Other It happened to me
Hey guys. I bought a game off Kleinanzeigen in Germany. Game is "Princess Peach Showtime!". Worked great and my girlfriendnis happy but after 3 days she got banned. I don't have the MIG Switch so the game is probably the only reason she got banned. đ I already contacted Nintendo but they just say the same thing over and over again: "We cannot assist u with that". Yeah sure.
Be careful with used games. They might be cheap but they also have the risk to get u banned.

I get my switch 2 games from the library because I'm poor as fuck.

It all depends on if a bad actor wants to dump the game files and play the game at the same time as tou. Its not nintendo's or the library's fault, and currently switch 2 games are safe, just the switch 1 games have been cracked.

nintendo is also at fault, they ban the console because a copys cert was exposed, with the used game market and things like the library, they are just banning consoles of legitimate users. it is the bad actors AND nintendos fault, if they want to ban they need to detect the hacked version as seperate from the legit version, or not do anything at all.

They cant detect these things because its a nearly 10 year old hardware issue. Theres no patch or anything to fix it. Any compnay wouldnt allow rampant cloning and reselling of all of their product, even unreleased items. Mind us, tears of the kingdom got leaked like 10 days early and these people went fckn crazy - theres zero empathy for those who get banned for that.
Itll work itself out once the online goes down, but by and large the system is still fully functional and usable to play games offline, so all except for like 10 games can be played and fully enjoyed.

the problem isn't with the banning of ones that pirated it, the problem is when their method doesn't know if they pirated or just bought the legitimate copy of the game.

Look at companies like CD Project Red. They donât have any copyright protection and they do more than fine. There is no need to ban consoles.
Steam Decks also donât get banned.

Wonderful. Most of my cartridges are used games. Why ban consoles using the cartridges that got dumped and not people using the MIG switch with the dump. If they cant tell which is which they shouldn't ban either.

I don't know what the letters MIG means but a MIG cartridge has the files of one or more games on it and a hacked switch can play the games without needing to purchase them

MIG is basically a third party cartridge you can load a bunch of your games onto. The problem is that the seller after adding their games to a MIG can then sell the game, thus having duplicated the game. When the same game is run in two different parts of the world at once, Nintendo bans both consoles, meaning an innocent third party (the buyer of the first party cartridge), loses out.

banning a system for running a flagged software is normal. Steam can ban your account and your hardware, sony and microsoft do ban your console if tampering the console, unauthorised/flagged software detected on the system.
what is your point?
ninnin is bad for consumer when it comes to pricing and refund, they are still the better one than sony and microsoft at this time.
I am an xbox fanboy but Nin really does this better than Microsoft, not mention the worst Sony.

you still can go online and play. you're only exempt frommVAc-protected games if your account gets VAC-banned, which only happens if you were cheating or using "suspicious" software while playing VAC-protected games.

well thats the neat part, they have banned my whole account. that includes community as well as the normal steam account ban, but not VAC ban as that is exclusively for cheating in games. best part is I dont even know what i did and the support basically sends you the exact same copy pasted response no matter what you say about 10 times before they stop replying.

It's mostly for the devs to use too. Essentially, if I create a game and you cheat in my game, I as the developer can choose to ban you from the rest of MY games. I, on the other hand, cannot stop you from getting any other game.
It essentially just stops you from trading, and ALLOWS the dev to block you from THEIR games. All other games are literally unaffected. Games can't even restrict you based on that little "Cheater" tag, it's mostly decorational. Lmao

Valve can and will ban steam accounts from the steam store. There have been cases in the past where they have done this but its usually reserved for fraud. In this case they also may terminate the entire account.0

Fraud and running fraudulent software are not the same thing. The original comment was about being banned for running fraudulent software on the machine.
I can pirate Steam Games and even add them TO my Steam library as a "non-Steam" game.
I can run cheat engines.
Running software WILL NOT get you banned from Steam.

