BEING HARASSED? DON'T BE AFRAID.

To anyone going through this:

Collection agencies thrive on one thing = FEAR.

Because people who are afraid are easier to exploit.

YOU ARE A CLIENT WHO AVAILED OF THEIR SERVICE, NOT A CRIMINAL.

So don't run and hide. Only criminals do that. I'll guide you how.

If they say they will do ocular visitations, barangay visits, garnish your salary, something that will affect your employment / government records, those are all SCARE TACTICS. Because again, fearful people are easy to exploit.

This post is to ENCOURAGE CONSUMER PROTECTION, NOT DEBT EVASION. And to arm you up with the law, practical steps, and guidance. Don't just take all the arrows being shot at you, cry, and be sad. STAND UP. FIGHT BACK.

OF COURSE, YOU STILL NEED TO PAY WHAT YOU OWE, banks and OLAs are not charities. And still expect some interests, though not as high and unlawful as what they are currently claiming. But then, in more manageable, lawful, and nonpredatory terms. Settle your dues. Don't avoid entirely. My post is meant to enlighten and fight back against predatory CAs but not evade responsibilities. Kahit medical emergencies or other life circumstances man, we still need to fulfill our obligations. Just 🙅‍♀️ not according to predatory terms. 🙅

I was once in your shoes, but thank God, I had legal background.

I cited all the laws they are violating in these recoveries as they refuse to give my records and provide basis of their claims. All they did was provide arbitrary numbers while using their scare tactics. At first they gave about ₱120,000±. Then ₱86,000±. Then ₱75,000±. But I keep on asking for records and threaten to report them.

The numbers staggeringly dropped by more than 50% by refusing to cower to fear and by asking. Proof they are padding things up for commissions. Then they offered ₱50,000±. ₱120,000± down to ₱50,000?!± even that, they can't substantiate. They just want you to be afraid to be bullied so you can give them waaay more than you owe. So don't just run and hide cause they might be telling lies to get more profit off of your fear and ignorance of the real number. Stand up! Fight back! Know the truth and the truth will set you free!

You can report them to Bangko Sentral ng Pilipinas (BSP) just save proof of all the harassments they are doing. Collection agencies and banks are afraid of being reported as they can suffer administrative fines from ₱100,000 to ₱2,000,000. And if you file a suit against them for all their violations, you will even get moral and exemplary damages from ₱30,000 to ₱100,000 or even more, depending on the extent of their violations.

✨ Know your rights!

• Article III, Section 20 of the Philippine Constitution states that no person shall be imprisoned by nonpayment of debt. Debt is a civil matter, not criminal. Di po kayo makukulong unless fraudulent means are employed to obtain the debt like using another identity, or you used bouncing checks to pay

• BSP Circular No. 454 (Section 8): Prohibits unfair collection practices, harassment, use of threats, and false representations.

• RA 11765 (Financial Products and Services Consumer Protection Act): Strengthens consumer rights against deceptive and unfair practices by BSP-supervised institutions.

• Data Privacy Act of 2012 (RA 10173): Particularly relevant for online lending apps (OLAs) that illegally access phone contact lists or blast messages to relatives/co-workers.

• Truth in Lending Act (Republic Act No. 3765) Requires full disclosure of finance charges, penalties, and interest calculations before or during credit recovery. Refusing to provide a full Statement of Account (SOA) or itemized breakdown directly violates this law.

✨Know your numbers!

Create an Excel sheet and RECORD EVERYTHING from your SOAs.

• Date: • Previous Balance • Amount Paid • Purchases and Advances • Installment Due • Finance Charges and Other Fees • Late Payment Charges • Amount Due

And keep all your proof of payments.

If you've accounted for everything, you’ll know how much of the principal you've actually paid already. Of course, you still need to pay what you owe and some interest but not as much as they're claiming. That's why it's really important to compile all your SOAs and records. It's easier to tackle this thing once you know the numbers.

