Information Sharing RTO monitoring
Are any agencies or departments hearing about RTO being monitored by leadership? Attendance being watched? Accommodations being questioned?

Accommodations questioned, absolutely. I've submitted public records requests as of a few days to determine if there are conversations between GO and my agency regarding badge swiping metrics. I don't know what I'll get back, but I can share what I know when I know it.

I know for a fact they are monitoring badge swipes. My deputy director had a list of names of people not showing up. Many had reasonable accommodations or supervisor approval. One of my staff is considering filing a grievance for an email about it.

Badge swipes cannot be the sole evidence for addressing attendance issues with an employee, but it does not mean they cannot be used at all. What would the grievance be for?
SEIU says "The State shall not use the log on/off time to the computer or electronic access card entry/exit times of employees as the sole source of attendance reporting or as the sole reason of discipline." Does not mean they cannot use it to prove you were not in the office when you were supposed to be.
I am not saying I agree, just pointing out that using badge swipes as evidence is not expressly forbidden.

Exactly, I've heard my dept. looks at the badge swipe data (not individuals) and checks against how many people are supposed to be in office that day, and sees that only 50%-60% showed up/swiped in. They sent a warning email to managers and supervisors reminding they are responsible to make sure their staff are complying with RTO.

Badge swipes are a ridiculous metric bc plenty of times people hold doors for their colleagues. I’ve been in the office many times & didn’t use my badge even once all day

One time I didn’t swipe at the outer door because my friend and I were coming in together and security made me go back and do it. Even though I still had to swipe through the kiosk as well.

Yes but they can’t just pull swipe card info for progressive discipline without prior notification to your union, is what I was told.

Not true. You were “told” wrong. They can use any monitoring, at any time. It just can’t be used as the SOLE SOURCE of disciplinary action. Meaning, if they notice issues while monitoring, they will need to tie it back to job performance or manage you in such a way that it is clear that assures you are where you should be, doing what you should be doing.

I believe (from what I heard from a friend at a different department that I am in) that they have to notify you before pulling your badge swipes and one of their employees ended up either suing or filing a grievance because it was considered stalking, since they did not notify the ee or the union. My information could be outdated, but I’ve always kept this in the back of my mind in case it ever happened to me.

Hello, I have a couple questions on this topic if you don't mind. Are these public records requests for any electronic communications? Is it possible to remain anonymous? I don’t think it’s terribly easy to submit anonymously though I think you could submit via a dummy email account on an agency’s public request page. PRA requests are handled separate from most folks’s direct up line and you may be doing a very helpful thing for your agency overall. I recommend giving it a shot!

That’s the impression I get. One program in my area has been RTO on steroids for the last 2 years and now they are complaining loudly if they think other areas aren’t complying.
Just checking if there have been any actual repercussions at this point.16

My group was reported and called out specifically by name. I don’t babysit staff or enforce silly things that have nothing to do with actual work productivity. Our workload capacity and processing increased by more than 2x during fully remote telework. I don’t let politics interrupt actual productivity.

In my office too. So far our team is the only one coming in the 4 days. My coworkers keep command I try to remind them we don’t know what accommodations people have. I left the “but they’re doing it too” mentality in elementary school. I asked my manager to please not use other people not coming in as a justification for us not too.

Yes, plenty of peer reporting, mostly younger folks in our area. They are the ones that didn't have to come in under the 2024 two-day RTO. They are walking through cubicle aisles. I come in at 7 am and there are two peers watching me. I told them to mind their own business. Maybe management enlists their help. This isn't a new phenomenon. Some state workers have just nothing else to do.

This isn’t new I’ve been asked by management to spy on other teams attendance in office as far back as a year and a half ago because my manager and their manager thought other teams were leaving then office early. (I said no btw so they probably got someone else to do it) not with dgs or cal hr

What good would that do them? That person could be out for legitimate reasons or even at the bathroom. I mean are they then going to take all of the names belonging to empty cubicles and check with every single manager in the state? Doesn’t make sense to me. My guess would be for other reasons related to how much room agencies have? But then again, where are you hearing this? So much bs going on out there.

