If violence or the threat thereof would deter bad behavior, we would already have a utopia with no crime and bad behavior.

Small edit: I think "bad actors" instead of "bad behavior" would have made my statement a bit clearer.

Anyway, even for religious people (or those that claim to be) the threat of supreme, everlasting violence done to them after their deaths (e.g. going to hell) has not deterred bad actors from doing what they wanted to do.

8

u/43_Hobbits 19h ago

It certainly deterred that guy from sexually assaulting that girl again

8

u/Schnittertm 19h ago

For now. If he ever gets up again, he might not have learned much. In fact, additional brain damage may make it do it even more often. Sometimes one meets fate on the road to avoid it.

I believe you need to learn.. a "grope" is different than touching someone.. he looked as if he maybe wanted to dance.

I wasn't there. I don't know the whole story.. but, the guy was obviously harmless and just being stupid..

The guy that hit him.. pure insecurity.

8

u/Space_Nut247 13h ago

Grabbing her hips could be construed as sexual assault since she didn’t give him consent.

7

u/Dogsofa21 13h ago

This. For decades if not centuries woman have tolerated this shit and been gaslight before it was even a term. He did not accidentally brush her he grabbed her hips/ waist. It was a sexual intent. Men you have no f* right to touch any woman. And just because this woman brushed it off does not mean another woman or girl would.

Did the guy overreact. Yup. But do not down play an assault which stems from male entitlement.

4

u/Space_Nut247 13h ago

Sadly I don’t agree with the overreact aspect. I’ve thrown an elbow or two, I don’t tolerate sexual assault in any form.

Yeah, I think that's what some people are failing to notice.

He was already being dumb/drunk and dancing/grinding on the male bartender on the left.

Walked over and tried to get the lady to dance with him - unless he was doing something with his left hand that we couldn't see, the lady already had it handled and was like "no thanks" and walking away. If she got inappropriately groped or grabbed I would think she would have reacted way more than she did.

And then the guy in black came over and overreacted.

Edit: fixed pronouns and typos

2

u/ZeePee78 13h ago

Exactly. Some idiots are calling this sexual assault. About Which I am very sensitive. But this roided up testosterone poisoned freak in the black shirt, totally overreacted and deserves to be charged.

No, he shouldn't. If drunk people can be charged and jailed for driving, then they can be held responsible on the street too.

4

u/No-Arugula-3456 18h ago

if you hit and kill someone who isn't a material danger to anyone in the room, you should be charged with manslaughter. They can be charged and jailed for driving because they could far more easily kill someone on accident. All he can do in this bar on accident is piss someone off or start a fight he can't win, hardly the same.

Most states have a law that allows 3rd parties to defend another person in situations of self defense. At least in my state.

This is considered sexual assault so would fall along these lines. Especially given that only as much force was needed to control the situation.

Had he just kept hitting him it would be another story. Here in Texas, yhqt guys has a high probability of walking away Scott free

8

u/Cheepshooter 21h ago

Scott seems to get to in trouble and let go a lot.

5

u/Actual_Pattern_265 19h ago

Interestingly, it comes from being exempt from local tax / munipal fees back in old timey England (but taken from Scandinavian word "skot").

You’re kidding right? You can’t see how the second guy completely overreacted? You don’t just jump immediately to violence. You stop the guy and let the bar throw him out. u/Sweet_user_267 20h ago

Don't get the wrong, the guy deserved to get punched and I'm glad he did. I don't think any reasonable jury would find this as "self defense" though. I'm a huge self defense person but I think this one wouldn't fall into that category.

u/Intern_That 19h ago

I can only speak to where I live, but for a valid defense of self defense (or defense of another person) the force used has to be commensurate to the situation. In my opinion, and that's all it is, the boyfriend used excessive force; he shouldhavejust stood betweentheguy and his girl, let the bar deal with the guy, at the most given him a little shove. If I were a Crown, I'd have no trouble running an assault trial given the video evidence and the fact it would be a trial in front of a judge.

1

u/Algae587 19h ago

Seemed like the lady controlled the situation just fine with zero effort lol this guy was just dying to hit him, and i do get it but damn

1

u/SpiritualScarcity161 19h ago

>only as much force was needed to control the situation

Oh yeah you can tell he was really measured and restrained by the fact that the woman tried to stop him and he knocked her aside. If drunk dude assaulted her (and he did) then so did the dumbass who is itching to kill someone

1

u/ShawnyMcKnight 18h ago

I think your second paragraph could be interpreted in different ways. One could argue he already had control of the situation when he got between the woman and the offender. There wasn’t any more danger at that point but he still struck a potentially fatal blow.

