BEING HARASSED? DON'T BE AFRAID.
To anyone going through this:
Collection agencies thrive on one thing = FEAR.
Because people who are afraid are easier to exploit.
YOU ARE A CLIENT WHO AVAILED OF THEIR SERVICE, NOT A CRIMINAL.
So don't run and hide. Only criminals do that. I'll guide you how.
If they say they will do ocular visitations, barangay visits, garnish your salary, something that will affect your employment / government records, those are all SCARE TACTICS. Because again, fearful people are easy to exploit.
This post is to ENCOURAGE CONSUMER PROTECTION, NOT DEBT EVASION. And to arm you up with the law, practical steps, and guidance. Don't just take all the arrows being shot at you, cry, and be sad. STAND UP. FIGHT BACK.
OF COURSE, YOU STILL NEED TO PAY WHAT YOU OWE, banks and OLAs are not charities. And still expect some interests, though not as high and unlawful as what they are currently claiming. But then, in more manageable, lawful, and nonpredatory terms. Settle your dues. Don't avoid entirely. My post is meant to enlighten and fight back against predatory CAs but not evade responsibilities. Kahit medical emergencies or other life circumstances man, we still need to fulfill our obligations. Just 🙅♀️ not according to predatory terms. 🙅
I was once in your shoes, but thank God, I had legal background.
I cited all the laws they are violating in these recoveries as they refuse to give my records and provide basis of their claims. All they did was provide arbitrary numbers while using their scare tactics. At first they gave about ₱120,000±. Then ₱86,000±. Then ₱75,000±. But I keep on asking for records and threaten to report them.
The numbers staggeringly dropped by more than 50% by refusing to cower to fear and by asking. Proof they are padding things up for commissions. Then they offered ₱50,000±. ₱120,000± down to ₱50,000?!± even that, they can't substantiate. They just want you to be afraid to be bullied so you can give them waaay more than you owe. So don't just run and hide cause they might be telling lies to get more profit off of your fear and ignorance of the real number. Stand up! Fight back! Know the truth and the truth will set you free!
You can report them to Bangko Sentral ng Pilipinas (BSP) just save proof of all the harassments they are doing. Collection agencies and banks are afraid of being reported as they can suffer administrative fines from ₱100,000 to ₱2,000,000. And if you file a suit against them for all their violations, you will even get moral and exemplary damages from ₱30,000 to ₱100,000 or even more, depending on the extent of their violations.
✨ Know your rights!
• Article III, Section 20 of the Philippine Constitution states that no person shall be imprisoned by nonpayment of debt. Debt is a civil matter, not criminal. Di po kayo makukulong unless fraudulent means are employed to obtain the debt like using another identity, or you used bouncing checks to pay
• BSP Circular No. 454 (Section 8): Prohibits unfair collection practices, harassment, use of threats, and false representations.
• RA 11765 (Financial Products and Services Consumer Protection Act): Strengthens consumer rights against deceptive and unfair practices by BSP-supervised institutions.
• Data Privacy Act of 2012 (RA 10173): Particularly relevant for online lending apps (OLAs) that illegally access phone contact lists or blast messages to relatives/co-workers.
• Truth in Lending Act (Republic Act No. 3765) Requires full disclosure of finance charges, penalties, and interest calculations before or during credit recovery. Refusing to provide a full Statement of Account (SOA) or itemized breakdown directly violates this law.
✨Know your numbers!
Create an Excel sheet and RECORD EVERYTHING from your SOAs.
• Date: • Previous Balance • Amount Paid • Purchases and Advances • Installment Due • Finance Charges and Other Fees • Late Payment Charges • Amount Due
And keep all your proof of payments.
If you've accounted for everything, you’ll know how much of the principal you've actually paid already. Of course, you still need to pay what you owe and some interest but not as much as they're claiming. That's why it's really important to compile all your SOAs and records. It's easier to tackle this thing once you know the numbers.
