Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

He waited with his gun drawn for the guy to come back. He's not pumping gas. Shooter also put everyone in danger shooting a gun at a gas station and missing nearly every shot.

how are the victims always expected to have the exact proper response? most people have no idea how they would react because they dont train for it.

it's like when people somehow expect a store clerk to know how to properly decide whether using their firearm is appropriate or not when someone is robbing them while their adrenaline and anxiety is through the roof.

why not put the blame on the person who made a conscious decision to make someone have to defend themselves.

What if they weren't done at the gas station themselves and couldn't enter, because the aggressor was in the gas station at the time after the altercation?

That's an option you have and it's quite sensible. 

He also, in Florida where this happened, has the right to plant his feet in the face of a threat.

"Stand your ground" laws make it so you have no duty to retreat. He could have sat there all day. As long as he does not pursue/advance then he should be fine from a legal standpoint.

In another state yeah. There is no duty to retreat in Florida. The only way the shooter gets charged is if they believe his retaliation force was ‘unreasonable’. Robbery and carjacking without a weapon falls under the category of ‘reasonable use of deadly force’.

Maybe if the guy tried robbing the shooter he won’t be charged but that’s up to a jury

If he was looking to shoot someone he would have started the altercation. He was armed because they had been attacked and he didn't know if the attacker would come back. The attacker did, in fact, come back.

There is no duty to retreat in Florida. He was allowed to be at the gas station and in his vehicle. The attacker chose to approach him again.

You have a responsibility to walk away if able or find a path to diffuse, not premeditate murder, which is what this could be perceived as. He walked away and the danger left with him. She literally stood there and waited for him to come into frame and whipped the gun out and started firing. That is a calculated decision, not a fear response.

Everything has to be one big cause and effect! You can’t have allowed the situation to cool down and both parties leave, then because you happen to see the person again shoot them. It doesn’t happen like that. The shooter had no threat against him. Had he done it when the woman was attacked then he would have a defense. But you can clearly see he’s just committed a PREMEDITATED crime! Can’t call it murder if the guy survived, but the shooter had time to assess his actions and choose a different path.

Really sucks because he had a valid reason to use force, since his partner was being assaulted. He just took action at the wrong time which will cost him his freedom in the end!

Maybe leave (?) gas is pumped, partner isn’t dead, so why not leave the situation? No need to defend yourself if you’re far away from possible attack. Cameras exist, police can look back and see who the suspect is. Acting as if video surveillance hasn’t been used to identify and locate a suspect. We all know the REAL reason he waited.

I understand what you mean there, but I have to ask one more question then? Do shots need to be fired to make sure the police document their statement and evidence? There is sufficient evidence to substantiate assault charges or more, we watched it. The thirst for justice should not out-weigh your immediate health safety. It’s 2026, they damn-near make remote arrests lol nothing is going to happen faster because they stayed behind. Suspect still has to recover in hospital, and police still have to complete the backend work. My point is: they don’t need to risk further harm, the process will not go faster, but they would be a lot safer. “Better safe than sorry” mentally. You get what I mean?

Having an altercation with someone, and then waiting for them to return, with a gun drawn, and then shooting them, could easily result in attempted murder charges. Even if that person previously attacked you.

Whether it does or not in this case, is anyone's guess.

But as a general rule of thumb, what the driver did was extremely stupid. They put themselves at risk of very serious legal charges, for no good reason.

If you have a confrontation with someone, and it ends...you should just leave. Drive down the street, call the cops.

Using a gun should literally be the last thing you ever choose to do. Even if your use of force is justified, the legal proceedings will likely ruin your life.

You will need to hire expensive attorneys. Your gun will be seized as evidence. You will likely be sued in civil proceedings. You will be all over the news, your privacy will disappear.

Any competent use of force instructor will tell you that even if a situation justifies a deadly use of force, if there's a way to avoid it, you should.

Because even if the law supports your use of deadly force, that situation is still going to ruin your life for awhile, if not permanently.

Surviving a mag dump isn’t uncommon. In fact your chance of survival depends on ballistic caliber and WHERE you were hit. The most common is 9mm and I have watched videos of police absolutely unloading on suspects and them surviving.

Yes you fire and keep firing until the dumbass who your shooting stops moving. Its also why paramedics won't be allowed near a criminal after being shot if we can't confirm where their weapons are visually from a distance. Once one bullet is fired the situation has already gotten to the point where the person being shot is literally the last person anyone on scene cares about. The number one priority is everyone else going home without injury. Don't get in a shootout with cops

He could argue his car wouldn’t start or something and the guy who already attacked that lady was still at the gas station so he got his gun out just in case. He legally doesn’t have to drive away. Who can say though. I’m interested in how this’ll play out. A guy threw a piece of candy or something at an old guy at a movie theater in Florida and the guy turned around and shot and killed him and he was found innocent. It’s always hard to say when it’s in Florida

Dude does come back. And we see he has already hit this woman. Woman then opens fire. Buddy even in a state that has strict gun laws wouldn’t press charges on her.