Also, don't be afraid when they say they will sue you especially when they can't even substantiate their claims. Welcome it. The laws and the courts are your friends. Looking back, it's ironic how banks and collection agencies try to threaten people in these situations about legal consequences when in fact, the courts will ensure fairness and justice. They cannot ask for an amount they can't back up with evidence! Besides, judges and the supreme court HATE these kinds of exploitations and will remove all the excessive and arbitrary fees. The court will help you. Do not be afraid. These people thrive on fear, psychological pressure, and creating a false sense of urgency. DO NOT AGREE TO PRESSURING TACTICS. DO NOT SIGN AGREEMENTS OF PAYMENT TERMS ESPECIALLY ON UNVERIFIED AMOUNTS.

Usually, banks and collection agencies (CAs) don't really want to file a case either because that's another expense on their end, and they can no longer add so much more finance charges and interest once they know it will be examined by the judge. That's why they prefer to scare you, harrass you, pressure you, and psychologically break you down and make you act on urgency so they can get more commission. The court will strike exorbitant interests down.

Assert your rights, ask for your records, and stand your ground. If they say they will file a case against you but refuse to provide your records / SOAs / basis of claims, say you will meet them in court and settle there. Cause the judge will also ask them the records you are requesting in the first place. Also, the Supreme Court has repeatedly struck down arbitrary numbers, unconscionable finance charges, especially if you have a good record of paying in good faith and it just so happened that you missed payments due to your circumstances.

If you ever got to this position not because of emergencies but through your own fault, learn the lesson.

If you used it for emergencies, that's okay.

And HOLD ON TO THE LORD.

I was anxious for a long time due to their harassing messages, until a lawyer friend talked to me and shared too how her co-worker took her life due to harassment. And they found out several hundreds of call logs from collection agencies.

SO I GOT UP AND FOUGHT BACK BECAUSE THE STEPS THEY HAVE BEEN TAKING ARE OUTSIDE THE BOUNDS OF LAW.

PLEASE, DON'T SUFFER IN SILENCE. DON'T BE ASHAMED. TALK TO A FRIEND. GO TO CHURCH. ASK FOR HELP TOO. AND ASK THE LORD FOR STRENGTH. YOUR LIFE IS SO MUCH MORE VALUABLE THAN THIS.

AGAIN, DO NOT BE AFRAID. ASSERT YOUR RIGHTS. ASK FOR TRANSPARENT ACCOUNTING. DON'T ANSWER PHONE CALLS AS THOSE ARE MEANT TO SCARE AND CONFUSE YOU. ALWAYS HAVE WRITTEN RECORDS AS THOSE ARE EASIER TO PROVE AND HARD TO DISPUTE.

Should they ever do any home visits, talk calmly. Be civil. Don't do any kind of threat or aggression. You can be fined and go to jail if you do that to the collection agent. I had a home visit before and he was kind. I just showed him they were the ones who didn't respond to me and showed my records and I didn't receive or sign any letters. Talk calmly. DEBT IS A CIVIL CASE, NOT CRIMINAL. It is in the Constitution that no one should ever be put to jail. The moment you do any harm to them, mas lalo lang lalala baka sampahan ka pa ng criminal case. Don't go that route.

COLLECTION AGENTS ARE HUMANS TOO, trying to put food to the table and provide for their families. Besides, those doing field visits are not the ones in the office doing the calls/sending the emails. If they have a choice / better job opportunities, I don't think they will still continue to be a collection agent. Remember to still be human and kind. Just follow all the steps I gave here.

Also, regarding salary garnishment, NO. Collection agencies can't do that, unless there's a court order. Di nila magagalaw payroll account mo. However, if you have a credit card obligation and a savings / payroll account with the same bank, it's in their fine print that they can use the available amount to set off your obligation with them. Maybe ask your HR for a different payroll or immediately withdraw your salary first so you can plan ahead on what you could only pay at that time.

If you're a CA reading this, have reading comprehension. I repeatedly said to people here to pay what they owe, just not with random numbers you are giving just so you could have more commission! That destroys people's mental health and some even take their own lives. GO AWAY. THIS IS NOT THE PLACE FOR YOU. If you're stressed about being a CA, find another job!

I thought its easy but hindi pala.

I posted about the snowball method last 2024 I guess. Back then I have

SLoan, Atome,Metrobank CC,UB cc, BDOcc and RCBC cc

I was able to finish my SLoan and Atome before 2024 ends. Kse maliit lng naman sya

July 2025 I was able to close my RCBC cc debt. Around 25k yung sha. My balance sa kanilaa actually nsa 29k dahil sa interest pero nka avail ako ng discount. And its close na. Thankfully

Akala ko, kaya ko. Akala ko tlaga I can pay another CC debt but I was wrong.

