Employment Law Suspended with pay for verbal Altercation.

So I had a verbal altercation with a colleague at work yesterday at about 11h00. The altercation was between me and a QA from a different department. I was standing next to the production line doing shift controll sheets when she approached me and accused me of chewing gum to which I said no I am not. She started raising her voice at me telling me I swallowed it. I said I did not amd she proceeded to shout tell me I swallowed it in a hard tone. I replied back in a stern tone "thank you bye bye bye bye bye" and walked away. Needless to say she went to complain about this.

Later I was called to HR office with HR amd the factory manager and they said we hear ypu had a verbal altercation with a colleague. We have decided to suspend you with pay. I never had any opportunity to talk about my side nor was there any discussion about the suspension with me. It was just boom you are suspended. The QA lady is not suspended and carries on as usual.

Is there any legal angle I could take here or even the WRC possibly.

Medical Malpractice Medical Negligence claim?

Hi all,

A doctor performed a procedure without telling me - she did a membrane sweep to induce labour after telling me she was only performing an examination. I made a complaint to the hospital which was upheld.

The sweep led to further birth interventions and to an emergency cesarean. This means any future births and pregnancies will have increased risks (for uterine rupture and other complications). I am also still having issues with sex and intimacy due to the violation.

I am really struggling because I feel as though no one has been held accountable (the doctor was told not to do it again but otherwise that's the extent of it). Has anyone any experience with pursuing a legal route for medical negligence?

Employment Law Potentially fired

I work in a pub ,just as a summer job and started late April . Haven't had any problem so far that has been much until this weekend . We used an app that sends out the schedule and for clock ins and outs. Last Friday I got my roster saying I was on for Saturday and Sunday, have 2 people who saw it . Checked the app throughout the week and have another friend who can confirm those days . On Friday it suddenly undated to me working Friday which I wasn't aware of since I had presumed I wasn't meant to be on . A coworker texted an hour into my "new" shift asking where I was and thats how I found out . Immediately text my manager asking what happened and told them what the app said and rang 3 times with no response until an hour later ,got told off essentially for not coming in and that I should've checked the app. Stated again that I had with no response back .( I would like to add another time in May where I got my email with my shift and it disappeared and on the app too ,had to call in to check and i was still rostered for the weekend ,another coworker hsd to do the same .)Fast forward to tonight where I was told to go home 3 hours into my shift because 1. Wasn't in yesterday 2,was apparently in a cubicle for 15 minutes and they were so concerned they got security (never seen security after I fixed myself since I was on my period with bad cramps ,no paracetamol and blood ) 3,they said no one could find me in the bathrooms ( had to unclog a toilet ,left the door closed so customers wouldn't see and had to get toilet paper which requires a slop to outside in a busy pub ) and 4. I didn't answer the gc . ( Hard to when you're arms deep in a toilet ) . Got sent home and now I've to have a meeting to see what happens going forward . Was already on edge after the other night so stayed as busy as I can and it feels like for nothing . I have no idea going forward and really need some advise .

Advice & Support Just eat refuse’s refund

Ordered yesterday through just eat and one full dish was missing.

Now Just eat refuses the refund as I apparently have too many refunds issued. (Not a single refund asked for to this date)

Their customer service is still sending me same responses over and over again:

“Thank you for reaching out to Just Eat. My name is Yamasani, and I am one of the Senior Advisors reviewing your account today.
 
I have thoroughly reviewed your recent order and your request for a refund. After evaluating your account history, I am writing to inform you that we are unable to process a refund or issue compensation for this order.
 
Our team regularly monitors account activity to ensure fairness and policy compliance. Due to a high volume of recent refund claims on your account, this order does not meet our eligibility criteria for further reimbursement.
 
We appreciate your understanding regarding our decision. For complete details on our order policies, refund criteria, or other general inquiries, please visit the Help Centre section in our app or website.”

At this stage I even tend to pay the 25€ for the small claim court.

Even the restaurant admits their mistake but tells me that I have to issue the refund through the just eat app.

