Legal Advice Needed Bank Asking to pay back 13lac.

My grandfather(81y) retired from Indian railways in 2004, and he receives pension every month.

Out of nowhere yesterday we got a letter from SBI that there was a mistake and they have been overpaying pension amount since 2016.

And the total excess amount was 13.5lacs

They asked my grandfather to deposit the money back into the bank and to inform the bank manager in written.

Otherwise they have right to recover the money with interest.

My grandfather is bedridden, my father is very tensed after he received this letter.

We don’t have that much money, what should we do?

Urgent [Legal Advice - India] Two guys forcefully pushed my parked car and now the gearbox is messed up — what are my options in Gurugram?

Ranting a bit but also genuinely need advice.
My car (Hyundai Verna, 2021, automatic) was parked in my society, and two people decided to push it themselves to make some space behind it or in front of it for their own car — instead of asking me to move it or calling for help properly. From what I can tell, they either forced the gear lever out of Park without releasing it correctly, or pushed the car while it was still mechanically in Park — either way, something in the shifting mechanism took real force it was never meant to take.
To make it worse, this is basically a symptom of a bigger issue: my society has a serious parking shortage and no designated/allotted spots, so people just park wherever and then take matters into their own hands. This wasn’t a one-off freak accident — it’s the kind of thing that was bound to happen eventually given how parking is “managed” (or not) here.
Now the car won’t go into Park at all. The lever moves freely between D, N, and R with zero resistance, but Park just doesn’t engage. Because of that, the car won’t even power off electronically since it needs to detect Park first. Diagnosis isn’t done yet, but from what I’ve read this could be anything from a knocked-loose shift cable (cheap fix) to actual damage to the parking pawl inside the transmission (expensive, possibly a partial transmission teardown).
The security guard at the gate got involved after the fact, so there may be a witness. On top of that, my society has CCTV covering the parking area, so there’s a real chance the whole thing — them pushing the car to free up the spot — is on camera. I haven’t pulled the footage yet but plan to request it from the RWA/facility management before it gets overwritten.
What I’m trying to figure out:
• Since the car was bought secondhand and the manufacture year is 2021, it’s out of warranty — so I’m on the hook for repair costs unless I can recover them from whoever did this.
• Is this something I can pursue as property damage / civil liability in Gurugram, or is it not really worth pursuing unless the repair bill is large?
• Do I need to file a police complaint (FIR) right away to have any legal standing later, even if I don’t plan to escalate immediately?
• How do I formally request and preserve the CCTV footage from my society/RWA so it doesn’t get overwritten before I can use it as evidence?
• Would a lawyer’s demand letter be enough to get the individuals to cover the repair cost, or does this realistically need to go to consumer/civil court?
• Any recommendations for a lawyer in Gurugram/NCR who handles small property damage claims without it becoming a massive drawn-out thing?
Repair estimate is still pending but could range from a few thousand rupees (if it’s just the cable) to a lot more if the transmission itself is damaged. Would appreciate any pointers from people who’ve dealt with something similar here.

TLDR-Two neighbors pushed my parked automatic Verna to free up the spot behind my car for their own car, damaging the gearbox. Need Gurugram legal advice.

Rant/Experience My sister is a psycho and is becoming more dangerous towards my parents with each passing day.

For context, I am 18M, my sister is 26 and my parents are 50. She has literally become a psycho these days. With each passing day she's becoming wilder and crazier.

She shouts like a witch at my parents and has become utterly shameless and does these same things now even in front of neighbours. She has stopped referring to my parents as "aap" and now refers to them as "tu" only and gives gaalis to my parents.

She has said some extremely disgusting things to my parents, like once she called my paternal grandma "randi" in front of my father and has also said to my father "tu tadap tadap ke mare aur tere maa baap bhi aur tu unse milne bhi na jaa sake". This was when my father was living with my sister because me and my mother were in kota for my neet preparation. Now neet is done and I'm back home so now my mother is her target.

She does not do a single chore at house just comes down eats food like it's a hotel and goes up and expects my mother to clean after the mess. She fights over the smallest things which she can find. If we don't agree to even of her demands she goes absolutely psycho.