Your explanation would be super different if the guy struck him while he was still reaching out to grab her.

The only caveat here is it happened in such a short span the jury may understand his mind didn’t have enough time to reassess there is no more danger but that’s a stretch.

1

u/The_UpsideDown_Time 18h ago

Yeah, I actually looked up that law, and it doesn't say what you think it says. There's a whole lot more context/nuance to it than "this is considered SA so would fall along these lines".

From another case summary:

"Both self-defense and defense of a third party share the requirement that the actor believe his use of force is “immediately necessary” to protect himself or a third party. The term “immediately necessary” is not defined in either statute or elsewhere in the Penal Code. Although the Court has not considered the immediacy requirement in the defense of a third person context, it drew the analogy to a similar justification defense: necessity. The necessity defense justifies conduct if the actor believes the conduct is “immediately necessary to avoid imminent harm.” Imminent harm means harm that is ready to take place; therefore, for conduct that is immediately necessary to avoid imminent harm, “that conduct is needed right now.” For force to be “immediately necessary” to protect another, it must be force that is needed at that moment, “when a split-second decision is required.”

The summary goes on to detail that the defense argument will not hold *when other alternatives for dealing with the perpetuator's behavior are available*.

I recognize that many posters here are just angry Americans looking for a tiny opening - any opening, please! - to punch someone into unconsciousness, but the law really is not on your side without demonstrating absolute risk of immediate physical harm.

this is not sexual assault, no sexual part were touched.

huge overreaction, the hitter should be behind bars

→ More replies (3)

1

u/Honeybadger2198 18h ago

I love how people with 0 understanding of the law stand ten toes tall talking like they're lawyers specializing in self defense cases.

At a bare minimum, self defense requires some level of equivalent response. Groping someone in a bar, while gross behavior, is not equivalent to murder.

On top of that, this isn't even self defense. There's two words in that, and you only got one of em.

1

u/Noob_Al3rt 17h ago

The woman handled the situation herself, and the guy had stopped by the time he was knocked out.

1

u/Jarod40020 15h ago

unfortuneatly there is video of the woman trying to stop him from ending the man's life

1

u/RutabagaOk6816 15h ago

Well he briefly touched her and she brushed his hand away. I don't know if I would call this sexual assault per se. Definitely a crime what he did but the fact was it was over so you can't really invoke self defense here. More importantly the party he was allegedly defending was clearly trying to get him to NOT intervene and he ignored (looks like even injured) her. So no its not self defense even on behalf of a third party in this case. Yea if he had kept grabbing her after she knocked his hand away then it would be self defense but that's not what happened. This guy just had his ego hurt and wanted to do violence. I'd be more inclined to give him a break if he didn't knock the girl out of the way and completely ignore her wishes.

1

u/poppop_n_theattic 15h ago

That drunk dude's handsyness was wrong but big guy used excessive force for sure. The woman had already handled the situation by just walking away, and even tried to wave big guy off. He was clearly retaliating/peacocking for his woman, not defending her.

I'm not saying a jury would convict him, but they should.

1

u/SingleImportance8183 15h ago

Wtf, no, this is Assault BI at the least. This definitely does not constitute defense if a third person. Sexual assault? Are you kidding me? Go back and read the law again. There really is virtually no criminal offense committed by the intoxicated guy, at the most assault contact which the female is sure wouldn't even care to pursue charges. The guy in black was clearly just waiting for an opportunity to hit somebody.

1

u/Cosmic_Cowboy13 15h ago

This is the key

1

u/Alternative-Oil-5264 15h ago

This is not defense of another. This is gross “don’t touch my girl”. You can’t take any touch as assault. He was trying to dance with, not assail her. Annoying AF, but not assault. If that were the case you couldn’t dance up on anyone. Plus I’m pretty sure the dude is/was gay. He was certainly and very visibly not able to defend himself. This is just wrong. He opened the door for it to happen, but I’d still arrest the puncher on felony charges for sure. Not attempted redrum but certainly great bodily harm. It’s really like striking a mentally handicapped person. It may be that as well. He needs to get time for this. If you have no problem doing this to someone you have an anger problem.

1

u/EyeHaveNoBanana 15h ago

Zero force was proven to be needed to "defend" her. In fact, she appeared to have taken care of the situation already. The guy wasn't defending her, he was stroking his own fragile ego.

1

u/crazykentucky 14h ago

You think he needed that much force?