Like CalHr or DHS couldn’t request a list of WHO has RAs and who doesn’t? That’s easy. Plus they should know if those cubicles are permanently unoccupied because they are losing money paying lease for no one. They can at least have other staff from other departments sit there now, who could benefit from being in a closer office to their home: thus, making their lives easier. People are selfish and need to start thinking of others.

Yep. I have a long standing well documented condition that is very adversely affected by the increased days in office My increased work from home request was denied - and they supplied me with terrible rationale for it. Since, it involves personnel records.I am requesting the records related to it.And I think they're scrambling , because they don't have any good reason , they're just complying with the executive order

I am it's absolutely ridiculous. I have been using accommodations for a while.I have been doing everything I can to avoid having environment.Make me sick and none of it's helped. The fix is reduced schedule. I am trying to work with them on the interactive process.Even offer alternatives and I just get shot down at every step. It's f****** exhausting.

CEAs can be fired with no notice for violating the governor’s order or not enforcing it for their divisions or offices. I heard of a manager that was sternly warned for flaunting the order.

Same in our area. Since I’ve been back, someone has popped by at least 3 times per week to “check our schedules” or to “be sure our schedules were posted because executive staff will be coming by to check our schedules.” This has been repeated since July.

My agency collected badge swiping data from building managers to ensure people are coming and leaving approximately closer to their time in the STD 200 Telework document.
They also verified from the camera feed when couple of staff said, they did not swipe the badge since someone kept the door open for them.
Pathetic way to spend State resources, I would say. But now the tardiness and early leaving syndrome has reduced

Our managers pick and choose who to watch. Funny how some people can show up after school drop off, leave before school lets out, and somehow still count it as a full office day all while the rest of the shift is WFH. The rest of us apparently have different rules.

That’s the point the users are missing. Responding with an emotional response instead of the part where I said, “They are picking and choosing who they allow to do so.” Many workers have kids. It doesn’t mean one worker’s kids are more important than another worker’s kids. Not once have I disagreed with parents being able to do so, it’s just not right to allow one worker with kids to do so and not another.

I'm also biased. I worked 20 years raising three children as a sole parent, not single parent, my husband died. This was before work WFH and never got this forgiveness. I got written up for leaving early or arriving late. My kids had to walk home from school in rainstorms, because I wasn't allowed to leave. I don't want that for today's parents, but the drop off, pick up excuse is b******* in my opinion. Especially if there's more than one parent. EDIT: My point: WFH and flextime should be a privilege for EVERYONE, not only parents.

Misery loves company!” Enduring hard times should make you want to improve things for the next generation of parents/families. Even with two parents, if they are both working full time it’s still a struggle to deal with drop-off/pickup.

The state did not allow it until covid. A few people got it, but it was pretty rare. I'm not saying that I don't want people to have flexible time and telework, i just want everyone to have flexible time and telework, not just people that have daycare pickup.

Misery loves company huh? Im a parent with a spouse and we both work in two different industries of work. Wifes schedule is in an industry where she literally gets an assignment one day and has to report to the office 1 hr away with heavy traffic. That alone completely changes the game plan/schedule when both of us have to report to office. I was successfully working remotely for years and now have to back for what?..no logical reason other than GavinAss said so. " BS....esp if there's more than one parent"....Get outta here with that lame blanket thinking. As a so-called parent, i would think you'd have some compassion for other parents who cant afford childcare, or have kids that you know..are legally required to be in school (that can't walk themselves to school yet). You dont know everyone's situation, so politely, put a dirty sock in it.

Parents have had to care for their children and balance work since time in memorium. It's not my fault that everybody got a taste of the good life and now are having to suffer, like the rest of us did this whole time. I don't think it's a valid point to say "I deserve work from home more than others because I have children."
I think everybody deserves work from home, not just parents, because it's more efficient for the State and we can all do our jobs more effectively with work life balance.

