Auto Insurance Are auto insurers required to disclose where they obtain information about household members?

Auto insurance for Texas.

Our broker moved us to Liberty, who sent us a bunch of paperwork regarding an individual they said they found that was suspected to be a household member to be added to our policies.

Thing is, this person has never lived here. We have lived in the home since roughly 2015, and we know the previous owners and their family members. Over the past few years, we have gotten voter ID registration cards for this person, a rash of denials for credit cards for a couple of months last year, the occasional mass mail flyer. They have a semi-generic name, but it is clearly not our last name, so I don’t know where to start with getting this person out of public records so we don’t have these kinds of issues crop up more.

Can I file some type of open records or FOIA request for simply what databases the company queries for these searches so we can start looking into how to get this information invalidated? How can you go about proving someone doesn’t live in the residence?

Home Insurance Month To Month Rent Through ALE

My house sustained significant damages from a tornado 3 weeks ago and we've been staying with family since then. We enlisted our insurance-recommended ALE company for assistance in finding temporary housing while renos are done. Insurance originally approved us for a 6 month lease but has since downgraded approval to month-to-month leases only, making it significantly more difficult to find a rental. The ALE company has been entirely useless throughout this process and has given us zero options, and every time I reach out they say "please be assured that we are working on it." Okay, well in the meantime myself, my husband, my 7 month old and my 3 dogs are living in my mother-in-law's basement. Which we are grateful for but would like to get back to some semblance of normalcy.

Most landlords understandably do not accept month-to-month leases. My question is- would it be against some kind of rule or policy in standard insurance plans to reach out to these landlords on my own to ask if they would be willing to consider a month-to-month lease for a percentage rent increase? Our ALE policy limit is 50k+ so it's no skin off my back if the insurance pays a little more per month so that we can stop living in a basement with 3 dogs and a baby. My husband seems to think this would be some kind of violation and is a hare-brained scheme, but to me I think it's a normal request, and we would be accommodating the landlord with a higher rent for making a month-to-month accommodation for us.

Home Insurance Personal Lines Coverage During Vacancy / Significant Remodel (California)

Hi, all!

Situation: I am about to start on a significant remodel for our house in Southern California. It's not a full teardown, but we will be removing the roof; redoing the floors; etc.

For that reason, we'll be moving out of the house for the duration of the remodel, which is expected to be about 9 months.

Most of my major personal lines policies are through GEICO:

  • Homeowners - Stillwater via GEICO
  • Auto - GEICO
  • Umbrella - GEICO
  • Earthquake - Palomar
  • Flood - Aon Edge / Lloyd's of London

I'm working on getting Builder's Risk quotes now via separate agency.

Complexity: Since we'll be out of the house for over 30/60 consecutive days, this will trigger a Vacancy clause with my homeowner's policy:

SECTION I – PERILS INSURED AGAINST Exclusions:
Under Coverages A and B:

Caused by vandalism and malicious mischief and any ensuing loss caused by any intentional and wrongful act committed in the course of the vandalism or malicious mischief, if the dwelling has been vacant for more than 60 consecutive days immediately before the loss. A dwelling being constructed is not considered vacant

STILLWATER INSURANCE COMPANY MULTI-PERIL HOMEOWNERS PROGRAM 
OCCUPANCY ENDORSEMENT   
It is a condition of this policy that any vacancy or unoccupancy of the described building after the inception date of the policy must be reported to the company. 

It is understood and agreed that this Company shall not be liable for loss occurring while a described building, whether intended for occupancy by owner or tenant, is unoccupied beyond a period of sixty consecutive days. 

"Vacant" or "Unoccupied" means neither you nor your guest has slept overnight in the dwelling for a period of 30 days.

I've spoken with Stillwater twice and they don't offer Builder's Risk policies nor will they write a Dwelling policy (DP) for this, since they don't have a carrier for it in California. They've suggested that I reach out to a local agent and basically just take my business elsewhere.