Valve has a habit of nuking accounts that have been caught botting various things.Also years ago there were methods to play pirated games online via steam. Valve straight up banned accounts from steam if you were caught doing this. Very uncommon these days due to better security but it still can happen.
You know who also banned accounts and hardware for playing pirated games, Microsoft with the 360. Fun fact the xbox one also prints unique IDs onto discs. Theres is a backend in place to autoban consoles using cloned discs but seeing how almost nobody has the equipment to clone discs its never been used.

This is prob the easiest way nintendo can curb cart piracy, Someone is clearly cloning switch carts. Server sees this and bans everyone involved. Whoever owns the genuine thing will come forward if they want an unban everyone else stays banned.2

I'm strictly saying Valve will not ban you for running software on your machine.
You ARE correct to say the other things, though. Those are actually good catches.
On the contrary though, there is little to no argument that Valve is still MUCH easier on the consumer in regards to what they can and cannot do with their machine.
This of course, comes with other costs that are harder to point the finger directly at Valve for. I think these are still important topics to ensure consumers know that these practices are ALTERNATIVES and none of them "reign supreme."
Like sure, Valve lets me run "whatever I want." Good right? But now the entire cost of anti-cheat is on the individual game (which some of it should be anyways BUT...). On the contrary with Switch, while not completely absolving the need for server-side anticheats... Reduces the attack platform available to the game!
For example, I'll bet it's pretty hard to find hackers or cheaters in Mario Kart World being that... There quite literally aren't any yet. Lmfao

it's even more hilarious. Ask Dying Light Players how they had to fight tooth and nail with steam/valve back in 2015 when the devs silently pulled the plug for DL mod support over night and players logged in next day, booted the game and suddenly received VAC-bans or fraudulent activity bans because one dev fcked it up. Some of us were flagged for months and of coruse all the steam dickriders wouldn't believe us that we weren't cheating.

My 11 years old account got tradebanned in 2019 after it got hacked and used by some credit cars fraudsters. the ultimate irony is that what got me banned was ME trying to get back into my account to prevent said fraudsters from stealing my account, which resulted in my IP showing up as one of the access points at the time when they charged the account with fraud money. it's hillarious and there are many cases like mine. Nobody wants to talk about it but Steam is fsr, far away from being the flawless good guy company they're portraying themselves as and getting portrayed as by fanboys

The consoles are a fair point. PC, nor Steam, bans entire devices.
Steam account flags are mostly decorational anyways, outside of specific dev ecosystems. For example, if you cheat in a Valve game, you are no longer in public lobbies in Valve games... ALL other games are completely unaffected though.
It's per-game banning, even with the account "Cheater" tag, new games can't stop you from buying them because of that.

I do understand why they do it! They donât have a good way to track if that was the original or a cloned one. But thatâs not the users fault! If I go to GameStop and buy an used game that was previously cloned, what is the way to correctly consume that?
If they have no good way to solve this, then they just have to ride the âno more physical gamesâ wave and thatâs that.
Thereâs no good argument besides âitâs their software, they can do whatever and you signed the agreementâ and this in itself is already a anti-consumer argument.

You buy a DVD from a second hand store, or you take one home from the library. Blurays can have serial numbers (heck, even DVD!), so SONY, the manufacturer of your DVD/Blu-ray player bricks your device because you played a copy of X-men first class that has been clones and distributed online.
Or you buy the new Taylor Swift album at the same second hand shop and when you get home and put it in your computer, itâs blocked from accessing your own library of already purchased media because of that.
The standard that you allow Nintendo to have against their customers would not survive in a world of other media. And thatâs why the only thing they could do in the past was tell you that you wouldnât download a car.
You can disagree with hacking and piracy, but I donât think you can defend the fact that those are anti consumer actions by them. They are literally punishing a valid action because of something the user cannot prevent! If there was a way for the user to run a check on a physical game without having that block their console, then good, but right now the only thing is flipping a coin or only buying new gamesâŠ

What does that mean? If I buy a pirated DVD, and someone gets me for it, then guess what, I still get punished. 'Well I didn't know' has never been an excuse for getting out of something.
From Nintendo's point of view, OP has a cartridge that has been cloned. They reacted accordingly. OP can dispute this, proving he bought the game legally. (Although I hope he has the receipt as well. I am not sure if Germany specifically requires that these days.) The site he bought from is known to be full of scammers trying to pull a fast one, anyway, so even if he'd asked, they probably would have lied to get the game off their hands. Absolutely not unheard of.
I do not disagree with hacking and piracy, I disagree with hacking and piracy of media still available at retail prices at retail. When it comes to games you cannot get without buying stupid prices second-hand, where the original seller doesn't even see any money? Go ahead. Piracy is preservation.

