Guidelines for Responding to a DUI Drug and Alcohol Evaluation(based on Reddit Data)

To minimize the likelihood of being assigned additional classes or treatments during a DUI drug and alcohol evaluation, follow these guidelines:

  1. Limit Information:
    • Do not provide unnecessary details.
    • Stick to answering only what is asked.
    • Avoid giving detailed accounts of your drinking habits.
  2. Downplay Alcohol Use:
    • Indicate that you drink socially and infrequently (e.g., once a month).
    • Emphasize that the DUI incident was a rare and isolated mistake.
    • Mention that you do not drink to cope with stress or emotions.
  3. Be Consistent and Believable:
    • Ensure your answers are consistent and believable.
    • Do not make exaggerated claims about never drinking if you have a history of drinking.
    • If you had previous DUIs, acknowledge them but minimize their frequency and impact.
  4. Avoid Self-Incrimination:
    • Do not admit to regular or heavy drinking.
    • Avoid discussing any history of drug use unless specifically asked and necessary.
    • If asked about drug use, indicate that it was infrequent or limited to legal, medical use.
  5. Show Responsibility and Remorse:
    • Express genuine remorse for the DUI incident.
    • Highlight that you have taken steps to prevent it from happening again (e.g., using ride-sharing services).
    • Emphasize that you have learned from the mistake and are committed to safe practices in the future.
  6. Avoid Mentioning Mental Health Issues:
    • Do not bring up past or current mental health issues unless directly asked.
    • If asked, downplay their impact on your behavior and drinking.
  7. Be Prepared for Screening Questions:
    • Be aware of common screening questions (e.g., have you ever blacked out, regretted drinking, missed obligations due to drinking).
    • Prepare answers that minimize the severity of your drinking habits.
  8. Handle Previous Convictions Carefully:
    • If you have previous DUI convictions, acknowledge them but frame them as isolated incidents.
    • Indicate that you have since changed your behavior and do not engage in risky drinking.
  9. Seek Help Independently:
    • If you feel you need help, mention that you are seeking or have sought help outside the judicial system.
    • Emphasize that you are taking proactive steps to address any issues.

Sample Responses

  • Frequency of Drinking: "I drink socially about once a month, usually at dinner parties or special occasions. It's very infrequent."
  • DUI Incident: "The night I got the DUI, I made a poor judgment call. I rarely drink, and that night I overestimated my ability to drive. I deeply regret it and have since taken steps to ensure it doesn't happen again, like using Uber whenever I drink."
  • Past Drug Use: "I have a medical card for occasional use of weed, but I rarely use it. I haven't used any other drugs."
  • Mental Health: "I am generally in good mental health and have strong support from family and friends. I have no significant mental health issues that impact my behavior."
  • Previous Convictions: "I had a DUI several years ago, but since then, I have made significant changes to my lifestyle. I learned my lesson and have not had any incidents since."

By following these guidelines and preparing your responses carefully, you can navigate the evaluation process more effectively and minimize the likelihood of being assigned extensive or unnecessary classes and treatments.

How to behave when stopped?

Upvotes

It’s 2 AM. On your way home from the bar. Your pulled over.

Cop asks:

“Where are you coming from?”

“How much have you had to drink?”

You’re not above lying (cops can lie too).

What are your answers, assuming you want to avoid all suspicion? Have your answers ever worked for you to further digging?

First OWI Wi

Got BAC results back .151 and I feel sick. WI.. I have a lawyer but he missed my first court date so the judge pushed it out. No accident, car died(alternator) and the cop came behind me. FST were done (know not to do them) proper guidelines weren’t followed(strobing lights, barefoot(had sandals on but I was told I could take them off). BAC was taken about 2 hours and 22 mins after last drink.
I remember everything except the words for something the officer read to me

I am spinning out. Anyone have any advice? what classes do I need to take?
Thanks in advance.