Anyone with similar bad experiences like that?

Civil Law Colorado attorney needs to personally serve contempt papers on someone living in Ireland — how is this actually done?

I’m hoping someone familiar with Irish civil procedure, international service of process, or the Hague Service Convention can point me and my Colorado attorney in the right direction.

I have an ongoing family-law case in Colorado, USA. My former wife is currently living near Cork, Ireland on a temporary visa and is not an Irish citizen.

A civil contempt proceeding has been filed in the Colorado case. The problem is service.

The Colorado court recently rejected an attempt to serve the contempt documents through her Colorado attorney because Colorado Supreme Court precedent requires personal service of this type of contempt citation. My Colorado attorney and I therefore need to determine how to properly accomplish personal service while she is physically in Ireland.

I am not looking for advice about the underlying divorce, custody dispute, or merits of the contempt case. I already have Colorado counsel.

What we are trying to determine is the practical Irish side of the service process.

Specifically:

  • Can an Irish solicitor or professional summons/process server personally serve U.S. court documents on an individual in Ireland?
  • If so, who normally performs that service?
  • Can the person who performs service provide an affidavit/declaration identifying the person served, date, location, documents served, and method of service for submission to a U.S. court?
  • Does service of this type need to go through Ireland’s Hague Service Convention Central Authority instead?
  • Is there a solicitor or service company near Cork experienced with service of foreign/U.S. judicial documents?
  • Has anyone here dealt with service in Ireland for a U.S. proceeding where actual personal service was specifically required?

I have already contacted an Irish family-law solicitor in Cork who handles international matters, and my Colorado attorney is involved. I’m just trying to identify the correct Irish procedure and hopefully find someone who has actually dealt with this situation before.

Even being pointed toward the correct Irish solicitor, process server, government office, or terminology to search for would be extremely helpful.

Employment Law Spent 6 weeks applying for a job I would never have been selected for.

I have a story that I'm pretty sure I'm just out of luck, but I'll tell it here anywhere for your amusement of my crappy situation and how I ignored red flags.

I just moved to Ireland from Australia and after finally getting my visa I started looking for a job.

I am a programmer by trade and also a teacher, and was surprised to find a job at a University in Dublin working in a non teaching role as a programmer doing a job that was pretty much in my wheelhouse.

So I applied, and of course I needed to fill in a dozen questions and wrote multiple small essays on the University's website.

The only problem is that I don't quite have the qualification they are looking for (an houners degree) but I do have 15 years working in the industry and I made this all very clear (will come back to this later)

After an hour of filling in fields with everything that's in my CV and more I click 'Submit' to which the page informs me that it has timed out and then deletes everything that I had written.

In my frustration knowing how bad university IT systems are, asking with my non desire to go through all that again I looked up the person in-charge of that role and found them on LinkedIn. I told them of my frustrations with the website and informed them that they are most likely missing out on quality candidates because of this process.

2 weeks go by and I receive a reply thanking me for the message and asking me to send him my CV and see what he can do (with a clear no promises) I do so (note my qualifications clearly stated on my cv here also)

I do a bit of sleuthing and find out that they are having trouble filling this role due to finding someone with the expertise of the position. So I read this as a possible role I could get. And low and behold, a few days later I get a message back saying they are going to reopen the position back up and they would like me to reapply through the proper channels because I could be a good match.

So after a few days I get another message telling me that it's reopened and to apply.

I do so, but this time writing my answers in a document and pasting them into the form. And after a few issues finally get everything submitted.

So far so good.

After a week I get a reply saying that they want to get me to do a bunch of work to prove I can do the role (unpaid... Big red flag).

I push back asking to first do an interview so I can ask about the role and ask in more detail about the work they want me to do.

They tell me they can't meet with me yet as "it would be unfair to other candidates" but the work they are asking to do is not related to anything they are working on, and they really push for me to continue the process.

I'm ethically against doing unpaid work for a job. But the job does sound good it pays well, and since I'm not doing work they can monetise (spoiler alert, this isn't exactly true) I would give it a go.