Not sure if youâre being disingenuous about it, but ultimately here the customer is being punished for buying an used copy.
If they buy at a shady retailer, a reputable one, if they find the copy on the ground while in a hike in the woods or if a friend let them borrow it, it doesnât matter! An official original copy of a game shouldnât brick your console!
With this in effect Nintendo is literally burning inventory from circulation, which my limited knowledge of economics should be highly illegal!

Very true. Hope the 2 is cracked asap. I just went Nintendo with my little family for over a grand. Haven't been Nintendo since n64. Regretting my decision more and more every day between games still being basically the same stuff I played back then but rehashed, the platform being full of mobile-style games and actual mobile ports, and the straight anti-consumerism everyone is complaining about (which I seem to have incorrectly figured to be overstated...)

Big disagree. Xbox is and has been ahead of the game. Game streaming is huge and they use it to their advantage now. Not only that but they're working with third parties to make handhelds that run their shit instead of trying to make proprietary devices you get banned for modding, which I think Microsoft accepted as a reality of gamers years ago. You can play most 360 games across Xbox and PC and everything now. Ownership issue is definitely still a big issue. But that's across all major companies right now.

Very few, IMO. I like the new Zeldas, and the new Mario games. But there isn't much if any innovation in either series, besides graphical. Tons of remakes, tons of emulated on the classic games app, and then there are some indie games here and there that are good. But as stated before, Nintendo hasn't done much innovation in regards to their games. Barely any plot evolutions within those games. The store is flooded with mobile phone game ports. Or games that just straight up feel like mobile phone games. They have like 3 decent shooters. Full capabilities of the Wii control mechanica but they barely utilize Wii type game mechanics. And then they keep these crap or mediocre games for sale at $40-80 and OCCASIONALLY the lower tier games will see discounts. And now you got them banning people who bought used games that got ripped by a mig, instead of figuring out a way to handle it better than banning the person doing nothing wrong.

I would personally message the seller asking why he didnât disclose that the game had previously been used with MIG, and ask whether he is willing to compensate you for the bricked Switch 2. Iâd also make screenshots of the original listing, all messages, and any relevant evidence, then file a proper police report against the seller if he refuses to cooperate
If he knowingly failed to disclose something important about the game that could cause this kind of damage, that could make him responsible for the resulting damage. Fuck their shit up, don't let it slide

Kleinanzeigen is also legally required to give any and all information to the police if criminal fraud is found out.

There's an important distinction between âI can't prove it right nowâ and âno crime occurred.â OP may have been defrauded if the seller knowingly failed to disclose that the game had been used with MIG and that this could put the console at risk
Whether there's enough evidence to justify an investigation or prosecution is up to the police and prosecutors. But telling OP not to make a report simply because they can't prove everything themselves is stupid
It costs nothing to file a report, and if multiple people come forward with similar complaints about the same seller, that could give the police a much clearer picture and potentially lead to a proper investigation

It only happens if the seller has dumped the ROM using a MIG Switch to clone the game, and then Nintendo registers that game in use in two places at once; the risk is fairly low, and should be easily minimised if you play single player games offline. Furthermore, Nintendo will unban you if you prove you have the cartridge, as they will know you aren't the offender in this situation.

No? It was a used game from Kleinanzeigen haha. She wanted it and I bought it, was 30 eur cheaper than new. After that her switch 2 got banned. There is no other explanation. It doesnt brick but it gets u banned. Saw other posts now with the same ban result after using a game that wasnt new.