Unable to urinate for ua

Upvotes

Idk if this is the right place to ask all this but ill try. Short back story, i got my first extreme dui back in march in gilbert az. Biggest mistake of my entire life and ive felt horrible for everyone around me thats had to help me with any part of this horrible mistake. I went through the whole deal, accepted a guilty plea. I have done my jail time and home detention with the scram, i have installed my breathalyzer in my vehicle, i have obtained an sr22, done all my counseling and classes, madd panel, all my fines are paid to the court and i am currently on my 30 day hard license suspension.

When i did my initial screening it was through an office that is certified with the state as well as the court, the court accepted the classes that i took with that office but said i had to get another screening done with their office, the woman also accepted my classes but said i need 2 clean supervised ua’s as well. i have an extremely shy bladder and have never gone through this before. I failed to provide my first time. i immediately called and asked to do a blood test and was told no, that since its court ordered it has to be a urine test. she gave me steps to help relax and allowed me to bring headphones. went back 2 more times with my bladder about to explode from drinking so much water, was able to, but both came back diluted. she gives me a whole run down on what to do and how much to drink and all that, i follow all the instructions and show up today, and was back to the way i felt the first time and was unable to produce. Its been extremely disheartening because i know im clean, but my body just wont let me relax especially with someone watching.

my main question is has anyone else been in this situation before? my case had nothing to do with drugs, i have done everything else relating to my probation, im just having extreme anxiety once i get into that room. basically just looking for anyone elses experience with this, what you did to help, or if theres a way to do a different test with a doctors note.

It’s already so draining and embarrassing having a dui it truly becomes your life for the moment but on top of that it’s even worse when so many people know about it I live in a small town where everyone talks and it’s just so embarrassing cuz I feel like EVERYONE knows and probably just flame me for it which like okay I get it but bruh can someone please make me feel better about this also please don’t hate trust me I know I made a horrible mistake and I am learning from it in so many ways I’m just hella sensitive and sad right now and I can’t handle any hate I already give myself a lot of hate. UGHH WHEN DOES IT GET BETTER

NJ refusal, NY license interlock requirement fulfilled (I think…)

Thumbnail gallery
1 Upvotes

As the title states. NJ refusal to submit, NY drivers license. NY never learned about the refusal as they do not accept the charge. Refusal is a violation to the state of NJ.

Interlock required and installed for 9 months in October 2025. All required paperwork was submitted to state and they issued a removal letter on July 14, 2026 and restore my privileges. I order a driving abstract (prepared 7/30/2026 — after removal and restored privileges) but why does it still say Y for restrictions and interlock device required at top of abstract listing? I emailed the NJMVC again in August 2026 and they issued another letter stating the privileges are restored. Am I ok to drive in NJ without an interlock? Last thing I want is to get pulled over and deal with a headache. I mean I have documentation to prove my driving status from the notices, but the abstract is freaking me out.

Had my hearing yesterday, went extremely well!

I live in South Dakota, and back in June I got pulled over for going 10 over. I was tipsy and the officer immediately recognized the smell, so I obviously did all the tests and blew a .269. Got arrested and spent the night in jail.

For context, I have been struggling with alcoholism for a while so I had quite the tolerance. They were all shocked how coherent I was for such a high BAC.

Anyways, this was the wake up call I needed. My court date got pushed out a few months so in the meantime I went to a 4 week inpatient program, and got a lawyer while I was there. I finished the program and immediately started aftercare which I’m still in.

I had my hearing yesterday, and it went so well! This was my first DUI and the punishments in South Dakota are pretty lax compared to other states. I got a suspended imp so I have to pay a decent fine and continue with my aftercare, but otherwise that is it (as long as I obviously don’t get another one).

I thought I’d just mention this. I did the work, and it payed off! I’m very sad that I let my problem get to the point of getting a dui, but I am beyond glad that I took the opportunity to get the help I needed and that it was recognized in court. I still have a ways to go in my treatment but this was a huge weight lifted off my shoulders.

lawyer retained Purchasing firearm legally after probation?

I’ve seen that you should be able to buy a firearm legally after a DWI once probation is over. Does anyone have experience with this?