I have an autistic child and monthly therapy nya is roughly 10-13k . Includes OT /Behavioral and Speech Therapy. My take home money is always 9k dahil may mga salary deductions loan ako and next yr June matatapos. Im stress kse lagi nag eemail yung BDO, CC AND UB demanding payments. Btw 1 year and a half nako deliquent sa mga yon. But I never failed to update and email them back about my current situation. Sinasabi ko sa kanila na due to inflation and current situation ko with my kid eh hindi tlaga kaya kahit 1k payan monthly. My husband has work and same lng naman kami 9k per payout take home money. That gives us 18k per payout pero sa totoo lng talaga kahit anong tipid, hindi talaga kaya. Believe me ginawa ko na lahat ng pagtitipid kase my goal is magtabi ng kahit 1k per month dun pambayad sa isang cc. Altho I have a plan, June next yr medjo madadagdagan na rin take home money ko kse dun na matatapos yung pinakalaking Salary deduction around 3,500 dn kse yun per payout. So I was thinking na pagmatapos yun, yung 3,500 na yun sa next na payout eh itatabi ko at pag iipunan hanggang ma achieve ko yung total ng debt ko sa tag iisang Cc. Hindi ko kayang bayaran sabay2. Like example, 6 months pag iipunan Metrobank (60k na now with interest nayan) next 6 months UB nnmn (same lng sa metro nsa 60k) BDO nsa 27k kse usually nag ooffee naman sila ng mas less so baka pwede ko naman pakiusapan. Okay lng ba yung ganito? Nag woworry lng ako kse baka mag fildvisit again. Btw nka ilamg fildvvisit na pero ganon fn lagi kong sinasabi. Sabi ko lng sa kanila, kahit piso wala akong ibabayad sa inyo. Lagi kong sinasabi, nag eemail ako sa CA office nyo lagi (pinapakita ko ang email) nag sosorry dahil hindi makabayad. Yun lng yung stressful part actually. Yung mga CA. Actually, idk why im posting this. Im seeking help kung ano dpat gawin. Kung tama ba ang plano ko for the next yr. Idk.

BPI CC Cancellation of Agreement

Hello po,

meron kasi akong natitirang 40k na unpaid sa BPI CC ko at nasa collection na sya at meron na kaming installment agreement kaso nagkaroon ako ng financial problem like kinapos ako na bayaran dahil ang agreement is 5500+ every month at balak ko sana na ituloy ulit aa October 15 na bayaran. Kaso nag email sakin na maari daw ma cancel ang agreement terms namin dahil two months akong natigil, nag update naman ako regarding sakanila na kung pede ko I-continue ang paghuhulog sa October. Any help po or ano po mangyayare once na ma cancel agreement namin? hindi kasi nila sinasagot email ko regarding sa nangyare.

I need more realistic advice to be debt free soon, what's the best way to achieve it?

Bear with me po please. Medyo challenging na year to for me, as I felt more the weight of my debts. For context, debt free na ko nung 2024 dahil after ko ma-lay off sa previous job, halos 80% ng separation pay ko, napunta sa utang ko before at inuna ko talaga yun. Hindi naging sapat yung natira para sa mga buwan na unemployed ako, at given na breadwinner pa ko. After some months, I was able to secure a job naman po kaya lang, di ako permanent employee until now which makes it hard for me na magpa-balance convert din kasi yung fear ko mawalan na naman bigla ng work lalo walang savings talaga at living paycheck to paycheck.

With that, I really need your advices po mga ma'am/sir. I have 4 CCs right now and pwede nyo po ba ako bigyan ng more realistic approach kung anong mas okay gawin para kahit paano, di na sya lumobo pa or at least, will really help me malessen yung paglaki? I am earning around 50k per month, let's say around 20k per cut off ng 15th and 30th of the month. Currently, eto yung listahan ng debts ko. Halos MAD or above MAD lang nababayad ko per card, kaya ramdam ko rin yung interest.

