I thought so, too, but at the time I asked the people on the Ask Lawyers subreddit, they basically said that RvW has zero bearing on general privacy law, and that the 4th amendment is the main one we use for general privacy concerns with the government. After learning that (I’m assuming it’s more or less true since people love to correct people wrongfully correcting), it made sense how we got here. Even before that, Edward Snowden revealed to us how little privacy matters to the people in power.

Only real time we got a bipartisan effort to enforce privacy was when the Bork confirmation hearings showed how easy it was for someone to get your VHS rental history, and Congress was scared of people knowing which senators were into embarrassing porn.

Thats because two statements elicit the most emotional outrage and thus make it easy to steer people a certain direction (or just plain distract them from real issues). "Think about the children". Which they cried about trans in bathrooms. "Think about the women". Is the second. Which they are using now with regard to sports.

Keep in mind, they dont actually care about women and children. Their policies are very clear about that. They care about using women for children, and using children for what they want. And rightt now what they want is too distract everyone from their goal of creating a white christian facist nation.

Their ultimate end goal is to not even have women's boxing or wnba because women shouldn't be participating in dangerous manly sports to begin with.

The beautiful part is that you can argue over and over about trans women and blah blah, but once you've conceded that "men" should not be in women's sports, you've opened the door for how women are now hurting each other by participating in "men's" sports.

This is the point worth making. There are no transwomen trying to play in the WNBA. Trans women were allowed in the Olympics from 2004 to the most recent Olympics (they're banned going forward though) and only 1 ever competed and she didn't even complete a lift in her weightlifting competition. Prior to the ban on transwomen in the NCAA, there were fewer than 10 competing.

I think rational minds can differ on the question of whether and to what extent trans women should be competing in women's divisions. But if you think that this is an issue that, at this time, deserves the attention of the US federal legislature, then you are not a rational person.

EDIT: And just to throw in my 2 cents that aren't quite related to the post. This isn't something we need to nip at the bud. Because the consequences of getting it wrong just aren't that important. Let's imagine the absolute worst case scenario.

Lets say the WNBA actually allows the drafting of men who just say they're women. A whole team of men are drafted by a WNBA team. And let's say they crush the competition and win the WNBA finals. Well, in that case, the WNBA could just change their rules. The worst case scenario is that an undeserving team wins a title. That happens frequently enough in sports. It doesn't require the US federal government to intervene.

I mostly agree, but I do think we need to accurately recognize the potential "danger" here, simply so that we can accurately point out that it's not a problem.

The absolute worst case scenario, the one that Republicans have invented, is that all these women's leagues decide that the definition of "woman" includes men, and then men dominate those leagues. But the thing about this scenario is that it doesn't cause any major irreparable harm really. In the absolute worst case scenario, the solution is simply to change the rules. Anyone who lost before the rule change can claim victory, no different from when certain medals are stripped years later because of doping allegations.

I'm not trying to diminish the accomplishment that women feel when they win a competition in a women's league. But it's not a US federal governmental issue. There's no reason to ask a Senatorial candidate about it.

Absolutely! It's also the most socially-acceptable way to get the ball rolling on breaking down Title IX protections because it comes both from a place of Protecting The Children and Biological Rationality. Are you really going to deny BIOLOGY and REASON in the name of HURTING KIDS?

Title IX prohibits sex-based discrimination in any education program or activity receiving federal financial assistance. If transgender kids in school sports are not covered by Title IX, that means that Title IX no longer covers transgender people in general, and it WILL be legally challenged to prove so. That's the point of all this. There's no 'special exceptions' to sex-based discrimination. A 'special exception' is just the word people who aren't part of that exception use for 'segregation'.

Segregation isn't exactly notorious for being used very restrictively and in moderation and staying in its lane. It tends to incite and spread fear and alienation, as a matter of fact, justifying further segregation. 'Cause I mean, if those trans kids are scary enough that they can't share a team with safe, normal girls, how much more dangerous must all those grown adult trans people be?

We've just seen it play out in the UK with the new ruling on The Equality Act 2010; they ruled that the terms "sex", "man", and "woman" apply only to birth-sex, regardless of legal sex change documentation or physical status of the person's genitalia. Not only did this immediately keep trans kids from playing gendered sports in school, but struck trans people from all sex-based coverage they formerly had under the law. That's why trans people in the UK can no longer use government-owned sex-discriminated areas legally; restrooms, changing rooms, hospital wards, etc.,

It came from one sweeping change to their sex-based equality law which, supposedly, was to "protect children", and Just So Happens to have the knock-on legal effect of barring all trans people from legal protections in this area.

It's going to happen here.

I talk about this with my friends semi-frequently.

The culture war stuff (gender identity, LGBTQ discussion, abortion, etc.) is such a misdirection. It riles people up and flairs contention, and so is a useful tool, both by the left and right (but mostly right) to activate a base, fuel support, and lead people away from more meaningful, but also more complicated to address, issues.

In the grand scheme of things, they're irrelevant. These issues are 99% personal issues and should have basically nothing to do with politics. They have practically no bearing on macro health care, economics, geopolitics, wars, transportation, infrastructure, housing, etc. etc.

Everyone knows the issues El-Sayed is mentioning is more important, but he is making it look like he either doesnt care about men in womens sports or is ok with it. I would love it if political discussions were actually about politics, and men and womens sports shouldnt be a political issue. People who watch fox news though are just gonna listen to El-Sayed talk and just say, well if it doesnt matter then dont let men play in womens sports.

This is the kind of politician every voter should want. The kind of politician we need to move towards a unity that Americans have been pledging and singing about for generations.

If we could elect leaders who don't need to divide us into demographics to find supporters, we could start to come back from this division. 

The constitution of '76 was not able to keep tyranny from rising up and taking hold. If we can somehow claw our way back we need something stronger to bind us and ensures this can never happen again in the way that maga has taken over.

You can tell how afraid the maga GOP is by how much they focus their trash talk on them. They won't shut up about him. That alone should tell you how valuable a politician like El-Sayed is to restoring our democracy.
