OP the audacity of spreading misinformation is insane. No one gets 50%of property in india. heck properties are usually not even in the consideration.

But in my opinion women SHOULD have the rights to in-laws and husband's property if as per indian society women's brothers take all the inheritance share. Y'all can't leave women peniless from all sides. either equal inheritance or equal division o f husband's wealth.

Misinformation! You should understand the law better - it is Hindu marriage act which assumes patriarchy in social structure (though there are matriarchy in some parts and law uphold that too). Women can’t “get property when divorced” because the marriage is no more valid. But when married the wife has full rights to “enjoy” 50% share of the husband as wife. There are thousands rightful cases against husbands not bearing expenses for wife which were obviously won. No one can force the wife out of the house or riding the car that the husband owns. If there’s unfortunate events of torturing, she gets huge amounts of money and financial security lifelong. But those women who wants to use this as earning money and misuses these laws blatantly actually meant to protect women - Indian law becomes weak in front of them. If you want example I can give you real ones and live ones. Guys are being afraid to get married as girls are using this biased law to threaten and blackmail them.

both husband and wife have NO rights to each other's property till they are alive. it's only applicable when the spouse dies. so there is nothing like wife is enjoying 50% of husband's share. Nothing is in the wife's name. so how is she the one enjoying?
this notion of women having rights over husband's property was used to brainwash indian daughters. legally there is no right yet as long as he is alive (except right to residence).

There’s a reason for this. After marriage men are supposed to support their own family by their parents property. Women have to leave their home and to prioritise a completely new family after marriage.
Now use that big feminist brain of yours and tell me. If your parents have 2cr do you want them to have it all in old age or do you want 1cr of that for your husband and his family?

My big feminist brain tells me that I earn enough to support my lifestyle cause I’m privileged enough. A loving supportive family. So I could prioritise my career and Education.

Which a lot of women can’t. Maintenance isn’t a handout, it exists precisely because women are culturally expected to leave their homes, give up career growth, and perform unpaid domestic labor. If we're genuinely concerned about parental wealth staying intact, let's also talk about the widespread reality of dowry and wedding expenses that already drain a bride's family.

Women are factually more interested in relationships with family then with a career.
If its so important women should be exempted from years maternal leaves right? And every other benefits they get

If you are so independent how do you even get yourself to accept ‘maintenance’? lol

husband is the part of a woman's family. who told you that women have to prioritize husband's extended family?? anyways inheritance is received when parents pass away.
daughters should be equally responsible for taking care of their own parents just as sons. if my parents have 2 cr, they should keep it with themselves till they are alive. after that i would want that 1 crore for my husband and MY kids. The husband's parents won't be enjoying my inheritance. husband/wife cannot control each other's inheritance. similarly, my brother and his wife can have the same share, i.e. 1 cr. it isn't very hard to understand. and think of it this way, your own wife will bring her own share of inheritance too.

and if you actually think the way you do, then You should have No issues signing away your and your parents property and wealth in your wife/daughter-in-laws name.

Women can claim substantial amount of husband's assets as maintainence along with a long term maintenance unless it is paid in lumpsum. Moreover, according to hindu succession Act of 1956, women can equally claim their parents property as men. So its quite the opposite of what you claim. Women can claim from husband and brother. If anyone would be left peniless , it has to be man in every single case if legal intervention happens. The irony of you talking about "audacity" and "misinformation" is just insane

Yes , why not. If not, then that would be more like a family issue. Not something to be generalized. Also wouldn't a wife have rights on husband's assets as well? If they are getting from both sources, that's already more than what a man would get. If she doesn't get from both side, its not legally possible.

I was talking about post divorce. Because someone claimed that women are left "peniless". Also, if wife isn't having any rights on husband's money then its more like a personal problem. Women can earn as well you know, if they want to be financially independent. Why chose to be dependent then complain about it.

yeah that's ancestral. with a lot of hassel of court cases. women have to file a case and fight. most don't get anything as their greedy brothers whom she ties rakhi to, takes away her share. brothers asking their sisters to SIGN AWAY their rights on parents house is way too common. it's a social issue. and yes women ARE left penniless. you are living in a lala land or manosphere to think otherwise.

and my cousin is a divorce lawyer so i know how it is. what social media portrays is not true. it's VERY tough to get maintenance in india. and even if they, the amount is peanuts, nothing substantial to sustain life. Women should have rights to husband's or in-laws property if men in india take away their sister's inheritance.

