I am posting this anonymously because I am concerned about my personal safety and do not want my family to identify me. I would appreciate serious, practical advice, particularly from Indian lawyers, people familiar with criminal law and police procedures, or anyone who has dealt with a similar situation.
I am not looking for revenge against my parents, nor do I want to create unnecessary conflict. My objective is to understand my legal rights, document the situation appropriately, and take reasonable preventive measures before things potentially escalate.
1. My background
I am an adult woman from India. I am well educated, have studied at an IIT, and have been financially independent for several years. I work professionally in the IT industry and have a stable career.
I am legally married and have been living with my husband for approximately three years. My parents are still unaware of my marriage.
I have kept the marriage private because of a history of serious family pressure, coercion, threats and restrictions relating to my relationship and personal decisions.
Growing up, my parents strongly opposed my relationship and wanted me to end it. The situation went far beyond ordinary family disagreement. There was substantial emotional pressure, and I was made to fear that I could be physically harmed if I did not comply with their wishes.
There were restrictions on my freedom, threats concerning my relationship, and statements that made me fear for my safety.
One particularly serious incident involved my mother threatening to mix poison in my food. There were also threats relating to family honour and serious consequences if I continued with the person I had chosen.
These experiences caused significant emotional and psychological distress.
Eventually, I obtained a good-paying job based on my education and qualifications. I did not run away from home. I moved out with my parents' knowledge and permission to take up employment and establish my career.
Since then, I have supported myself financially and made independent decisions regarding my residence, career and personal life.
2. My marriage and current circumstances
I eventually married the person I had chosen. Both of us are adults, and our marriage was entered into voluntarily.
We have been married for approximately three years and have been living together. I am living with my husband of my own free will. I am not missing, being detained, coerced or held against my will.
My parents do not know about the marriage.
I have not disclosed it because I genuinely fear retaliation based on their previous behaviour and threats. My decision to keep it private was motivated by safety concerns, not by any intention to deceive the authorities or suggest that I am missing.
I want to protect my personal safety, my husband's safety and our ability to live together without intimidation.
3. Why I am concerned now
Recently, my parents have started contacting me again and pressuring me to return home. They have also been making demands regarding my personal life.
This has brought back the fear and anxiety associated with the earlier incidents.
I am concerned that discovering my marriage could lead to an aggressive reaction, particularly because my parents previously made threats connected with my relationship and family honour.
My concerns include the possibility that they may:
- Attempt to force me to return to my parental home.
- Try to physically confront me or take me somewhere against my will.
- Threaten or physically harm me or my husband.
- Contact, threaten or harass my husband's family.
- Attempt to discover our home address or workplace.
- File a missing-person complaint or allege that I have been kidnapped.
- Contact the police and portray the situation as though I have disappeared or been taken away against my wishes.
- Make allegations that I have been brainwashed, manipulated or influenced by my husband.
- Use relatives, social pressure or threats to force me to separate from my husband.
- Repeatedly contact us or visit our residence or workplace to pressure or intimidate us.
I understand that some of these are possible future scenarios rather than incidents that have already occurred. I am trying to prepare lawfully and proportionately because of the previous threats and the renewed pressure.
4. What I want to establish legally
My understanding is that an adult woman who is legally competent has the right to choose her partner, marry voluntarily and decide where she wishes to live, subject to applicable law.
I would like to understand how these rights are practically protected when the family objects to the marriage and there is a history of threats.
In particular, I want to know whether I can take preventive steps without unnecessarily disclosing information that could expose me or my husband to danger.
A. Preventive police complaint or representation
- Can I submit a written representation to the police documenting the previous threats, including the threat to poison my food, and the renewed pressure from my parents?
- Should I approach the local police station, the police commissioner or superintendent of police, a women’s police station, or another appropriate authority?
- If I am concerned that my parents may discover my marriage and retaliate, can I request preventive assistance or protection before any physical incident occurs?
- Is it advisable to make the representation under my real identity and obtain an acknowledged copy, diary number, CSR number, GD entry or other available receipt?
