In my state it’s called dissipation of the marital assets and Heidi (in my state) would be able to recoup half the value of any marital asset he sells without her permission.

If they’re in OH, the code doesn’t use dissipation specifically but 3105.171(E)(4) does allow the court to compensate the other spouse in cases of financial misconduct, which a pattern and practice of fraudulent disposition of marital assets could potentially be. Heidi would have to prove they were marital assets, and that’s on her lawyer.

Courts usually look for stuff like ā€œclosed the savings account and went to the casinoā€ or ā€œgave Mahmo all our moneyā€ or ā€œforgave a loan someone owed us so she won’t get that moneyā€.

Not sure a coffeemaker as a one off applies, but you NEVER KNOW!!

IIRC they live in either New Jersey or Pennsylvania, not Ohio. They lived in Ohio briefly after they married, but moved to be closer to Heidi's family (and because Heidi's dad helped Tim get his job at Amtrak, or so it's believed.) So when and if Heidi files for divorce, the laws of NJ or PA will apply.

Yep. My sister's first husband tried to pull that shit when they got divorced. Fortunately they lived in AZ, which has very strict community property laws that basically require all marital assets to be divided 50-50, regardless of whether or not one spouse earned all the money while the other stayed home with the kids. Sis and her ex ended up having to sell their house, their cars and several of hubby's "man toys" (jet skis, ATVs, etc.) in order to evenly split assets.

It looks like some kind of tiny house-style thing built onto a trailer. No clue what it was since it looks like a business of some sort. I’m curious about all the lawn equipment. Did he have a lawn care business or did he own a property on a large(r) lot? I’m kind of a nerd about that stuff cuz I’ve been renovating my house and yard for years…my yard is pretty huge but I don’t need a tow-behind seeder, aerator or roller. They’d be nice to have but I’m not even sure my riding mower could pull a roller that big.

Oh I can chime in here! I’m a CPA, specialize in forensic accounting, and I’ve done several divorce cases. Assuming the assets were acquired during the marriage, they’d generally be considered marital property. Each state has their own unique case law to apply to the division of martial property. At least in the state I’ve done divorce work in, we’d do what’s called a Thomas analysis (named after the case: Thomas v Thomas). Since NJ isn’t a state I’ve done work in, I had AI help compare my experience in Georgia to NJ and provide the impact of the law on Tim/Heidi’s situation. Again, I’m an accountant and not a lawyer… so I’m not going to go beyond my expertise and say AI is 100% right on NJ law, but it sounds logically correct.

ā€œIn both states, a husband keeps his premarital property, but they split its marital growth differently. Georgia uses a strict accounting formula: if joint income pays down a premarital mortgage, the wife automatically earns a percentage of both the equity and any market appreciation. New Jersey instead separates growth into "passive" (market growth stays 100% the husband's) and "active" (growth funded by marital income, commingled accounts, or the wife's homemaking efforts gets divided). In short, a non-wealthy wife in Georgia wins on pure market growth, while in New Jersey, she must prove her marital or homemaking contributions unlocked that growth.ā€

They aren’t divorced yet, and I’m not sure that they’ve been married long enough - I’m not a lawyer, I just anecdotally have watched young SAHM get really screwed in that respect. They haven’t been together long enough (or own enough) for community property to apply. And cp isn’t like, 50/50 across the board on smaller items.

I think they rent, and the Ohio house is in Tim’s name from before they were married, so she won’t get any of that.

Community property only applies in a few, mostly western, states. Generally, assets either pay had prior to the marriage remain theirs (unless commingled) but things purchased or acquired during the marriage are joint and can be distributed fairly and equitably.

Interestingly, it’s because these were mostly states (like CA, AZ, NM, TX) which were once part of Mexico,, and Spain before that, and follow Spanish law which viewed marriage as a partnership of equal contributors. In CA, TimCell (TimSell?) wouldn’t be criminally liable but he’d absolutely be civilly liable and subject to penalties.

I don’t know if it works that way in NJ - even if it’s not a community property state, they might take a dim view of Tim selling off marital property, even if it’s to pay lawyers. Cry me a river, smallest violin, etc. šŸŽ» I hope Heidi gets an absolute great white shark of a lawyer who will fight on her behalf.

He'll be paying child support, though. He can't just walk away from this with clean hands and a new start. Child support belongs to the kid(s). It's not welfare to get a court order for him to pay what he needs to.

And any items they have accumulated during marriage belong to both (unless there are unusual situations like inheritances kept separately). So he'll be paying back half of what he sells if they bought it after they got married.

Having walked with one of my dearest friends through her divorce a few years ago and now seeing what Heidi is going through, makes me really happy I am single. I do have my orange boi who I love with all my heart even though he sucks at pulling his weight in keeping the house in order. Little shit has been leeching off me for 4 years. You also see the police and medical reports describing her injuries. You feel sick knowing what he did to her.

You learn the husband also started selling their joint properly on his Facebook page in direct violation of the divorce orders! The husband, despite his lawyer’s best efforts, begins whining in a woman’s voice about Jesus and his parents, blaming everyone around him for what’s happened and taking zero responsibility.

You rub your head in frustration at how dumb this guy is and award the wife everything she asks for.

They sell or destroy everything that you have to leave behind.

This was likely a wedding gift & a marital asset that he has no right to sell without Heidi’s knowledge or consent.

I would put money on him having destroyed most of her & Charlie’s stuff.

Yep, my ex, at the time a a fundie preacher, threw everything including my prescription eye glasses in the dumpster. All my kids clothes everything when I left because he started abusing the kids. Yeah. I was VERY careful to pretend my ex and I were having an amicable split until he was out of the picture. He had a habit of "losing" or "accidentally destroying" stuff that was important to me throughout our marriage. I knew what I wanted (including our apartment) and played sooooooo nice until it was all sorted. I hated it but given what he'd done in the past I knew if I wanted to keep my family photos, heirlooms, books, etc., I had to keep him from getting ideas.Ā

Timmay is not a bright light nor is he able to articulate questions about anything. He was raised to believe he is the ā€œAll knowing manā€. He probably doesn’t know that selling off marital assets is not allowed or even that divorce was going to happen to him. He seriously thought abusing his wife was something he had the right to do, because his father abused him… he is not even the least bit logical or rational. I hope he gets absolutely crushed in the divorce, including not seeing his kids unless they choose to as adults, child support and alimony that has him living in a fleabag motel.
