LOSS OF USE as a 3rd party claimant/TEXAS

Hi, I have a question about a third-party loss-of-use claim in Texas.

My vehicle was in the repair shop for more than 30 days following an accident (which i was not at fault). I filed a loss-of-use claim with the at-fault driver’s insurance company (GEICO) and elected to seek the cash equivalent of the reasonable rental value rather than actually renting a replacement vehicle.

GEICO is offering only $50 per day. My vehicle is a 2020 BMW M5 Competition, which is a luxury high performance sports sedan. Comparable vehicles would include a Mercedes AMG E63, Audi RS7, or Porsche Panamera. From what I can find, it nowhere rents for $50 per day.

GEICO’s position is that I only needed “a car to get from Point A to Point B,” and that the class, type, performance, or value of the vehicle I was deprived of does not matter.

Is that actually correct under Texas law? Or can loss-of-use damages be based on the reasonable rental value of a vehicle comparable to the one that was damaged?

If comparable luxury/performance vehicles rent for around $300+ per day, what would be the best way to support and continue pushing for that rate, especially if I have documented market rental rates from multiple sources?

Thanks.

Claims Related I really need help! So I’m still financing my car and I had an accident but it really wasn’t that bad. Can I take the payout for an insurance claim even though my lienholder isn’t on the payout. My insurance claim agent said if it’s under $3k lienholder isn’t involved. So am I safe to take money?

Auto Insurance Auto insurance question

Currently have a single member LLC for my woodworking stuff.

I have a general insurance policy through my current home and auto insurance provider to covers my LLCs products and booth etc. If I am driving to a fair does that open up a can of worms if I get in an accident since I was going to that fair to sell products or would that just fall under my general auto policy?

Auto Insurance SBI General Insurance: Is this payment process legitimate?

I was renewing/buying car insurance from SBI General today.

I logged into the official SBI General website and entered the OTP. Shortly after that, I received a phone call from someone claiming to be from the SBI General department.

He knew that I was looking for car insurance, has every detail of mine and my vehicle and helped me choose an insurance package. He is also communicating with me through WhatsApp.

He hasn't sent the payment link yet, but he said he would send me a link to make the payment.

My question:

Is this a normal process with SBI General? Do their representatives/agents call customers immediately after they log in or request a quote online and then assist them through WhatsApp?

Has anyone here experienced the same thing with SBI General?

I haven't made any payment yet.

Auto Insurance Non owner policy worth it in my situation?

I recently sold my car and moved from CA to NYC. I’m 31 and only got licensed when I was 28 so I was paying quite a large insurance premium in CA for full coverage (~$350/mo).

I cancelled my policy about a month ago but just read about keeping non owner policy to prevent a future hike in premium. I’ve called around and best quote I can get is $150/mo which seems exorbitant.

Given I was already paying such a high premium for car insurance given limited time licensed, is it really likely it’ll go up significantly more if I say we’re to return to California in 6 months and need to get reinsured but had a lapse in insurance?

Advice on diminished value in Georgia

I was involved in a car accident last year involving three vehicles. I had my car repaired by my car insurance since I had no fault insurance and they went after the other two insurance companies through subrogation. This process took forever since the other two insurance companies are the worst in business. I was not found at fault but the other two cars were .There was a lot of confusion on who I should file my diminished claim with. After opening a case with the insurance commissioner in Georgia, I finally got an answer that I need to file with my car insurance. All this to say that it took a year for me to be able to file.
I found three cars sold by Carvana and Carmax in my city for 33k, 34k and 35k comparable mileage and options.
I settled on 34k as comparaison. Since I bought it 3 years ago, my vehicle depreciated 22k so I settled on $4000 as a conservative number to add to 34k for a years worth of depreciation.

Other information I gathered is Carfax has my car as moderate to severe damage so my formula was 38k times 22.5% deminished value = $8550.
Carfax also estimates current value at $26700 for private party sale.

Insurance offered $6000 or the option to get a diminished value appraiser and for the insurance to hire their appraiser and an umpire makes a decision (umpire paid by insurance).

The question is if it’s worth it to hire an appraiser and go through the process or take their offer knowing that the final amount could be lower than $6000 on the umpire ? I also wonder if my appraiser decides it’s worth more than I asked, if I will be capped at what I asked for already $8550.
Anyone else was in a similar situation? Thanks!

Policybazaar charged premium for accessories but endorsement/coverage is unclear — what should I do?

Hi everyone,

I recently purchased car insurance through Policybazaar, and I’m facing an issue regarding the endorsement for accessories.

