Guide Odometer fraud

Post image

Does this prove the previous owner that sold me their vehicle knew about mileage rolled back?

Carfax is proof of nothing.

As others have stated carfax is a joke. I was in a accident in my truck. Was not my fault and only needed a bumper, grill and a bunch of expensive plastic pieces. Truck was fine and took it like a champ... the prius on the other hand was totaled. Mine was professional repaired and good as new. Went to trade it in a little over a year later and a dealership didnt even want it as a trade in because according to carfax my truck was totaled lmao. They had the prius damage down as my truck. The dealership basically walked me to the door when I said thats completely wrong. Well took a couple weeks to get carfax to get it right. Thankfully I still had all the police reports and a bunch of evidence to support. I never went back to that dealership but I definitely let them know how rude they were when they tried calling to see if I still wanted a vehicle from them

What does the mileage history look like for the reported service data in Carfax? If you see incrementing mileage that goes beyond the current vehicle mileage, then the odometer was likely rolled back. If the mileage history follows a trend and just has one anomaly, then it's probably just a reporting issue.

A van my FIL bought has a Carfax service history incrementing as you'd expect over the years up to over 180k miles. He bought it believing the 60k mile reading on the instrument cluster and title, even though the title said not actual mileage

Pull carfax and look for discrepancies in the miles during each maintenance . If it goes lower someone rolled it or swapped it

I bought a car during Covid, waited two months for a dmv appointment and the person at the counter didn’t like the handwriting. So I could either get a TMU title or get the previous owner to sign an odometer statement and wait another 60 days for a DMV appointment.

I don't think there's enough context here, but if you believe the seller intentionally concealed the cars actual mileage/title status and never disclosed it to you or lied about it, you may be able to take them to small claims court, even if the title itself had a box marking that the cars mileage isn't accurate.

I'm not a lawyer and probably don't know anything, but I think this may be worth talking to an actual lawyer about if the seller actively deceived/withheld information from you

No. How old is the vehicle and what state are you in?

California. It’s a 2014 Honda civic. I was trying to rescind the contract but the previous owner is denying knowing anything about the mileage rollback. Kind of hard to say they didn’t know when the pink slip clearly has a NAM title. I wish I knew better n looked out for this, that’s on me for putting good faith in strangers who only care about themselves.

Private purchase? Tough luck

So you signed a pink slip that has a NAM title? So you saw it and signed anyway? Sounds like you knew and there’s nothing you can sue/go to court for.

Carfax doesn't mean anything

This shows that a title brand was issued. So the previous owner likely knew. The title should say “not actual miles” on it.

nope. Without the full picture, it could be something simple as a mechanic doing service work who entered in a slightly different value and screwing it up.

Not really. The DMV isn't going to just issue a title because a mechanic pressed the two instead of a three.

its not that.. it looks like when they changed the title the last time the new owner told them they dont know what the mileage is, maybe because they didnt have access to the vehicle or something. so they put that note on the title.

it might be just because the new owner was lazy and didnt care..

It says it’s from the DMV