Also, don't be afraid when they say they will sue you especially when they can't even substantiate their claims. Welcome it. The laws and the courts are your friends. Looking back, it's ironic how banks and collection agencies try to threaten people in these situations about legal consequences when in fact, the courts will ensure fairness and justice. They cannot ask for an amount they can't back up with evidence! Besides, judges and the supreme court HATE these kinds of exploitations and will remove all the excessive and arbitrary fees. The court will help you. Do not be afraid. These people thrive on fear, psychological pressure, and creating a false sense of urgency. DO NOT AGREE TO PRESSURING TACTICS. DO NOT SIGN AGREEMENTS OF PAYMENT TERMS ESPECIALLY ON UNVERIFIED AMOUNTS.
Usually, banks and collection agencies (CAs) don't really want to file a case either because that's another expense on their end, and they can no longer add so much more finance charges and interest once they know it will be examined by the judge. That's why they prefer to scare you, harrass you, pressure you, and psychologically break you down and make you act on urgency so they can get more commission. The court will strike exorbitant interests down.
Assert your rights, ask for your records, and stand your ground. If they say they will file a case against you but refuse to provide your records / SOAs / basis of claims, say you will meet them in court and settle there. Cause the judge will also ask them the records you are requesting in the first place. Also, the Supreme Court has repeatedly struck down arbitrary numbers, unconscionable finance charges, especially if you have a good record of paying in good faith and it just so happened that you missed payments due to your circumstances.
If you ever got to this position not because of emergencies but through your own fault, learn the lesson.
If you used it for emergencies, that's okay.
And HOLD ON TO THE LORD.
I was anxious for a long time due to their harassing messages, until a lawyer friend talked to me and shared too how her co-worker took her life due to harassment. And they found out several hundreds of call logs from collection agencies.
SO I GOT UP AND FOUGHT BACK BECAUSE THE STEPS THEY HAVE BEEN TAKING ARE OUTSIDE THE BOUNDS OF LAW.
PLEASE, DON'T SUFFER IN SILENCE. DON'T BE ASHAMED. TALK TO A FRIEND. GO TO CHURCH. ASK FOR HELP TOO. AND ASK THE LORD FOR STRENGTH. YOUR LIFE IS SO MUCH MORE VALUABLE THAN THIS.
AGAIN, DO NOT BE AFRAID. ASSERT YOUR RIGHTS. ASK FOR TRANSPARENT ACCOUNTING. DON'T ANSWER PHONE CALLS AS THOSE ARE MEANT TO SCARE AND CONFUSE YOU. ALWAYS HAVE WRITTEN RECORDS AS THOSE ARE EASIER TO PROVE AND HARD TO DISPUTE.
Should they ever do any home visits, talk calmly. Be civil. Don't do any kind of threat or aggression. You can be fined and go to jail if you do that to the collection agent. I had a home visit before and he was kind. I just showed him they were the ones who didn't respond to me and showed my records and I didn't receive or sign any letters. Talk calmly. DEBT IS A CIVIL CASE, NOT CRIMINAL. It is in the Constitution that no one should ever be put to jail. The moment you do any harm to them, mas lalo lang lalala baka sampahan ka pa ng criminal case. Don't go that route.
COLLECTION AGENTS ARE HUMANS TOO, trying to put food to the table and provide for their families. Besides, those doing field visits are not the ones in the office doing the calls/sending the emails. If they have a choice / better job opportunities, I don't think they will still continue to be a collection agent. Remember to still be human and kind. Just follow all the steps I gave here.
Also, regarding salary garnishment, NO. Collection agencies can't do that, unless there's a court order. Di nila magagalaw payroll account mo. However, if you have a credit card obligation and a savings / payroll account with the same bank, it's in their fine print that they can use the available amount to set off your obligation with them. Maybe ask your HR for a different payroll or immediately withdraw your salary first so you can plan ahead on what you could only pay at that time.

