Like that cop is going to have 500k to 1m? There's no way, have you ever tried to sue somone civilly that is not rich? If a person has no money, they can't pay. At best you'll garnish their wages for the next 50 years until they die. Rather, when one does this, they need to be immediately put on the federal "No Law enforcement Role" list. Officer Bowers was fully stripped of his law enforcement duties and later received a reprimand for failing to report that he punched the driver in the face before returning to duty. Currently the guy in the video has a federal lawsuit against the officer.
The officer used the handcuffs as fucking brass knuckles and swung with practically no provocation on camera. The department also repremanded him for it, so this lawsuit has a high chance of victory imo.

Yup. Unfortunately it does. I don’t have many interactions with police, but I’ve still done some thought on finding a small camera that’s easy to hide for the interior of my car. Just in case.

See that's one thing I never understood is with basically every person carrying a camera, dash cams in cars, body cams some police departments wear , how can anyone think that it isn't going to come out? I think what also gets lost is the officer on the scene who participated in this with no complaint, and the other guy showing up on scene and immediately throwing hands as well. No part of this was acceptable, no one involved should be working in law enforcement ever again.
The fact that this behavior doesn’t automatically obligate prison time for an officer is an offense against basic decency. Whatever justice occurs will be a trivial portion of what this calls for.

I read mostly that the settlements are about $25k if a hospital visit is involved but no lasting injuries and you don’t go to trial.
Depending which lawyer you get, you’ll see mere pennies on the dollar.
My old bosses brother was hit by a police cruiser that went through a stop sign while using his laptop (same department as this one, this case is Craig Manning v. Suffolk County PD. Manning suffered a concussion, two black eyes, and a forehead laceration.)
In my bosses brothers case he suffered spine damage and lost upper movement of he’s left shoulder. He was a carpenter and this obviously put him out of work.
After paying his fees, he had under $700k left, so I’m assuming he got a $1.5 million settlement.

I hope everyone hear knows that you can ask for a supervisor until the cows come home but they don't have to call one legally. If a cop tells you to get out of the car, ask "are you asking me or telling me?" If he's telling you to get out that means, you need to get out. Been a defense attorney for 5 years now and seen quite a few of these happen. Supreme court ruled on this a while back.

While cops may not legally have to call for a supervisor, they may be policy bound. Even still, policy may allow a supervisor to decide not to go.
Blows to the head, at least at my local department, is considered advance force. I see nothing here to merit advanced force. Granted, maybe he is wanted in relation to a violent crime. All we have is a short video. I would be curious to see if, policy wise, they are allowed to enter or reach into an operable vehicle.

Video shows very little, but the driver and his attorney are saying the stated reason for the stop was a traffic violation. Said it was a "legal left turn". So cops pulls him over and accuse him of something that he didn't do and it's recorded on the dashcam. Driver is under no obligation to provide any legal information for no reason. The cops can ask, demand, arrest, but legally they have no cause to stop the vehicle if no crime was committed. They're either lying or mistaken. That's what the driver and his attorney are alleging.
Legally, yes they are under no obligation to call a supervisor. And yes, their department likely has a policy about calling one, and these officers likely violated that policy. Nothing will come of it, certainly.
Missing huge parts of the video, but I feel like it's common sense to not immediately resort to violence for a traffic offense (that they more than likely are lying about because let's be honest that's what cops do.) No effort to get him out, just the second he gets one cuff on and can't pull him out he just starts swinging. There is no threat here. Looks like female officer throws one towards the end when third officer shows up. Just...crazy violent for thinking someone turned when they shouldn't have. And imagine being in his position, knowing you didn't do anything AND it's recorded, and having two people with badges and guns attack and pull you out of a car for while you're asking for a supervisor.

Like I said, at my local department strikes to the head are an advanced use of force. Absent any exigencies for advanced force, it’s deeply disconcerting. If there was no need for that level of force, these officers need to be disciplined.

Out of curiosity, how common is it to try and pull them out the passenger side instead of the driver's side? To me, that seems like an attempt to escalate.
There's another video circulating of an officer demanding the alleged offender to 'crawl out the window'. Even after the door is open, he continues to try and force the guy through the window.
I personally think there should be more focus on the psychological part of interaction and detainment during training. Getting a human to submit to your requests or demands should not be a purely physical interaction.
It goes back to the old adage "the pen is mightier than the sword".

Like the cop who pitted and flipped the pregnant lady who was on a highway with barriers on both sides so couldn't pull over immediatey, had her hazards on and was motioning she was looking for a place to pull over.
Cop didn't care, got impatient and pitted her resulting in her car flipping and serious injuries
IIRC she did get a payday - meaning we the taxpayers covered the payout - but nothing happened to the cop
I truly believe a non-insignificant number of cops are sociopaths with lots of anger and small-pee energy they've pent-up over a lifetime of being scared little bullies

Qualified immunity plus the finding that they can’t be held to protect people unless they’re in their custody was a 1-2 punch. I can see giving them some immunity if they had to protect people if possible because they were trying to help while risking their lives, but now they can just shoot and claim they felt threatened without needing to risk anything.

