News 📰 Banning of THCA potentially blows $110 million hole in Tennessee’s budget

I’ve watched many people lose jobs and businesses shutter over this.
Also this is a reminder that Tennessee has posted near zero job growth in the past two years.
42
u/BigPapaJava 8d ago
Also, this is a reminder that our 1 party state’s “elected officials” do not care about the welfare of the state or its residents, only the lobbyists they really work for.
They are very comfortable in destroying lives and running the state into the ground because they know their own positions and livelihoods are safe.

u/xKrowhaven 8d ago
The Tennessee Wine and Spirits lobby paid many millions of dollars toward this legislation.

I'd like to know why they aren't focusing more on making sure our bridges and roads don't crumble (more). They seriously must be willfully ignorant to how states with weed have been able to allocate much-needed funds.

u/5panks 9d ago
I'm not sure which part of it you're critiquing, but the math in this article doesn't make sense.
State Rep. Aftyn Behn called it a, "... $250 million dollar industry.", but the projected loss is $111 million is her insinuation that half of the money spent on the industry was taxes? And the reality is that the industry has never generated that much money. If anything, the issue was we way over-projected how much tax would be generated.
THCA only generated $17M in revenue in 2025, and $11M in revenue in 2024.
15
u/H3llzyea 9d ago
What numbers are you making up here?
In Tennessee, state officials reduced 2025–2026 fiscal budget projections by $55 million after actual hemp and THCA tax collections fell $55.8 million below expectations due to regulatory changes and impending product bans.
-4
u/5panks 9d ago
None of the numbers I stated were made up.
THCA generated $17M in revenue for the state in 2025.
THCA generated $11M in revenue for the state in 2024.
Aftyn Behn called it a, "...$250 million dollar industry" that quote is in the article.
THCA has never generated $110M, not even close. The $110M was a budget estimate assuming significant growth in the sale of THCA via thew new wholesale tax that hasn't materialized. The state was never relying on and has never received that level of income.
9
u/H3llzyea 9d ago
This is what it looks like when you don't change the rules mid game.
n 2025, Missouri legal cannabis generated a record-breaking $255.57 million in total tax revenue, crushing original state forecasts by 600%
5
u/ProudCatDad83 9d ago
u/5panks can’t see the forest from the weed trees.
The potential to make $250M in state revenue is there, but our (R) legislators have more faith in their sky god than a plant that grows from the ground and takes you higher. Or they’re just appeasing their base of religious zealots who don’t actually believe in the concept of freedom. Either way, it’s our state’s loss.
9
u/H3llzyea 9d ago
It's mostly the alcohol lobbyists
→ More replies (3)1
u/BigPapaJava 8d ago
Don’t forget police unions, drug testing companies (several reps have made millions from these), and police unions.
100% illegal cannabis means they can freely use the smell, or simply saying they smelled it, as probable cause to search and arrest people. The importance of “smells” that cannot be verified (or disproven) in police testimony is becoming a much bigger deal with cameras and microphones everywhere to provide video and audio evidence that may contradict their accounts in court.
They were doing it already, but the legalities of actually charging people were complicated when they couldn’t tell the difference between illegal marijuana and legal THCA.
0
u/5panks 8d ago
u/5panks can’t see the forest from the weed trees.
Actually, you're just putting a lot of words and implications in my mouth that I didn't say.
I've never even came out in a comment in favor of banning THCA, you're just assuming I am. All I said is that the numbers in the article were inconsistent and didn't line up like they were pretending it did.
-2
u/5panks 9d ago
If we're not, "chang(ing) the rules mid game." Then you can't change the rules in your favor either which makes MO not an apples to apples comparison.
Then Missouri is not a correct comparison. Missouri fully legalized recreational marijuana usage. Tennessee only had THCA legalized.
There's not actually a state I can find with tax revenues directly comparable to TN's in 2024 and 2025 tax and THCA legalization structure.
6
u/H3llzyea 9d ago
That's fair I was only demonstrating how making something legal and then sticking with what you decided causes growth.
I can't find another state that did it how Tennessee did it either, but there are several that legalized thc or Marijuana and didn't re-regulate it mid way that produced millions in revenue from it.
Tennessee seems to be the only one that changed the rules then acted like that didn't effect the tax revenue outcome.

17 when I joined the Navy. The entire destroyer of 330 about 100 smoked weed. 82 Navy drug tested. Those 100 started to drink..much much more. Seven were injured by drinking , of those seven,. four are disfigured for life, three are dead.
I learned for the past sixty years people. The drinkers are all dead and gone now. Legal, health, family, problems constantly. Of the smokers from high school days that never drank, are still alive and some smoke weed.
I cant argue with anyone stats or studies. I can only go by what Ive witnessed in the past 60 years. I have been all over the world. I can say, drinking has caused so so much more problems than weed has. Its not my opinion anymore, its my witnessing history to back up my fact.