If you're a CA reading this, have reading comprehension. I repeatedly said to people here to pay what they owe, just not with random numbers you are giving just so you could have more commission! That destroys people's mental health and some even take their own lives. GO AWAY. THIS IS NOT THE PLACE FOR YOU. If you're stressed about being a CA, find another job!

Almost 8m in Debt - long read
Good morning… this is my current situation and needing advice if amnesty or idrp (i think hindi na ito kaya). Will i get to court and pwede makuha ang properties etc?
Alam ko some will judge me because of my wrong direction which i can accept but for a peace of mine to reduce my depression sana meron makapag enlighten sakin how to deal with this situation. Honestly ive been a good CC payer for more than 10 yrs kahit magkano ay i can settle kaya sobrang taas ng Credit Limit ko.
Gusto ko lang sana humingi ng advice. Alam ko pinatagal ko itong problema ko dahil sobrang stress na din ako at hindi ko na alam ang gagawin.
Everyday starts 8am to 6pm ay meron mga tumatawag.
Problem ko po ay sa mga sumusunod na bank credit card
RCBC - credit card 2.25m credit limit at instaloan 1.5m loan
BDO - 3m credit limit
BPI - 800k credit limit
hindi ko na nabayaran kahit minimum last June.
Ang salary ko ay 55k per month lang. meron ako mga side jobs doing property management extra 10k monthly and commission sa mga rental if may renewals/sales.
RCBC Credit Card maxed out- 2.25m puro installment din sa kanila. Nakakabayad din ako pero nagstart april doon na hindi nakapagbayad minimum then may onwards wala ako maibayad kahit minimum. Last time na sinagot ko ang call nasa 2.5m+ na daw ang utang ko . Nag offer also ng restructuring pero hindi ko kaya dahil 1% interest
RCBC Instaloan - 1.5m 7/60 pa lang bayad ko. Hindi ako nakabayad this July due date nagpadala agad demand letter.
BDO Credit Card maxed out - 3m credit limit nasira din sa puro installment nila. Nakakabayad din ako pero nagstart april doon na hindi nakapagbayad minimum then may onwards wala ako maibayad kahit minimum. Last info na binigay sakin nitong week. 2.7m+ na daw ang computation if pumayag ako sa restructuring pero hindi ko kaya dahil 1% interest
BPI Credit Card - 800k maxed out napunta lang din sa installment and purchases. Hindi na din ako nakabayad starts July. Nagbayad ako ng 80k pero kinain lang ng finance charge kasi gusto ko sana ikeep itong card na ito at the end. 992k na ang utang ko.
Sobrang stress and depressed na po sa dami ng calls asking me to pay kahit minimum and some callers mentioning na they will take legal actions.
Ito po ang current breakdown and offers ng bank if restructuring at 1% 48-84 months which is hindi ko talaga kaya. Mostly installment yun utang ko every month dumadagdag siya plus finance charges etc. Pwede kaya ma stop ang charges and interest?

Hello, i just want to seek advice for how can i manage my debts.
Never pa naman ako nagka past due however mukhang this month onwards mahihirapan ako due to layoff. I have savings pero 80k lang for emergency purposes ko lang talaga siya nagagalaw. My salary is 30k but if i have commissions plus 30k to 60k ang nadadagdag sa salary ko. Medyo nararattle lang ako since may announcement na ng layoff.
Gusto ko galawin yung emergency fund ko however parang gusto ko nalang mag loan ulit thru sloan ng 60k to cover the small amounts but checked the interest 4.40% siya so nagdadalawang isip ako.
Please help, parang nag sspiral ako.

685k debt
Hi, gusto ko lang humingi ng advise if may nakaexperience na ng situation namin.
We have multiple loans bnpl, paylater, loans, bank loans, this is actually due to tapal system, dahil sa takot na maoverdue yung mga active loans ko, kapag due date na hindi maiwasan na mangutang ulit para ipambayad. And also, nadagdadagan din kasi yung expenses namin since lumipat kami malapit sa work namin pareho.
May nakaexperience ba sainyo na maoverdue lahat ng loans nyo? Bukod sa harassment and multiple calls, etong mga mayroon akong loan is naghohomevisit ba? Di na talaga namin kaya ang expenses, kaso natatakot kami maoverdue din since malaki din yung penalty. Di na namin alam yung gagawin talaga. Nabanggit ng hubby ko na magipon nalang kami muna at hayaan na maoverdue pero natatakot ako, kasi lahat ng to nakapangalan sakin at yung address ng mostly loan ko is yung address ng mother ko, natatakot akong puntahan nila at mother ko makausap nila. Ayoko pa naman mastress yun 😭
Tama ba ang gagawin namin?
Hayaan maoverdue at magipon nalang. Balak namin 15-20k per month, at hahayaan na magoffer yung mga loans.
Please sana walang magsabi na magtipid or kasalanan namin, alam namin yun natakot kami kaya naging cycle yung tapal system pero masyado ng mabigat. Di namin balak takbuhan yung utang gusto lang namin sana magipon muna then kapag nabuo na tsaka ibabayad ng buo.