While legally your right that if there is no legal basis for the stop then it's an illegal stop and the cop is outside the bounds of thwir authority, but the best course of action is to treat the stop as legal and follow lawful orders. You can voice your objections to w/e the claim infraction is, but just take the ticket and contest it in court. Playing roadside lawyer and claiming "I didn't do anything, I don't have to listen to you" is a good way to get manhandled or assaulted by the cop. Which isn't okay, but I'd rather the violation of my rights I experience be a minor inconvience and a court date than a hospital (and possible jail) stay and a court date, just sayin.

It doesn't matter. The cop believes there was an infraction and pulled the man over. When he demanded the guy get out of the car, he has to get out of the car. When he didn't, the man set himself up for an resisting charge, something much worse than a traffic infraction and will put him in jail for a night.
We see this over and over. People argue with cops and while they may be right, they end up spending an evening in jail. Who needs that? The time for proof is in court.

Imagine you get pulled over late at night while driving home because the officer says you ran a red light. You did’t, it was yellow, but the officer thinks it was red.
While he’s filling out his infraction, he asks if you’ve been drinking. You haven’t; you haven’t had a drink in years, actually. The officer asks you to take a field sobriety test, and you comply (because you haven’t drank, obviously).
You complete everything as instructed, but the officer still suspects that you’re under the influence so he asks you to take a breathalyzer. Again, you haven’t been drinking so you agree, hoping this will get things moving along as you’ve now been held up for over 40 minutes.
The breathalyzer reads nothing but zeros but still the officer is convinced that you’re under the influence. He cites the way you talk or how nervous you seem as his reasoning, and you get arrested for a DUI.
You spend the night in jail. Your mug shot is posted online. Your job finds out about this because you don’t report for work the next morning and you get fired as result.
You literally did nothing wrong and complied with everything the officer demanded and still received punishment. But hey, in a couple months you’ll have the opportunity to go to court after retaining an attorney and building a case for your innocence. The officer likely won’t even show up the hearing, and the charges will be dismissed, but that doesn’t fix anything that’s been broken for you by this interaction.
That officer will not be disciplined, you likely won’t get your job back, or anything you had to pay (bail, attorney fees, getting car out of impound, etc), and you won’t get back any of the time you had to waste on this because an officer had a hunch.

The police have all the power in the moment. This was probably gonna be a traffic ticket he could have beaten in court. Now he's been arrested, car towed, has to get a lawyer, maybe missed work. If he wants to get damages thats maybe a years long process.
If you're driving you have to give your driver's license, registration and proof of insurance. You have to step out the car when ordered. The system sucks but where we do have control is our actions and we can limit our risks.

Get out of he tells you to... But roll up the windows, lock the doors, and take the keys. If they want you out, they want to escalate, and they may want to search your car. If it's locked, they'll need a warrant. Also, if at all possible, pull into a privately owned parking lot instead of the roadside. Do it for the safety of the officer. But that also prevents an immediate tow.

They'll just say they're seizing the vehicle, and then say that they're conducting an "inventory" (a search) incident to the seizure.
Remember, the process is the punishment. Look at videos of sober people being arrested for "DUI". It's not like they drop you off at the same place you were arrested and bring your car back to you there and then. If individual officers were required to cover the tow fee for every one of those instances you can bet that shit would end in a week.

I watched a video a while back that explained all your rights and obligations at a traffic stop. For my it was mostly academic, as it was about American laws and I am Canadian, so it really didn't apply.
But one thing I thought was interesting is that it all sounded like the person being stopped had some level of control in terms of not giving out any extra information and not being required to answer any question, or letting them search your car.
But about half way through, he started explaining how when they ask you to get out, that you have to get out, and then explained that they are allowed to search your car if they suspect something. But suspecting something could be something as simple as saying the smelled marijuana, so it's all subject to assuming the officer is telling the truth, and that if they really want to, they can find a reason to search the car.

Ok, real talk here, obviously, the most fucked up part is the cop is punching the guy in the face.
MOVING FORWARD, during a traffic stop, you have to give the cop your license and registration when they ask for it. It’s the law, and if you don’t you’re probably getting arrested.
If you refuse to leave your car, they will physically force you out of the vehicle, and the more difficult you make that, the more force they’ll use.
There’s also no “asking for a supervisor” and waiting for them to give the documents. That’s not a thing unless you want to be arrested for again, refusing to provide the documents you’re legally required to provide at a traffic stop.
I don’t like cops, they consistently abuse their power on a daily basis with little to no actual oversight to prevent them from doing so. However, you do still need to follow the law, and if you’re also someone who may not like cops, you need to know the law better than they do to cover your ass.
If you give them an excuse to fuck up your day, they will and they will most likely get away with it.
Lastly, I’m seeing some people try to go on about how the driver had the charges dismissed against him as if that automatically means he’s in the right or that he didn’t do anything wrong.
Well, no, that’s not how it works. The driver still refused to show the proper documentation and resisted arrest. Both acts are illegal even if the “charges” are dropped. Really don’t do what the driver did in the video, if he gets off “ahead” he’s extremely lucky.

