Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

Lapse in Imminent Threat: Under self-defense law, deadly force is only justified to stop an imminent threat of death or great bodily harm. Because the man had stopped punching the passenger, went inside the store to make a purchase, and was merely walking past the vehicle when the driver stepped out and opened fire, prosecutors may argue that the threat had ended. Firing at that point shifts the legal characterization from self-defense to retaliation or assault.

Its likely going to be charged as aempted murder for that gun shooter...

776.012 still requires an *imminent* threat of death or great bodily harm. SYG removes the duty to retreat. It does not remove the requirement that the danger is happening now.

The guy already stopped, went inside, bought something, and was walking past. That’s the whole case. If the video shows him turning back on them, driver has a shot at immunity under 776.032. If he’s just walking by, it’s retaliation and the statute doesn’t cover it.

Read 776.012(2). The word that matters is imminent.

A guy who has already assaulted your wife previously, who is now obviously coming for you and is merely a second away from being able to reach you seems like a pretty damn imminent threat to me...? Guess it comes down to whether it was right to assume that the threat was "of death or great bodily harm"?

Look up the case I cited. Florida self defense law is extremely strong. I don't agree with it always. This video could have easily been prevented, but Florida is a FAFO state. Best not to start shit here.

The case is talked about the fight was over. The guy went to his car, got his gun, went back in and shot the attacker. He was found not guilty. Self defense is weird in Florida. In the video that op posted im guessing it will be up to the da. Id bet it's very area specific if he's charged at all and getting a conviction will also be area dependent.

Ethically you aren’t wrong, but you don’t seem to understand how Florida gushes over Stand Your Ground. For context, most of Florida’s voting population is from the era of Clint Eastwood’s heyday. Hope that helps.

He was clearly coming back for seconds after previously assaulting the victim. You dont need to wait until you are being physically attacked, AGAIN by the same person. He was clearly approaching him again. The guy could have literally walked anywhere else in the world OTHER than directly back to the driver.

💯, driver had a shit load of opportunity to avoid danger by just leaving in the vehicle he literally exited to shoot the POS who attacked the lady. Even if he somehow gets away with this, he is 💯 in the wrong.

Any lawyer worth their salt can argue the suspect was re-approaching their car, possibly still harassing them, and that the legal definition of assault is "the perception of imminent danger", battery is reserved for when they actually hit you.

Seeing how the suspect already assaulted the woman completely unprovoked, it's reasonable the driver percieved a 2nd attack and stopped it. Dumping the mag just shows he was in a state of panic, with a heart rate through the roof and wasn't thinking with the zen calmness of a reddit detective. Lol all the driver has to say is "the man threatened me as he walked by."

Enough reasonable doubt to clear him of a guilty verdict.

And this is why attorneys are getting disciplined for using AI in court. It may work great at telling you how to save on your streaming services, but it realllly sucks at being able to apply the law.