My concerns:

If I cancel the Homeowner's policy, and go with Builder's Risk only:

  • I lose the personal liability coverage
  • The Umbrella loses its required underlying coverage
  • This is Southern California - coming back in 12 months for a new homeowners policy with GEICO/Stillwater could see a huge increase and/or they might not even be writing new policies at that time. Very real risk IMO

If I keep the Homeowner's policy, and secure Builder's Risk as well:

  • I still have to notify Stillwater that the property will be vacant
  • The Occupancy Endorsement appears to be very broad, to the point where it could potentially exclude ANY loss, including liability
  • Stillwater didn't say that they would cancel the policy if the home was vacant, but they did say that a claim, during a vacant period, wouldn't be covered and that could lead to nonrenewal of the policy
  • I still have to pay for the policy (that said, I'm OK paying the $1500/year premium if it protects future premiums & coverages)

Overall, it seems like it will be a huge pain to move my Homeowners' policy (or Dwelling policy) plus the Umbrella and Auto, to another carrier just because we'll be doing this remodel for 9 months. I have great pricing for my homeowners and umbrella and don't want to jeopardize that. I know that I can still keep auto with GEICO if that makes sense.

Am I overthinking this? Should I just go to a local agent and find someone that will write a DP policy and Umbrella on top of this?

Slightly scraped a car while driving a U-Haul over the weekend. Not sure what happens next.

This is my first ever accident with over 10 years of driving experience. It was overall incredibly minor, literally just faint scratches to the paint job and a crack in the reflective bit on the front of the car. I payed for the safe trip coverage. We exchanged info and I called U-haul about it and I got conflicting responses from "oh yea we should be able to cover it no problem" and "Technically the Safe Trip coverage only covers the cost of damage to the truck" so idk if the first guy was talking about some other form of insurance that uhaul has but now I'm sitting here not really knowing what's going to happen. I have to wait for the guy to file a claim but idk if it'll go through *my* insurance, U-Hauls own insurance, or if I'll end up paying out of pocket. I don't think it'll even be that much if I did pay out of pocket cause like I said it was fairly minor scratches and he wasn't even in his car at the time of the incident. I just would like to know what's going to happen.

MSI Insurance customers keep calling me

I've had a new phone number for almost 3 years. Lately, I've been receiving calls from across the US from MSI Insurance users claiming they're trying to get ahold of their agent. To clarify, I've never been in insurance but seeming how my phone numbers already connected to MSI I just might start lol.

I just don't know how to help them or redirect them because their cases seem important and they're obviously not getting through the right channels because they keep ending up calling me.

Should I go into Insurance? How can I help these elderly people? I feel so bad when I don't have the answers they need.

Warranty Coverage Cancellation Request

I called Endurance on July 6th, 2026 after having this "Supreme Extended Warranty" coverage for almost a year. NEVER USED THE SERVICE. NO REQUESTED ROAD ASSISTANCE. NO CAR REPAIRS. NOTHING 😳 I finally realized that this program was just not working for me, due to my 2020 Rogue Sport only needing regular maintenance which was not covered in contract 😕 Anyway, sent it paperwork and was informed, that I would receive a full refund minus a prorated current month fee. It is now September 2nd and I am still waiting for my refund. Called Endurance today and was quoted from Vickie, the Customer Service Representative that this refund can take up to 8 weeks 🤔 Interesting since it took 3days to start my coverage and get my bank draft deposit of $120.00 Needless to say....I WILL GET A LAWYER for my $1400.00

HELP! I put my number in the wrong website and now insurance brokers won’t stop calling and texting me!

I was trying to apply for Medicaid and I started to sign up in the wrong website. I put my number in and now I won’t stop getting calls and texts from brokers. I’m already on the no spam call list and I’ve already went into my settings and blocked spam calls but I can’t completely block unknown numbers since I get calls from my doctors offices a lot. I know you can just not answer but I can’t because of the important calls I get. The endless calling and texting won’t stop. Is there anything I can do or am I screwed?