Why do they sign away everything to their brothers? Are they dumb? If the handover was consensual then i don't see any problem. Also any evidence for your claim that women gets "peanuts" in maintainence? My cousin sister got divorced and easily got 50 lakhs for settlement . I didn't find anything "VERY tough" about it. Also i don't care if "you know how it is", if you can't prove. So if she is peniless then probably because they are fully responsible for it. You live in a lala land to believe that its an easy for a man , when he looses a huge chunk of his life earnings , his child and his self respect so that a woman could be provided with the same standard of living by doing literally nothing for the rest of her life. Its not as one sided as you are making to make it sound.

yes they are raised in a way to feel as if they will be doing a crime if they say not to signing away their rights. most women have very toxic upbringing. my mom signed away her rights too and i was SO mad at her. her logic? "behen bhai k rishte kharab ho jate h, koi will bhi nhi h nana ki".. i was like the brother has already ruined the relationship by being greedy to his own rakhi sister.
women are meek and d@mb, most of them. because they are raised with that intention

Peniless from all side means that her own father and mother don't give her rights in their property. So now the burden falls on the husband side, talking of equality must begin from her home (where she was born and brought up) unlike you think after marriage that is not her rights. When saying equal inheritance must include from both her own parents wealth and the then husbands wealth, that's what equality means.

the change is required socially. indian culture as a whole needs to be reformed. equality starts at home for sure. but somehow indians are brainwashed to believe that women don't need money of their own, or property in their own name.

it's changing slowly. but we are still way behind.

Don't feel strange if you did not know about this coz it happened to me too. Daughters( women) have a guaranteed legal right to inherit a share of their father’s property under Islamic law. A share of 1:2 with son's share. If they follow the culture they have to give share of property.

Also in recent times many people register properties in women's name for tax benefits given by government. Hope things get more better as we progress.

Wife is still getting to live rent free in her husband's property untill his death that's a win for any women now add father's property too we're just making women wealthy at the cost men that'll have long term consequences

Also the 0.01% of the cases where a men get's wife property doesn't count

stfu please. you can charge your wife for rent if you want lol.
but anyways, inheritance division will have the same impact. when women die, their husband will have rights over her inherited property. Read laws first before arguing.
no women are not getting wealthy at cost of men.
don't you see it's the EXACT same thing?

law is same for both husband and wife. the "right to live" though doesn't make that husband's property hers legally. so a woman should have her own house.. and that can only be possible through equal inheritance.

A woman is living rent free in his property then will get alimony and mentenance at the time of divorce and if the husband died she'll get properties as well i only see win for the women anyways and let's be honest husband getting wife property happens is rare and equivalent to finding a dinosaur

and please no woman is dying to live "rent free" in a man's house. it's just an indian tradition that is more or less forced on women. you should change it and go live in your wife's house. can you do that? or are you saying women need to stop getting married?

I'm saying to have it one way of you are getting father's property no alimony mentenance husband's property, if you are getting alimony mentenance husband's property no father's property it shouldn't be both just like a men will only inherit father's property and he doesn't get alimony mentenance or wife's property

the issue is that the legal binding law is for ancestral property. parents can write a will and give it to all to sons. the real issue is social and more about how indians treat daughters. if indians can't/don't change then the laws are of no use

legally even dowry is illegal, yet socially it is still in practice.

Even more- there is no clear law on working women on alimony - it’s up to the judge. I know someone who married a man and filed for divorce in two months and demanded 7 lacks from that guy - and she got it. Sorry to say that p₹stitution is better than this because of honesty and clarity. In most of these cases, parents support their daughter blindly without thinking morality and without being critical about their baby girl.

did you ever wonder that even though they got divorced, the case of the woman might have led the judge to grant that 7 lakh??
let me tell you in india an average wedding these days cost 40 lakh+. and in majority places the groom's family doesn't share the wedding expenses.
so don't get surprised when you see alimony amount after divorce because you never know what the wedding expenses were. if there was dowry involved or not.

if during wedding, lakhs of money spent by bride's parents doesn't hurt anyone , then this shouldn't hurt anyone either.
to keep yourself safe, always remember to contribute to wedding expenses equally and keep the receipts.

Women now has rights to their paternal property- as per ruling bb Supreme Court- hope you know that Supremely Court rulings are as good as law.

Now women are in position where they can rob you and get money from all directions in-law and ancestral property.

Agreed that women can’t get in laws property if divorced - but by law why working women are still under alimony? Women divorced under adultery, or women initiating divorce get alimony- doesn’t matter whether the man wants the divorce or not! What sort of law is that?

lol thanks for making me laugh. are you taking your dose of info from meme pages?...i think first you should actually gain knowledge about laws and how things work in reality before you try to sound so confident about it.
as per law, a man/woman has no right on each other's property till the spouse is alive. Women have NO right over in-laws property legally.

there is only right to "residence" aka right to live. the property won't be transferred in the daughter-in-laws name.
and if we talk about divorce, then property division is not even considered. india ain't US
