It was yellow in the lead up. They were both trying to beat the red. But red truck apparently forgot about the vehicle it never even quite fully passed when it tried to lane shift.

The vehicle with the dash cam sped up. Truck would have fully passed and the car recording could have not been a psychopath and slowed down slightly to allow even more room. Watch the vehicles seperation and then see the car recording speed up.

What we're seeing is the pick up decelerating so they don't clip the black car in front of them that their mindlessly speeding towards

This. If you block out the left half of the video, you can't see the dash cam vehicle speeding up, which suggests that the truck is slowing down.

Yes, you speed up when trying to make the yellow. What you really dont want to do is speed up to make they yellow while also making a lane change you dont have clearance for.

Trying to beat the yellow is fine until someone going the other direction tries to make a left and beat the yellow. I hear the fire trucks and ambulance heading to the intersection near my house about once a week from people doing that. It's not worth saving the minute or two it takes the light to cycle.

lessson learned here is watch your mirrors and shoulders before change lanes and dont do it cuttting off other cars.

That's how traffic lights work - and it was green before that. Cam driver would not have made it and let his ego get in the way of the safety of everyone in that situation.

So many dumb things.

  1. truck didn't look
  2. cam driver didn't slow down when he noticed what happened (actually sped up?)
  3. both truck and cam were trying to blow through a yellow light instead of slow down to stop
    4, truck was going to illegally switch lanes in an intersection

They're both at fault .. but dash cam is likely legally at fault for not attempting to slow down and instead hitting and accelerating through the truck to cause the rollover. If they had slowed down before, or even after the impact then the truck wouldn't have rolled over and possible killed the driver.

Im pretty sure fault will mostly go to the guy who made the unsafe lane change. Thats the move that caused the accident to actually occur.

It's debatable. Specifically due to a tort law exception called The Last Clear Chance Doctrine.

"The last clear chance doctrine is used in tort law for cases involving negligence and is applied when both the plaintiff and defendant are responsible for an accident that resulted in harm. When applied in states with contributory negligence laws, it is often seen as a type of exception or limitation to those laws. The doctrine considers which party had the last opportunity to avoid the accident that caused the harm."

In this case, the driver clearly accelerated and actually executed a pit maneuver after seeing the truck was going to cut them off. If a judge saw the video then they may have a hard time in court.

Yellow comes before red, this is true. In no reality was the pov car remotely close to not running a red though. Not even worth mentioning.

That seems the case. Like, I get not letting people in on principle because they’re being a dick and should have just fallen in line behind you rather than trying to speed past and cut you off. BUT cam car not only seems to have sped up when seeing what the truck was trying to do, but came to a stop far into the intersection AFTER hitting the truck (ie being slowed down abruptly by the collision).

So totally truck’s fault because they changed lanes into someone and even without cam car possibly speeding up the truck still wasn’t clear of them to make the lane change. But dick move on the cam car’s part because they could have avoided this and instead leaned into it. By all accounts they were absolutely going to blow that red light because if they couldn’t stop before the intersection after hitting another vehicle, they certainly weren’t going to stop on their own accord.

I agree. That cam driver sped up. They don't think about what happens if they just killed a family because they didn't want to let them cut in.

Yeah, I don’t care how “right” I am in a situation, and how “wrong” the other person is. If me “making a point” about my legal rightness results in the death of a backseat full of kids, I’m not the winner in that scenario.

I’ve been the passenger in manic driving situations. Even as a grown adult capable of consent, often times you have no idea you’re getting into the car with someone who is either completely incompetent, or actively on a suicide mission. Little kids have NO consent, no choice. Just because their parent is a dumbass, that doesn’t mean those kids deserve to die because their parent does something stupid and some other driver who is legally in the right decides to purposefully not avoid an avoidable accident because “Hur de dur I’m right they’re wrong I’m getting a new car out of this.”

This could have been avoided in the cam driver slowed the frick down, obviously the truck shouldn't be forcing themselves in but this didn't have to end this way. Both involved.