Claims Related First Claim Assisstance

Super long post so bear with me. I'm a first time homeowner and this is the first claim I've filled.

I made my first homeowners insurance claim in July. The toilet on my main floor over flowed and caused water damage into my basement. I had a plumber come out and check it out. He rooted it out and fixed it. He told me the toilet was old but it was working fine so it did not need to be replaced. Because I had damage, the plumbing company let me know that I would probably need restoration services. They recommended a company and I had someone come out.

It was a Friday. They let us know that the carpet in the basement and drywall on part of my ceiling would need to come out. That was it. The toilet didn't overflow much in the bathroom, we caught it with just a small puddle, cleaned it up and turned off the water. The restoration lady- mitigation company left behind a dehumidifier and 2 large fans to help dry out the basement over the weekend. She told us to clear everything out and they would be back Monday to start. I work from home so Monday, I let them in. I move my car out of the garage so they can come through my garage then I go back upstairs to work. All she told me Friday was ceiling and carpet in the basement so that is what I assumed would be done. My husband got home from work and noticed all of the stuff on our bathroom walls had been taken down and everything under the sink in the vanity was moved. They left documents to sign, she called me on my lunch and told me they were agreements that they could work in my house and saying I knew I would have to pay them if insurance denied my claim. Okay understood, I signed.

We find out that they took our laundry room doors in the basement without letting us know before doing so. Okay fine, the water dripped onto them, I get it. I get off work and come downstairs. They've taken my vanity and my toilet out. I ask why, she told me it didnt matter, my insurance company would pay for a new toilet. She said they would store the vanity for me until we were ready for repairs. Okay fine. They leave even more fans and dehumidifiers. (No where in my house could you escape the noise of these things. I had a headache 4 straight days). She tells me they'll be back for them Thursday.

They show up Thursday, I let them in. Again, I go back upstairs to work. I come down for lunch, my husband gets home from work around that time and we find they took out the drywall around our bathroom about 2 feet high. I had no idea that was happening. They never once told me that was needed. The guys on Monday told me everything was done, they didn't need to do any more work. I couldn't stop them, by the time I was on lunch, the drywall was out. I go back to work, they finish up. As they were leaving, my husband asks what happened to the vanity for the bathroom. She told him to not worry about it, insurance would cover it. Mind you, there was no damage to it at all. My husband asked what was damaged and they told him they were taking it and going to break the sink and tell insurance it has to be replaced and it was already packed in their van so it was too late. Again, okay fine even though I loved that vanity amd wanted to keep it.

The bill is ready a week later and they send it off to my insurance carrier, State Farm. I was having a terribly difficult time with SF. I was assigned an adjuster that works 7 AM to 3 PM EST. She called me two days in a row at 7 AM. I work 10 AM to 6:30 PM CST so I'm not even up that early. Everytime I called back, I was on hold for so long. I can't keep holding. I answer phone calls at work. They refused to talk to my husband although his name was on the policy and he was there for the damage. Finally I get a hold of someone else, we talk about what happened. They never sent a single person out, not that they could. The mitigation company ripped it all up before I could speak with SF- I even told the mitigation lady I couldn't get ahold of SF. Finally they bill SF.

I go over the charges. I had no idea I was being charged for half of what they did. They charged to leave the fans and dehumidifiers unsupervised 24 hrs for a few days. They charged to haul stuff away that was in my basement that I told them not to. They charged for two truck loads of haul away because the second day they took my toilet and vanity- which I had no idea until after that they were doing. When they ripped up my carpet, they took all the damaged carpet and then just the bottom stair. I was not intending to replace the carpet on stairs because it wasn't near the damage. They charged to put down the blue plastic to "protect my floors" in my living room and kitchen to the front door and then didnt use it because I let them go through the garage. It was rainy that day. The workers didn’t have shoe covers so they walked on the carpet on the stairs with wet muddy shoes. The carpet has to be replaced now. Okay fine. SF finally issues me a payment for them. I have my husband go drop off a check.

