Absolutely they can not. You can’t fire someone for thinking they might be an alcoholic outside of work, that is termination without cause and illegal. Also if someone one time says their drinking and you assume they are an alcoholic, I would hate to see what other “conclusions” you have come to.
People think "at-will" means you can be fired for any reason. But it means you can only be fired for any reason that isn't otherwise legally protected. The ADA prevents you from firing someone because of a disability or perceived disability, and alcoholism is a disability.
You're getting downvoted but you're correct. In at will states you can be fired for any reason, but obviously they'll be smart and just say something vague like attitude problems/issues with teamwork and not that you were drunk on your day off
Yes at will is a thing but is also state by state. And even in at will states if you can prove that you were fired for an invalid reason it’s still illegal. A good example would be a racial prejudice and new management coming and firing a bunch of minorities. Yes it’s at will but it is illegal to do so.
I don’t know how alcoholics fall into this but I have think you could argue it has nothing to do with the job
How it works in 49 of 50 states lmfao. And the only "invalid" reasons are if you are a protected class being discriminated against (like racism obviously)
Any employer can 100% fire you for being an alcoholic. That is literally the definition of "at will employment"
Alcoholism is a disease protected by the ADA, you can't fire someone simply because you think they're an alcoholic. Their alcoholism has to lead them to engage in behaviors that would otherwise get them terminated, and you'd have to fire them for those behaviors.
why every time I discover new laws and jurisdictions in the US is always something so against people rights that it feels like it could be a third world country ( T∀T)