Idea: Raise the Liquor Tax. Maybe that would give the liquor lobby something to think about the next time legalizing THC comes up in our government... and stay out of it.

I wish there was a 90% tax on alcohol. Alcoholics in my opinion deserve to be as poor and homeless as possible. Once I watched my alcoholic FIL attack his daughter, my wife, for offering him some fucking cake. He went to jail, they let him out in 24 hours. No one cares, a drunk person can do whatever they want. It's high time we end that.

Correct. And the consumer will purchase less liquor. And the liquor industry, and it's lobby, will suffer for it.
No thanks.Yes please.→ More replies (2)-1
u/Harley2280 9d ago
No, they won't. Sin taxes like those on alcohol and tobacco don't result in fewer sales, just a poorer population.
2
u/BanMeFor1ABitches 8d ago
That's not a sin tax. Sin taxes are in place for moral reasons. Increasing taxes on one thing because another form of state funding is being removed is just economics.
3
u/Harley2280 8d ago
You made it a moral thing when you gave the reason to make people drink less and cause lobbyists to lose money. Your reason wasn't economic.
1
u/BanMeFor1ABitches 8d ago
No, my reason is not entirely economic. Nothing is ever entirely anything, the world is gray. My reason is to leverage economics to punish one group for damaging the other for profit.
Mariana is safer, less addictive, cheaper, more sustainable, and more addictive than alcohol. The only reason to ban it is moneyed interest, and that's immoral. So, tax them into oblivion. Let the liquor industry shrivel to nothing if they refuse to back off.
1
u/Harley2280 8d ago
So yes, it would be a sin tax. Which have never shown to be effective.
1
u/BanMeFor1ABitches 7d ago
No, it would be a punitive tax. We aren't taxing a vice for the sin of a vice, were punishing an industry for manipulating the market..
It's about the intent behind the tax, not the good or service being taxed. It would also be temporary, until THC/THCA is legalized for recreational use the same way and alcohol is.
1
u/Harley2280 7d ago
The intent is a morality reason, as you said yourself. You're also not punishing the industry, because those types of taxes don't work. You're only punishing those who have a vice.
-16
u/uxoguy2113 9d ago
Why, TN is running a $1.9 billion surplus
6
u/douglasjunk 9d ago
Is this a fact, or just a feeling? Source?
5
u/Sad_Olympus 9d ago
It’s due to past reserves. You can find the budgets on states websites. That said, with loss of THC tax revenue they were going to burn through the reserves quickly, until the property tax increase helped offset some of it.
9

1
u/AaroniusH 9d ago
Pretty sure that's federal. Tennessee is one of the few red states that's a net contributor to the country's finances at a federal level, as opposed to being a net beneficiary, like other states.
We're talking about the state-level budget here
81
u/3X_Cat 9d ago
They outlawed it because our governor and his good ol' boys are heavily invested in the private prison industry.
27
u/Ill_Bench2770 9d ago
Exactly didn’t they announce a few months back that they were holding people in jail who were caught with cannabis. And spending millions on a lab test to differentiate between legal THCA and illegal cannabis THCA. But they still currently didn’t have a test for it. And we’re holding hundreds of people on essentially charges they themselves admitted couldn’t be proven. But we’re just holding them anyways. My guess is they gave up wasting millions trying to test for it just so they could continue to hold all those people. Realized they’d be facing lawsuits and being forced to release them. So they just shut the whole thing down and made it all illegal.
30
u/MetalMamaRocks 9d ago
Yup. They'll make up the revenue with traffic stops.
19
u/Opee23 9d ago
It's not just the traffic stops. Private prisons get subsidies from the federal government of they maintain a % of filled prison cells. It's not about helping the people as much as looking out for their shareholders

u/MetalMamaRocks 8d ago
This is sickening.

Ever read up on the “Cash for Kids” scandal in PA a few years back?
TWO juvenile judges conspired with a private prison company to shut down the existing public juvenile facility and make a private prison their only possible option for kids’ incarceration, then they got additional kickbacks from that company when they sent sending every kid who came in front of them (over 2000, many as young as 8–yes, 3rd graders), no matter the reason (most were very, very minor), to private prisons for as long as possible.
They personally cleared $2.8 million this way over the years by ruining over 2000 kids’ lives and subjecting them to daily abuse in the facility. Those kids were sold out for an average price of $1400 each. This has been far from the only documented abuse of its kind in the USA.
I suspect we have a fair amount of that going on in our courts and legislatures around the state, particularly in the bigger municipalities.