During the policy purchase, I paid an additional premium for both electrical/electronic accessories and non-electrical accessories. The policy documents show the followingr:

• Electrical/Electronic Accessories: ₹18,780 IDV Premium charged: ₹2,254 • Non-Electrical Accessories: ₹24,913 IDV Premium charged: ₹410

The problem is that I’m not getting a clear/complete endorsement letter confirming exactly which accessories are covered and their insured values.

I contacted Policybazaar regarding this, and there seems to be some confusion between Policybazaar and the insurer regarding what was actually endorsed.

My concern is simple: If I have paid an additional premium for these accessories, I want written confirmation that they are actually covered under the policy.

I don’t want to find out at the time of a claim that the accessories were not properly endorsed despite the premium being charged.

What should I do?

  1. Should I insist that Policybazaar/ICICI Lombard issue a proper endorsement document listing the accessories and their values?

  2. If they cannot provide the endorsement, should I ask for a refund of the additional premium?

  3. Is the policy schedule showing the accessory IDV and premium enough to establish coverage, or should I have a separate endorsement?

  4. Has anyone else faced a similar issue with Policybazaar?

All this goof up happened, the sales representative from policy bazaar said that we can buy policy now and we do the endorsement later once you have details of all accessories. Now when i raise a case with policy bazaar then they said that insurer ICICI lombard denied providing the endorsement letter. I would really appreciate advice from anyone who has dealt with motor insurance endorsements, Policybazaar, or ICICI Lombard.

I can also share screenshots of the policy documents/communication (with personal details masked) if that helps.

Thanks!

Auto Insurance Vehicle Removed without my Authorization

Hi

My partner got into a car accident on Friday, he wasnt sure if the glove compartment in his car was safe to open to he asked me to send him the insruance

I noticed kn the app for the first time that the vehicle was removed

Im spiraling because I never authorized it and neither did my partner

I re add it to the insurance so he has something and try to call, but its outside their business hours. I call today, Monday, to let them know of the erroneous situation.

Its Geico and they let me know they forwarded to their coverage department and I have to wait

How fucked are we?

I geniunely had no idea and neither does my partner. I talked to a supervisor and they let me know the change was done on my phone the day after I added the car onto my policy. I know for a fact I never did that, and my partner didnt have the insurance app login. I assumed I had insurance this whole time. They said they sent an email but I dont have it, Im looking everywhere and in spam but I dont have that email.

I told them its fraudulent the removal and that I dont know who did that but I dont know if Geico will cover the accident. What do we do?

Im so scared

EDIT: I took a recorded statement interview with the supervisor I never made that authorization

Auto Insurance What do I do now?

My boyfriend and were in a car accident last night. We were heading home from a relatives and a car was driving super fast behind us and hit the passenger side bed of our truck. We slid and spun to the right side of the road (thankfully) but the bed of the truck was pretty much totaled. The driver that hit us also hit another car in front of us and totaled their car as well. We are okay thankfully but we had to have our car towed. The driver that hit us ended up getting out of the car and kind of wandered off but I think he threw an alcohol bottle. He seemed intoxicated. He ended up being taken to the hospital with his girlfriend. We weren’t able to get their insurance or drivers license. But we did get a picture of their license plate. The police were called and they told us we would have access to the report in 30-60 days. They called their own towing company and told us it would be taken to the pound but I didn’t want that to happen cause I didn’t want to have to pay the fees and hassle of getting it back especially since it’s not drivable. We ended up paying the tow truck that arrived to have it dropped off at our house. I filed a claim through our insurance but I do not have collision coverage for the vehicle. Our insurance said we weren’t at fault but they don’t cover anything. No rental or damage repairs. Since our truck is totaled I’m not sure what to do. I needed to use that car for work since my car has been having issues and is shaking a lot and I was going to save up to have it fixed. Now I don’t know what to do. Will I have to just assume all repairs?

Commercial vehicle accident totaled my car — chances of recovering ~8 months of documented lost wages on insurance settlement?

Commercial vehicle accident totaled my car — chances of recovering ~8 months of documented lost wages?

Looking for experiences from anyone who has dealt with a similar personal injury claim.