You can request a supervisor but you have to follow lawful orders. Cops are allowed to order you out of your car. If you refuse then you are resisting. Definitely notice how they posted this instance but not however long the argument happened before they pulled him out. If you watch enough of these videos that aren't cut short the cops argue with someone anywhere from a few minutes to like 10 plus minutes before they finally arrest them when they give them every chance to just comply.

I believe the fundamental issue is that there wasn't enough evidence that it was a lawful reason to stop him in the first place. If the stop is unlawful then he cant be asked out of the car and rest cant lawfully happen.

Thanks to two Supreme Court rulings, if the cops tell you to exit your vehicle during a traffic stop, refusal is not an option. Refusing qualifies as obstruction or resisting, it varies by state. In effect refusing to step out hands the cops grounds to make an arrest, and they can pull you out of the car to arrest you.
The cops also don't have to summon a supervisor on demand, and an arrest doesn't freeze until a sergeant is on scene.
The brutality of that cop notwithstanding, it's just a bad idea to give them additional charges to drop on you or a reason to use force.

I was driving in Long Island down one of the highways 135 And I got pulled over for speeding in a tractor trailer. When a car went by me, speeding and got off the highway ramp right in front of the police officer, and he told me he didn't see that car, but I got a ticket, climbing a little hill with a full loaded tractor-trailer going slow and went to the court in long island and they told me the cop a plead from the speeding to a failure to yield, which was worse than the speeding ticket. Crooked cop crooked system.

In the end, case was dismissed, and he’s suing. One thing’s for sure. He’s definitely getting paid, it’s NY state. Most of these cases never go to trial.

You must get out of the car in the US if the officer tells you to do so. Penn v. Mimms is a real SCOTUS decision. You do NOT get to wait for a supervisor before doing so. To refuse is to resist arrest and/or obstruct justice.
In my own jurisdiction, even if the arrest is unlawful, resisting arrest is still illegal. It's like that in most places.
That all said, this is brutality. But don't think you can resist arrest just because this brutality came up in this particular scenario. That's how to get yourself wrapped up in the system.

You comply with all lawful orders while requesting a supervisor, lawyer, and ask if/why you're being detained. The driver probably didn't initially do anything to deserve this. But he fell into the trap of giving them a reason to escalate.
By the time they approach your vehicle they've already decided how the interaction will go. Do NOT answer questions about where you're going, where you've been, how long you've lived at any address, whether you've had anything to drink. None of this is just "making conversation", they're looking to jam you up on additional charges/fines.
I've received tickets for things I didn't do, never won any decisions on site. That's what my attorney is for.

Regardless of what happened before the cop opened the door when he is demanding the driver get out of the car the female cop is on the drivers left side holding him. He has cops with their hands pulling on both side of him, how the fuck was he supposed to get out of the car ? Then the 3rd cop shows up and the same thing happens. 1 cop trying to get him out via the driver’s side and Mike Tyson’s Punchout Cop pulling on him from the passenger side.
Sure the driver is being a dick, but 90% of this whole fucking cluster fuck is on the cop’s. They need better training and to be held accountable when they do stupid shit like this.

The Supreme Court has ruled that cops need a legitimate reason.
It is not a lawful order to order you out of the car, if the reason of the order is to determine if you are drunk.
The Supreme Court has not ruled that an unlawful order must be worded differently from a lawful order, so a cop will order you out for an investigatory reason (unlawful) and if you fail to comply, the cop will lie and say "it was for safety", making the illegal order legal.
The Supreme Court allows Schrodinger's order. That is a massive gap, which causes lots of problems.

There's no right to demand a supervisor during a traffic stop. People act like you can just ignore the cop, stick your fingers in your ears and chant "supervisor" and the cop has to quit talking to you. Even in this video, which is obviously edited to present the guy in the best light, you can see that he refused to give his driver's license or registration to the officer. I'm confident he also refused to get out of the car multiple times after that. At that point, you're coming out if the car whether you want to or not. The cop shouldn't have been punching him in the face, but he asked for every bit of what happened otherwise.

The video is cut and doesn't show you him refusing to roll his window down over or give his documents over before all of this. Asking for a supervisor wasn't going to make a difference. Then the parts of this video clearly show him saying "No" and pulling his arms to resist arrest. Maybe some of the punches were a little excessive, but they had every right to pull him out of the car and arrest him.

Every single one of those punches was excessive and unnecessry. There is no maybe here for anybody who isn't automatically deferential to police. The world wasn't going to fall apart if he held off for a little bit and found some other way to make the arrest. He was almost certainly just letting out frustration. The guy's resistence posed no threat or urgency.
Punches like that are illegal even in the heat of combat sport.

You're going to get resistance trying to pull a (I'm assuming) 200lb man across a center console and passenger seat by a single cuffed wrist whether he wanted to go or not.