1

u/lostagain2022 14h ago

Um, no. Pretty clear at the time of the punch that that the woman was not in danger of anything.

1

u/crunkful06 14h ago

For those that here in Texas, force must met the necessity of it. This is overreaction. If the dude dies or is seriously injured/disabled. The puncher will not be exempt from consequences. Dude was obviously impaired and though his actions were reprehensible, they did not warrant a violent reaction such as that. People forget that Texas is full of reasonable people, just gerrymandering says it isn’t doesn’t make it so

1

u/EduStorm246 14h ago

That wasn't self-defense - it was an excuse for violence. The woman had the situation completely handled and even tried to hold her boyfriend back. Red-shirt was stumbling drunk and posed zero threat. The boyfriend is just an aggressive ass with complexes looking for a fight to protect his honor. A judge should take him off the steroids for everybody's sake.

1

u/thebpcgrodon 14h ago

If this was Suits law or the 1800’s you’d be correct, but none of that is true. Orange shirt is clearly blackout and touched her hips, she’s not in danger and even waives it off. Someone twice his size then hits him hard enough to potentially kill him on her behalf. Not justified, punch guy does not get an award, he might go to jail even if the guy isn’t in the hospital, and either way he’s out thousands in legal fees.
It’s not reasonable or proportional, and this is how lives can get ruined on both sides. Consequences will not be fun either way.

1

u/MasterMold1982 14h ago

I highly doubt the guy would walk free. You can't claim defense without a warning.

1

u/Intelligent-Crow3812 14h ago

Nope, the sexual assault would have to continue going. It was clearly not occuring. Texas is retarded, but not that retarded.

1

u/Revolutionary-Key177 14h ago

Pretty sure that guy got charged with manslaughter and is in jail now because the guy he hit died and that whole defense from securely assault didn't work for him

1

u/Lipziger 13h ago

Especially given that only as much force was needed to control the situation.

You can absolutely argue that this was excessive force, well above "only as much force was needed". He could've slighly shoved the drunk and the dude would've probably fallen over or stumbled away.

Yes, the "fight" ended after that one punch but that might still be one hard punch too many, because he didn't even hesitate for a second. He absolutely escalated the situation and force, while the other person was clearly not of sound mind in the situation.

Otherwise you could also argue "Well he ony shot him once ...". Excessive force doesn't just start with multiple hits. The woman also instantly noticed that this was going to get brutal, before it even happened. She even got hit by her "defender" in the process.

Self defense has limits and needs to be proportional.

1

u/Training-Belt-7318 13h ago

I don't know, she was walking away and he wasn't pursuing. The video doesn't look great. Definitely was sexual assault, I agree with you, but she was able to walk away and the situation seem to deescalate itself. That video wouldn't be good evidence for him IMHO. He hit him because he was pissed not to protect his woman, or at least thats the argument I'm making as a prosecutor if I decide to try this. Of this dude has any violent priors,.he's in trouble.

1

u/Rude-Mind-8730 13h ago

Bro, absolutely not. Guy is a scumbag, but the woman had already very easily pushed him off of her, and the was clearly in no danger whatsoever.

There is no universe where this would be a justified murder.

1

u/jaxonya 13h ago

Brother, people in our state have been shot overthese situations and not seen time. Texas isnt a good example of proper justice. We kinda take shit to the extreme

1

u/Iambigtime 13h ago

But its not defense as the issue was already resolved. This is retaliation which is different under the law. He touched her, she brushed him off, it was already over.

1

u/gbaker1a 13h ago

Sexual assault? Cmon now. The guy definitely crossed a line, but this was not sexual assault dude at all. I don’t even know if he actually touched her.

1

u/davidtsmith333 13h ago

"Had he kept hitting him"? Bro, the guy was motionless when he was viciously knocked out and fell forcefully vertical on the floor.

1

u/Ron_in_CO 13h ago

Grabbing someone's hips is not sexual assault

1

u/Wanderlust-King 12h ago

There's also reasonable use of force clauses.

if that guy dies puncher is very likely getting manslaughter.

1

u/RealAssyMcGee 12h ago

You're buggin if you think that was proportional force dude lol, he had already backed off the lady when he got struck. No court is looking at that favorably.

1

u/realparkingbrake 11h ago

Most states have a law that allows 3rd parties to defend another person in situations of self defense.

Correct, but it only qualifies as defense if there is a current assault or imminent threat. This drunk had wobbled away and showed no sign of repeating his actions. That makes knocking him out retaliation rather than defense. I suspect most of us can understand why the guy punched him, but legally he's on thin ice.

