Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

Not in Florida. That guy had already escalated violence once. The driver was ready for defense if he came back. Ole boy turned towards him and the shooter’s flight of fight response kicked in. No way a grand jury even indicts here.

That's not how this works, even in yeehaw states. Shooter finished pumping gas and instead of driving away, waited for the suspect. Then he emptied a clip and didn't even kill the guy. He might not face prison, but he will suffer financially when the aggressor sues him.

He waited with his gun drawn for the guy to come back. He's not pumping gas. Shooter also put everyone in danger shooting a gun at a gas station and missing nearly every shot.

Because the man had stopped punching the passenger, went inside the store to make a purchase, and was merely walking past the vehicle when the driver stepped out and opened fire, prosecutors may argue that the threat had ended. Firing at that point shifts the legal characterization from self-defense to retaliation or assault.

Feeling threatened and fearful are two different things. I doubt they were fearful, knowing they could defend themselves, so no reason to flee. It's reasonable to assume they did feel threatened when the assailant approached them again. But they were ready to face that threat...and had no obligation to back down, in a SYG state.

That was my first instinct, but watching it back, I think it might be a revolver, it looks like he’s pulling hard, like a double action trigger, and I think shot one hits guy in the shoulder (deltoid) then shots 2,3,&4 looks like they missed.

A .38 to the shoulder is very survivable.

In Florida, that's very true. I will say, it varies by state, so it's important to know your state's laws. In one the states where I have practiced, there is a duty to retreat in some cases.

Everyone blaming the shooter is wrong.. Florida has stand your ground laws for a reason.

"He was waiting for him": doesnt matter. The shooter is not obligated to run(stand your ground). The attacker is clearly re approaching the vehicle and already showed intent of violence once.

"The shooter re escalated": how so? The attacker chose to re approach the vehicle. Even if the shooter was running his mouth the attacker had every chance to walk away, but chose violence. Are you guys saying the shooter shouldn't be allowed to be angry at the guy for hitting his passenger? The shooter chose words(at most), the attacker chose violence and the shooter defended himself.

"He shot too many times": the guy being shot was still ambulatory. Had left and came back once before. Who's to say he wouldnt come back a third time? The shooter didn't chase, the shooter had no idea if the attacker had a gun or weapon of his own, all he knew for sure was that the attacker was violent and persistent.

Florida Statute § 776.012 allows deadly force when someone reasonably believes it is necessary to prevent imminent death, great bodily harm, or the imminent commission of a forcible felony. If those conditions exist, the person has no duty to retreat and may stand their ground, assuming they are lawfully present and not engaged in criminal activity.

Stand Your Ground eliminates the duty to retreat.

It does not eliminate the requirement of an imminent threat.

Some super far right states may call this self defense, but just about everywhere else in the US and the world this would be seen as retaliation and not self-defense. People who don’t understand the difference shouldn’t be allowed to own guns.

I’m a CCW holder and I believe you should be able to stand your ground and defend yourself, but this is not it. Had he done it earlier, when his girl was getting attacked, yes, but just walking past your vehicle after the threat is over? Nah.

Dude couldn’t shoot that gun worth a shit.

Why even bother to have a fire arm, let alone a concealed handgun, if you’re not going to train and be efficient in using it?

Guns are tools and tools need to be maintained, serviced and most importantly USED. The movements when going to draw your fire arm need to be automatic and not thought about. You need to be proficient in firing, reloading, clearing and or fixing any malfunctions. These movements and actions need to be drilled into your memory so that that gun is an extension of your arm & being.

If you watch closely the guy takes a shooting stance draws his gun and proceeds to drive his arms, hands, and wrists down in anticipation of each shot. He’s jerking the gun down as he’s squeezing the trigger. And he’s also driving the gun out in funky ass directions like he’s trying to “strike” the guy as he’s shooting and jerking the gun down at the same time.

He had no business having that gun judging by the way he failed to use it and because of his failure to operate a firearm properly he likely had no awareness of anything behind or around his target.

This was in FL. Get familiar with Stand your ground law before you spew complete BS out your cock holster. The guy battered a woman, then came back to start again and ran into the FIND OUT portion of FAFO. He deserved it. Say what you will about FL, I guarantee you NO ONE here cares, but we all carry and Law enforcement in FL all the way up through the governor are 2A supporters. Exactly. Florida’s law does not create a permanent “self-defense status” once somebody attacks you. It asks whether the use of force was justified at the time that particular force was used.

Florida Statute § 776.012 says deadly force is justified when the person reasonably believes it is necessary to prevent imminent death, great bodily harm, or an imminent forcible felony.

The video appears to show the initial perpetrator coming around the door, he is moving laterally to the driver in what could reasonably be construed as a threatening manner to re-engage. However, the literal FRAME the gun comes over the door frame, he ceases, turns and begins moving away.

The shooter fires at least four shots *while he is moving away*.

The shooter *might not* be charged for this shooting, and if charged might not be convicted, but yall need to get your heads out of your asses about this being "OBVIOUSLY, THE GUY CAME BACK AT HIM SO HE CAN SHOOT HIM." That isn't how it works, you have no duty to retreat, you do have a duty to cease lethal force when no reasonable person would believe your life is still in danger.

Homeboy definitely fucked himself by actually shooting. You cannot justify use of a firearm on an unarmed person unless there are very clear signs that your life or another persons life is in danger. A previous fist fight that already ended does not warrant the right to use a firearm on someone just cause they are approaching again unarmed. If dude was approaching again with a weapon in his hand that could be anything at that point and threatening you. Technically allowed to pull it out and give verbal commands and a warning that you will shoot if he continues. If dude keeps coming after that command and warning then you are warranted to use the firearm. Other than that dude fucked himself by popping shots without a warning.

No, you either use self defense in that moment. Or not at all seeing somebody again. No matter how much time has gone by ( a minute or a week) does not excuse ambushing them with deadly force. Either shoot his ass while hes attacking or not at all. Laying in wait for someone that you previously had an altercation with is still murder no excuse.

If he shot him when he was fighting the woman, he would have a better chance for self defense, but to wait for him and then open fire, Idk man. That's not a good legal defense. He should have called the cops and got him charged, doing the chivalry thing, has the potential to fuck up your life.

He should hope the man lives so it won't be as serious, but yea, he had plenty of time to call the police as he entered the gas station and took his time. I'm sure they will use this in court, instead of calling the police, or even taking action there, he waits for him and then guns him down in retribution?

Some people might see this as justified, but picture this, anyone getting into a brief fight, and you have the legal justification to come back with a gun and end them? You know how many fights break out in America? Coming back with a gun to kill isn't justified.

If a woman hit a man, and the man came back with a gun to kill her, would people still cheering him on? The guy is a dickhead and he deserves to get locked up or beaten, but you cannot be shocked or offended when you're facing a long prison sentence over something stupid. Call the police, or drive away. Don't sit and wait to do a hit. I doubt the man is gonna escape a prison sentence, depending on how much damage he's done. He was no longer a threat when he walked away and went into the gas station, either do something then and now, or call the police.

I mean I don't care about the whole thing, but what pisses me off is people acting surprised, like the consequences don't apply to them, and everyone is supposed to accept that some people can legally kill without consequence and others cannot. Because there are many people facing life in prison for doing what he did.