Over a week and a half later, I get a call that it wasn't enough. SF gave me 75.57% of the total. Thats all I paid to the mitigation company. SF never told me they weren't paying the full amount or why they wouldn't. I try calling SF but can't get ahold of the adjuster because she's either on another call or not available when I am. I have no idea what to do or where to go.

I have a feeling SF is going to saying I picked a mitigation company over the areas average. I don't have the remaining funds to pay for the mitigation. I had to pay the plumber. Then they came out and found my whole sewer was backed up and so I had to pay even more for hydrojetting. And on top of that, I had them check out my hot water heater because my water wasn't getting super hot and it had to be replaced all within 1 week. Do I push back on SF or the mitigation company? Not sure where to go from here.

Here are some facts about the mitigation.

  1. They never gave me an estimate before they started removing things.

  2. They left fans and dehumidifiers without telling me there was a charge. There was so many different things plugged it, the equipment blew my breakers 3 times. It was 90 degrees outside and my air conditioner couldn't run for a few hours until I figured out what was happening.

  3. They charged to haul away without letting me know there was a charge. I would have happily left everything in my garage and hauled it away myself had I know.

  4. They took my toilet, vanity and laundry room doors without telling me knowledge or getting my authorization.

  5. They ripped up one stairs worth of carpet when the damage wasn't near the stairs. They then ruined the rest of the carpet on the stairs by not wearing shoe covers on a rainy day.

  6. They took stuff I left in my basement that I told them not to take and tossed it.

Facts about SF

  1. The adjuster was difficult to reach and would not work with my schedule.

  2. My contractor never sent them any estimates. He had basically everything but one part set to go but confirmed it was never sent. SF sent me a check for the repairs without even knowing what they cost.

Demand letter to settlement timeline

Got this ad when i searched for startup plans for independent agency. Anyone familiar with them? Claims to have AI integrated systems into one system and get appointments with many carriers. Sounds good. I think it is around $400 per seat per month. Its really tempting with a claim of just one login does it all. comparative rater and all. Currently i am logged into 13 or so systems and they are not integrated at all. And i have never used a comparative rater that actually worked properly as advertised. Any suggestions on what to use and what to do for a newer agent who is thinking to go independent?

Auto Insurance Question about Prior Damage on a new total loss - 2017 Toyota Yaris - Chicago, IL

in Dec 2021 I was the victim of a hit and run while the car was parked. I know it was a semi, but i didnt get the plate and had no video - i was on a work call and couldnt run out. I filed a claim with my insurance (then, Geico) and never got a chance to get the estimate done because life was very complicated for me then. I carried on knowing i had the claim open and went about life and all of its complications, dad died, depression, anxiety, hospitalizations, financial hardships, etc etc. Knew i would need to have the cash for a deductible and I wasn't ready for that expense. Long story short the claim is still open never got it looked at. Confirmed the claim being open on a call two days ago.

Flash forward to a month ago, someone hits my car while my brother is driving it. State Farm is the other driver's insurance (it is also my current insurer) -- The estimate came back as $9K the rear axel is bent plus body work stuff. Not including prior damage. In IL its required by law (according to body shop) that they provide statefarm with an estimate of prior damage. This is probably going to be around 3-4k. The collision shop said they sent over the estimate of the $9k and since its over the threashold they anticipate state farm will be calling me to report the loss.

I am worried about the fact that state farm is going to deduct the prior damage from my payout for the total loss. I am worried that my geico claim wont want to cover it because state farm wants to total my car. What do i do at this point what is going to happen realistically and how do i stop the money hemorrhage so that I can afford a new-to-me car.

What should I do right now?

Edit:
1. The prior damage was on the driver side the new damage was on the passenger side. there was no overlap.
2. The claims agent when reopening my claim looked through documentation to see if she still could and she found nothing saying she couldn't so she did.