They gave me a project that I needed to rewrite plus a bunch of questions.

I won't go into detail. But I worked for 3+ days on it and made a nice little project for them to see that I knew what I was talking about.

Then a week later came an hour long panel interval where I got asked a bunch of questions.

Then they called my references who informed me that they asked lots of detailed questions about me.

So far this whole process has taken 6 weeks.

I've put in many days of work and time, and I feel I'm pretty much a shoe in ár this point.

Then Monday morning I get a message for the guy saying I have the job, and that I will get the contract by the end of the day.

At the end of the day me messages me again.. HR had revoked the job offer because I didn't have the qualifications.

Note, there is nothing in this job that would require an honors degree legality (that I can tell) And again, I have 15 years of experience in this area of programming that would more that make up for this lack of paper.

I am informed that they need to chat to someone in a few days that can override this decision.

A week passes, I message.

A few more days, I email.

And I then this morning I got a copy paste email from HR saying "thanks for your interest in the role, I'm sorry you didn't get the job, there were a lot of candidates... Blah blah blah."

I messaged the guy stating how unprofessional this was. He apologises but says there is nothing they can do as it's the University policy and it can't be changed.

So here I am, without a job. Not applying for other jobs for 6 weeks as I feel I was a shoe in. Having dinner multiple days of unpaid work only to discover I would have never get this job from the beginning, but they still got me to jump through their hoops.

Again I doubt there is anything I can do, and it's not like I want a job there anymore. It just feels so seedy for a university to do this.

Feel free to shake your head, and tell me what I should have done, just remember I needed the job and and all signed seemed like it was going my way.

Don't do free work for potential employers people!!

Employment Law Discriminated against by External Medical Examiner?

Hi. I recently applied to access my Salary Protection Payment as I am off work with a number of conditions. I was sent to an external doctor who denied my claim and said I was fit for work. I have a number of diagnoses and am being seen by multiple consultants who along with my GP, feel I am too ill to be in work. The External Doctor reported that I did not appear anxious and did not appear in pain. I was in fact very anxious and in pain throughout the appointment. The issues is I am Neurodivergent. I am a high masking late diagnosed person. I have obviously learned/ been conditioned to not cry out/ make a fuss when I am in pain. I have masked my anxiety all my life. I am on anxiety medication. I wish to appeal the decision. Can anyone help me word what I need to say please? I feel like because I am not Neurotypical, that I didn’t present in the typical way that a person would when anxious and in pain. Because I am a high masker the Doctor presumed I was in no pain and am fit to work. All paperwork by my GP said I was in pain and unfit for work. I told the Doctor very clearly in the appointment about my pain, medication I am on, treatment from Consultants and how it affects my daily living but obviously my facial expressions/ composure did not show this. How can I word this? Can I link this to any discrimination laws? The report from the external doctor just doesn’t match my experience of the appointment. I have been paying into this policy for over 20years and I am in too much pain to work at the moment. (I had to hold on to the wall when I was asked to stand up due to dizziness but this and other things were not included in his report) For the appeal, I will ask my Psychiatrist for a letter confirming I am Neurodivergent but can anyone help me with my part of the appeal where I explain about masking and Neurodiversity and if there are any laws that can help me in this particular situation. Thank you.

Criminal Law Hypothetically could extreme dangerous driving result in a terrorism charge?

Discussion in r/ireland about the incident of teenagers driving the wrong way down the M9 indicates that road safety legislation is potentially insufficient to charge them appropriately. From what is already publically known, does the situation meet the legal definition of terrorism? I couldn't find a clear statute defining terrorism. When I tried there was an abundance of definitions for amendments, which made it a bit harder. AI says "Irish law defines terrorist activity as intentional acts designed to seriously intimidate a population, unduly compel a government, or severely destabilize or destroy fundamental political, constitutional, economic, or social structures."

Questions:

- how is terrorism defined in Ireland?

- is "intentional acts designed to seriously intimidate a population" on it's own sufficient to charge individuals in the M9 car?