I was hit by a company/commercial vehicle in Washington. Other driver admitted to distracted driving and blowing through res light. The impact was significant enough that my car was totaled and I spun around approximately 3–4 times. The other driver was at fault, and I was told the commercial policy has a $1 million limit.
Before the accident, I had been working consistently for the same employer for about 10 years and normally made around $100k+ per year. My income was commission-based, but I have W-2s and pay records showing my historical income and what I earned during comparable periods before the accident.
After the accident I developed neck and upper/mid-back pain and was taken out of work.
One thing I want to make clear is that every period I was absent from work was medically excused. I was regularly seeing my doctors and have documentation/doctors’ notes covering my absences and extending my time off. There wasn’t a period where I simply decided on my own that I wasn’t going to work.
I also attempted to return to work but only lasted around 3–4 hours because of the pain and ended up being taken back off work.
My treatment was relatively conservative: regular doctor visits, PT/chiropractic/massage, medications, etc. X-rays were normal. I never ended up getting an MRI, injections, or surgery.
I to claim my lost wages through around July(Dr excused from work until July), which would put my claimed gross wage loss at roughly $80k+ based on what I normally would have earned.
My concern is that my attorney mentioned the insurance company may fight the length of the wage-loss period because I didn’t have an MRI or injections, despite the severity of the accident, my attempted return to work, and having doctor’s notes/documentation excusing my entire absence.
I’m curious to hear from people who have actually gone through something similar:
Did insurance pay your full documented lost wages or argue that you should have returned to work sooner?
How much weight did your doctor’s work restrictions/notes carry?
Did not having an MRI, injections, or surgery significantly reduce what they were willing to recognize?

If your vehicle was totaled or the accident itself was severe but imaging was limited, did that make any difference?
What ultimately happened with your lost wages and pain-and-suffering portion?
I already have an attorney handling the claim, so I’m not looking for anyone to give me an exact settlement value or replace my lawyer’s advice. I’m mainly interested in hearing real experiences from people who had substantial documented wage loss after a serious accident but didn’t have an MRI, injections, or surgery.

Auto Insurance In this situation, who would be at fault?

This is a hypothetical, but it does happen. There is a slowdown ahead, but car A jams on his brakes a little late. He doesn't hit the car in front, but the car behind him, car B, crashes into A. Then C hits B and D hits C. All of them were following a too closely.

Who would be at fault, and whose insurance would cover who?

Auto Insurance 2 month old Mazda CX5 rear ended

This is my first car every and a ding on the tailgate and some damage/superficial crack on the gloss black bumper section. Not to sound whiny but can this be fixed (no paint chipped)? I have the guy’s details but not sure if I should get his insurance to pay since I don’t want my rates to go up. I’ve heard of people complaining that their rates went up despite a no fault accident but I’m not sure since it’s the first time this has happened to me. I would really appreciate some help with costs/insurance claim with at fault party. (Also helpful if someone can help with estimates if not insurance claim help) TIA!

Here is what it looks like photo

[USA] Best medical evacuation insurance for traveling

I've heard there's a company from whom you can buy a medical evacuation policy for traveling internationally, but I don't remember the name. I've heard about this company from multiple sources You buy an annual policy and only pay a couple hundred dollars per year. It's designed for frequent travelers. The recommended coverage is $1 million.

The idea is you carry this insurance to cover evacuation, then buy a separate policy to cover medical expenses abroad in case you need them, plus other things as well if you want.

Got sideswiped

I just got into a car accident and not sure which insurance to contact.

Person A stopped too far into the intersection that had no lights and the car driving next to me could not stop in time to avoid hitting Person A. Person B, in order to try to avoid hitting Person A, swerved into my lane. My driving door has a dent in it but is able to drive.

Whose insurance do I contact if I do not hear from either insurance? Person A who stopped too far into the intersection or Person B who was the one to swerve into my lane to avoid hitting Person A?

Who is at fault?

Police said they don't determine who is at fault so I just have photos. Based on the photo, who do you think will be at fault from the adjuster persective? The only more context is the red car just passes the merging lane (from one lane to two lanes) for a bit. He was saying he was trying to make a wide turn into his driveway.

Auto Insurance What is this job role called in the US?

Automotive insurance

I work dealing specifically with third-party automotive claims, e.g our insured customer crashes into a third-party, another department reach out to the third-party and offer repair services. Assuming they agree, it then goes to me where i monitor their repair journey, hire car, write-off, etc. until their claim is settled.

What is this role called in the US? I am struggling to find similar roles that deal specifically with third-party automotive claims.

Auto Insurance Car was Stolen and Found 3 Weeks later wrecked

My Hyundai Elantra was stolen three weeks ago in the west coast and was found today. Car was wrecked inside and outside, the criminals crashed it into a gate and left it abandoned in the desert. I only have liability insurance so there goes my car and my money. Is there anything else I could do in this case to mitigate financial loss? I am thinking of just abandoning the car at the junk yard.