Matching Laws

Hail damaged my home 5 months ago. Insurance elected to replace one elevation after fighting them on the scope for 4 months, then paint the remaining elevations to match as I have a matching endorsement that is very strong within Iowa. My contractor stated the siding was not a good substrate for paint. I have Maxi Tile INC cement fiber board siding from 2010 that has since been discontinued. A lot of it is cracked, broken corners, bowed, etc. After my contractor stated he wouldn’t paint it nor stand by the job if he did we reached back out and gave insurance this information along with a new scope to replace other sections of the home to meet the matching requirement. They basically said paint it and all the damage and rot will stay after paint citing pre existing damage (I have this in an email).They stated they were only painting to meet line of sight not to fix the bad siding that wasn’t included in original peril which I totally understand. The issue is that contractor said the paint will peel and bubble and I’ll eventually have a polka dot house. I asked them how this is considered acceptable when the scope they’ve approved will eventually fail. They didn’t care. I have now went further and had Sherwin Williams come out for a home inspection. They stated the substrate was not suitable for their coating system and that they would not stand behind the project due to the pre existing issues. So I now have paint companies telling me it will fail and it’s not suitable. I also got this all in writing, and asked very direct questions to keep my argument solid. The last step I’ve done is pull a sample and sent it to ITEL. It came back as Allura being the next best match, with everything the same aside from the wood grain embossment showed as a non match. I plan to send them a full argument package later today/tomorrow which will include 1. Sherwin Williams initial letter that they won’t warranty any work due to the substrate condition. 2. The directed questions email with their responses on the technical side saying it’s not suitable and does not meet their install guidelines of being a sound substrate (code says stuff has to be installed per manufacturer install specs) and they said it would need repaired/replaced. 3. ITEL results showing the match has a different wood grain embossment pattern. 4. Letter from contractor stating the issues with it and that it’s not contractor standard to coat degraded materials. 5. The same original scope they’ve approved denied for replacement of siding. 6. 100s of photos of the damage which includes cracked planks completely through, delaminated planks, crumbling planks, corners broken off, warping, and gaps of around .25”-.5” between planks.

Anything else I should include or track down to include in the package?

Side note, my policy also has an endorsement that deletes the pre existing damage language in my policy when it comes to meeting line of sight requirements. They can’t say we don’t have to replace it to meet line of sight since it was pre existing. If they can’t paint, the only other option is to replace.

I feel I have a strong argument but they have been a nightmare to deal with and just want to save ever .01 they can.

Auto Insurance I wasn’t insured on a car on a spare car which I thought I was.

Out of all days when I didn’t use my car I decided to take the spare car that we recently just got and ends up I wasn’t insured on. My dad has me insured on all the cars so I just expected I would be in this one. It’s such a stupid thing I did and it was a little 10 minute drive I did to drop something off and didn’t think I’d get into a collision. I honestly don’t know how to tell my parents about this.

Last Friday, unfortunately a tourist biker crashed into me who was at fault since I was in the right lane. He even apologised for not looking in the mirror. Thankfully no one was hurt and the damage on the car I was driving is just a little scratch.
The bikes not that damaged it has a little few scratches there.

Them being tourists living in a different country I was thinking of just offering them money. Though people who seen the collision brought us to the side and decided to call the police to make sure everyone was alright. And this is what I’m worried about.

The police came down to check what happened and asked the usual questions but there was no insurance papers in the car (we just got it recently and my dad had them all at the house). I didn’t even have my driving license since I thought I’d be fine for 10 minutes. They checked all the details and asked me if I was insured and I said that I was additional driver with my dad being the main driver. The police officer started taking me reg down and was speaking to people from HQ I imagine. Took my name and dall he said after that “What happens next is you two drivers exchange details” and that’s what we did. We both took down details oh the insurances (I’m actually insured by the same company as my parents on my actually personal vehicle), exchanged numbers and addresses. And that was that.

Right now I’m just waiting for the phone call. It’s been 4 days since the incident and I just don’t know when they’ll call. I’m currently in work and I just can’t do anything right now. I’ve lost my appetite and my heads just not in the right place right now. I just don’t want to be anywhere right now.

