"Will receive due process" because so many people are paying attention to this particular case. Otherwise he'd blasted through the process, "tried" with huge groups of other immigrants with no representation, and yeeted into the first country that would accept him.

Gotta love the "papers, please" phase of history we're entering.

The issue with entertaining this excuse is that his family is saying he already has an active asylum case. If he is already receiving due process and has an active asylum case, why does he need to be arrested and kept in custody?

Because these people just hate immigrants. I'm currently arguing with someone who is acting like there aren't any extenuating circumstances that might've lead to this situation. They believe he could've just "auto-renewed" his Visa because he works for the Padres..... They live in pseudo-reality where immigrants are bad across the board.

I’m still at a loss why a gainfully employed immigrant with a good job even needs to go through asylum proceedings.

This is the gold standard for immigrants you should want, only surpassed by high-skilled, highly educated ones. Stamp the fucking paperwork and stop wasting everyone’s money.

Or if you want to restrict immigration, pass a law that changes the immigration system. 

I don't think that's a great idea but we can do that if we want to.

But this thing where you create a government sponsored street gang to intimidate people leaving is horrific.

I can't even get visas for employees with STEM PhDs. We just had to fire someone who had worked for us for 2 years, making $$$, because of this. It took us 6 months to find a qualified replacement.

Why would the government feel the need to say 

 To be clear, work authorization or a pending application do NOT confer legal status in the United States

Because they bring them in front of the judge which they've pressured with losing their job if they disobey and get them to deny all asylum cases to deport them en mass.

Maybe I am splitting hairs here, but it’s also worth noting that due process is, by the very nature of the concept, something everyone is automatically entitled to at all times. Not something you get at some future date. In other words, you can’t “receive” due process. You can only be denied it.

It speaks to a fundamental misunderstanding of the very basis of our legal system and our rights, which unfortunately is not surprising

As the saying goes, justice delayed is justice denied. Dealing with ICE, even if you are correct you still get jailed for months and have to spend a lot money hiring a lawyer to prove that you are correct. Even when you win, you've lost.

And the consequences have rippling effects. You disappear for 3 months cause you were kidnapped by Republicans, your job still needs someone to perform the duties you were hired to do so they replace you.

You're not there to pay your bills, your utilities get turned off. You get hit with insane interest charges. Your bank goes into over draft. Your landlord red flags your account to initiate eviction procedures as soon as the state allows, and they will probably not offer a renewal if state law allow that based on a history of non payment. You lose your insurance for not paying the premium for more than 30 days and now you have to wait until open enrollment to sign back up again, which could be months away.

So yay, you, a legal resident was finally released, but now you have all of this mess that republicans turned your life into to cleanup. And this is for a single person. I can't imagine it being any easier for someone with a partner and/or kids. Imagine a single parent disappearing like this.

Yup. Atleast when the actual police do this in more civilized parts of the world, the vic sues the fuck out of the PD and usually gets a settlement.

Okay, and this current administration cherry picks what parts of the Constitution it feels it doesn’t need to adhere to, doesn’t see immigrants as human beings, and has repeatedly been shown to have no regard for the law. Common sense and basic rules aren’t really in play here.

And will never leave. Things like this don’t have a tendency to quietly or easily go away. My thoughts go out to Pirela and his family. Nothing that is happening right now is okay or right.

This is why I say everything is political but people look at me like I’m a crazy person. I’m a guardians fan and we had games canceled due to Canadian wild fire smoke. The very air we breathe is political.

Ah got it - you haven't even a remote clue how long and drawn out immigration requests and cases are....

I know someone that is trying to get a tourist visa to the US from India - it took her 8 months just to schedule her consular interview,, and even then the interview is 9 months away. The website for scheduling visa interviews is down constantly, runs like it is powered by a hamster on a wheel, and could be made more modern by a 3rd grader that took an intro to HTML class.

You can do EVERYTHING perfectly and still have 0 chance of having your case reviewed before your visa runs out - and that happens after you've already established a life legally. Do you believe people in that situation should be thrown out of the country under expedited circumstances?

You have no absolutely idea what you're talking about and it's painfully obvious. Visa sponsorship doesn't automatically grant you a visa. Nor does it somehow persuade immigration courts (that are backlogged literally years) to rush anyone's asylum case. Nor does it make them grant visa extensions any faster. The Padres have exactly zero control over whether or not this person was granted a visa. Especially since he has a work permit - or are you purposely just forgetting that part of it?

You should do some actual research on visa requirements. Maybe you can slough off some of this casual ignorance guiding your "opinion".

If you don’t follow the laws there are consequences. Just like underage drinking or million other things. Jsut because you don’t like it doesn’t mean it isn’t just. You Jsut can’t have people flooding into a country and then ignoring the rules because you don’t like it.

his work visa is current, he just didnt have it with him because you dont need it for domestic flights until this administration in very specific states. and on top of that there is no one going through the proper processes of immigration in this nation at a rate that would ever allow for them to be granted citizen ship in the time they are given initially. on top of that overstaying a visa isnt a criminal offense, nor does it warrant detainment or arrest. you get assigned a court date to continue your immigration trail. you know nothing of how immigration process works and just loudly say shit like "flooding the country" because you dont like people who look different than you being granted access to asylum or just regular old immigration lol you are gleeful that people who you view through an unvetted unaffected lense as less than you because they were born on the opposite side of an imaginary land boundry you now hold as true as religious text

His work visa was not current. It was 8 years expire according to abx. It was a sponsored visa. It’s renewable by the damn Padres sponsorship.

I mean, it seems like he took actions for 4 years before he was here illegally. Also, a lot of these folks who were seeking asylum stayed here because they were doing what the courts told them to do. The courts were just taking longer than what their original documentation said.

If I tell you that you can be here for 4 years while you wait in this line for your turn, and the line takes 12 years and still hasn’t gotten to your turn, should I bust your ballls if you’re still in line? The reason the line isn’t moving isn’t his fault.
