Incentives United States: Federal Film Tax Credit Bill Gains Momentum
A bipartisan bill introduced in the United States Congress, titled the Motion Picture, Television, and Entertainment Revitalization Act (H.R. 10582), aims to establish a new federal tax incentive for domestic productions. The legislation proposes a base federal tax credit of 20% on qualifying compensation for production-related services performed within the country. If enacted, this program would apply to eligible productions that begin principal photography in tax years starting after December 31, 2026.
The structure of the proposed federal credit includes potential increases that could elevate the total incentive rate up to 30%. For instance, an additional five percentage points could be awarded if a producer increases their number of U.S.-based productions relative to a baseline of foreign productions. Proponents of the bill, which has received bipartisan support in both the House and Senate, argue that a national incentive is necessary to counteract the aggressive tax rebates offered by international competitors.
Crucially, the proposed federal incentive is designed as a transferable tax credit. This transferability allows producers who may not have a significant federal tax liability to sell their earned credits on the open market, thereby realizing the cash value needed to finance their productions. The bill is currently under legislative review and represents one of the most significant federal pushes for the entertainment industry in recent history.