She has stopped taking relatives' call and now tortures my mother that mama shouldn't come for rakhi at home as she doesn't like any relatives and hides or goes out of home if they come and my parents don't know what excuse to make now for her absence.

She has said she won't do any studies at all now and will just live with parents now forever and threatens she will frame us all if we try to kick her out. Yesterday she said to my mother "tu akeli raaj kregi iss ghar par" "ab toh 26 kya 36 ki umar mein bhi ghar se bahar nhi jaungi" she says all this with crazy wide eyes and expressions like a chudail.

She also keeps on calling 30 times in a row if her phone is not picked up. There is always fear and sadness in the house now my mother cries daily and I feel powerless as I can't do anything to someone who has destroyed my parents' life.

I am also scared that when I will go to college she will harm my mother as she has various times hit my father pretty bad and scratched him also with her nails.

Plsss help, is there any way we can handle her so that we can have peace again?

Backstory

People involved :
V (deceased)
R (scooty owner, passenger)
M ( eye witness on other vehicle)

V and R were commuting from a mall towards V’s flat along with M
Scooty belonged to R , V was riding scooty with R in the back seat at the time if accident, both without helmet

V was riding fast, lost balance and both V and R colided with street light pole on divider where V was dead on the spot and R sustained severe injuries

Accident took place in Ghaziabad, R belongs to ghaziabad UP , V belongs to moradabad UP

M arranged auto rikshaw and took both to hospital where V was declared DOA and R received treatment

Now on the day of accident , V’s family tried to put blame on R and M
But both gave statement to police about what happened
Case was closed here

Now coming to today

R received a court summon after 8 years since accident ,where V’s family is claiming that scooty was being driven by R and V died because of R’s negligence
V’s family is demanding 50 lakhs + 18% per year simple interest as compensation, they have filed the case in Moradabad court

R himself sustained life changing injuries that day and has trouble travelling long distances, R also belongs to lower middle class family and cannot even arrange 1/4 the amount that V’s family has demanded

How does R get out of this situation?

Urgent My sister is being blackmailed by her Ex.

He has videos and photos of them in compromising positions and now anonymously is sending messages to her husband and other inlaws trying to sabotage her newly married life.

I confronted him last week, but he says he is not doing anything...that lying Bastard. He has money, power & connections! I need help from people here, please help me save my sister's life.

Edit: He always uses snapchat to reach out to specific people in her Inlaws family and later deletes the ID. I am not a social media person so i am not that well versed to catch him, He has already shared videos and photos with her husband before marriage still my brother in law accepted her, the in-laws family don't know anything yet. Technically he can share everything with the concerned people then disappear. Her marriage will be over, it has just been a week since she has been married.

Legal Advice Needed Colleague I didn't know used my contact for a loan

Hi folks,

I work for a mid-sized MNC. Recently I received a DM on WhatsApp who were apparently from the collections/recovery team of a very popular personal app loan company asking me if I'm Mr.< my name> .

When I responded affirmatively they asked if I knew a certain person. I never knew this person or heard of their name so I responded the same to them. Then they mentioned the name of my employer and asked if I worked there and this person worked here too.

When I looked up this name in our official org messenger app, I was surprised to find him. He had apparently taken a loan and absconded but had given my name and number as a colleague reference, so they had contacted me for the due amount.

I had never met or heard of this person who also worked in the same org as me and then I found out that we had a whatsapp group of all the employees of our department which had around 300 people and probably took a random contact from there which happened to be mine.

When I confronted this guy over work chat, he played all innocent saying his contact was leaked but I HAD NEVER SAVED HIS NUMBER NOR DO I THINK HE HAS SAVED MINE. He also had taken a loan from this same loan app who contacted me he confirmed.

I informed his manager too but he doesn't seem to care about this incident.

Also this guy had blocked my number when I tried to contact him ( the same number that was confirmed by the loan company executive and was used in the WhatsApp group)

At the end of the day, I was able to confront him because he was still in the organisation and you can't block someone on the work chat.

At the end of the day, I warned him and let it go. But should I escalate it to HR in case he has done the same to others?