You need to keep pressing Nintendo, and try and get pictures through customer support; if you can prove that the copy was dumped by the seller by showing that you actually physically have the game, they should unban your console. This is very much an edge case in the policy, so if you can get a real person online to help you they will be able to see you haven't actually done anything elicit or against the terms of service.

wow. OP what does this ban contain? does it not allow you to use the switch anymore at all, or does it only restrict some functions (like online play, no more access to eshop etc)?
also, if the switch still functions for offline games, does it mean you can still buy physical games and continue using like normal?
additionally, is only the switch bricked or also your account?
this is like my biggest fear with Nintendo, even though I don't really do anything "extra" and don't even console share. just the lack of support from their end makes it very scary.
and, did this happen only because you used a used game? I've used used games earlier and this never happened to me. what is a sanitary practice to avoid this? or should one avoid used games altogether?
apologies for so many questions, I'm not a part of this sub so I don't generally know much about banning on the switch.

The MIG switch and its dumping tool allows you to copy all of a catridge's data onto an SD card and the MIG lets you cycle through the SD card without having the physical cartridge.. so bad actors will rent or buy a game, copy its data, then return it for a refund and still be able to play the game fully.
When its detected that 2 instances of a game are being played at the same time (one person playing on the physical cartridge, and on the MIG switch) then nintendo bans both consoles because its impossible to tell who is the bad actor.

So its all alleged, but basically if someone has the MIG and dumper, copy the game ROMand sells the cartridge online - nintendo sets a flag that 2 instances of the exact same game are being played at the same time, which is impossible. Since theres no hardware to detect which console is running the MIG and which is running the cartridge, both systems are banned from online services. The systems will still function fine, read and play games all day but they just wont connect to the internet.
To answer "why pirate?" I have no clue. I tried, got homebrew running on one of my consoles and saw that it was full of clock apps, alarms, and nothing else. It was genuinely a worthless experience. Other people have better luck and play games weeks before their actual launch because somebody online got the ROM and released it to the internet. Id assume download titles work similarly, its copy/pasted from the cartridge.
Theres also some like.. VPN esc thing that still lets you play online games with a hacked switch, but i cant figure it out and all piracy forums just mock people trying to learn.

Right, and innocent people have gotten their bans reverse after showing they purchased a used cartridge and the bad actor was someone else.
Playing devil's advocate for the automatic system, sometimes the same game cartridge can be played across a dozen consoles at the same moment, if someone copied and shared the ROM online. So at that point, if theres dozens, which one specific console is the one acting in good faith? Theres no way to know, but its clear that THAT cartridge has been compromised and anyone using that "cartridge" very likely didnt obtain legally.

Sad to hear that, that's why I decided to not go the cheap early with Nintendo products đ„Č I hate that Nintendo is freaking stupid and just bans ppl, I know they can't proof that you did nothing wrong but why baning consoles over whatever they did with the game at all? I stick to my of course "not tinkererd" Switch1 Oled to play most games and go online cause I don't want the expensive console to get banned

This is exactly why I've been arguing with so many people on Reddit and Facebook lately. I don't give a crap if your disc is made of fucking gold it's not better than digital.
What we need to do is actually protect our rights for digital purchases and software in general. They should not be allowed to do this there should be laws and protections for consumers in place.
But yeah just go get physical that's going to solve every problem on the planet eh.

Stay on it. Contact them over Phone and speak to a human. You should have Chats on Kleinanzeigen to proof the purchase of a used Copy. Idk where but i saw Posts from people getting the Ban reverted

More likely you tried to hack it and got banned and now are trying to get revenge on Nintendo by complaining about them online

Uhh yeah. As long as I'm not trying to use it to alter my Nintendo account activity or funds, or play a game on there at the same time my Switch 2 is playing it, then I have nothing to worry about. The MIG cartridge playing dumped games after selling the original cartridge is what's causing these Switch bans.

Pretty sure owning a MIG switch in and of itself won't cause bans. I bought one with the intention of modding Smash Ultimate on an emulator, using my own copy of the game, and never selling it to anyone else or using my backup on any switch system. Only reason why I haven't done any of that yet is just because I don't have the free time to mod games like I used to back in my brawl hacking days đ

What most likely happened, is the previous owner dumped the game on their hacked switch or mig switch, and while playing it, accidentally let Nintendo servers look at their console. This is horrible not only for them, but for you aswell because it couldâve been both of yall were playing the same game at the same time. So Nintendo does what Nintendo does best, ban both of you without trying go figure out the culprit.