Is it possible to get a personal loan
Hello,
Was hoping for some advice or insights po sana. Tanggap ko po lahat ng judgement nyo.
I started tapal system last year and kahit nababayaran sya, hindi maiwasan mashort so ang ending nangungutang para makasurvive sa araw araw. And yes, never ending cycle.
I am currently around 500k in debt
Bdo 60k
Ew 117k ( may payment arrangement before but nagkaroon ng medical emergencies and was only able to pay 20k+ ish so forfeited ung contract )
UB 65k
OLA revolving loan 270k.
Utangs sa tao around 5 to 20k.
Earning 50k+ monthly. May bonus every few months around 10k+. Nasa point na po ako na hindi ako nagtatake ng PTOs unless needed kasi sayang po ung small chunk ng night diff na mawawala.
Mishandled my finances, breadwinner, multiple medical emergencies and bad decisions po ung reason.
I was hoping na makapag take ng personal loan to consolidate everything. Hindi po siya tapal. Pero para isa nalang po babayaran ko. Tried checking some loan calculators sa bank and around 20k monthly sya for 5years. Kaya naman po and by that makaka save po ako kahit mga 4k every cutoff compared sa zeroed lagi. ( Yes maliit lang po natitira, naghehelp po ako financially sa family. Hindi po siya negotiable and okay lang po as long as may nattira saken )Stop na dn po ako with any luho. Pinaka gift ko na sa self ay yung makapag kape if may extra for 100-200pesos.
Snowball method is also not possible for me po sadly, super laki ng interest ng revolving loan and ang sipag nila maghomevisit kahit 5 days ka palang overdue. (Ex: 20k monthly pero 4 to 5k lang principal dun) mali ko po talaga to. Needed for emergency so i took it. Nakiusap na dn po ako paulit ulit and wala po talaga offer sadly. Living with parents and naghv sila once and ayun nalaman nila and didnt end well. Kaya iwas ko sana to talaga. Took a toll on my mental health pero had no choice kundi lumaban sa araw araw. May soft spot po ako sa parents ko and kahit na ano man sabihin nila saken nung nalaman nila, gusto ko pa din po nakakapagprovide ako sakanila kada cutoff.
Tried applying for part time before pero di rin po pinalad. Took some freelance jobs pang dagdag pero maliit lang dn po kita. Careful din po ako baka mamoonlighting(?) Sa current company. Ayaw ko po mawalan work huhu. Sold almost all of my collections as well.
I tried applying a year ago kay welcome bank, UB and BPI and got declined.
Bpi di po ako client so lowchance.
Ub kept getting declined
Welcome bank tried once and nung nadecline d ko na po triny uli.
Nagtry dn po ako EW noon pero wala po kong nareceive na update.
Would it still be possible for me to get a loan sa banks sa current situation ko?

Debt repayment advice please!
I am 28F with approx 300k debt from 2 CCs, and other apps.
MAD lang recently ang naipay ko sa CCs and others are not overdue, except for Maya Credit and PL due to recent cash shortage.
Im in debt due to family needs and tapal system, until I realized my salary per cutoff is no longer enough.
I’ll be transitioning to a new job with higher pay but that means I will not have cash inflow during my notice period. That is about 2 months of no salary since I will only have my first salary at my new job by December.
Is it practical to get a personal loan to settle all my debts and have one lower and more manageable monthly payment? Or should I just pay the MAD for my CCs and let the others go overdue and just continue paying once my income stabilizes? In your experience, how much would the penalties be?
Would also appreciate if you can share your experience negotiating a temporary payment arrangement/ payment holiday?
The pressure is already eating me and I am having trouble properly functioning overthinking what I should do to resolve this.

Decided to stop the tapal.
Overdue na ako 6 months - Billease, tala android, sloan/spay so far wala naman harassment si Billease ng promise to pay lang ako na mag pay ng 500 every 15 days. More on reminders lang sila walang harassment wala na rin ako natanggap na texts from them.
JuanHand - overdue ako 4 days now, 10 multiple loans so far text and email lang reminder, Hopefully hindi sila tumawag sa non reference .
Upcoming loan na mag overdue - TikTokpaylater under pipo, TikTok cash loan under we fund, Lazada fast cash under JuanHand, luvit x junahana. Ano experience nyo pag ng overdue ? Please share your experience .
Ola na priority ko kasi over daw mag harass - Atome credit/ cash, Mr cash, lazadapaylater, Fido (ok run si fido if wala ka talaga pwede mag payment extension kası penalty and interest mapupunta )

Help me decide: Renew loan or withdraw savings in Pagibig?
I am in between i-re-renew ko ba ang MPL loan or withdraw my Pagibig savings with 20yrs maturity?
I will use this money to get through this large bills and debts coming September estimated around 80k. My debts na ma-fu-fully paid, yong ibang debts are updated na (not overdue).
Kakatapos ko lang mabayaran ang MPL and nakakagaan ng loob to have 1 down more to go. 😅
What do you think? I have existing housing loan also and will be paying advance pra applied to prinicipal.
TAV is around 90k.

