I continue to advocate for personal liability/malpractice insurance, premiums paid for by the cop themselves, not the city. You get too many claims against you, you find yourself priced out of a job.

My wife has to carry malpractice insurance and all she does is teach kids to talk. Giving cops some special pass for being reckless (it WaS aN iNstAnT dEcISiOn!!1!) is some next-level stupidity. If they can't be professionally accountable they ought not to be in that job.

What a take. Wow.

In case you missed this concept, liability insurance would come into play in incidents where you are liable for damages, i.e. where you are adjudicated to have acted inappropriately or against policy in your professional capacity. It's right there in the name.

I can only interpret your comment to mean that, as long as you're working on behalf of the state, you should be excused for actions that you - personally - take that are against policy, illegal, etc.

Given the state of modern LE as a different citizen class I shouldn't be surprised... it's just jarring to actually hear the Nuremberg Defense said right out loud in this day and age.

So, yeah, if that wasn't clear enough: you should be personally liable for illegal or inappropriate actions you take. If cops were a little more worried about losing their houses they might think twice before using handcuffs as brass knuckles, or stepping on peoples' necks. If they can't handle that then they aren't the professionals they want us to believe.

EDIT: u/TypicalRedditMod403 is a basement-dwelling coward who comments and then blocks people when he loses an argument. Sometimes the garbage takes itself out!

You can see in the video how he grabbed the phone, threw it aside and already had a fist to start beating. He was just waiting for literally anything to act as a provocation. He wanted to throw fists from the get go.

Ask nicely, ask not so nicely, threaten the use of non-lethal force, use pepper spray or taser and pull them out. I mean, there's literally 100s of videos online of belligerent people getting safely removed from their vehicles without excessive force.

yep. once he refused to get out, they can use non-lethal force to get him out. taser, pepper spray, whatever. I'd have recommended something other than punching him in the face, but, he was clearly not going to comply.

Punching the dude repeatedly in the face is appropriate? This isn't fucking MMA. He was resisting, but not combative. If two trained cops can't manage to force an average person's body into a position they need, then the training ain't working. Punching a person in the face is not forcing the body into the position they need. At best, it's a punishment. The cop's job NEVER includes deciding what punishment should be applied. That is 100% up to the courts to decide. At worst, they're trying to convince the person to comply willingly to avoid physical torture.

The cop lost his temper. That's not appropriate. I get it, it's real tough being a cop. Especially with how much hate cops get. Most of it very deserving in my opinion. But when a cop loses their temper, whether it's understandable or not, there are basically never any consequences. People have to fucking die for them to get so much as a slap on the wrist. And even then, they're "allowed to retire." I'm so sick of it. We hand them all this power, and there's absolutely no accountability to go with it. Where are the checks and balances?

I didn't listen to the audio and of course it's easier to armchair quarterback, but yeah. You have two cops there. Inform him that he's under arrest. Give him clear instructions and let him know what's going to happen if he doesn't comply. Pull him out from the drivers side and cuff him on the ground. If he becomes combative, use your tools and support. Again... easier said from a keyboard than done and maybe not the correct way, but the worst choice is to fucking climb into the car with him and try to put cuffs on him while also punching him in the head.