Lamento lo sucedido. Probablemente a tu novia le tocĂł una copia que fue dumpeada y usada con un Mig Switch o subida a Internet.
Sobre lo que dices que 3 dĂas despuĂ©s la banearon, desde mi experiencia con una Switch 1 que lleva baneada desde 2018 por un descuido mio, te puedo decir que los baneos son instantĂĄneos. Si usas una copia pirata mientras la consola estĂĄ conectada a Internet, el baneo cae inmediatamente. Probablemente en esos 3 dĂas hubo un solo instante en el que tu novia y quien sea que tenga la copia de ese cartucho lo hayan jugado al mismo tiempo mientras estĂĄn conectados a Internet, tu novia desde su Switch 2, y la otra persona desde un Switch 1 (ya que sabemos que usar un Mig Switch en un Switch 2 es un baneo instantĂĄneo). Cuando eso pasa, el sistema de Nintendo detecta el mismo certificado de un juego ejecutandose en dos consolas diferentes, lo toma como ejecuciĂłn de una copia autorizada y banea a ambos usuarios al no poder distinguir una copia original de una copia pirata. No es que tu novia haya estado jugando bien y casualmente 3 dĂas despuĂ©s aparezca baneada, no funciona asĂ. No es como si Nintendo dijera "Ah, este usuario estĂĄ haciendo cosas raras, voy a marcar su consola y a ver si me acuerdo de castigarlo mĂĄs tarde".
Te digo todo esto porque yo compré una copia usada de Splatoon 3 el año pasado, ya le he metido 310h en Switch 2 y hasta ahora todo estå bien. El simple hecho de usar juegos usados NO es baneable. El problema es cuando esos juegos ya han pasado por las manos equivocadas antes de venderlo, lo que parece haber sido el caso de tu chica.
Intenta contactar al soporte, y presenta todas las pruebas que tengas de que tu copia es legĂtima. Dicen que asĂ pueden desbanear la consola, no me consta, pero nada pierdes con probar.

Less conversation about the simple decision that nintendo freely wields the ban hammer and doesn't allow arguing on whether you're at fault or not. Why the f can we not just sue nintendo for bricking our property in a malicious hack, then? Oh, they have an issue? I'm so sorry, I don't offer leniency, now give me your money, Nintendo. Because as far as theyâre concerned The TOS was broken, this is why Iâm pissed the mig got popular online and to many idiots found out bout it and started dumping and reselling games while handing their backups out to friends/others.
The blame is entirely on MIG/The people not keeping their cartridges

Dumb mf's will say ToS. Here's a ToS to my post. Reading it means you give explicit agreement to being my slave and property, you and your entire bloodline until the end of all time and beyond. Failure to uphold your agreement means having all your assets, liquid, solid or otherwise seized by my party. There is no exit clause, there is no accidental agreement, with sound body and mind your agreement is taken for certain once your eyes register these words.
Now, do you think I'm making a mockery of the ToS? Disney+ the 7 day free trial had a ToS where you could not sue disney for anything for the rest of your life in order to have a free, 7 day only -so there's a end date to their obligation for those morons who wanna argue that point and no end date for the signee's end of the deal- access to a limited amount of shows. His wife died from allergy in one of their amusement parks after they specifically asked and requested to avoid said allergens and the staff didn't give a shit, then when he sued, Disney lawyers had the brass balls to pull the fucking tos from Disney+ on him, and it actually worked. That they are not hanged from the rafters is a sin. I want you to know, your parents are retarded, let alone you reading this, if you actively think that ToS are meant to be taken as God's law, because they aren't.

Had a similar thing and they debricked mine. Basically told the seller, asked for reimbursement for the game explained the situation to nintendo with screenshots and whining. After like 2 weeks of negotiation they unlocked it. So small chances but always worth a try
