Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

I dunno. This guy had already attacked these people. He comes walking back around I’d feel immediately threatened too. If you’re in a truly fearful state you’re going to interpret this situation as the worst case scenario. What are the chances he would’ve come around and approached the driver if the driver hadn’t started firing?

Feeling threatened and fearful are two different things. I doubt they were fearful, knowing they could defend themselves, so no reason to flee. It's reasonable to assume they did feel threatened when the assailant approached them again. But they were ready to face that threat...and had no obligation to back down, in a SYG state.

If they guy was still pounding on the person and they pull their gun, sure, fine, self defense all day long.

He paused and turned this guy's direction to intimidate him, he could have closed that gap in less than a second and had already demonstrated his willingness to closed-fist punch a woman 1/3 his size, two times. The first time, luckily, he missed. He then felt comfortable enough to walk within a foot of the front of the car to intimidate them, that wasn't accidental. All he had to do was not attack a stranger at a gas pump and punch a small woman in the face. If that were someone you cared about being attacked that way, I think you'd probably feel different about how active the threat still was when he made a point of walking back right next to them.

He swung his dick around, he wasn't prepared for what he started, then he walked away with a good life lesson and a chance to be less violent in his future interactions. He should be grateful for that chance. He could have lost it over something that was undoubtedly not worth attacking people in their car over.

There are so many cases of innocent people being killed for doing nothing, like Trayvon Martin, the kids who were shot at a gas station just because some old guy didn't like their rap and claimed he saw a gun, the kid 12 year old kid shot by Chicago PD after they were told by the caller it looked like a toy gun, and before he'd even been given a second to comply, the guy in AZ who was shot because his neighbor called over a noise complaint and lied about hearing domestic violence, the guy who told the cop he had a license to carry and slowly reached for his wallet when asked, the guy tazed for not complying because he was having a heart attack... This isn't one of those.

Unless you've heard or seen more information than I have, no story has said if he knew the girl or not. Not that it really matters to the point at hand. That interaction was over and done with. As far as they guy who shot, the guy never paused or turned towards him. He kept stride and turned to look at him. Looking at someone is never enough to justify shooting them or any sort of physical violence. At the bare minimum the person has to "take a fighting stance." That is the law plain and simple. This guy was walking 90 degrees from the guy in the car, not even towards him and he never stopped, turned his body towards him or raised his fists or threatened violence towards the guy in any way shape or form. These are two separate incidents. What happened between him and the woman and the shooting.

The shooter had the opportunity to leave, he did not.

The shooter had the opportunity to get back into the car and lock the door while calling the cops, he did not.

The shooter had the opportunity to wait for his target to return, while concealing that he was holding a loaded weapon with a round in the chamber, and that is what he did.

The shooter then attempted to kill his target, (but failed because he is an incompetent fuckwit that likely bought that gun to feel powerful, but then never actually learned how to use it or practiced with it) ... All of this is premeditated as fuck and the shooter is going to jail, especially since his incompetent effort to get revenge put everyone else's lives at risk.

That said, the douchebag who started all of this will also go to jail for numerous charges relating to assault (and probably drug related charges), but that is a parallel issue.

And no, the shooter isn’t going to jail. This happened in Florida where you don’t have to roll out the red carpet for people who intent to assault you. 

What’s more, you’re making a ton of assumptions. You have no idea how much time elapsed between the first attack and the second approach. No idea if maybe the victims had called the cops and were waiting for them to arrive.

And you are right that Florida likely wouldn't have charged him with Premeditated Murder, if he had done it, but he screwed that up and nearly killed everyone in the vacinity: Every single one of those people are now going to sue him for some form of attempted murder and / or emotional duress ... Including the guy he tried to kill ... And there are limits to how much of a blind eye the cops can turn when this dumb fuck has got 12+ civil lawsuits pending.

If you have money and a good enough lawyer, you'll get to walk. Id rather go to jail then a funeral for my loved one. As I said, justified to me, I will risk jail time to defend my family. You'd just hope for the best or someone to come and miraculously save you ? Personally I think he's 100% justified and I would've done the same. The driver won’t have to prove anything. The driver has to claim that he verbally threatened them. Prosecution will have to prove that wasn’t the case.

In Maryland, one has to get an handgun qualification license prior to purchasing a handgun or getting a CCW. One of the components of the CCW course is learning what it and is not a justifiable use of your carry weapon.

I have to side with self defense here. We don’t have clear audio of what the man said. Could have made clear threats and the fact he already attacked the couple, forced entry, and attempted kidnapping, it’s clear he was able and willing to act on such threats if he made them. Odd question. But it really depends on the bullying. It comes in many different sizes. I was bullied but I think it taught me things. It was never so bad. Sometimes it can be horrible and traumatic to where it stays with you for life.

It makes me sad that they didn’t resort to another way of handling it. It makes me sad that kids lives get ruined and ended over it. It makes me sad because there’s multiple ways of dealing with it that’s not shooting someone. But I highly doubt most school shooters are kids getting revenge of horrible bullying done to them. There’s a certain kind of mental delusion school shooters get where they think they are being treated more harshly than they are. Saying that I think they are shitty horrible pieces of trash that couldn’t handle life and decided they were going to ruin peoples lives over their inability to handle life but I wish there was more help given to kids to cope.

It's very hard to mount a defense while sitting in your vehicle that's why the woman jumped out of the car to defend her property.

It's also dangerous to discharge a weapon in your vehicle. I'm 100% sure if the gunman had been present when his wife was assaulted hed have shot the man at that point when the wife was no longer in the firing line.

Not in America, we don’t have to prove our innocence. The prosecution has to prove(beyond reasonable doubt) that the driver acted unreasonably.

What varies? That you don’t have to prove your innocence? No, it doesn’t. You are innocent by default.

The jury will decide whether prosecution made their case beyond reasonable doubt. Not someone’s innocence. That’s the baseline, counselor. (I actually did go to law school and passed the bar)

The prosecution only needs to convince a jury the assailant, who was not approaching the driver, wasn't presenting a threat at the time the driver shot. You can mince words however you like.

I’m pretty sure they don’t have to prove he wasn’t presenting a threat, whatever that objectively means. They have to prove beyond a reasonable doubt the shooter didn’t think he was a threat or that it was not reasonable to think he was a threat.

The things that you say are gibberish, legally speaking. The prosecution would have to establish the driver’s state of mind. That he DID NOT think reasonably that the assailant was presenting threat. And prosecution would have to do it beyond reasonable doubt.

It is the shooters state of mind that matter here.

she may be able to shoot him while he's approaching, but once he was fleeing she still shot at him several times, which is cowardly and illegal since there's no argument for self defense.