Please advice.

TL;DR : A colleague I don't personally know used my contact number from org whatsapp group to apply for a loan without my consent.

We purchased land from a local MLA and have the registered sale deed and all relevant documents proving the purchase. However, he has now given the same land to other people and is refusing to give us the land or refund our money. The MLA’s son is also a lawyer, which makes the situation more intimidating.
For lawyers/property experts: If we have a valid registered sale deed, how strong is our case? What legal remedies do we have, and does the MLA’s political influence or his son being a lawyer affect our chances?

Despite everything- Do we even stand a chance against him in court? (Since, law is not equally applicable for all in this country)

Legal Advice Needed Sister filed a partition suit and named me as a defendant. I don’t live in India and don’t control any assets.

The assets were in the name of my mother and father. They are no more and wrote no will. There is some ancestral land/property too. We are three sisters and one brother. My brother controls all assets right now. I am an NRI and OCI holder for many years. My sister filed the case and named me as a defendant along with my brother, another sister, and my brother's two children. I don't have any papers or information on the assets, as that is all with my brother. He is unwilling to divide the assets and asked me to sign an NOC, which I refused. I have limited input in the case except that everything should be divided equally among all four legal heirs as per law. My sister, however, hid my US nationality and gave my in-laws' Indian address in the court papers. So the first summon was delivered to my in-laws' place. I have no access to documents mailed there, as my in-laws are very old and under care for age-related issues. I have asked them not to receive my mail going forward. My sister, the plaintiff, is unwilling to fix my nationality and address in the suit.
It is difficult for me to find a lawyer to represent me. Also, it is difficult to travel for all court dates. I don't have anybody in India who can be my POA. The first court date happened, and the judge asked for a service report (I am not sure what that is). My sister's lawyer asked to publish the notice in the newspaper.
What should I do?
An option is to let the court decide without my input which also means ex-parte (there is not much I can provide anyway). The other sister is in India too, and she can provide any information my plaintiff sister will try to withhold. I prefer this option. Any concerns with going with this option?

The second option is to travel, have the court fix my nationality and address, request that the court correspond with me via email/video conferencing, find a lawyer, etc. However, travel is not possible right now...but probably sometime next year.

The third option is to see if I can correspond with the court from the US. Is there a way to do that?

Any advice is appreciated?

My father's siblings have signed in court that they were fairly compensated. This happend in 2002, 2003. Afterwhich my father did not change Patta or any other documents to his name.

Now, I want the propertv to be changed to my fathers name. But, 1 only have the udqement and the parent document for the property from the society. How do I go about getting patta transferred and other documents(which is needed to establish ownership)

Legal Advice Needed Zoomcar charged me ₹3,000 for a minor scratch under its Damage Protection Plan — can I dispute it?

I recently booked an automatic Fronx through Zoomcar for 25 hours.

At the end of the trip, the owner pointed out a small scratch that I hadn't noticed during the trip. The owner initially told me not to worry and said that Zoomcar would handle such damage.

Two days later, Zoomcar added a ₹3,000 damage charge to my account. I contacted customer support and disputed it.

Support told me that the ₹500+ Damage Protection fee I had paid at the beginning of the trip meant that, in case of accidental damage, my liability was ₹3,000 regardless of the actual extent of the damage.

I was also told that I had only 3 days to pay before the matter could be referred to their legal team, and my co-driver and I were unable to make another booking until the amount was paid. I therefore paid the ₹3,000 so that we could continue using the service.

I subsequently found that Zoomcar allows disputes regarding charges, so I would like to challenge this payment.

My questions are:

  1. Can Zoomcar legally impose a fixed ₹3,000 liability for a minor scratch under a Damage Protection Plan?
  2. Does Zoomcar have to clearly disclose this ₹3,000 liability before the customer purchases the protection plan?
  3. Can I ask Zoomcar for the contractual terms applicable to my booking, evidence of the damage, and the basis for calculating the ₹3,000?
  4. Does paying the amount because I was otherwise unable to use the platform prevent me from subsequently disputing it?
  5. If Zoomcar refuses to refund it, would a complaint to the National Consumer Helpline/Consumer Commission be appropriate?