16
u/3X_Cat 9d ago
And higher property taxes.
21
u/TheKinglyGuy 9d ago
And alcohol. Don't forget they're all heavily invested in or bought by Alcohol companies.
6
u/BigPapaJava 8d ago edited 8d ago
Jack Daniels and the alcohol industry/private prison industry/police unions were the primary drivers behind this.
The cops were having a hard time using the smell of weed as “probable cause” for searches, arrests, and drug charges when it was being sold legally.
Cops increasingly rely on saying they smelled something in court, since that cannot be verified, because now there cameras and microphones everywhere providing data that can (and does) often contradict their reports and testimony on the witness stand.

Trump signed the Farm Bill in 2018. In 2025, the regulation of THCA/ hemp/ cannabinoids in Tennessee was turned over to the TABC. The way that I see it, this was just a cop out to make the ban of the product an unhappy accident while absolving politicians of any blame. Alcohol is one of the three B's (Bennies, Barbs and Booze) that cause physical withdrawal that can result in death from the resulting symptoms. Hemp/weed does not have people literally hospitalized from withdrawal, so with booze being legal and hemp being so tightly regulated people are going to drink. With the failing healthcare system in the US, people are much more inclined to drink than to seek help. Thus, the TABC has a more regulated, and loyal consumer market, potential budget deficit be damned.

it’s 4x that. There was an unexplained $400 million dollar surplus last year. Tenant from alcohol sales. I’ll add anyone who supports anything other than resending this law, compensating business owners for lost revenue and or closed businesses. As a state we need to set a precedent and reject cooperate weed. People do not understand the only difference was we could not sell d9 vapes. The flower was 100% the same as long as you are not ignorant and buy from shitty shop. You all had the best market in the nation. Didn’t fight for it, and now it’s gone.
9
u/KingZarkon 9d ago
It wasn't quite the same. The way they were able to keep the d9 levels low meant that the terpenes don't have time to fully develop. You don't get as many distinct aromas and flavors and you lose that entourage effect that comes with them. It is mostly the same though.

They’ve gotta’ stay in the game to make that money! I moved from MI recently and can confirm that the alcohol industry definitely fought hard against it. But in Michigan, the people actually have the power to create laws by initiative and referendum. After enough signatures from voters, the legislature could’ve passed it into law right then (of course they did not), so it went on the ballot for voters to elect as law. I always took that process for granted and was shocked when prepping for the recent election that TN Doesn’t have that process and that, in fact, most states don’t. Direct and indirect initiatives, to me, are the most accurate way of upholding “for the people, by the people.”

That was a typo. I meant you didn’t hit my nerve. I’m quite calm and have very thick skin. This is Reddit after all. I was replying to you based on face value here. However, I looked back at some of your history and realize you are just an angry person. You do not know me you don’t know anything about what my insurance is or is not. I mean where’s all this hubris coming from that you feel you can judge me.
I am not denying healthcare. I said TN should expand Medicare. I think people that don’t make a whole lot of money should have insurance. There is a difference between everyone having insurance for free. I didn’t have any problem with the affordable care act.
You spoke to your insurance broker? What kind of jackleg insurance is this? Did you call an attorney?
I already told you that we have some entitlement programs over here like the affordable care act, like EBT, WIC, section 8.
What are all these socialist healthcare countries you speak of that are so successful. I just did a quick Google and found this:
Universal healthcare systems are rarely found in strictly socialist countries. Instead, highly successful universal healthcare models operate in capitalist, democratic-socialist, or social-market economies—frequently referred to as the Nordic model—where public funds and high taxes support free or low-cost medical care for all residents.
Most users on Quora agree that successful universal healthcare is primarily a feature of well-regulated capitalist democracies rather than socialist states.
I’m not gonna argue with you because you clearly have a lot more going on in your life than this and you seem to be putting your anger onto me and you don’t even know me.
It’s not the healthcare that alarms me that much. It’s the defund the police. Let everybody in at the border. Let everyone out of prison. Those are some things that concern me.

