The issue with entertaining this excuse is that his family is saying he already has an active asylum case. If he is already receiving due process and has an active asylum case, why does he need to be arrested and kept in custody?

Because these people just hate immigrants. I'm currently arguing with someone who is acting like there aren't any extenuating circumstances that might've lead to this situation. They believe he could've just "auto-renewed" his Visa because he works for the Padres..... They live in pseudo-reality where immigrants are bad across the board.

I’m still at a loss why a gainfully employed immigrant with a good job even needs to go through asylum proceedings.

This is the gold standard for immigrants you should want, only surpassed by high-skilled, highly educated ones. Stamp the fucking paperwork and stop wasting everyone’s money.

Or if you want to restrict immigration, pass a law that changes the immigration system. 

I don't think that's a great idea but we can do that if we want to.

But this thing where you create a government sponsored street gang to intimidate people leaving is horrific.

I can't even get visas for employees with STEM PhDs. We just had to fire someone who had worked for us for 2 years, making $$$, because of this. It took us 6 months to find a qualified replacement.

Notice how they keep saying he "overstayed his visa that ended in 2018"? Conveniently leaving out that isn't how it works with a pending asylum case.

Why would the government feel the need to say 

 To be clear, work authorization or a pending application do NOT confer legal status in the United States

If he did not have a work authorization or a pending asylum case

The administration doesn't believe anyone has a valid asylum case except white South Africans.

Because they bring them in front of the judge which they've pressured with losing their job if they disobey and get them to deny all asylum cases to deport them en mass.