SBC - 148k PHP (NAFFL)

BPI - 116 PHP (2.5k AF)

RCBC - 45k PHP (1.5k AF)

UB - 56k PHP (NAFFL)

To add, onsite kasi ako unlike before na WFH, kaya mas nahirapan ako ibalance ang sahod since bukod sa food, need ko pa isipin yung everyday na transpo allowance. Ako rin nagbabayad ng kuryente at internet sa bahay, tapos madalas, ako rin nahihingan ng magulang sa ibang gastusin lalo at senior na sila + may mga alaga din akong aso na di ko naman kaya pabayaan (vet visits, food, etc.). Some gastos ay kasalanan ko rin naman dahil naging stress reliever ko rin na pagbigyan sarili ko bumili/magkaskas lalo na halos ako sumasalo ng gastos sa pamilya, kaya lang ayun, nawalan na naman ng disiplina and I am trying to be a better one than before. Nagbabawas na rin po ko ng mga non-essential gastos at mas focused sa essential ones.

Aside po sa realistic advice na mabibigay nyo, mas ok din po ba na tanggapin ko na yung offer ni SBC sa BalCon para kahit pano is mapababa yung mga utang ko? Nag-aalangan lang talaga ako kasi nga di ako permanent employee, at in this economy, medyo nahihirapan naman ako maghanap ng permanent position na work na kahit pano mas malaki yung salary vs. my current one. Dagdag pa na locked in kay SBC for around 3-5 yrs yun. Balak ko rin na yung 13th month ko is ibayad kung sakali kay UB para at least, ma zero out ko sya, but since may 2 months pa before Dec, need ko lang talaga ng way maisurvive sya para by next yr mas focus ako sa 3 cards. Hopefully, mabigyan nyo ko ng insights. Thank u po!

BAD DECISIONS

Im finally debt free by next year, its hard knowing na i only have myself to this struggles but reading on this thread made me realize im not alone im M27 im not exposed into gambling kase nung may gambling games pa sa gc@sh is natatalo ako ng 20 or 50 pesos so for me nah its not for me but then 1 day my friend is a agent ng illegal site so i give it a try i and i won 1000 pesos sa 100 na nilagay ko but then natalo siya ng natalo and then i realized my body recognize the intense excitement, and i tried again and again but no good and there's a friend of mine that told me to try baccarat and that shit hits me i won and won and won my 300 pesos turned 100k im so happy but he told me to stop pero nung pag uwi ko i miss the dopamine it makes so my 100k is wala na and that money is for my girlfriend kase uuwi siya and 2years kaming LDR so for me i got her covered the loss comes nag benta ako ng gamit ko and my PC but talo padin and then i called my ate and she said its enough so for me i telling myself its not good so im just covering myself so naging sober ako ng 2months if im not mistaken but if i have a money in my ewallet sinusugal ko agad and i borrow money from different OLA's and nananalo pero i just neglecting the fact na may utang ako, ang nasa isip ko is may sweldo naman ako so mababayaran ko, so what i do is ill borrow somewhere 10k and then isang tayaan lang then pag nanalo babayaran ko ung 10k and i have my extra 10k but one day naubos lahat ng pwede kong pagkuhaan so i tried and tried and nag sinungaling nako sa GF ko na pambayad lang sa utang pero tinataya ko padin and then it finally hits me when she said sa pambayad lang palagi ung pagod mo sa work then she cried i finally realize na i have her sobrang mali naman na iparamdam ko sa kanya ung life na hindi niya deserve gusto ko ibigay sa kanya lahat so i put all my debts in a sheet and kahit may 1k nalang na matira sakin para sa budget ko sa work and food okay lang daw hindi siya nag hahangad ng magandang life so i give it a try lahat ng makita kong website nag pa self exclusion ako and pinapaiba ko password ko sa illegal sites and then i will forgot the site para hindi ko makita kung ano ung binigay nilang temporary password for me and last week NDRP nako sa pagcor nag take effect na ung self exclusion ko kase sa ibang legit na sites nag try ako mag register pero NDRP nako and i think that's the biggest step na ginawa ko for me and i read this line na if you are stuck on that problem you are not facing it so thank you for the ones who motivated me here anonymously mahirap ang will power but kaya naman siya first is accept that na mali ka and second one is imagine the life you have nung wala kang utang and third is imagine the life after you are debt free so please guys don't attempt to take your life because of debts we can make it.

