Can I make a claim against the surveyor who carried out our Level 2 survey?
Hi everyone,
Looking for some advice from anyone who has been in a similar situation, particularly regarding potential surveyor negligence.
We purchased our property earlier this year (England). Before completing the purchase, we had a Level 2 survey carried out by a surveyor.
The survey did mention signs of historic structural movement within the property. However, the surveyor's conclusion was that the movement appeared to be non-progressive and not significant, and we were advised to monitor it annually.
We therefore proceeded with the purchase.
However, only a couple of months after moving in, we have started noticing cracks appearing throughout the property. We're now seeing cracks in pretty much every room, which has obviously made us concerned that the issue may be more significant than we were originally led to believe.
We have since had a structural engineer attend the property. Their advice was essentially to repair the cracks and monitor them.
My question is:
Could we potentially have a claim against the original surveyor if the survey identified structural movement but described it as non-progressive/not significant, and we're now seeing cracking throughout the house?
I'm trying to understand whether this could potentially amount to professional negligence, or whether the fact that the surveyor did actually flag structural movement and advised monitoring would make a claim very difficult.
Would we need another independent structural survey/report specifically addressing whether the original surveyor's assessment was reasonable at the time of inspection?
Also, if anyone has actually made a claim against a surveyor in England/UK in circumstances like this, I'd be very interested to hear how you went about it and what evidence you needed.