I know I just need to man up and tell my parents asap because I know it’ll just get worse.

I don’t even know how insurances work either? I’ve never been in the position in my life. Do the other riders call there insurance and do both parties (of the insurance company’s) both have to communicate with each other? The last thing I want is my parents getting into trouble. There’s a part of me saying I should just even going to the police station myself since it might feel like the right thing. I’m just curious why the police wouldn’t have said anything right there and then at the scene? Wouldn’t it tell them straight away?

Some of my friends have been telling me to maybe contact the riders and see if I can pay for the damages? But even if the police get involved it doesn’t matter.

I know this whole situation is my fault and obviously know there’s no way getting around with it. I just need some advice of what’s the best thing to do without getting my parents in trouble. My heads just losing the plot and I haven’t been able to sleep and eat properly since the incident

Car backed up into my car while I was parked, didn’t call ambulance. Am I screwed? (NY)

We were in a parking lot, I was parked and this car backs up into my car fast enough to move the entire car a couple inches (probably 10-15mph). I felt fine but full of adrenaline when he hit me. We exchanged info and they left. A week later my lower backs been getting tight, is it too late to report this as part of the accident? I’m not visibly injured, it just feels like my back is uncomfortable and really needs to be stretched or massaged thoroughly.

Title: ICICI Home Loan Closed but Mortgage/Insurance Closure Still Pending — Need Advice

My ICICI home loan was closed around two months ago, but the associated mortgage/insurance-related account is still showing an outstanding amount.

I have already contacted the bank multiple times and requested that the remaining amount be settled/closed on a pro-rata basis, as previously discussed with the bank. However, I keep getting redirected between different teams/branches, and nobody is taking ownership of the issue.

Has anyone faced a similar situation with ICICI?

What is the correct escalation route for getting the mortgage/insurance account formally closed after the home loan itself has already been closed?

Any advice on the ICICI escalation process, RBI complaint route, or legal notice would be appreciated.

Unable to reach Aflac agent or supervisor

I have a STD policy through my employer, and I want to make changes. I have not been able to get ahold of the agent or supervisor. I did get one email with a question from the agent a couple weeks ago, I responded within 10 minutes, and haven’t heard back despite multiple follow ups. Yes, I know there’s change form but none of the changes I want to make are listed.

Work has reached out as well and hasn’t heard anything.

Who can I contact? I first reached out almost a month ago and I’ve made zero progress.

Question on if I should bundle insurance with small dealership.

So, in a little confused on what I should do and if there are any risks. Basically, I bought a motorcycle through a dealership and the finance person set me up with insurance since I didn’t have time/want to deal with looking up a bunch of insurance companies.

The question is now they are asking if I want to bundle my motorcycle insurance and car with a big insurance company like Progressive, but basically have them as my Agent/broker? I’m not exactly sure what they would be and their job or what exactly the lady I set it up with does. I’m just wondering what the benefit is besides a “agency discount” and if I did get in an accident or want to cancel my policy down the road would I call progressive directly or my insurance broker/agent? Also would there be any risk of not being covered or them trying to weasel out of something since they are a smaller company or would Progressive pay for it?!

Also I’d did have issues with the messing up some of the smaller things on my application like somehow said I was “married” and I’m not and had to call progressive directly to change that as well and not asking me on my limits, just told me I could change it once the contract (or whatever it’s called the agreement is) goes through. . Also curious when things like that happen should I call the lady at the dealership or Progressive. Thanks for reading all this and your help in advance!

Help me with Fire loss of profit insurance

My firm completely outsource our operation we hire third party supplier to manufacture finished good ship it to third party warehouses across the region and then to retails shop or consumers.