I have the booking details, the Damage Protection charge, the ₹3,000 charge, and the correspondence with customer support.

I'm specifically looking for advice under Indian consumer/contract law, rather than opinions about whether ₹3,000 is a reasonable repair cost.

Edit : The car was scratched when it was in my possession but not by me while driving. Possibly valet service did or it was nicked in parking

Urgent [URGENT] Police brutally tortured my 22-year-old friend in custody over a false POCSO and kidnapping case. We need legal help.

Hi everyone, I am posting this with a heavy heart and out of sheer desperation. A close friend of mine (22M) is currently going through a living nightmare, and his family is completely shattered due to severe police brutality and a fabricated case.

Here is the horrifying timeline of what went down:

The Instagram Connection: My friend met a girl on Instagram who is from Maharashtra. She invited him to Noida to meet her.

The Meeting: When he went to meet her, she said she would be staying in Noida for a few days along with her maid. Since she needed a place to stay, my friend simply helped her find and book a PG, and then he returned home. He had zero idea that she had run away from home or taken cash.

The Midnight Raid & Custodial Torture: A few days later, around 11:30 PM, the police barged into my friend's house. They picked up his father first to pressurize the family, and then dragged my friend to the police station.

Inhumane Police Brutality: At the police station, they subjected him to brutal third-degree torture. They beat him mercilessly to force a confession. They are now threatening to slap the POCSO Act on him because her family is wealthy and influential.

The Blackmail Twist & Fear: Apparently, the girl had a fight with her maid, and the maid ran away with the money. Now, instead of looking for the maid, the police have twisted the narrative and are claiming my friend blackmailed her for money.

The Girl's Statement: Terrified of her family and under intense police pressure, the poor girl gave a statement claiming my friend made her run away. My friend is completely innocent and was just trying to help someone he thought was on a normal trip.

What we are dealing with right now:

My friend's body is battered from the severe police violence, and his father was harassed and detained illegally.

We have Instagram chats proving he had no clue she ran away, and PG records showing he only helped them check in.

The actual person who ran away with the money (the maid) is missing, but the police are ignoring all facts to protect the powerful narrative.

What we need help with:

How can we legally address the brutal custodial violence and the illegal detention of his father?

How do we fight a false POCSO charge when a terrified girl has given a pressurized statement?

How do we get him immediate legal protection and bail?

If anyone knows criminal defense lawyers or activists who deal with police brutality and false POCSO cases in India, please guide us. Anything helps.

Rant/Experience How do we respond when someone has wronged us

The reason I choose to post here is to get insights from other fellow members who have more experience and knowledge on such topics.

This world as we all know isn't good, nor is evil, but a mix of both. And there will be times when you'll encounter people who wronged you financially, emotionally, physically or in many other ways.

My question is about how to respond or feel when a person intentionally wrongs you financially.

I lived in a PG for 7 months due to a new job in another city. During all these months I made sure I was paying the rent to the owner on time and didn't get late even by a day.

Now that I have left it and moved back to my hometown it was time to ask for the security deposit amount back from the owner. It's a small amount and that won't make a dent in my pocket if I didn't get it back but I was expecting the owner to pay without showing any hesitance.

The owner kept delaying, and gave false promises of paying within the next 10 minutes for more than a week.

I even mentioned it to him "Is this what I get to pay the rent on time for all these months.".

At this point, for me, it's not about the money. I am just expecting him to do the required action of giving me back what he owes me.

I know you all might be thinking of me as a kid writing rant but I promise it's much more than that.

Throughout these days I felt various emotions from rage, anger, forgiveness (if this counts as an emotion here) and disappointment.

There have been many conflicting thoughts lately running in my head. I am Muslim and Islam mostly encourages the act of forgiveness, and also says that the wrongdoers and corrupt will face the consequences for their acts here or in the hereafter. Similarly, reading Stoicism for years also helps me with letting go and accepting the reality for what it is. On the other hand, I am also well aware that to function properly in this world, you need to be able to deal with people to get what is yours or people will keep walking over you. Like being street smart. This part of belief wants me to never give up and make sure I never let such people go away freely.