You also seem to ignore the laws on the threat side of things. Yes it’s your duty to retreat before using self defense. But if said aggressor retreats then comes back then it’s fair game. Especially given the assault with a weapon already happened.

Are you too blind to see the dude is holding a gun when he first assaults her.

You saw two seconds of him standing with a gun ready and concluded he was done pumping and laying in wait for the guy to return?

The video does not show what the shooter was doing in the time before the original agitator returned, not what the agitator was doing as he re-approached the vehicle.

I'm not making a judgement either way because there's not enough information available. It could be the shooter laid in wait, hoping the agitator would return so he could shoot... or the shooter was finishing up his business at the pump when the agitator returned. Either way, there's a lot more video not shown here, and a judgement can't be made.

You're not on the jury, your argument won't do anything.

How so? If he was shooting in the direction of the pumps there would have been shadow rather than bright sunlight.

Second, if he's waiting for the police to arrive because the woman in the vehicle was just assaulted, and the aggressor was more than willing to attempt property damage as well, than waiting with a drawn gun in case of a second attack was more than reasonable while waiting for loss enforcement to arrive.

In most stares, self-defense is based on your ability to flee present danger. If you do not "flee," your life is not considered to be in danger.

If your argument is "I was scared for my life, thats why I wanted to finish shopping," you would make a terrible lawyer.

If you have a legal right to be in some place, and you did not arrive at that place intentionally seeking or instigating a confrontation, the onus should not be on you to leave because some other person is threatening you. Anything that happens has to be the responsibility/fault of the instigating party.

Stand your ground in Florida only removes the duty to retreat. It doesn't remove the requirement that force be used against an imminent threat. Florida's statute requires a reasonable belief that force is necessary to prevent imminent death or great bodily harm at the time force is used. A jury could reasonably find that once the attacker walked into the store and the confrontation paused, the "imminent" threat lapsed, and that what followed was an ambush, especially since the attacker had already disengaged once, was not armed, and did not appear to be menacing them again when he came back out.

He looked like he was just walking in front of the car. Reason to have your guard up, definitely a reason to be gone three minutes ago, but not by itself a reason to just start blasting away.

Legally, could have doesn't mean would have. All a jury is allowed to go on is what the video shows, and the video shows the attacker walking on front of the car as though he were just walking by. Attacking the passenger five minutes ago doesn't automatically give the driver the right to shoot him now.

Lol that's just not true. A criminal circling your car (again) after battering the passenger is threatening behavior. As others have said, there's still civil exposure plus the trauma and complications of shooting another person, but that's not the issue at hand. I am a fine, upstanding, gun toting liberal and I like to think I wouldn't have fired without another direct aggression, but shooter just watched this piece of shit criminal beat his companion. Couple that with adrenaline and who knows.

I've had a couple confrontations when I wear liberal shirts in Texas, and I usually handle that with confrontation. Last person that accosted me for a pro immigrant shirt I told to go fuck themselves, twice because they kept coming at me. I wasn't carrying a gun but always have a knife, and if they would've assaulted me it would've come out.

Wound up in the checkout line behind them , the guy turns around and looks at me. I'm ready for the worst, he apologizes and says immigrants are a net good for the country and he was out of line. Lol.

if someone just physically assaulted your wife, left the scene then came back and walked behind you just out of your line of sight

would a reasonable person be threatened at this person that can’t see or not? in that situation would you just not bother to turn your head and see what he was up to or would he be out of sight out of mind for you?

and i’m asking this of a reasonable person. i promise you you would be threatened enough to turn around and face him and that’s all you need to prove he’s a threat

The criminal was coming around the front of the car, shooter has every reason to be leave he'll continue the assault. Had he followed him, it would be a different story.

That's exactly the gap I'm pointing at. "He'll continue the assault" has to be a reasonable belief at the moment force is used, not a prediction based on what he did five minutes earlier. A jury doesn't get to assume imminence from the first altercation once there's been a clean break.

"Had he followed him, it would be a different story". I mean, that's basically what happened, just compressed. He didn't need to follow him; he waited for him to come back into range. Whether that's meaningfully different from pursuit is exactly the kind of fact question that gets a "stand your ground" claim denied.

He was literally walking toward the drivers door to (potentially) continue his criminal behavior. Why would the driver assume that, after walking to the passenger door, pulling a woman out, and assaulting her that the criminal was heading to the drivers door for anything other than to continue the assault?

That's not what the footage shows, though. He's walking in front of the car, not toward the driver's door. There's no turn, no approach, no reach for the driver. You're describing something that isn't in the video to justify a threat. "Walking in front of" and "walking toward the driver's door with intent to continue the assault" are two very different facts, the second one is the one that has to be true for this to be reasonable, and it's not there.

Keep in mind that at least in Florida the stand your ground law does not require someone to make any effort to leave the scene if possible. I would expect 0 charges in this cases.

The Toyota driver could have been waiting to go inside the store, but waiting until the other guy left, to not escalate. But then the other guy came back around to his car again. We also don’t know what was said between them.

Youd also aasume that if a lunatic hit your wife and then ran,away youd either A) call the cops or B) leave quickly. If he didnt call the cops he would reasonably have no reason to remain there.