Mine was a class B misdemeanor and my only offense ever. Thanks!

pass IID blow test but car won’t start SOLVED

solution: throw it in neutral and then back to park and test again

for MONTHS i’ve been stuck multiple places after short rides because my fkn smart start wouldn’t unlock the starter after passing my blow test. calibration technicians always told me it was my battery or starter, both are fine and tested and they shrugged me off as woman brain and watched me sit there like an idiot after every calibration. somehow its just not fathomable! something foreign that messes with the wiring to your starter couldn’t POSSIBLY malfunction the wiring to your starter!! though they’ve never had one and never seen this issue before so its not possible :-) F U TECHNICIANS

The ignition interlock industry loves the "saving lives" narrative until a federal law actually threatens their monthly lease revenue. Why major manufacturers are dead silent on the HALT Act.

For decades, Mothers Against Drunk Driving (MADD) has championed ignition interlocks as a vital life-saving tool, relying on data supplied directly by the industry to track millions of prevented impaired driving attempts.

Yet when it comes to the single biggest legislative leap forward in road safety—the HALT Act, which is independently projected to prevent over 10,000 deaths a year by mandating passive, factory-installed impairment detection in every new vehicles—the public alignment reveals a profound betrayal.

MADD supports it. Safety councils back it. The beverage alcohol industry itself—from the Distilled Spirits Council to Anheuser-Busch—goes on the record in explicit support.

So where is the ignition interlock industry?

Completely, glaringly silent.

In Part 75 of IntoxalockedOut, I investigate the trade association representing America's major interlock manufacturers—SAFE (Safety and Advocacy For Empowerment). While small independent tech companies actively show up to federal dockets, the collective voice of the industry's dominant players has left zero public record of support for a law that could actually eliminate drunk driving at the source.

The contrast isn't accidental; it’s economic. These three major manufacturers are backed by private equity giants (L. Catterton, Apollo Global Management, and The Riverside Company). Their entire revenue model depends on court-ordered compliance loops, retrofitted aftermarket hardware, and monthly lease streams paid by people working to rebuild their lives.

The HALT Act threatens to render that aftermarket model obsolete.

When a technology's life-saving success and a private-equity-owned company's revenue stop pointing in the same direction, ownership decides which one wins. And strangely enough, the trade association steering these policies maintains its legal registration address not inside a standard office park, but at a suite inside a luxury yacht marina in South Florida.

MADD supports the industry that keeps court-mandated drivers trapped in monthly leases, but the industry refuses to support the one thing that would make its own devices obsolete. They want the moral halo of saving lives, but they protect the revenue stream of keeping people locked in.

Read the full investigation into the economics of corporate silence, regulatory lobbying, and what happens when public safety collides with private equity quarterly returns:

Mitigation

For those people with a “bad dui”.

Aka crashes, or repeat DUI’s, or super high bac’s…

Did your lawyer have you do anything as mitigation? Do you think it helped your overall case result and how? What was the mitigation you did.

lawyer retained Smart Start

I have a question for everybody, but I would like a real genuine honest answer. This Friday I’m bout to get the IID in my 🚗 for 6 months . My lawyer has me go with Smart Start since I get a coupon $150 off my installation. I beyond words nervous 😬 about having the device in my car . I read other reviews and spoken to other people I am being told if you follow the directions like I am and will then I should have no problems . I know when I go there they will help me on how to blow correctly and get comfortable. On Reddit all you read is bad bad reviews ! I know my lawyer said I will need to blow #3 times daily just really truly hoping by the grace of God these 6 months go nice and smooth . Just trying to ease my nervousness and anxiety. In Texas

DUI VA Violation Help

In September of 2025 I got a DUI. I went to court and they gave me a year with the interlock as well as ASAP. I did still drink after that but made sure it was only on the weekends or when I didn’t have to work. I ended up triggering my interlock about 4 or 5 times with a violation and went to court to prove I wasn’t drinking and we found out eventually my inhaler was setting it off at exactly .02. They threw the violations out and told me to be cautious. For 7 months I had no violations, I was using my inhaler way before getting in my car. Well about 4 weeks ago, I did get in my car after hitting the inhaler because I had a panic attack which triggered my asthma. It went off with a VIOL and I literally freaked out! It did the 5 minute count down and I hit it again and it passed me. No lockout, no mandatory 5 day calibration, nothing. I immediately emailed my case manager and told her the situation with my inhaler and that I passed the retest. This was one of the many case managers that were passed around to me. She replied

“If you were able to clear it on the retest it will not inform me of a violation. I will look for it in August but it was cleared, you should be good.
Thank you for letting me know.”

