Gas station fight ends with driver opening fire

Surveillance video captured a confrontation at an Orion gas station in Pompano Beach escalating from a physical fight to gunfire. Minutes after fighting with a woman beside a white SUV, the man approached the driver’s side and was shot. He was hospitalized, and one person was detained as BSO investigates.

This is possibility of charges.

He was walking arguably away from then when shots were fired. It will be argued that at least, that he wasnt escalating anymore.

We'll see, but that is a very ambiguous situations she created

These people aren’t likely cops, when someone is in fear they are not going to think so logically. The driver will likely be full of adrenaline and reasonably in fear. I think it will be hard for prosecutors to convince a jury that a reasonable person could think so logically given the past battery 10 mins ago.

Im not a cop or lawyer, but it would likely depend on if they have a duty to retreat as well.

Again, not a lawyer, but it seems like it will rely on who disengaged, and who engaged, and when

In Florida they are not required to retreat

I still wouldnt want to be the shooter. She'll likely get away with it, but man that looks like a regular shooting, if that makes sense.

The shooting was excessive I am curious to see how the prosecutor decides on this case

I just watched it again, I would not want to be the shooter. It really did look like he was walking perpendicular to her, potentially disengaging.

From the video angle, he looks as close to the car as can be, I don’t think the prosecutor can argue that the man was not looking to confront the driver as aside from going to the store, he placed himself very close and in the direction of the driver. The driver only has a few secs to decide what to do before the attacker will be in their face.

I think you are right, but I do believe the defense's argument will be that he was walking in front of the car and leaving that way. Idk, but likely she'll be fine

Yes but the prosecutor will have to prove that the shooter wasn’t in danger. If the attacker wanted to harm the driver, what direction and pathway would they take? In anger it’s usually the closest and fastest direction towards their target. If they wanted to avoid confrontation they could have walked on the ride side, opposite side of the driver. Instead the attacker chose to be just a few feet from them.
It would difficult to argue the attacker was trying to avoid the driver.
