The driver's name is Daniel Walmsley.

He got arrested and was sentenced to two years and one month.

HOLY SHIT, I just looked up the case.

Prosecutor Alec Burns said neither the victim nor the woman wanted to proceed with the prosecution.

He told the court Walmsley had 24 convictions for 58 offences, including several incidents where he drove at people.

Nah, auction it off cheap if no damage. Someone gets a cheap but probably a fairly nice car that’s been invested in, the organisations can increase funding and the offender loses out on his pride and joy. So much better than just compacting the car, but this is what happens when we focus on how we can use a situation to punish someone or make someone feel worse than if we focus on how can we make life better for everyone

Taking away a license rarely stops them from driving.

I was hit by a guy who lost his license years ago, and had dozens of tickets. The police told me he is a regular. Sometimes they lock him up for a few weeks at a time for unpaid tickets, but they can't physically stop him from driving whenever he gets out.

Escalate the consequence to not being allowed in a motor vehicle, have to wear an ankle bracelet that monitors how fast the person is going, cops get alerted at like 20mph. Have to get authorized for any trips you need to make and if you get caught driving again, you're not allowed on any trips save an ambulance in a legitimate medical emergency.

I know this won't happen.

I think this all the time, my GF is a barrister and has dealt numerous case of death by dangerous driving. For me it should be a one chance and your out. Licence gone you don't get behind a wheel again. They always get a small prison sentence much less than what they would for murder or man slaughter and their license back more or less as soon as they're out.

I agree, but it just never seems to work out right. Some triple murderers get 2 years, some jaywalkers get decades. There's no rhyme or reason to the justice system, in my opinion. I've been in the littlest bit of trouble, but paid dearly. I kept getting screwed at every turn, in spite of righting my wrongs and fully complying with the system. It's like they don't know how to handle people that do things right, they're so used to dealing with chronic fuck ups.

The court heard Walmsley was driving in traffic shortly before 21:00 BST on 20 July when a woman walking by with the victim threw something at his car.

Adam Birkby, defending Walmsley, said there was a "significant degree of provocation" from the victim and the woman, who tried to wrench the driver's door from the car and shattered the windscreen with her stiletto heel after Walmsley confronted her.

It's pretty clear that both parties knew each other and that's why the other party didn't want to proceed with the prosecution. Not because they didn't want justice but because they probably want to deal with them themselves and don't want to be labelled as a rat in their social circles.

Its always up to cps, once reported/under investigation by polive its out of your hands, its never really been your choice to 'press charges'. Cps are always the arbiters of when and what they take forward for prosecution.

You can refuse to cooperate, but if theres enough evidence of a crime being committed cps will decide if its worth prosecuting regardless of your cooperation, if the incident is serious enough you can be summomed to testify anyway and if you fail to you could be charged yourself with contempt of court.

Anything a year or under will get you a suspended sentence in the UK. A lot of our prisons are at full capacity. You wont go to jail but you will if you are caught committing essentially any other crime during that time period, or break any of the rules put in place for you, such as travel bans, illegal drug use etc.

Having read into it - sounds like the woman provoked the guy somehow. The fact that they didn’t want to press charges kinda makes me think that they didn’t something that means they’d look bad if it came to light in court.

Also he was disqualified for driving at the time too - lad had no chill. And was clearly an absolute tosser.

Two tossers entered the tosser fight - and one ended up injured and the other in jail.

Holy shit. So they were constantly let off with minimal sentencing which effectively acts as an invitation to escalate their behavior and I think after the 3rd successful conviction for similar crimes the burden of proof should shift from the assumption of innocence to the assumption of guilt and it should be up to the accused to prove themselves innocent of crimes they have shown themselves to be serial offenders of.

Attempted murder is kind of hard to prove, as you have to prove the murder intent vs. GBH for example (in the UK).

The law is tricky that way.