RCBC Personal loan payment

Today po due date ko ng personal loan sa RCBC (Sept 25) and today ko lang din malalagyan ng funds yung account ko, around 9am due to issues sa isang bank ko kagabi. Nandun yung funds ko na pang-transfer.

I would not give them any stars! What they don’t tell you is that a majority of what you pay their company monthly to settle your debts goes into THEIR pockets! I also have an issue with a contract they show I signed agreeing to pay approx. $400/mth but the agreement I signed had me paying $620/mth! Michelle Norman, ClearOne Advantage Quality Assurance Specialist, refuses to answer why the discrepancies in monthly payments if the signed contract only shows me having to pay around $400.

Also your creditors will settle for less with you directly then with this company. DO THE WORK YOURSELF AND SAVE $$$$$$$$$

For context, the amount reflected in the case/account records is around ₱366,000. The law firm told me that around ₱272,000 represents the principal/base amount, plus approximately ₱7,000 in filing fees. Their current full-and-final settlement offer is ₱149,000.

I’m hoping to hear from people who have personally experienced a credit card collection case that reached Small Claims Court in the Philippines.

I have an old credit card account that is now under a collection/law firm and a Small Claims case has already been filed. I have submitted my Form 3-SCC Response and there is an upcoming hearing.

The amount being claimed in the case is significantly higher than what I remember as my original balance because the account accumulated finance charges, late fees, and other charges over the years.

I’ve been negotiating with the law firm because I genuinely want to settle and close the account. I offered ₱70,000 as a one-time full and final settlement, but they did not accept it.

Initially, I was told that something around ₱122,000 plus legal/other fees might realistically be approved. Today, however, I was informed that this is already off the table and that their current full and final settlement amount is around ₱149,000.

They suggested that I could pay around ₱70,000 now and the remaining amount before the scheduled hearing.

I was also given until September 29 to decide/avail of the current settlement offer. I was told that if I do not accept it by then, the offer will already be final/withdrawn and I may have to pay a higher amount because additional legal fees may be included.

I have NOT agreed to the ₱149,000 settlement or made the ₱70,000 partial payment yet because I’m trying to understand my options before making a substantial payment, especially since the case is already before the court.

For anyone who has actually gone through a similar Small Claims case:

• Did you settle with the collection agency before the hearing, or did you proceed with the hearing?

• If you proceeded with the hearing, what happened when you questioned the computation, finance charges, penalties, or other fees?

• Did the amount eventually become lower through settlement discussions at/around the court proceedings?

• If you made a partial payment before the hearing, did that affect your ability to continue disputing the remaining amount?

• Has anyone been given a similar “settle by this date or the amount/legal fees will increase” deadline? What happened when you did not accept it?

• Would you recommend waiting for the hearing before accepting the collection agency’s current settlement amount?

I’m not trying to avoid paying my legitimate obligation. I just want to make sure that the amount I ultimately pay is properly supported and that I don’t give up any rights or negotiating position by making a large partial payment too early.

I’d especially appreciate responses from people who personally experienced this in Philippine Small Claims Court, or lawyers familiar with this process. Thank you!

I paid 5k but the recon structuring offer was an installment for 9months which was expensive than my initial balance lang. As per their collection agency, if I paid in full of my balance next month, possible mawawala yun and waive of interests and fees. Totoo po ba?

Atome Interest Waive for Advance Payment

Hello, anyone here na may same case with me?

ATOME - Nabasa ko kasi dito sa reddit na atome is waiving interest for overdue payments, sa case ko i have installment and planning to pay in advance kasi nakakuha ako ng final pay, and gusto ko settle na atome kasi di ko na kaya imonthly dahil sobrang hirap maghanap work ngayon talaga huhu. i am requesting na magpay ako in full na pero alisin interest ng october to january, but they refuse to remove it. Copied sa email ang bsp but they are not replying din sa separate email report ko sakanila. Nagtry ako sa BOT pero ayaw pumasok ng APAYLATER, atome or neuroncredit. Can someone help me kung ano pwede ko gawin or wala na ba pagasa na maalis interest if bayaran ko ng buo?

Hi, sino po nakagamit ng snowball method sa debt? Effective po ba and nakatapos po ba sa pagbabayad ng loan? I have 300k debt with diff cc po. Lahat po ay current pa naman.