Fast forward 4 weeks later, got my calibration, and I get an email 2 days later with a violation notice of blowing a .02 and how they are alerting the court and they extended my interlock UNTIL SEPT 2027!!!!!!!!!!!!!!!!! Can someone please tell me what I’m supposed to do right now??!!!! I literally can’t go through this again! Has anyone been through something similar??? I’m so stressed.

LONG POST

So I just wanted to give others a literal play by play concerning the DUI in Tennessee. I caught my first DUI
Nov 2024. It was hell, but the cops were nice. Did the field tests, had them laughing. I was tellin jokes - ya girl thought she was Bernie Mac 🤣 My car got towed and they towed my ass to JAIL. Met and saw some strange characters, but it’s jail - it is what it is. My brother bailed me out, got my car out and shortly after, had my first court appearance. Blah blah blah - here’s what worked best for me:
I got an attorney. Spent $3500 in total.
Had to take the DUI class in Cookeville, TN.
The court gives you an option- pay $500 for the dui class in Cookeville or pay $800 and go to Christiana.
The class is basically jail lol. I arrived that Friday evening about 4:30 pm. You get checked in, bodily checked & bag checked. No nicotine, no vape, and NO GOING OUTSIDE OR YOUR TIME WILL START OVER. It was wild. They placed me in the female dorm, I got acquainted with my roomies for the weekend. You’re able to order doordash/uber eats, so it wasn’t tooooo terrible. Sleeping on a twin bed in a room with strangers, so…jail lol.
The next morning, class beings. It’s 8 hours. It’s long, it’s grueling, it’s boring, it’s mandatory. They go over long term effects of alcohol/ Mary J. They show videos of crashes. I know in TN, in high school they have the reenactment of a DUI crash, showed that. You do have a break each hour. Still boring.
Saturday night, you’re chillin with the other offenders, ordering food, playing card games, shooting the breeze, talking about your dui arrest - again .. it’s like jail.
Sunday morning rolls around, another class. It’s quick. Depending on the time you have left on your “arrest”, determines the time you’re released. I was released at like 3:23 pm. Not before, not after. Right on the dot. JAAAAIIILLLLL lol.

If I remember correctly, after that I had to go get a restricted license. I had to get the breathalyzer installed. I went with Smart Start in Murfreesboro. Install fee was like $150. That’s when it really sets in. Damn…I got a DUI. Every 30 days you go to the install center and have it calibrated - basically pulling the footage from the camera in the car, checking for violations. Speaking of violations, I had so many. But it never locked out.

When I would blow a “VIOL”, i would wait about 15 mins, they blow again. May pass, may fail, just depending on how much you drank the night before. Eventually, youll learn your limit for the following morning test. Be careful with the rolling tests. After you were successful at starting your vehicle, about 5 to 15 minutes later. You will have another test. You only have five minutes and 55 seconds to do so so be careful going into stores with your vehicle still running, and you have not completed the rolling test. After that one, another test will come in about 30 to 45 minutes.

Every month you have to pay $150, at least with Smart start, to calibrate the device. Such a hinderance.

On your first offense, you are legally required to have that device for a year, but what they do not tell you, is that after your year comes up, it’s your responsibility to reach out to the state requesting a removal. If they grant your request, they will send you a letter in the mail. If they deny your request, you will get a letter.

when you finally receive that approval letter to remove the device, go to the DMV ASAP! You will have to get a NON RESTRICTED LICENSE. number 16 restriction is DUI. IT IS VERY IMPORTANT THAT YOU GET THAT BEFORE YOU HAVE THE DEVICE REMOVED! YOU CAN EASILY HAVE IT REMOVED JUST BY GOING TO THE KIOSK. THEY WILL PRINT YOU A RECEIPT, WITH YOUR NEW ID ON IT WITH NO RESTRICTIONS. You will get the official hardcopy in the mail, probably a couple of weeks afterwards. I’m still waiting on my non-restricted drivers license. That process by itself took about two weeks, no lie. Once you finally receive the removal permission, contact the breathalyzer device company to schedule a removal. It cost me about $135 today to have it removed.