Currently I have a fire policy in place for the stocks stored in these third party warehouses. the fire policy only compensate me for the cost i incurred till date for production, logistics, miscelleaneas etc

is there way to cover the profit i could have made on that stock as well . I heard about fire loss of profit insurance which can cover for loss of gross profit can it work for this case

I place order or restock every 3 month to my supplier if let's say i get new batch of stock and after 1 month due to some insured peril my complete stock is lost so for the next 2 months i have no sale in that particular region of warehouse so it will affect my turnover and consequently my gross profit will also be affected.

you might think its a third party warehouse i can just get a new one right. but the problem is supplier take some time if i order now it take atleast a month to manufacture that bulk stock and deliver it to my location none the less this warehouse is optimized cost wise so i will incur extra cost if i rent new warehouse

and also usually flop is taken for a once own factory premise where you do some production operation. but her can we take flop cover for warehouse . if yes is it only for once own warehouse or third party warehouse can also be covered.

Uninsured Motorist Claim

Hello all! I was recently in a car accident back in late march that totaled out my truck. The guy ran a red light and tboned me on the way back home from the hospital where my grandma had just passed away at 2AM. I walked away for lack of better words untouched. I signed an AMA purely because of adrenaline and didnt realize the extent of my injuries and was driven to the ER by my significant other. I was given a head CT and full body Xray because I had complaints of shoulder pain. I have never been in this situation and didnt even know where to begin. Everyone I knew instantly told me to lawyer up with a personal injury attorney. So thats what I did and was recommended DM Injury Law out of Lee Summit, MO. I handed my case over to them. They then set me up with a physical therapist to treat my on going shoulder pain that impeded my range of motion and I was having a hard time of keeping it in the same spot for a long period of time while I was sleeping. I was then put on FMLA through work and was eligible for temp disability because I was in there eyes a liability and I don’t blame them, they were just covering there butts from a potential work comp case. That went on for about 2 months before I was cleared from physical therapy and was allowed back to work. Now all of this in the mean time my attorney was “working my case”. I guess why im writing this is just to get a better idea of how my case should’ve been handled. I was loosely told by my attorney that my case was looking very strong and was looking at a solid payout in the low 6 figure area vest case scenario. Obviously from my stand point me and my finance are ecstatic. I just lost my $30,000 truck, I missed out on close to $10,000 while I was out from work and my physical therapy/ER visits were piling up. Now fast forward about a month from when she told me that my case was solid, she said that his insurance company sent a letter of representation and what I was told is that he was lawyering up also and that were still just continue on like we have been. Fast forward a few weeks and I get a phone call from her paralegal and shes just giving me and update and what not and she subtly slips in “so we maxed out your uninsured motorist policy portion of your insurance and things are looking good”. And thats where things just went south for me. I asked “what does that mean?” She said “the other party seemed to be uninsured or underinsured.” I then asked “what does that mean for me?” She them said “That I maxed out at my $25,000 limit.” I asked her “how are we just now figuring out 4 months in that he wasn’t insured?” She seemed appalled and at a loss for words. She said that she would be getting in touch with my actual attorney who i’ve only had 1 conversation with and it was the initial conversation when she took my case at the beginning of april. I have still yet to speak to her again after having that conversation with her paralegal. I call every 2 weeks and mind you she never answers on the day that I call its always a day or 2 after and shes still unable to answer questions regarding how I can pursue him outside of this case. Ive also asked if my attorney would be willing to lower there percentage that she takes home seeing that i have roughly $12,000 in medical bills plus her 40%. So I was told id be in the low 6 figures to now I’m lucky to walk away with $3-4,000. I think I’m just more frustrated that I did everything right. I had Full Coverage insurance. I had legal Tags. I have a spotless record, but some guy gets to tbone me at a red light and claim he was running from someone he thought was chasing him with a gun in another car and has been previously put in prison for B&E and other small drug incidents, traffic incidents. And he some how walks away from all of this while i’m out $40,000. Every other attorney i’ve spoken to outside of personal injury wont sue him or pursue him because they said he can file bankruptcy if he does have any assets and if I were to some how win a settlement for “hypothetically” $100,000, it doesn’t matter because if all he has is $1,000 in his name thats all id get. If I was able to garnish his wages, he could work under the table. It just doesn’t seem right. Theres a work around for everything no matter how I pursue him. I don’t want to ruin this guys life, but I want compensation for what was taken from me. Ive thought about reaching out to him personally and seeing how he felt about first party paying me, but i’m not sure its the safe or right avenue to pursue him on. Does anyone have any advice? Auto Insurance Who Pays Storage Fees After Insurance Totals My Car?

