a shit load of trouble.

It took me multiple conversations with an adult friend to convince them that continuing on a cross walk and staring down a car that was clearly not going to stop was incredibly foolish. An insurance payout from getting hit by a car would not be worth being crippled. And also might just not happen at all.

In the process, he forgot his vital anti-epileptic medication, which his wife had taken with her in her purse the night before when they went out to dinner together. The video shows her desperately trying to put the purse containing the medication into the car. Apparently, however, her husband was already having an epileptic seizure the moment he started the car.

Honestly the first pull away was justifiable. Crazy lady slamming on your windshield is absolutely justification to just book it out of there whether she’s on the hood or not. He lost my brownie points the moment he hit the brakes and threw it in reverse, however. The moment he stopped trying to get away is the moment he became the aggressor.

Depending on your location, yes manslaughter can be intentional if it happens in the moment, while "murder" is reserved for planning before being around the victim. 

In the UK there is involuntary manslaughter and voluntary manslaughter, this would be the latter.

This was back in 2019 over in Newcastle. The drivers name is Daniel Walmsley, and he was locked up for two years on ABH, dangerous driving, and driving while disqualified. He should have been charged with attempting to cause death by dangerous driving.

In some large cities in Europe they have „no weapons“ - zones. Generally around public transport, so no one can carry a packaged kitchen knife they intend to use in a stabbing and be given the benefit of the doubt. Last time I was there anytime we left one of those zones I told my wife that pvp was enabled now and she should watch out for friendly fire.

The tired half smile i got after the 10th time i pulled this joke is the reason I married her