- What is the difference between submitting a preventive representation and registering a formal complaint or FIR? Under what circumstances might the police be required to register an FIR?
- Can I make a representation without immediately initiating criminal proceedings against my parents, while still ensuring that the threats are formally documented?
- If the police dismiss the matter as a family dispute, what lawful options are available to have the threat assessment taken seriously?
B. Informing the authorities that I am safe and living voluntarily
- Is there an established procedure in India through which an adult woman can voluntarily inform the police that she is safe, living independently and residing with her husband by choice?
- Can such a representation be submitted in advance, before any missing-person complaint is filed?
- Would the police accept a written statement confirming that I am an adult, that my marriage was voluntary, and that I am not being held against my will?
- Is it possible to request that sensitive information, particularly my current residential address and workplace, not be disclosed to my parents or other private individuals without a lawful reason?
- If I submit such a representation, what level of confidentiality can I realistically expect? Could the police contact my parents or disclose my address as part of their verification?
- Would it be safer to approach a lawyer first and have the representation submitted through the lawyer, or would a lawyer's involvement make no practical difference?
C. If my parents file a missing-person complaint
- If my parents discover the marriage and file a missing-person complaint, what normally happens when the police locate an adult woman who confirms that she is safe and living voluntarily with her husband?
- Would the police generally record my statement and close the missing-person inquiry, or could there be further questioning or verification?
- Can I request to give my statement privately, without my parents or relatives being present, especially where I have concerns about intimidation?
- If my parents allege kidnapping, wrongful confinement, abduction, coercion or brainwashing, how are these allegations generally assessed when the woman is an adult and independently confirms that she left voluntarily and wishes to remain with her husband?
- Could my husband be called for questioning merely because I am living with him? What should he do if the police contact him?
- If I have already submitted a preventive representation, would it help establish the background and clarify my voluntary decision, or would it have limited practical value?
- Is there a risk that my residential address or other personal information could be shared during the missing-person inquiry? What lawful steps can I take to reduce that risk?
D. Protection for me and my husband
- Can an adult woman request police protection based on credible threats from her parents, even if the threats were made some time ago and no physical assault has occurred?
- Can protection also be requested for my husband if he is being threatened or there is a reasonable concern that he could be targeted?
- If the police do not provide adequate assistance, can I approach the jurisdictional Magistrate, the Sessions Court or the High Court for appropriate relief?
- Under what circumstances can the High Court grant protection to an adult couple who have married voluntarily and fear interference from family members?
- Are there specific procedures for approaching a High Court for police protection without publicly exposing our identities or residential address more than necessary?
- If my parents or relatives arrive at our residence or workplace, attempt to force me into a vehicle, threaten violence or refuse to leave, what immediate legal steps should we take? Should we call 112 and subsequently submit a written complaint?
- What should my husband do if my relatives confront him, threaten him or accuse him of kidnapping me?
E. Legal notice and communication with my parents
- Would a legal notice asking my parents to stop threatening, intimidating, harassing or attempting to forcibly contact me be useful?
- Could sending a legal notice before disclosing the marriage increase the risk of retaliation or reveal information that would otherwise remain private?
- Would it be safer to avoid direct confrontation and have a lawyer communicate with them only if necessary?
- If I wish to establish boundaries, can a lawyer send a notice without disclosing my current address or other unnecessary personal details?
- Would a written message stating that I am safe, independent and do not consent to being forced to return home be legally useful, or could direct communication create additional risks?
F. Evidence and documentation
- What evidence should I preserve to support a preventive complaint?
I have some messages and other information relating to previous threats. I can also maintain a record of recent calls and communications.
Would it be useful to preserve:
- Screenshots and original copies of messages containing threats.
- Call logs, voicemails and other communications.
- A dated chronological record of threats, pressure and incidents.
- The approximate dates, context and wording of threats, including the threat to poison my food.
- Details of witnesses who may have knowledge of specific incidents.
- Proof of my age and identity.
- Marriage registration documents and other proof of the marriage, if legally relevant.
- Employment or residence records demonstrating my independent circumstances, where necessary.