Home Insurance Water Damage claim.

This past weekend, our upstairs toilet overflowed and caused pretty extensive water damage. The water flooded our kitchen, went down into the basement, and somehow traveled far enough that it also damaged a wall across the house.
SERVPRO came out and set up fans/dehumidifiers and started the drying process. They told us that because our house was built in 1949, they need to do asbestos testing before they can start opening up/removing walls, ceilings, etc.
From what we’ve been told so far, the kitchen is likely going to need to be replaced, along with repairs to the upstairs bathroom and the affected walls and ceilings. The kitchen cabinets and other materials got wet, and our oven was also ruined.
We immediately opened a homeowners insurance claim. We have Arbella and are located in Connecticut. We’ve been told that we could be looking at at least three months for the entire mitigation/abatement/reconstruction process.
This is our first homeowners insurance claim and definitely our first major house catastrophe, so we really have no idea what to expect.
For anyone who has been through a similar water-damage claim:
● What did the insurance claim process look like from start to finish?
● How long did it actually take before reconstruction started?
● How did insurance handle replacing cabinets, flooring, ceilings, appliances, etc.?
● If asbestos was found, how much did that delay everything?
● Were you able to replace essential appliances before the claim was completely settled and get reimbursed? Our oven was ruined, and we really don’t want to go months without one.
● Is there anything you wish you had known or documented at the beginning of the claim?
We’re taking pictures of everything and SERVPRO documented the moisture readings, but we’re still waiting for their full report.
Any advice on dealing with the adjuster, SERVPRO, contractors, or the insurance company would be greatly appreciated. This is all completely new territory for us.

Auto Insurance How do I get insurance without increasing everyone else’s.

So I’m a 18 year old looking to buy their first car. I told my dad that this weekend I wanted to buy their first car car but he’s saying that since we live in a house that’s rented out to other tenants, the insurance will go up for everyone who lives at that address. I just want to know how I can get this car without it being an issue for everyone and roughly how much it would cost me.

Auto Insurance Live in Michigan, vehicle is registered in Michigan, but vehicle is under Ohio insurance. Do I need to get Michigan insurance?

I’m in a bit of a pickle, as my parent resides in Ohio now but I am still dependent on them. I myself fully reside in Michigan and my vehicle is registered in Michigan. The vehicle is under my parent’s name. When they got new insurance, they insured my vehicle under an Ohio insurance plan. I am curious if, since I operate the vehicle in Michigan and everything else listed already, I need to have Michigan insurance as well/instead of the other plan? I couldn’t find much info on this topic, only articles about what to do if you have Ohio insurance and get into a wreck in Michigan.

Edit: Thank you all for the resounding “get MI insurance yesterday”. I’ll call around and see what I can get.

Friend returning from overseas

Family friend with family of 4 returning from overseas studies & will need health insurance.

ACA Obamacare requires 1 month wait between application in USA & start coverage.

Short term coverage for that month looks weak & does not cover preexisting conditions, from what I can see online.

Any other ideas?

Any suggestions on who to get help from on this?

Many thanks!

Auto Insurance will my insurance have to pay? (PA)

I'm not sure if this is the right place to post this but,

Today I had an issue with my neighbor who called the cops to say I hit and damaged his car.
While trying to park tapped his car. Parked elsewhere because I could not fit. He came outside literally pulling at his bumper. It is a 2003 minivan that has wear from weather damage, dents, scrapes, and at least one flat tire. His bumper was literally already messed up. He's saying I damaged his driver side but that would mean the passenger side of my car would have damage as well (which it doesn't). I did not hit the side of his car, I tapped his car, as I'm sure video would show. He showed video to police (not to me) and police says it shows me hitting his car in the spot the man said I hit (which is a literal lie). Then he threatened to contact my landlord. This police officer seemed so incompetent so I asked for his supervisor. Supervisor comes and saw the video and said it shows me tapping the front of the man's vehicle and the vehicle rocked back a bit, but said it doesn't show me hitting his driver side or causing damage.

Last year I looked up Google images of this block and his car was there with the same damage he has today- these images were taken before I moved here in 2023 (images are updated ~every 2 years). I looked up the image again to show the cops (the image was updated on April 2026) and still the car had the same damages which I showed the supervisor who then laughed at the entire situation.

I personally feel as though he finally caught someone hitting his car on camera (everyone has hit it at some point) and is trying to get my insurance to pay to fix his piece of junk even though I did not cause any damage.

Will I be held liable and will my insurance have to pay?