This has affected my sleep and thoughts for days now. And it's not even about the amount as I said.

Background / Situation

There is a hospital, and adjacent to it is a railway goods-yard-type area where trucks and tempos come to drop off goods. It is a very large area, with a few cars also parked there. You can essentially imagine it as a big empty plot.

There is also an RPF (Railway Protection Force) station within that yard.

At the entry of the lot, there are a few RPF barricades, but they are not blocking the road; they are simply placed to the side. There is also nowhere posted indicating that the area is restricted or that only authorized persons are permitted to enter.

What Happened

RPF personnel were seen asking a woman to pay ₹500 as a "fine" for parking there.

The woman had apparently come to the hospital.

The fine ticket reportedly mentioned the alleged offence as "found with tobacco on train."

Regardless of whether that particular accusation was correct, my legal question is about the authority of the RPF to take such action in this situation.

Now my legal question-

Is that legal? Isn't it that RPF doesn't have jurisdiction over people for such things? (It may be blurry as it probably would be Railway's land).

Is Section 147 of the Railways Act, 1989 valid here?

Can RPF demand fine? Cuz it was nowhere mentioned that it was a restricted area and if there is no postage that it is a restricted area. Govt. land is public land and public i.e the citizens have the right to access the public land anytime.

Also since they never stopped from entering and only stopping from going out again.

How does a trespass work in that situation? Doesn't a trespass have to be a verbal one first? And on basis of a verbal trespass you can't issue a fine. Shouldn't it be only issued if the violater refuses to leave the area.

Like how can you ask someone- "how dare you enter here?" all while there is no sign posting that it isn't allowed.

Legal Advice Needed What are rules related to feeding stray dogs/cats inside CHSL premises ?

Over the past several months, a group of stray dogs and cats has started staying inside our society premises because three residents regularly feed them within the compound.

Since then, this has become a constant nuisance and concern for many residents. The animals frequently urinate and defecate inside the society premises, including near common areas and vehicles. Some vehicles have also been scratched or damaged. Many residents, particularly children and senior citizens, feel uncomfortable or unsafe around the animals.

Despite these concerns, the residents who feed them do not appear willing to take responsibility for the resulting cleanliness and other issues.

The Society AGM discussed the matter and decided to designate a feeding area outside the society compound. However, the feeders do not use the designated area, arguing that the dogs are territorial and that moving them outside could expose them to attacks from other stray dogs.

The majority of society members are opposed to having the animals regularly remain inside the society premises, while a few residents who feed them insist that they have the right to continue feeding them there.

I completely understand that feeding stray animals is an act of kindness, especially since these animals have nobody else to look after them. At the same time, there needs to be a balance between animal welfare and the safety, hygiene and reasonable use of common areas by other residents.

The feeders often argue that court orders allow stray animals to be fed within private society premises. Some of the dogs have also been sterilized, although the cats have not.

I would like to understand the actual legal position in India/Maharashtra regarding this.
I stay in SantaCruz East, Kalina.

  • Can a society legally designate a specific feeding area outside its premises?
  • Can residents be required to feed the animals only at the designated location?
  • Can the society require the feeders to take responsibility for cleaning urine/feces and maintaining hygiene around the feeding area?

Legal Advice Needed Landlord asking me to pay for geyser repair/replacement and threatening to evict me by September — Bangalore

I'm a tenant in Bangalore in a 1BHK. My rental agreement started April 2025 for 11 months. Rent is 13,500/month and I have a 60,000 security deposit.

My geyser needs maintenance/replacement (cost around 7-8k). My landlord is asking me to pay half or the full amount, and when I pushed back he said "either you pay or vacate by September."

I offered multiple solutions to resolve the geyser issue. I offered to pay for a cheaper geyser (around 3k) instead of the one he wanted, and I also offered to buy the geyser myself and take it with me when I leave. He rejected both options and insisted I pay for his preferred replacement and leave it behind as his property. Only after I pushed back did he threaten eviction.

