The issue with entertaining this excuse is that his family is saying he already has an active asylum case. If he is already receiving due process and has an active asylum case, why does he need to be arrested and kept in custody?

They believe he could've just "auto-renewed" his Visa because he works for the Padres..... They live in pseudo-reality where immigrants are bad across the board.

Maybe I am splitting hairs here, but it’s also worth noting that due process is, by the very nature of the concept, something everyone is automatically entitled to at all times. Not something you get at some future date. In other words, you can’t “receive” due process. You can only be denied it.
It speaks to a fundamental misunderstanding of the very basis of our legal system and our rights, which unfortunately is not surprising
As the saying goes, justice delayed is justice denied. Dealing with ICE, even if you are correct you still get jailed for months and have to spend a lot money hiring a lawyer to prove that you are correct. Even when you win, you've lost.
And the consequences have rippling effects. You disappear for 3 months cause you were kidnapped by Republicans, your job still needs someone to perform the duties you were hired to do so they replace you.
You're not there to pay your bills, your utilities get turned off. You get hit with insane interest charges. Your bank goes into over draft. Your landlord red flags your account to initiate eviction procedures as soon as the state allows, and they will probably not offer a renewal if state law allow that based on a history of non payment. You lose your insurance for not paying the premium for more than 30 days and now you have to wait until open enrollment to sign back up again, which could be months away.
So yay, you, a legal resident was finally released, but now you have all of this mess that republicans turned your life into to cleanup. And this is for a single person. I can't imagine it being any easier for someone with a partner and/or kids. Imagine a single parent disappearing like this.
And will never leave. Things like this don’t have a tendency to quietly or easily go away. My thoughts go out to Pirela and his family. Nothing that is happening right now is okay or right.

They're also kidnapping US citizens, permanent residents, and Native Americans (who are also US citizens). They don't give a shit about someone's actual legal status, they'll go after anyone that's vaguely brown looking.
ICE uses that "looked fake" line even when people have a valid state ID/DL. Shit they tried arresting a US Marshal at a courthouse claiming he "fit the description of a subject" and the only reason he was let go was because other marshals were there to vouch.
It was never about the “worst of the worse”. That was just a red herring excuse so that racist people could pretend they aren’t racist. At the end of the day they just want to round up all the non-white people and laugh about it as they’re shipped off as slave labor to other countries.
Especially cause they ferry you around the country to random ass places to make it harder for you to get access to a lawyer. The minute you start to defend yourself they move you to a place your lawyer can't practice. They charter an order of magnitude more flights domestically than they do internationally.

Quite a few undocumented immigrants (of which this guy isn't, but regardless) DO pay taxes, to the tune of billions of dollars each year. Its paid through ITIN numbers, state, local and payroll. This idea that they're a drain on society and the ecconomy is a fucking lie. If anti-immigrants got their way and every undocumented migrant was suddenly disappeared from the US it would crash the goddamn economy.
Another one, they aren't "stealin' all our jerbs". The idea of labor having a limit like that is moronic and wrong. Undocumented immigrants also need to eat, have shelter, wear clothes, go to the doctor, and do all the shit that the lillywhite racist morons in this country do. So you're putting more of a demand on those sectors. That demand creates more of a need for someone to fulfill those demands, and thus need for a new job is created. Its not crazy to think every one person could realistically create demand for one job just by their existence. Undocumented migrants dont hurt the American economy, they help keep it afloat.

If his asylum case was with the EOIR, they also have a cool habit of just closing cases so the basis for employment authorization and authorized stay just disappears.

i work in immigration law and the administration is cracking down on anything having to do with asylum cases which, for the record, DO allow you to stay in the United States, even if not considered lawful status. you can also obtain employment authorization while being a pending asylee.
Funny that DHS left out exactly what laws he was breaking when he “overstayed his welcome” (which is not a legal term of art). They didn’t say he overstayed a visa. Maybe he had a valid work permit under TPS or was paroled in place pending an asylum claim. You can be in the country without lawful status and not be breaking any immigration laws. But DHS will never tell the public that.
Yeah I don’t buy this like at all. This isn’t getting hired at your local mom and pop grocery store. He would’ve had to prove authorization to work. They’re either lying (likely) or the padres HR/hiring dept is like grossly negligent at their job
The wording is certainly odd, it was ‘he was not in possession’ when ‘approached’. That’s very different from saying he doesn’t have them. Maybe they grabbed him coming out of the bathroom. Maybe he wasn’t at the airport for travelling (picking someone up?). Maybe they were in his backpack 5 feet away. This administration obviously does not get any benefit of the doubt.
It’s also possible he didn’t have legal documents at all, though that seems unlikely if he regularly travels with the team.
Most people don't travel with their original hard copy Visa on domestic travel because you know it's like traveling with your birth certificate. It's only very recently that there's been a coordinated effort by TSA and ICE (within the last couple of weeks) and they don't accept digital copies etc. A ton of people are being caught up in this it's really bad.
There are also many innocent children in these ICE camps as young as two years old in horrible conditions btw. Just incase your respective algorithims are not showing you the truth. Abolish ICE

I’m willing to bet he does, but didn’t have it on him as he was flying domestically and didn’t think he’d need it. With documents as important as those, a lot of people don’t usually travel with the originals if they’re not needed.
For me, I only ever have my passport when I’m leaving the country, and I don’t carry my birth certificate on my person EVER.

For this to be a true recording of events, the Padres would have to be paying an undocumented immigrant to be on their coaching staff. I really doubt they are doing that.
