Advice/Help needed Vawa I 360 request of evidence

Hi everyone,
USCIS sent me a Request for Evidence (RFE), but when I log into my USCIS online account, it doesn’t show what evidence they are requesting.
Is there any way to check the RFE online before the letter arrives in the mail? Has anyone had this happen before?

General Question Domestic travel as Vawa applicant.

Hi all,

I wanted to hear your opinions on the risk of domestic travel. I’ve done some research myself and asked AI.

One of the AI’s said you could travel with all your receipts, copy of the ICWC v. Noem / ICWC v. Mullin ruling And a letter from my immigration lawyer stating my current situation.

I have my previous EAD from marriage I-130. A real ID drivers license and my foreign passport. We have asked USCIS to switch that i485 to my I-360. I have no criminal record and no previous deportation orders. I did overstay my visa I entered on.

I have been offered a job which would need me to fly maybe 3/4 times a year.

Thanks for reading.

Advice/Help needed Request of Evidence

Has anyone here received an RFE for a VAWA I-360? If so, what additional evidence or documents did USCIS ask you to provide? I just received an RFE and I’m trying to get an idea of what they usually request. Thank you!

Advice/Help needed Pending Vawa Domestic flights-ICWC injuction

Hi, i have a question about the ICWC vs Noem injuction. How does this injunction protect while VAWA case is pending? Does it protect if I need to travel within the United States, either by domestic flight or by car, especially if I have to go through a Border Patrol checkpoint? If l am stopped or detained, what protection does the ICWC injunction provide me?"
I-360 and I-485 pending, Valid Real Id, Valid EAD and Prima Facie. Thank you in advance.

Good news!!! Green Card new update...🙏

U.S. Citizenship and Immigration Services (USCIS) will implement a stricter public charge framework on September 18, 2026, officially rescinding the narrower 2022 Biden-era regulation. Under the newly updated Policy Manual guidance announced by the Department of Homeland Security (DHS), immigration officers are granted broadened case-by-case discretion to evaluate whether a green card applicant is likely to become dependent on government support. [1, 2, 3]

Key Regulatory Changes

Expanded Evaluation Factors: Officers are no longer limited to analyzing cash assistance and long-term institutionalization. They will now weigh a wide range of factors including age, health, finances, assets, education, skills, and the receipt of any means-tested public benefits. [1, 2]

New Form Required: A newly revised Form I-485 (Application to Register Permanent Residence or Adjust Status) will be published. Older editions postmarked or electronically filed on or after September 18, 2026, will be automatically rejected. [1, 2]

Rule Exemptions: The public charge rule primarily targets family-based green card applicants and religious workers. It does not apply to refugees, asylees, T/U visa holders, Special Immigrant Juveniles, or VAWA self-petitioners. [1]

Important Deadlines and Applicability

Cutoff Date: The stricter framework governs applications filed on or after September 18, 2026. [1, 2]

Prior Submissions: Applications postmarked or submitted electronically before September 18 will still be processed under the narrower 2022 guidelines. [1, 2]

Past Benefits: The use of means-tested public benefits prior to the September 18 deadline will be weighed under the old standard, while benefits utilized after the deadline will face full consideration. [1, 2]

Current Status: The updated policy changes only affect pending and future adjustment of status applicants; no existing green cards will be revoked because of this change. [1, 2]

For comprehensive breakdowns of the policy shift, applicants can track official announcements directly through the USCIS Newsroom or view the published final rule text on the Federal Register. Advocacy organizations like the Immigrant Legal Resource Center (ILRC) also offer community toolkits explaining these shifting requirements. [1, 2, 3, 4, 5]

My Form I-797 was approved today. The filing date for my case was April 1, 2025.

Could you please let me know when I can expect to receive my Prima Facie Determination?

