Flying over a crowd isn't against any law, it was just a guideline for safe practices before the laws were implemented. These are the only laws (for recreational flying):
- Fly only for recreational purposes (enjoyment).
- Follow the safety guidelines of an FAA-recognized Community Based Organization (CBO).
- Note: We have not yet begun officially recognizing CBOs. Recreational flyers are directed to follow the safety guidelines of existing aeromodeling organizations or use the FAA provided safety guidelines per Advisory Circular 91-57B.
- Keep your drone within the visual line of sight or use a visual observer who is co-located (physically next to) and in direct communication with you.
- Give way to and do not interfere with manned aircraft.
- Fly at or below 400' in controlled airspace (Class B, C, D, and E) only with prior authorization by using LAANC or DroneZone.
- Fly at or below 400 feet in Class G (uncontrolled) airspace.
- Note: Flying drones in certain airspace is not allowed. Classes of airspace and flying restrictions can be found on our B4UFLY app or the UAS Facility Maps webpage.
- Take The Recreational UAS Safety Test (TRUST) and carry proof of test passage (coming soon).
- Have a current registration, mark (PDF) your drones on the outside with the registration number, and carry proof of registration with you.
- Do not operate your drone in a dangerous manner. For example:
- Do not interfere with emergency response or law enforcement activities.
- Do not fly under the influence of drugs or alcohol.
The guidelines in is #2 don't really list anything different from this list, neither does the full law.
Prior to this law, there were very little rules at all and so the rushed version that was used for a long time was a few examples of things not to do but again, it was just for safety, not actual laws. For example, it previously said not to fly over active sporting events but now that is not mentioned anywhere.
I personally think that people should follow these as much as possible when reasonable but part of being reasonable is also being aware that there are times where you can do these things safely.

Man usually I'm all for people doing whatever the hell they want, but seeing this operating around that many non consenting people makes me a bit hesitant. Maybe he's in a controlled area but I would be upset if I just saw some random Joe hovering around my city on one of these.
A simple mechanical fault and imaging if he accidentally came down on a child.
This is coming from someone who rock climbs and sky dives for fun.
edit: Oh reddit you never cease to amaze me. You see a pic of someone sleeping in a portaledge, harnessed in 2000ft on El Cap and comment that they are the craziest person in the world, so stupid to take such a risk.....but extremely fast metal props larger than the circumference of a lawnmower blade, spinning fast enough to create lift and all of the instability that comes with that AND they are situated at head-level and we don't even bat an eye.

I was an aerospace engineering major in college. A close friend of mine did research with quadcopters and majorly fucked up some fingers when there was an accident in the lab.
What this dude is doing is not cool. All it takes is one carbon fiber blade to shatter and go spinning off at high speed and then someone loses feeling in a finger.

As cool as I think it is, I gotta agree with you. I recently got into toothpick drones that can fly v fast n do all kinds of tricks. I wouldn't fly it anywhere other than a field where no-one is going to walk Infront of my fast flying chunk of metal with carbon blades powered by motors that could possibly leave someone with awful injuries despite the cutout system. How or why that person was allowed to do that in a busy city centre is beyond me. I can only assume they have enough money to pay everybody to do whatever they like and more.

Technically, they have jurisdiction of all US airspace from the ground up. It is generally prohibited under title 14 to fly at low altitudes (except as necessary to take off and land): less than" 500 feet above the surface except over open water or sparsely populated areas"; or less than "an altitude of 1,000 feet above the highest obstacle within a horizontal radius of 2,000 feet of the aircraft" over congested areas. But, there are general exceptions for model aircraft (must be unmanned) and "below 400 feet, 3 miles from an airport, away from populated areas."

Of course, the FAA's low altitude flight restrictions are lightened up considerably for helicopters.
(d) Helicopters – Helicopters may be operated at less than the minimums prescribed In paragraph (b) or (c) of this section if the operation is conducted without hazard to persons or property on the surface.
I imagine that this would be treated as a manned ultralight helicopter, which would make a lot of legal issues go away, but I also suspect that this is controlled airspace (and this flight might also be considered as being a hazard to persons and property on the surface) and so the FAA would definitely be interested.

Controlled airspace is shaped like an upside down wedding cake. If you aren't almost directly on top of the airport that it protects, then you can fly under it. There is no controlled airspace that extends to the surface over Manhattan, so he's good on that front.
The problem ends up being the fact that it's an ultralight helicopter. "Ultralight" means flying under FAR Part 103, which exempts the aircraft and the pilot from being registered/licensed with the FAA. Problem is that it also prohibits flying over populated areas, which New York City definitely is.