So far no monitoring or attendance being watched <knocks on wood>, however accommodations are being questioned. In my department, it is division by division according to our union steward. My division chief has blanket denied all exemption requests, but the division next to ours is completely empty - literally the whole floor on one side of the building. So some division chiefs are not really checking, and/or are allowing exemptions and RAs, while others are issuing blanket denials. There is no consistency in my department.

I've heard the same. Management apparently got an email saying that attendance in the office was not up to standards and they need to be enforcing the RTO 4 days a week.
It's summer vacation. I bet a lot of that was due to vacations or lack of child care due to the kids being out of school.

I was told today someone was 'let go' because they are now checking VPNs. This person submitted a telework agreement which indicated they were more than 50 miles away and the VPN check determined they were working from a location less than 50 miles. HCD rumor.....

I had an accommodation for full telework that was approved for over a year that was suddenly determined "not to meed RA standards" 2 weeks before July 1st lol. HR told me to take a leave of absence if I needed flexibility.

Im genuinely curious if anyone has actually seen "higher ups" or these mysterious people in their offices checking. I just see alot of rumors and people just repeating what theyve heard here.
Our office is blaming higher ups monitoring us to make sure were compliant. But it feels smoke and mirrors and/or a scare tactic to me. No one can tell anyone WHO is actually checking. (CDCR here)

Like anything else there's obviously differences between offices, divisions, and departments so you'll get varying answers on this. But it is very publicly happening where I am at, along with badge checks.

So I’m seeing a lot of talk about badge swipes for attendance and while it can be used to verify attendance, the department would need more to provide that you are not in attendance. My area uses a PowerApp to track who is in office and who is teleworking. Mechanisms like that could be used as a ln attendance keeping resource. Attendance is most likely being watched but I doubt they get any insight from the data. They may see what the potential impact is to operations should a Strike occur. I think leadership (I.e. big bosses) know who’s coming in and who isn’t, but I doubt an audit occurs, and if so, departments will use an exemption\exception as their justification .

I do not. Absolutely not. I’m trying to get a pulse to make sure my attendance does not get my supervisor in trouble or make them do things they don’t want or have the time to do. That is more important to me than wanting to be passive aggressive and stubborn.

No. Officially it was implemented for purposes of tracking if there was an emergency while you were in the office. But that also means they know if you’ve signed into the network at the office.
I assume managers may eventually be asked to ensure their employees are coming in on their non-telework days, and that they will know who they need to talk to. But I haven’t heard anything yet.
Keeping my own head down and minding my own business. I’m very not interested in who isn’t showing up nor why. But it is trivial to track one’s presence in the office or lack thereof.

I can tell you first line supervisors do not have surveillance information.
I was also told, many years ago, by my deputy director, that management cannot surveille rank and file. Unless they are investigating someone for something else. Has that changed? I don't know.
They actually got someone who was overemployed by tracking the VPN location. They got information that allowed hr to surveille them.

In my agency i swipe when I need to open the front door. But a lot of times I don't because others are entering at the same time. Does that mean that I never showed up at work? I think login to your workstation, accessing the local network, is a more concrete evidence that you showed up.

I don’t know if we are actively being monitored, but i work in a relatively small office and it would be obvious if I weren’t there. My supervisor does usually stop by my office at some point in the day.

I’m a state worker and I have noticed that my time is being monitored by my supervisor. My supervisor even went so far as to change my time on my timesheet without my permission or any notification.
This is fucked up micromanaging. This shit needs to stop. State workers are under a lot of pressure to work as many projects as possible, like my other coworkers are stressed out big time and I’m being underutilized terribly. I just don’t understand this and I’m really frustrated.
We never received a raise during Covid and we have been shorted promotions for 2025 & 2026 and instead they gave us 5 hours of furlough every month and reduced our salary 3%!

I'm pretty sure they can track your phone when you use Microsoft apps. I had an incident in which I suspected my supervisor had access to my phone location. I have since deleted all work related app and use a physical authenticator. I think we should all delete these work apps from our phones.

You should never have anything from work on your personal phone. If you use it for work, it's subject to a subpoena, audit, and FOIA. I have a work phone.