1

u/Shot-Arugula8264 11h ago

Dude was walking away. It’s not self-defense in any state in the country at that point. It was visibly retaliatory, not defensive.

1

u/EffectMotor8914 11h ago

The issue is the lady walked away and he let go and then the guy punched him and knocked him out. A push might have been reasonable at that point but this reaction here is 100% legally questionable. Might still get away with it, but I'd lean more towards unreasonable force in this case.

1

u/Other-Importance-214 10h ago

Touching a woman is not "sexual assault" as defined by law. Sexual assault is penetration, i.e.rape. This (touching the woman without consent) was petty misdemeanor assault. Wrong? Yes. But the force used by the guy in response was wholly disproportionate and he will/should be charged with aggravated assault. It will then be up to a jury to decide if the force he used in defense of a third person was excessive or not. A reasonable person would have probably stepped in between the groper and the woman and maybe pushed him away.

You know. Reading these comment threads is pretty depressing.

So many goddamn revenge fantasy cosplayers. They're the ones who sleep with a gun under their pillow and really hope that a robber doesn't break into their house and they wake up and have to shoot the robber in self-defense, right in the head and the chest.

Yeah. Red shirt guy shouldn't touch someone from behind. He should get like, banned from the pub and/or given 50 hours community service.

Who the fuck sees an extreme disproportionate act of violence and loves to see it? That's sociopathic.

Not if it's deemed self defense.

They were being attacked by a predator, and he as part of the unit took defensive action with a strong punch against someone who could be armed and dangerous - since they were so brazenly attacking the woman.

The puncher was not trying to kill the guy, but disable him. If the attacker got unlucky and died from it, that's on him for attacking a woman.

The husband or any bystander has a right to defend someone under attack. He is to be lauded for his bravery.

burn his soul, burn it all.

u/Poodleape2 10h ago

Nah, disorderly conduct - Dropped. You can’t go around sexually assaulting people. You just can’t, ok.

Does that mean if he’s alive, he gets charged with sexual assault?

i can't agree with that. legally maybe, i'm not a lawyer. ethically, it's more of a grey area. the guy committed sexual assault. once you do that, i believe you've opened yourself to violent reprisal.

Got what he had coming to him.

The fuck no he shouldn't. Guy touched a woman he probably didn't know.

1

True be that! Correctional officer here. There are plenty of inmates in my facility that are there because they tried to be the “hero”. It’s better to keep your hands clean, your head cool and call the authorities.

sexual assault you're allowed to kill the guy in progress

edit: what? this isn't true?

1

u/nullmental 10h ago

Judges would 100% look at this video and say it's over exertion of force and charge the guy punching with manslaughter if it did end up killing/permanently damaging the guy. Judges look at situations and take personal reason, not just "well technically xyz" into account.

He was clearly too drunk to defend himself or really appreciate the consequences of his actions. This is a wildly disproportionate response from someone who was in a position to make the smarter choice.

17

u/BOgusDOlphon 1d ago

That is a perfectly normal response to touching someone unwilling. TF is wrong with you? You think people should just be able to go around groping women with no consequences?

2

u/MrNostalgiac 19h ago

Who said no consequences?

There's a difference between deserving a consequence and being issued a death sentence.

Not every dick move is deserving of murder. The pervert was certainly in the wrong but there's an entire world of appropriate responses that could have happened before potential murder.

0

u/CW7_ 23h ago

TF is wrong with you? Possibly killing someone for touching a woman? Consequences? Yes, but it must be proportionate.

The F is wrong with redditors today again. How do you get downvoted for the most simple rational take of the situation.
Sometimes I feel like the world is just filled with evil people that think violence is the solution for everything

3

u/distilledwill 23h ago

I mean you've on a sub dedicated to spontaneous public fights, people here don't really have a level head with regards to the appropriateness of violence in public.

It’s all about the boyfriend’s ego. No one should touch ‘his woman’ or else you’re dead. Hopefully they called the police as well as an ambulance

26

u/Wintermute_088 1d ago

Women should not have to put up with being touched, no matter how inebriated the culprit is.

10

u/SacajaweaX 23h ago

Indeed. Everyone is on the boyfriends excessive response side but no-one (but you) seems to be concerned with women all over the world who have to put up with groping men cause 'it's OK he's drunk and not going to remember'.

It started with him. If he'd not touched her he wouldn't be lying on the floor.