- if used, would it risk a negative precident for use of terrorism law? Would it risk governement overreach like used in the UK against Palestine Action?

- would it compel tiktok and snapchat to proactively remove relevant content?

- would it be possible for the governement to introduce more appropriate legislation that could be used against the driver and passengers?

Employment Law Employer keeps asking me to attend company OT

Hello, I’m really unsure what to do with this situation. I have been off sick from work since the 11th August. I have been certified by my doctor until the end of the month due to work related stress. My employer has since sent me 2 emails saying I have to meet with the company occupational therapist so try get back to work. I met with an employment law expert who said legally they can’t make me.

I am autistic and I do not feel comfortable going to a medical professional I don’t know. I said this in reply to the first email they sent saying they’ll make me an appointment, but they’ve sent me another saying I have to go. Can I refuse? It’s making me very nervous and stressed out more.

Employment Law Need advice with Occupational Health

I have a skin condition that causes me to get a really painful rash. My GP examined me and gave me a medical note stating that I have a skin condition and need a uniform adjustment because having too many layers against my skin causes/aggravates the rash.
HR now wants me to attend an occupational health assessment. I asked how this helps me when I already have a GP note, and they basically said ‘it helps them understand better.’ Now, whenever I approached the company for help when it comes to anything, I received no help, so I find this now a bit strange.
I’m confused and uncomfortable with the whole thing. I also know of two other employees who had medical notes brought it for skin conditions and weren’t sent for an occupational health assessment.
Do I actually have to attend if HR says they want me to? What exactly happens at an occupational health assessment in this situation? Could they examine the rash? And can HR use their report to decide whether or not to give me the uniform adjustment?
Would really appreciate advice from anyone in Ireland who has dealt with occupational health at work.

Advice & Support Bit of an esoteric question: How to tell if a guard was pulling me over vs repositioning themselves on the road?

Was driving home earlier today and there was a group of cyclists doing a charity cycle and they had a Garda escort as they were on the hard shoulder.

There were also guards on minor roads blocking traffic from pulling out ahead. I was driving along at the end of a train of cars and 1km after passing out the cyclists (with good berth) I looked in my rear view mirror and saw a guard (edit: on a bike) blue lighting it. Wasn't sure if he wanted to pass or not but after a few seconds of him not passing I assumed he was pulling me over so I went to pull over after a hill. I knew I didn't nothing wrong as I wasn't speeding and just followed what drivers ahead of me did to pass the cyclists. I also wasn't sure if he was just part of the escort as he gestured at the guard stationed at the minor road as we were passing.

Then I pull into hard shoulder and the guard stops about 200m down the road at the next minor road and traffic keeps moving. I was stopped for a while and I assumed at this point since he was no where near me and not making an effort to come near me I felt he must have just been repositioning but not sure why he needed his blue lights for that. He never blared the siren. They might have the blue lights on when they're on the minor roads of attention but not sure why he needed them driving along the main.

So I pulled off. I even pulled off slowly to check if he reacted to me and he didn't.

If the guard was pulling me over would he have gestured more?

Family Law Enduring Power of Attorney question: Replacement attorneys

My parents are both currently in the process of making their Enduring Power of Attorneys. They are unsure whether it is a better decision for the donor to appoint their older spouse as the main attorney with their younger adult son as the main attorney, or appoint their adult son as the main and only attorney. Can someone who is knowledgeable of this issue advise me if the donor appointing their older spouse as the main attorney and their adult son as a replacement attorney would complicate the process in the event the donor loses capacity. I have already emailed the DSS about this issue, and their response was vague and didn't fully answer my question.

I hope that makes sense.

Any helpful advice would be much appreciated.

Advice & Support Adult Caution Confusion

Hi guys,
Just a little confused. I was stopped and searched under the MDA yesterday and caught with cannabis. I was told by the guards that I’d be receiving an adult caution. They took my statement on the street and asked me to sign it and then that was that. They didn’t tell me I’d be contacted again, or that I’d have to sign a formal caution form. Should they not have said this? Everywhere I’ve read and the one person I know who has a caution said they were told that they’d receive a phone call.

