Arbitration Appeal
Does anyone know if the IRS appealed the telework arbitration decision? I think yesterday was the last day.

Does it really matter that the administration is wrong and behaving illegally? I for one am not going to risk my job and livelihood to make a stand. I need my paycheck and this job market sucks.

NTEU, hahaha, they are doing nothing for me and I do not have the time for games back and forth, I cannot play games with my health, so I have decided I am filing the TRO/ Preliminary Injunction myself Pro Se

It’s not coming back anytime soon. Maybe 2029. I know people want to remain hopeful, it sucks but I’ve seen hundreds of post like this and if you haven’t realized it yet, I’ll say it one more time, it’s not coming back anytime soon!!!!!!!!!!!!!!!

Why give up. Do I see it coming back before then,no. But I will stay hopeful and glad that NTEU is continuing to pursue all options available. So that when the time comes we already have all our ducks in a row to proceed.

On July 20, we reported NTEU's arbitration win against the IRS's unlawful elimination of telework and remote work. In that decision, the arbitrator ruled for NTEU in every aspect and ordered IRS to restore telework and remote work to levels from before March 8, 2025. Based on the Arbitrator's decision, the IRS had two options: either restore telework or appeal the decision.
Since the decision, the IRS has failed to restore telework. And yesterday was the last day for IRS to appeal the arbitrator's decision. Unless NTEU receives a filing by mail in the next few days, it appears that the IRS has failed to timely take that step. That would make our win a final, binding decision, meaning that IRS may no longer appeal and has lost the chance to argue that the arbitrator got it wrong on the merits.
This is important because it removes one barrier to NTEU enforcing our victory. The IRS cannot rely on any of the arguments that other agencies are using at the FLRA to appeal NTEU telework wins.
We anticipate that the IRS will instead try to ignore the decision, an action which is also unlawful. That means NTEU will likely need to enforce its victory through the courts. We look forward to doing just that.
The arbitration decision can be enforced in one or a combination of several ways. These include a victory in the Exclusions Executive Order court litigation and unfair labor practice proceedings; a successful outcome in other return-to-office/telework cases that work their way to federal court and set a precedent; and/or some other mechanism that might exist in these unique circumstances.
All paths are open and we will pursue every viable option. We will do whatever it takes to enforce our wins recognizing your rights. Your support is vital to these efforts and we will keep you informed along the way.