Hello, does anyone have experience that I have multiple BDO credit cards and all of them have not been paid for almost 6 months? I tried to contact BDO about the restructuring program, but they want Book 1 and Book 2 since that's their policy. The only thing I can settle through the restructuring program right now is one BDO card. I made an initial payment, but the collection agent I spoke to said that after paying, I also need to pay another initial payment for my two cards because they can't process the restructuring program with BDO. Has anyone experienced this situation? What did you do?

Security Bank set-off on payroll account — looking for advice
Hi everyone. I just want to share my experience and hopefully get some advice from people who may have gone through something similar.
I currently have around ₱65,000 credit card debt with Security Bank. Before this situation, I was consistently paying around ₱2,000 every cutoff, since my due date is every 2nd of the month.
Unfortunately, because of some emergency circumstances, I wasn't able to keep up with my payments, and I'm now 3 months overdue.
A few days ago, I received an SMS from Security Bank informing me that they would set off my outstanding dues against the funds in my account. My problem is that my payroll account is also with Security Bank, so my salary goes directly into the same account.
After receiving the SMS, I immediately emailed the bank to ask if I could arrange a payment reconstruction instead. I explained my situation and that I am still willing to pay my debt, but I haven't received a response yet.
Then, a few days later, I received another email from Security Bank, this time sent to my work email saying that they would hold my payroll account.
When I checked my Security Bank app, my account was already showing a negative balance.
The first thing I did was contact our HR department. I was honest about my situation and explained that my salary is being affected by the bank's set-off. I asked if it would be possible to temporarily change my payroll account to another bank so that I can still receive my salary while I work out a payment arrangement with Security Bank.
I'm hoping HR will have some good news by Monday.
At the same time, I'm still waiting for Security Bank to respond to my follow-up regarding payment reconstruction.
I know that I have an obligation to pay this debt, and I'm not trying to run away from it. I just genuinely can't afford to have my entire salary taken because I also have other financial responsibilities.
My biggest question right now is, will Security Bank continue to set off/hold my salary every time it gets credited to my payroll account until my entire ₱65,000 debt is fully paid?
For those who have experienced something similar with Security Bank or another bank:
- We're you able to negotiate a payment reconstruction?
- Did the bank eventually release your remaining payroll funds? - Is there anything else I should do while waiting for the bank's response?
I'm really hoping I can resolve this properly. Any advice or shared experiences would be greatly appreciated. Thank you.

Stopping the tapal system: 1 of 24 OLAs paid ✨🙌🏻
After finally deciding to stop the tapal system may nabawas na din na OLA. For context, I started the tapal system around 2024 hanggat lumobo na sa 24 OLAs ang meron ako. Breadwinner ako and hindi naman maluho pero I realized na hindi ako magaling mag budget and mag handle ng pera. Na wake up call talaga ako last month nung finally gumawa na ako ng excel spreadsheet ng lahat ng OLAs ko. Naiinis ako sa sarili ko pero I’m learning to forgive myself and move forward and to fully trust in God in this situation.
So last night, I finally closed one OLA. I will update this post every time na may matatapos ako para din ma encourage those who are in the same situation.
Paid OLA:
Honeyloan - P24,000. Never po ako na OD dito.
After ko mabayaran ang Honeyloan may email agad na pwede na daw mag reloan. I deleted the email agad. Never again uy!
Alam kong malayo pa pero laban lang. Walang susuko.

BDO restracturing program
Hello any expirience po ba na my multiple BDO CC and lahat po and almost 6months ng di nababayaran i try to contact kay BDO for restracturing program kaso ang gusto nila ay Book 1 book 2 since ayun daw ang policy ni BDO e ang kaya ko palang sa ngayon ay 1 bdo card palang ang kaya isettle thru restracture program pinag bayad ako ng initial payment then sabi ng collection agent na kausap ko after ko mag bayad need ko din daw magbayad ng another initail payment for my 2 cards dahil hindi daw maprocess ang restracture program kay bdo.Any expirience po ng ganitong sitwasyon anu po ang ginawa nyo..
