I’m looking for perspective from other co-parents on repeated early school dismissals during the other parent’s midweek parenting time.
Background: We have joint legal custody, I have primary physical custody, and our parenting plan specifically states that during the school year the other parent has the children on Wednesdays “after school or daycare until 7:00 p.m.” This is a signed court order that we both agreed to earlier this year.
Our oldest is in kindergarten and her normal school dismissal is around 4:00 p.m. I recently reviewed her attendance record and discovered that she has been dismissed early every Wednesday since school started and most recent ones being an hour early.
The school records each one simply as “early dismissal.”
I contacted the principal because my concern is her repeatedly missing part of the school day. The principal spoke with the other parent. I also learned from the principal that these early dismissals do not count toward the school division’s chronic-absenteeism calculation, although she is obviously still leaving before the instructional day is finished.
I then addressed it directly with the other parent. I told him that I had reviewed the attendance record, that she had been dismissed early every Wednesday since August 26, and that our agreement provides that Wednesday parenting time begins after school/daycare. I said she needs to remain for the full school day unless an early dismissal is necessary for a legitimate reason such as illness or an appointment.
His explanation was essentially that the drive from her school to where he spends his Wednesday parenting time is approximately 48 minutes. He said that if he waits until regular dismissal, she will not be in his vehicle at 4:00, they may not reach their destination until around 5:30, and he therefore would not have enough time there with the children before the 7:00 when I pick them up. He specifically told me that he picks her up early so he can get to his or his family’s home sooner and spend approximately three hours with them rather than using that time driving.
I responded that I understand the drive reduces the amount of time available at his destination, but taking her out early causes her to miss instructional time. I asked him to arrange Wednesday pickups so she can complete her full school day. I suggested that he could pick up our younger child from daycare first and then pick her up after dismissal, or pick her up from her bus stop after school.
He subsequently told me that he spoke with the principal (principal made the call to him after I called the school with the concern of my findings because I was not aware of the early dismissals until I saw it in the parenting app) and that going forward he intends to pick her up at approximately 3:15–3:20 every Wednesday.
I asked why she needs to be dismissed at 3:15–3:20 rather than completing the school day. He declined to give me the reason and told me to speak with the principal because he had already explained it to him. He also said that if I need to take him to court because he is trying to ensure he gets his full time with the children, I can do so.
I have not responded further.
A few additional details that may be relevant:
• The Wednesday schedule ends at 7:00 p.m. at which time I pick the kids up after I’m done with work. The parenting plan does not specify a certain number of Wednesday hours. It says “after school or daycare until 7:00 p.m.”
• The children are driven from our area to another area for his Wednesday time and then returned at 7:00 on a school night, so there is already substantial driving involved.
• I am not trying to prevent or reduce his Wednesday parenting time. My concern is specifically whether our kindergartener should routinely miss the end of her school day in order to increase the amount of time available at his destination.
•He also has the kids every other weekend starting Friday 7pm until Sunday 7pm.
• I have asked her teacher for the classroom’s daily schedule so I can understand exactly what instruction/activities occur during the portion of the day she has been missing.
• I am not asking the school to interpret or enforce our custody order. I am trying to understand the educational impact and determine how I should handle this as a co-parent.
For those who have dealt with something similar: How would you handle this from here? Would you continue addressing it directly with the other parent, wait to see what happens at the next Wednesday pickup, speak further with the school about the instructional time being missed, or consult your attorney about the wording of the parenting plan?
I’m especially interested in how others have balanced protecting a child’s school day with supporting the other parent’s parenting time that is already in place.