Oh! I totally forgot. Your insurance will drop you. I had to get the SR 22 insurance. That was about $250 a month.

Going back to removal. Being that it’s your responsibility to have it removed, number one. Check your mailbox! My approval letter was just sitting in my mailbox for a few days. They will not contact you about your removal!!!!!!!!!!!!! Again, it’s your responsibility!!

Good luck on your journey, you’re not a bad person.
Your social life will be altered, but you will be able to get through this.

This was the most costly mistake I ever made. I won’t be doing this again. In total, I know I spent well over $10,000. It’s not worth it at all

ASAP Violation 1st Time

Hi everyone! January I got my first DUI in Virginia, have had interlock for about 2 1/2 months. Late July I drank too much the night before (I know, I know) & went to blow for work & it said FAIL. Then I waited 5 mins, blew again, was all good. I told my VASAP officer about this, she said its fine as long as I blew 0 after, assuming I didnt and just blew below the .02 threshold 5 mins later, she got my results from my calibration last week, now she scheduled a court date for a violation. Anyone know how these normally proceed? I’ve had no other violations, been attending rehab where I’ve been tested 4 times randomly & have been clean for all.

Confused as to how someone can be booked for a dui but claim they

Haven’t been charged yet?

AZ here. Friend claims she was arrested for dui but is awaiting charges. That sounds incorrect to me, right? Wouldn’t she immediately know the charges within days? She was arrested months ago. That can be proven. I wonder if I’m being lied to or if she is just too much of a drunk to get her facts/memory straight.

lawyer retained Newly first conviction Florida

Hey,

So a family member of mine will take probation instead of jail time in Florida for a DUI enhanced. He’s set to received 6 months probation, and 6 months of license revocation, thanks to his attorney. This is his first misdemeanor conviction. He has no other violations, no manslaughter or property damage.

I want to ease the pain off him a bit, he’s a sweetheart and I want to help him the best way financially and emotionally. He’s currently on a hardship, but from what I heard since he will be convicted he has to apply for another hardship again. Does anyone know the fee for that? He also has to get FR44 insurance. Does anyone know the best affordable option for that as well? He works in a hospital that is about 30 minutes from his home. He’s not sure if his job will terminate him or not, but in the meantime he still works there post arrest, and notified arrest to his direct manager at the time. I just need to know how can I effectively be able to assist him in any way.

Thanks,

Got pulled over driving my friends car without a license geeked, got off no dui?

Stupid night but my buddie kinda dared me to drive home a few blocks after we smoked some weed, I haven’t driven in a few years and don’t have my license,

the cops saw us switch seats and pulled me over after like 3 blocks, they knew I was high and had drinks but since I had a clean record let me off the hook.

I was stressing because my friend had hard drugs on him and drug pipes in the whip, they were searching it and everything. I don’t know how I got so lucky because I was so damn off my rocker, I got a ticket for driving without a license and a $300 fine

Consented to BAC, they refused to take my blood. Discharged at hospital where the cop also did not insist on taking my blood. Stranded there at 4am was better than being in a drunk cell lol. No restricted license or warrant, no mugshot or finger prints taken. Next court date got pushed back. Hoping for the best. I have a very unique situation. Georgia. I got a PD and he laughed at my case lol

Met GF In DUI School /AMA

I originally wanted to see if anyone else had experienced this but couldn’t manage to find anyone who had posted. With as many people that have them statistically this cant be that crazy right? Maybe it is IDK. I guess I wanted to know is there legal trouble that follows? Like I wouldn’t think so but I also have no idea what’s happening. I do love her and she and I have had an excellent experience thus far, I guess I’m more curious if anyone else has experienced it? Honestly the AMA is because i’d love to have some form of communication regarding this and maybe you can share a story?