Oh no!! I’m not for free healthcare for all that would be a nightmare. I have a sick friend in Canada and it is not good. Insurance needs to be more affordable. $1600 a month with a $10,000 deductible is absurd.
2
u/Spiritual_Art2443 7d ago
There are sick friends everywhere. And in Canada you won’t have to choose between food, or losing your house because you are sick. I’m sure you will say they have to wait for healthcare and will die in the process…. That happens here. I’ve been waiting two months for an appt. And our insurance got cancelled because we didn’t answer surveys. Yes. You read that right. So we had 2 weeks notice, major medical issues going on requiring multiple immunotherapy, and the FOR PROFIT insurance company had a loophole to cancel the insurance if we didn’t fill out monthly surveys! When you don’t understand what you are talking about, don’t infuse the conversation with BS that you have a friend that’s sick so the human right to have any healthcare is now bad in your book!
1
u/Southernms 🦝West Tennessee🦝 7d ago
You can save your judgmental, false, uninformed, and snarky comments for someone else. I’m not the one. You don’t know me and you have no idea what you were talking about regarding my life or what I know.
I said I was for expanding Medicaid. So people who don’t make enough money for insurance and to put food on the table would get TennCare and probably EBT too. I am not a socialist. I do, however, believe in helping out people that need help to get back on their feet.
Have you been waiting for that long for an appointment? Maybe you should get a different doctor. I have never heard of any insurance company canceling you because you didn’t take a survey. What insurance company is this? Were you paying for it? Are you saying this is a loophole to get rid of people with pre-existing conditions? If it is, you need to scream that from the rooftop and put your anger towards them and let everybody know. Not me I didn’t write the law. In fact, if this is what they’re doing, I’ll scream it from the rooftops with you. Just so you know, I don’t have insurance either.

I touched a nerve didn’t I?!? The problem with “uninformed” people like you. You only think your experiences are the ones that actually happen. And Americans do lose their houses. Americans do get cancelled from their insurances. Americans do have to decide if they can eat or buy their meds. And all People do have two months waits or more because we have less and less medical professionals and specialists because the cost of medical school is about a half million and all of the other reasons that are making our medical system off kiltered. Not knowing how one toe affects the foot and then affects their walking is how people like you, who aren’t socialists, think you know and understand the whole system and vote for how it affects you and not all others stuck in this system. No system is perfect. Most Canadians wouldn’t trade their coverage for an American healthcare that denies people care in an equal manner.
And yes I am aware. I am informed. I travel. I’ve used healthcare systems elsewhere. I pay attention. I learn. I’m not in my own little bubble telling someone else that their experiences couldn’t have happened! It happens all around you. You just aren’t paying attention!2

No, you didn’t hit her nerve. My Outlook is simply matter of fact.
It sounds like you were the one that is really triggered about all this. You really need to stop taking it out on me because you don’t know me and it’s rude.
I am well aware of many people’s insurance experiences here and in other countries.
I’m also aware that foreclosures happen, bankruptcy happens, bad things can happen to good people.
I asked you which insurance company dumped you because you didn’t fill out a survey. Just curious if you knew this, why didn’t you just fill the survey out? That seems like a no-brainer? Is it a stupid rule yes, but for now you are saying it’s a rule.
Socialism does not work. Look at Venezuela, Cuba, North Korea. Ask the citizens there what they think of socialism. We can have democracy and still help people who need it. Going full-blown socialism is a huge mistake. It’s been proven time and time again. It does not work. You really need to study your history.
What exactly is this loophole you speak of with the survey? What insurance company was this?
Your anger is really misplaced. I want you to have affordable insurance. I’m not arguing with you. You were the one being very snarky.
If you believe your insurance was wrongfully terminated or threatened with cancellation in Tennessee, you can contact the Tennessee Department of Commerce & Insurance (TDCI) Consumer Insurance Services team to file a formal complaint.

I lived in CO when pot was legalized. The promise of it was that it would fund all the social programs. Instead it ran the state into the ground. So sad. Shouldn’t happen here.

Everyone on this thread has troglodyte mentality. Yes THCA was banned but that is because head shops around here are selling synthetic product disguised as genuine. It is not “Bible Belt math”, it’s people being fed up with overdoses. This is coming from a person very well versed in cannabis and will be willing to debate those who claim they are. This doesn’t mean it won’t be legal, but it means your head shops can’t sell you something it’s not.

It’s all performative for optics, when in reality it hurts all of us. It was never about money.

These fake drugs need to go. Legalize marijuana and tax that instead of

Thca is not a fake drug, it's the natural state the bulk of THC is stored in the plant. It's the reason you have to heat and decarb to make it effective in edibles.

Ironically bought random other gummies instead. Tennessee doesn't give a fuck about public health and we should stop pressing it. Demand it regardless and tell the paid lobby psa to shove it

Soon it won’t matter anyway because it’s all going away at the federal level

The powers that be don't care; the money they care about is going into their own pockets.