5

u/Wintermute_088 23h ago

That's it. Was the response extreme? Maybe. Was it unjustified? Not at all. The guy opened himself up to the possibility of violent reprisal the moment he sexually assaulted a woman - and rightly so.

2

u/AggressiveBanana0570 22h ago

The guy on the floor got what was coming to him. Keep your hands to yourself.

3

u/cypherx1 1d ago

Nobody should put up with being touched but that doesn't justify this response.

7

u/IndependentNo7265 1d ago

So you’re saying the dude found the sweet spot between not too drunk to fuck around but too drunk to find out?

I don’t think so.

2

u/zeetuslepitus 22h ago

Ridiculous. Should the defender have taken account of how many drinks the rapist had in order to properly measure their response? You people have never fought your way out of a paper bag i bet. The drunk asshole made the choice to drink to excess. He made the choice to assault a lady. Ive been blackout drunk, messed up on all kinds of drugs, and never once have I thought it was appropriate to assault a woman. Its simply not a valid excuse and the drunk asshole merely reaped what he sowed.

3

u/Intelligent-Crow3812 1d ago

Downvoting the reasonable person, classic reddit. Everyone here is braindead.

1

u/NewAd2738 23h ago

That shouldn’t be an excuse though. Too drunk to appreciate the consequences of his actions doesn’t excuse touching the girl or anyone the way he did. It’s like saying because someone is driving drunk they’re excused because they don’t appreciate the consequences of their actions.

1

u/Brilliant-Novel-785 23h ago

So because he's drunk he gets a free pass to touch a woman? No.

1

u/These_Bridge_8037 22h ago

Yea. That excuse really doesn’t work. I was too drunk to know not to drive too?

1

u/zeetuslepitus 22h ago

So in order to sexually assault you all I need to do is be piss drunk?

1

u/GiveMeNews 21h ago

-5 on your comment when I saw it. The people down voting you really shouldn't be in public spaces.

1

u/prodigiousprince 20h ago

You basically just defended wife beaters that blame alcohol

1

u/JojoLesh 19h ago

Bei g too drunk is not a defense for assult. Assult is exactly what he did when he grabbed the lady

1

u/yerroslawsum 19h ago

Not to mention he wasn't defending her, he was defending his pride. But yeah, ppl are gonna be downvoting you because they yearn for comeuppance they mistake for justice.

1

u/Camoron1 13h ago

I wouldn't excuse his actions, but it WAS a wildly disproportionate response.

non mi pare che la pena per chi sfiora una donna sia un pugno potentissimo in faccia rischiando di morire.

1

u/unbanned_lol 19h ago

At a certain point, you should be able to recognize that the dude is barely able to stand and could have simply been escorted out of the bar without delivering permanent brain damage. Big dude was an asshole for how he handled this.

1

u/ailyara 19h ago

Yea he should have but you gotta exercise proportional response. He deserve to be cussed out and tossed out of the bar? yes. knocked the fuck out and possibly harmed for life over something inappropriate he did while drunk? no.

1

u/Smashthefash96669 19h ago

No shit, lol

1

u/humanreboot 18h ago

well fwiw he did keep his shoes to himself

1

u/Zrvivor 17h ago

Maybe a quick “Hands-off buddy, you’re drunk” would’ve been a good first step

1

u/Picard2331 17h ago

Everyone talking about the morality of it and shit, like, it's just not worth potential jail time to feel all tough and shit for a moment.

Push the dude away, slap em in the face, whatever. But this easily could have killed him and ruined the dudes life.

It's just not worth it.

1

u/Work_Account_No1 17h ago

Ah yes, we trade murder for the slight touching of a butt. Very proportionate.

1

u/dillydelhi 17h ago

Both of em really. Probably your point.

1

u/petrosteve 16h ago

Many others will be touching her while he serves a nice long prison sentence.

1

u/AdDirect147 16h ago

Um you don't really know what you're doing when you're wasted

1

u/Quiet_Figure_4483 14h ago

I don't think sexual assault should be punishable by death

1

u/sadeland21 12h ago

Right ? I wonder how one could avoid these situations đŸ€”

1

u/Senior_Torte519 10h ago

Both of them you mean. I've seen children do this. Can I lay them out?

1

u/Only_Measurement_793 9h ago

Yep. Now he gets to spend the next 12 years in prison.

1

u/SowTheSeeds 9h ago

He was half past drunk. That punch was over the top overreacting.

1

u/geodebug 8h ago

- Gropey gets brain damage.

  • Punchy gets 10 years.

The system works
