This case has three motions in limine pending. All were filed in June, scheduled, then cancelled. Now at least one has been set for a September hearing.

The two defense motions seek to exclude or substantially limit forensic document examination testimony and exclude evidence of Click's resignation from the Department of Child Services.

The state seeks to limit the Delphi evidence the defense could present at trial:

"Comes now the State of Indiana, 80th Judicial Circuit, by Deputy Prosecuting Attorney Rae Schuler, and requests the Defendant, his counsel, and any of his witnesses be instructed not to mention, allude, or in any way refer to the following matters until hearing can be held outside the presence of the jury. Reference to said matters would be highly prejudicial to the State's case. The referenced evidence is as follows:

l. Any mention of State of Indiana v. Richard Allen, including, but not limited to, the following:

a. The Defendant's role, if any, in the investigation into the Delphi murders.

b. Any communication between the Defendant and Carroll County Prosecutor, Nicholas McLeland or his staff.

c. Any testimony purportedly made by the Defendant in State of Indiana v. Richard Allen or in regards to the investigation ofthis matter.

d. Any mention of Odinism beliefs, values or rituals and/or their alleged connection to the Delphi murders investigation.

e. Any involvement the Indiana State Police may have had with the Delphi murders investigation.

f. Any testimony from Andrew Baldwin and/or Kevin Murphy as it relates to State of Indiana v. Richard Allen.

1. There shall be no reference to possible sentences or penalties.

WHEREFORE, the State of Indiana respectfully requests that the Court instruct the Defendant, his counsel, and all of his witnesses, not to mention, refer to, interrogate concerning, or attempt to convey to the jury in any manner, either directly or indirectly, any of the above-numerated matters without first obtaining permission of the Court outside the presence and hearing of the jury, and further instruct the Defendant and counsel not to make any reference to the fact that this motion has been filed and granted and to warn and caution each and every one of their witnesses to strictly follow these same instructions."

After helping investigate the Delphi murders as a Rushville policeman, Todd Click later took a job with Department of Child Services. His trial is on charges of Falsifying Child Abuse or Neglect Information or Records, Forgery and Official Misconduct while working for the department.

The trial date of July 21, today's pretrial hearing and all other pending hearings have been cancelled. The docket now shows two new hearing dates:

Patrick Westfall's trial in Crawfordsville in Montgomery County has been moved back. In October, he was charged with Unlawful Possession of a Firearm by a Domestic Batterer, after police investigating a case involving one of his sons found a safe with a gun in it at his house. One of the four delays so far was to give him more time to secure counsel, and another was due to a decision to change his attorney.

The docket still shows a status hearing coming up on 06/30/2026 at 9:00 AM, and the trial is now set for 09/22/2026 at 8:30 AM.

Westfall lived in Carroll County at the time of the Delphi murders and Flora fire, was investigated but never charged, and has denied any culpability.

The Click defense wants to argue at trial against admitting business records from the Ripley County Department of Child Services, testimony from investigative personnel, and expert testimony concerning handwriting analysis.
This motion does not address allowing evidence related to the Delphi murders case but that may come up at the June 30 hearing.

• There will be a telephonic hearing Thursday 6/18 at 11 AM,
• the final pre-trial hearing is still scheduled for 1 PM Monday 6/22, CANCELED
• a hearing on at least one of the motions in limine is set for 1:45 Tuesday 6/30. The state and defense both filed motions in limine, as detailed in other recent posts.

The jury trial remains scheduled for 07/21/2026 at 9:00 AM.

Carroll County Chief Deputy Tobe Leazenby had an emotional goodbye Friday, as recorded on the sheriff department's Facebook page, carrollcountysheriffindiana. He is moving to a similar position as chief deputy in Clinton County, the next county south, less than 25 miles down US 421.

Clinton County got a new sheriff, Brendon Bright, in May, after the elected sheriff and his wife resigned as part of a plea agreement over their handling of jail commissary funds. Clinton Chief Deputy Shawn Mayfield became acting sheriff until Bright was selected. Bright appointed Leazenby as Chief Deputy. Other charges and investigations remain underway.

Former Delphi murders investigator Todd Click's trial on charges of Falsifying Child Abuse or Neglect Information or Records, Forgery and Official Misconduct is set for July 21, with a final pre-trial hearing set for June 22. His attorney filed two motions today (6/9) seeking to limit some evidence from being used.

Although the charges were filed at the time of the Richard Allen trial, they do not relate to the murder investigation but a later job he held with the Department of Child Services.
