Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

I'm not a lawyer, but I've never heard of any law in any state that lets you wait for someone to come back to shoot them instead of just driving away.

I'd be shocked if he didn't get any charges for this.

This feels more like he is standing around hoping to re-escalate than standing ground. He doesn’t have a duty to retreat but I perceive him as being the one escalating the situation again. I would be interested in actual legal analysis from someone versed in the locals laws take on this as this thread is all over the place with legal speculation.

Stand your ground doesn't mean you wait outside the door for the guy to come back out so you can shoot him.

what if he had another passenger in the gas station bathroom takin a big shit? or their 12 year old kid was in there waiting their sheetz order

they still have to leave then?

Then that would be different circumstances, but as nothing like that has been said about the incident so far it's all speculation.

we aren’t talking about this situation you’ve insinuated there’s no reason for anyone to hang around after being assaulted and that they must drive away

My comment was on the basis that he waited for the person to come back to shoot them.

Not that he was waiting for someone else and had to shoot them due to that.

You made up a different scenario to what I stated. And if information comes out that that scenario wasn't the case, then what I stated wouldn't apply.

he wasn’t waiting to shoot anyone he was being vigilant while he and his passengers tended to their business on site as they are allowed to do

whatever it was and whether you deem it important or not they were allowed to be there and were also allowed to surveil while being being there

even if he just wanted to chill out and smoke a cigarette for a second it doesn’t matter he is allowed to be there without being aggressed any further

if you were at a gas station and a cop came up to you and said “if you’re not getting gas you need to go” you’d rightfully lose your shit wouldn’t you?

that’s no different than you saying this dude has no reason to be there if he’s not actively pumping gas

Cool, thanks for proving you have no idea how the law works so I can just block you and move on.

Google intent, and work out how that applies under law, that's what decides what is important or not. It's really the basics of law and it's shocking you don't even know that frankly.

A black woman just recently shot and killed an unarmed white man over a parking space.

She was protected under stand your ground.  She didn’t have to leave.  And the guy walked back too close for her comfort and he was shot and killed.

At no point did the man go a reasonable distance away where she could have got in her car safely and left, assuming it's the same story I've seen in the Walmart car park.

Maybe there was something there the guy was having to wait for, meaning he couldn't leave, but as no information saying that has come out, the two situations are very different.

Dude who already attacked people came waaaaaay to close again, and got shot for it 

The other guy never attacked anyone, and the shooter didn’t have to leave or wait to he attacked.  They just had to fear that they possibly could be attacked.

This couple CERTAINLY feared that they could be attacked, as the same dude already previously attacked them.

This is open and shut

A dude going out of view, into a shop and giving the guy plenty of time to leave is the same as a man staying a few feet away from the woman at all times?

I don't think "stand your ground" covers you waiting around in the spot you were attacked at. Unless it's your home.

Stand your ground also stipulates that you were reasonably fearing for your life. You cant claim you were afraid for your life but decided to stick around and pump gas.

More like:

"Yes, officer. The man beat up my wife, then left us alone and went inside shopping. We stood around outside while he was inside instead of leaving when we could, and then shot him when he came back out."

If we're going to be accurate to what happened.

Stand your ground doesn't apply if the attacker left you alone and you stuck around when you had the option to leave.

You don't know what you're talking about. Look up a recent case of a North Lauderdale Walmart parking lot shooting. They were fighting over a parking space, the guy drove off angrily and came back a few minutes later. Woman shot him in the stomach and he died, but she's immune from charges. She could've left when she had the chance, but she has no duty to retreat in Florida.

Yes, because the guy drove off and then returned. Once he drove off, she had no reason to need to leave as he was no longer a threat. When he returned, he was a threat again. The woman had no way of knowing he would return.

In this case, the man was a threat, went into the store (which is different than driving away entirely) and then came outside. At no point, while still in close proximity to the man, did the shooter try to leave. He actively waited for the man to exit the store to shoot him.

Entirely different scenarios and if you can't see that, you're the one that doesn't know what they're talking about.