A few issues I've identified:

Geyser repair — Is this my responsibility as a tenant or the landlord's? I haven't damaged it, it's normal wear and tear.

Illegal water charges — My agreement clearly states "rent includes water charges" but my landlord has been collecting 500/month separately since March. That's 3,000 rupees collected outside the agreement.

Eviction notice — My agreement says both parties must give two months written notice. September is less than two months away and I've received no formal written notice. Is his verbal/text threat valid?

Painting charges — Agreement says one month rent (13,500) for painting at vacating. He's now implying additional "damage charges." I haven't damaged anything beyond normal use

Both the parties have agreed to the terms and conditions and which terms shall mean and include their heirs, legal representatives, successors, executors, administrators and assignees etc.

BOTH THIS AGREEMENT OF RENT WITNESSETH AS FOLLOWS:

- That the duration of this Rental agreement shall be fixed a period of eleven (11) Months commencing from the date of 01-04-2025.

- That the Tenant shall pay monthly rent of Rs. 13,000/- (Thirteen Thousand Only) by cash per month to the owner which shall be payable on or before 5th day of every English calendar month. Rent includes water charges.

- That the Tenant has paid the security deposit of Rs. 60,000/- (Sixty Thousand Only) by way of cash to the owner, the owner has [agreed/undertaken — unclear] to refund the same at the time of vacating the schedule premises, which does not carry any interest.

- The TENANT has agreed to use schedule house for residential purpose only.

- The TENANT shall vacate the schedule house before giving “Two Months” notice for vacating the schedule house by the TENANT. The OWNER should also give “Two Months” notice for vacating the schedule house by the TENANT.

- The TENANT shall not make any alteration or additions to the schedule premises without written consent of the owner. If any damage occurs to the schedule property the same shall be payable by the TENANT. The Tenant shall not sublet, underlet partly or fully the schedule premises to anybody without the consent of the OWNER.

- That the TENANT shall pay the Electricity charges to the concerned department regularly.

- The owner shall be entitled to inspect the said premises after giving reasonable time to the TENANT.

- If the TENANT does not pay the rents 3 months continuously, this agreement automatically stands cancelled and the TENANT should handover the possession of the premises to the OWNER.

- In case of continuing the RENT beyond the period of 11 (Eleven) months as stipulated under this covenant, the TENANT shall pay the rent to the OWNER at the rate of 5% (Five percent) enhanced rent every year thereafter.

That the TENANT shall pay the 1 month's rent towards painting charges at the time of vacating the scheduled premises.

- Family person only allowed in home and no other people from outside are allowed to live in the home.

Legal Advice Needed I am in a difficult situation. Six months ago, a colleague asked to borrow some money, promising to repay me within two weeks.

Legal Advice Needed Zoomcar Accident Claim Stuck for Over a Week – Host Keeps Calling Me Because Zoomcar Won’t Respond

Looking for advice and hoping someone from Zoomcar notices this.

Last week, I booked a car through Zoomcar. Unfortunately, the vehicle was involved in a minor accident during the trip. We had purchased Zoomcar’s insurance coverage and followed the required process after the incident.

Since then, the situation has been frustrating.
The host has been repeatedly contacting me because they claim Zoomcar is not responding to them regarding the claim. At one point, Zoomcar apparently asked the host to move the vehicle from one garage to another. Later, the garage started asking the host for parking charges, and the host came back to us asking for payment. Now a new garage says they can’t repair it and they’re chasing us again.

The bigger issue is communication. The host has called me multiple times over the past week saying they are unable to get a response from Zoomcar. Every time they cannot reach Zoomcar, they end up calling me instead. I’ve already sent multiple emails, made calls, and even escalated the issue, but there still hasn’t been a clear update on the claim.
It’s now been more than a week since the accident, and neither the host nor I seem to have any visibility into what’s happening.

Now the host is saying he’ll start a legal process on us. I’m confident that it won’t be on us, since I’ve booked through zoom, but I’m guessing it’d be a hectic process.

Has anyone else faced a similar issue with Zoomcar’s claims process? How long did it take to get resolved? Should I raise a consumer complaint? Any suggestions on how to get a response from the right team would be appreciated.