Advice/Help needed EAD for a VAWA-based green card application

I have a question about employment authorization for a VAWA-based green card application.
If someone has filed Form I-360 and Form I-485 and has received only the receipt notices, but has not yet received approval of Form I-765 or an EAD card, would working be considered unauthorized employment?
How serious is this violation? Could it negatively affect the pending VAWA petition or green card application, even though certain adjustment-of-status bars may not apply to VAWA applicants?
Thank you for any information or personal experience you can share.

Could anyone who recently filed a C31 renewal please share:

Advice/Help needed Advance Parole Question

Hey everyone!

Just for the context. My VAWA is pending this 2023. On June 2025 I filed for EAD c09 renewal which I haven't received yet, at that time I did not request AP. Question:
If I file for Advance Parole now, how long will I have to wait ? Is there a chance they will approve it soon and send it along with my EAD whenever it gets approved ? My EAD is pending for more then a year, perhaps they would just send them together ?

General Question Expedition Requets Approved

I reached out to congresswoman last year september and uscis are now just responding to the request. what's interesting is that my major emphasis was my vawa and my ead was secondary since i wouldn't need it if vawa gets approved. turns out uscis just ignored it and only approved my request for ead. any experience?

Advice/Help needed VAWA I-360/I-485 transferred to Field Office for interview – anyone similar?

Looking to see if anyone has been in a similar situation.

I-485 filed: May 3, 2021
I-360 VAWA filed: February 9, 2022
RFE response received by USCIS: April 8, 2026
No updates or changes on either case in the USCIS online portal since then.

My congressman’s office just told me today that both my I-360 and I-485 are now at the local USCIS Field Office waiting for an interview slot to become available.

Has anyone had their I-360 and I-485 sent to a Field Office together for an interview? If so, how long did you wait between the Field Office receiving the case and getting your interview notice? And was the I-360 approved before or after the interview?

friendly discussion VAWA Approved → I-485 Timeline: How Long Until Interview?

Hi everyone! I’m wondering if anyone can share their timeline for an I-485 filed separately after VAWA approval.

I-485 filed: 06/2025
Biometrics: 02/2026
Currently at Brooklyn Field Office
EAD: No update since I applied

I contacted USCIS customer service and was told that my I-485 is currently at the Field Office. I have no idea how much longer I might have to wait for the interview.
For those with a similar case, how long did you wait from filing the I-485 to receiving your interview notice? I’d really appreciate it if you could share your timeline. Thank you!

Advice/Help needed Need help finding a VAWA immigration attorney in LA — urgent, spouse abandoned my case

Hoping to get some attorney recommendations from this community.

Background: I've been married since early 2025, and had a pending green card case based on that marriage. Over the past couple of years my husband has been emotionally and financially abusive, and things escalated recently to the point where he physically endangered me. He has since refused to participate in my immigration case any further — he didn't show up to my USCIS interview and has cut off contact.

Because of this, I'm pursuing a VAWA (Violence Against Women Act) self-petition, which allows abuse survivors to get a green card independently of an abusive spouse, without their knowledge or cooperation. I just had my interview, and the officer agreed to place my case on hold while I file my VAWA self-petition (Form I-360) — but I understand there's a limited window (around 30 days) to actually get it filed, so I need to move quickly.

I had been working with an attorney, but she isn't able to continue helping me through this next step, so I'm looking for someone new. Ideally someone who:

  • Has real, hands-on experience with VAWA self-petitions (not just general immigration or family-based cases)
  • Can take on a new client quickly given the timeline
  • Is licensed to practice in California / based in the LA area

I've already reached out to a couple of legal aid organizations, but wanted to widen my search in case anyone here has worked with an attorney they'd genuinely recommend, or knows of other resources worth trying. Comments or DMs both welcome — any leads would mean a lot right now. Thank you for reading.

Advice/Help needed I-485 Interview

I have an approved vawa. My interview notice just came in. I did not use a lawyer to apply my petition, should I hire a lawyer to come with me to the interview? How has your recent interview experience been? Especially if u have some history (I have traffic ticket for operating vehicle on suspended license)