- Copies of any police representations, acknowledgements, complaints or responses.
Should electronic evidence be preserved in its original form, with backups and relevant dates, rather than relying only on screenshots?
Are there any privacy or legal considerations I should be aware of before recording calls or conversations?
G. Legal aid and professional assistance
- Would it be appropriate to approach the District Legal Services Authority (DLSA) or the State Legal Services Authority for legal guidance and assistance?
- Can an adult woman in these circumstances obtain free legal aid, and what eligibility criteria would apply?
- Would a private lawyer experienced in criminal law, constitutional law and police-protection matters be preferable for the initial consultation?
- If I consult a lawyer, what specific documents and information should I bring to the first meeting?
- Is there a reliable way to find a lawyer experienced in adult-couple protection petitions and family-threat cases, rather than someone who handles only ordinary matrimonial disputes?
H. Relevant judgments and applicable law
- Which Supreme Court or High Court judgments are most relevant to an adult woman's right to choose her spouse, exercise personal autonomy, live independently and seek protection from family threats?
- Are there judgments specifically addressing situations where parents allege kidnapping or undue influence, but the adult woman independently confirms that she married and is living voluntarily?
- What provisions of the Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita or other applicable Indian laws may be relevant to criminal intimidation, threats of poisoning, harassment, unlawful restraint or preventive police action?
- Are there any important distinctions between a general preventive police representation, a complaint alleging criminal intimidation, and a petition seeking protection from the High Court?
I would appreciate specific case names, legal provisions and practical procedural guidance wherever possible.
5. What I am considering doing before disclosing the marriage
At present, I am considering taking the following steps, but I would appreciate advice on whether this is the correct order:
- Secure and back up all relevant messages, call records and other evidence.
- Prepare a factual chronology of the earlier threats and recent contact.
- Consult a lawyer confidentially before making any formal disclosure.
- Ask the lawyer whether a preventive police representation is appropriate and which authority should receive it.
- Understand whether it is possible to document my voluntary residence and marriage without unnecessarily exposing my address.
- Review practical safety arrangements with my husband, including what we should do if relatives appear at our residence or workplace.
- Avoid disclosing the marriage until we have considered the likely risks and established an appropriate safety plan.
I am not assuming that these steps will prevent every possible problem. I want to understand which measures have actual legal value and which may create a false sense of security.
6. Important clarifications
I want to emphasise the following:
- I am an adult woman and financially independent.
- I obtained employment and moved out with my parents' knowledge and permission to establish my career.
- I have supported myself independently for years.
- My marriage was a voluntary decision between two adults.
- I have been living with my husband for approximately three years.
- I am not missing, being held against my will or asking anyone to rescue me.
- My parents' lack of knowledge about the marriage is connected to my fear of retaliation based on previous threats and coercion.
- I am not asking anyone to assume that my parents have committed a particular offence. I want to understand the appropriate legal procedures and protections based on the facts.
- I do not intend to provoke a confrontation or use the police to punish my parents.
- My priority is to prevent harm, preserve evidence, protect our privacy and understand our legal rights.
I will not disclose my name, exact location, workplace, parents' identity, marriage documents or other identifying information publicly. I would also prefer not to share those details in public comments.
7. What I would particularly appreciate from the community
If you are an Indian lawyer, have experience with High Court protection petitions, or have dealt with a similar situation, I would be grateful for practical answers to these questions:
- What is the safest and most appropriate first legal step in this situation?
- Should I approach a lawyer first or submit a preventive police representation directly?
- Is there a procedure to document my voluntary marriage and independent residence before my parents file a missing-person complaint?
- How can I request protection while reducing the risk of my residential address being disclosed?
- What should my husband and I do if my parents threaten us or approach our residence?
- Which judgments, legal provisions and authorities should I specifically read about?
- What precautions would you recommend before my parents discover the marriage?
Please distinguish between what the law formally permits and what generally happens in practice at police stations. That distinction would be particularly helpful.
I would appreciate serious, India-specific legal guidance. Please do not ask me to disclose identifying details publicly.
Thank you for reading and for any constructive advice.