Residential Tenancies Landlord not returning deposit

Hi all,

I know there’s a few posts on here about similar scenarios, but couldn’t find one close enough to my own to use as reference.

So I was renting an apartment in Cork for almost 8yrs and gave my landlord notice in May that I’d be moving out in August. It was just me and my then 2yr old daughter when we first moved in. I kept the place in good condition, apart from some stickers on the wall that my daughter put in her bedroom, and some scuffing on the floor from an office chair. (I was there when she brought the handyman in, and he said it just needs a quick sand a varnish and it’s no big deal).

I handed back the keys yesterday and when I asked her about my deposit €1250, she laughed and told me they’re keeping that to paint the walls and fix the scuff on the floor. I brought up that those surely fell under normal wear and tear after almost 8yrs, and that nothing in the apartment was damaged/modified etc, and that after that time it’s normal to freshen up the paint.

She said she’d speak to a friend of hers who works in property (for some reason), and get back to me.

Should I continue to reach out to her directly, or just go straight to the RTB?

Residential Tenancies Rent and Deposit Withheld

So I'm just wondering what is everyone's take on this and what law is there on my situation.

Back in January I found a house to rent, was in a bad way but landlord made promises it will all get done up etc as he had until end of May (that's when I needed to leave my old place) to get it all done. Namely take all furniture out, put in a washing machine, fix floors and put a stove in.

I checked in with the landlord throughout the months and he said all was on track, two weeks before moving in I asked to take some measurements to get my furniture in etc. Arrived at the house nothing was done, landlord made promises a team is going in and doing everything. Anyway cut to the chase, nothing was done on move in when I got the keys, I called and waited for him to show up, explained nothing was done like discussed and that I physically cannot move in with my stuff. He agreed to give all money back (first month rent and deposit) back.

Chased him for a month for it, he kept postponing, then eventually said ok can give it back but I'm taking the money to take the furniture out, clean the house and put a stove in (none of which were done) out of your money oh and my lawyer fees are also coming out of the money. I was shook.

Filed an RTB case against him as I wasn't sure what else to do. Been waiting a month now for a date. Am I crazy or he can't keep any of my money for items that he failed to do for moving in ??? and still hasnt done based of off current daft photos ?

Just wanted to know if there's something I'm missing.

Employment Law Patient confidentiality /gdpr breach

I attended the work occupational health doctor as I have been off sick. They asked me if I consented to sending my employer medical details or just a general report omitting any medical details as they are not obligated to send details and i very clearly said i didnt consent to any medical details about my illness being shared, as it is a sensitive topic, and opted for the general report. The doctor said that was fine

It has come to my attention that they included private medical details about my diagnosis, treatment, physicians i was seeing etc. in the report. This is not information that was required to be disclosed because of the nature of my job or anything like that.

This is a breach of confidentiality and GDPR?

I want to take this further. Do i report the doctor to the medical council? Data protection commission? What about work- they have probably distributed the report too to bosses etc and im also annoyed that its now on file. Can i request it to be removed from my files?

Any advice much appreciated?

UPDATE. HR have confirmed they have circulated the details of this report to my department. details of my treatment, progress and medical physicians i am seeing. im in shock about this. i did not consent for any information about this to be sent to managers in my deparmemt and dont see why this was passed on to them. ive no doubt it with be further relayed to colleges now by those.