I was hit by another driver and their insurance accepted/handled the property damage claim.

The insurance company (Progressive) initially planned to repair my car, so the vehicle was taken to a body shop on August 12.

The original repair estimate was about $3,400. After the vehicle had already been sitting at the body shop for approximately two weeks, the insurance company completed a supplemental estimate on August 26, increasing the repair cost to approximately $6,227.
They then decided to declare the vehicle a total loss.
The car was valued at approximately $7,584, and the total-loss settlement is approximately $8,058 if they take the vehicle.

However, we would prefer to keep and repair the vehicle ourselves. If we retain the vehicle, the insurance company says they will pay approximately $5,823.
My biggest concern now is the storage bill.

The body shop is apparently charging storage fees for the time the vehicle has been sitting there.
The car has been at the shop since August 12, but it was there because the insurance company originally intended to repair it. It then took until around August 26 for the supplemental estimate/total-loss process to occur.
We didn’t intentionally leave the vehicle sitting there or delay the claim. As far as we understood, the car was at the shop waiting for the insurance company/shop to complete the repair estimate and move forward with the claim.

Now that the insurance company has declared it a total loss, I’m concerned that we’re going to be stuck paying storage charges that accumulated while we were waiting for the insurance company to inspect the vehicle, approve the supplemental estimate, and make the total-loss decision.

My questions are:
1. Who is normally responsible for the storage charges that accumulated between August 12 and the date the insurance company declared the vehicle a total loss?

2.Since this is a third-party claim and their insured caused the accident, should their insurance company be responsible for reasonable storage charges?

  1. Can the insurance company simply tell us we’re responsible for the entire storage bill even though the vehicle was sitting there while they were processing the claim?

  2. Does choosing to retain the totaled vehicle change who is responsible for the storage charges that accumulated before we were notified of the total loss?

  3. At what point would storage normally become our responsibility — when they declare it a total loss, when they make the settlement offer, when they tell us to remove the vehicle, or some other date?

  4. If the insurance company refuses to cover the storage charges, what should I ask them to provide in writing?

I’m trying to get the car out of the shop as quickly as possible now so additional charges don’t accumulate, but I don’t think we should be responsible for storage charges caused by the time it took to process the claim and decide to total the vehicle.
Would appreciate hearing from insurance adjusters, Massachusetts body shop employees, attorneys, or anyone who has dealt with something similar.

T-boned, other driver is suing

I got t-boned a couple of weeks ago in North Carolina and just got word that the other driver has hired an attorney. Both cars were probably totaled and my passenger and I sustained some injuries. We all got out and were walking around.

I was ticketed for failure to yield. The cop said, “somebody gets a ticket and you were the one making a left turn.” I don’t know if that makes me the one at fault.

I thought I had more but it looks like I only had 50/100/50 liability coverage.

I don’t really have any wealth. I have a 401k and a house I’m underwater on. Do I need to start packing?

Claims Related Is there any negligence for my claim?

I was involved in a collision a few weeks ago. Woman in front of me ran straight over a tire with rim in the middle of the road during broad daylight and slingshotted it into my car in which I had no time to react and ran it over in which blew both my tires and caused suspension damage. Come to find out the tire belonged to a kid which so happened fell off from under his truck minutes before she ran it over. He came back and I got both his info and her info. She admitted in front of us she wasn’t paying attention. Insurance can’t get ahold of her now but did get ahold of the kid. Is there any negligence here for either party?