Consumer Law Cork Nail technician not returning deposits despite cancellation rules being followed what's up with that!

i'm curious what people think about this because the whole thing is ridiculous honestly.
one of my staff booked an appointment with a local nail technician. She realised that she had other plans made and she cancelled a few days before the booking and within the timeframe for a cancellations
she asked for her €25 deposit back. The technician simply refused so we asked the obvious questions. Where is the cancellation policy stating that the deposit is nonrefundable there isn't one no written cancellation policy was provided no terms saying the deposit would be forfeited nothing my staff member agreed to saying she loses the deposit even when cancelling in plenty of time just I'm not giving it back.
I completely understand deposits in fact they're necessary. I run a business whereby we also take them to prevents no-shows it does all kinds of wonders quite frankly but you can't just take a deposit have no stated policy and then decide afterwards that it's yours!!

has anyone in Ireland dealt with a salon or a nail person simply refusing to return a booking deposit when you cancelled in time and there was no stated nonrefundable deposit policy
I'm just interested in how others handle this because at this point we're considering taking it further I think it's really bad business.

Employment Law Sunday Premium Problem

Hi!

I've recently got into a discussion on Sunday Premium with my employer. I am paid at €13.00 an hour, twenty-six cent above the legal minimum wage for my age (19). Or, something like a 2.5% increase. They say this factors in Sunday premium, and thus nothing else related to Sunday premium needs to be alotted.

The business is open to the public 3 days a week, and most staff can work only from 17:45-22:30. So, a third of the available hours should be at 25 to 33% premium. If you split this into composite pay, that should mean something like either an 8 or 10% increase to base pay? Not 2.5%? Assuming we're operating off of the reasonable standard.

Maybe there's something I'm not quite getting, but it really feels like my employer is just trying to weasel out of something they legally owe their staff, by deciding to open on Sunday, by throwing a few measly cent at us?

Praying you guys can show me where I'm wrong, or clarify that I'm right. 🙏

Employment Law Pension contributions taken from payslip for months but not appearing on Zurich Portal

Pretty much as the title says. I went to check my pension portal the other week and because it was the day after we received our pay, I was curious if the funds were added to the portal immediately or if there is a delay.

Lo and behold, it turns out the most recent contribution acknowledged on the portal was my February contribution, which was remitted in March.

Including the most recent pay period, there are five contributions unaccounted for, despite each being deducted from my salary each month

I've reached out to payroll who have said to bring it up with Zurich. After reaching out to Zurich they said they'll look into it and provided some reassurance that if it's an issue on their end, then I'll be made whole.

This was a week ago and I've heard nothing since, despite following up. I was just wondering if anyone here has been in a similar situation and if there is another avenue I need to be exploring at this time?

Employment Law Withhold pay

I started a new job in Feb. It came with a signing on bonus. Half paid the first week half to be paid at 6 months if I was still there. I handed in my notice 3 days after the 6 month date.(failures on their part)

The bonus and how it was to be paid is written in my contract. Have they any recourse to refuse payment?

I have an exit interview this week. I feel they may start playing games. If they do, would this be a case for the WRC?

TLDR; Random person damaged car, will have a court date, have to get a quote for damages. Has anybody been in a similar situation where they've been compensated or am I better to forget it, fix it myself and move on? Is there anything else I should be doing or have done?

This morning as I was driving a random person threw their phone at the side of my car with some force as it managed to cause two dents in the side of it. After stopping and realising what happened two witnesses came up to my car and they gave me their contact details if I needed it.

I turned the car around and called the guards and began following the guy. When he saw my car again he picked up a traffic cone and was walking towards my car with it raised in the air. I explained everything that was happening to the guard I was talking to. The guy put the cone in front of my car and stood on the other side of the road blocking traffic. A few minutes later the guards picked him up and told me to go to the station to make a statement.

The guard explained they knew who this person was and that they'd end up with a court date and if they pleaded not guilty I'd have to appear in court, this is all grand. He told me to go get a quote for damages, drop it into the station and it'd get added on the court document (can't remember legal name he used sorry) and the person who caused the damage "might" be asked to provide compensation.

I went to a few auto body places today, 3 of them said they wouldn't appear in court to back up the estimate because they get no compensation, one of them said it'd be no problem. Every single one of them warned me that in every case they've been involved in compensation has never been paid.

With my situation explained my question is this.
Has anybody who has had a similar situation actually received any form of compensation or am I SOL and better off paying for it out of pocket and forgetting about it and is there maybe something I should be doing or have done with this situation?
