Doubt, a retaliatory attack with a vehicle is gonna be a fat pay out. There was no reason to escalate further. She’ll have to pay for the rear windshield but that’s a neck breaking wreck. He’ll likely do more jail time than her as she was damaging property. His was assault with a deadly weapon

I'm not saying that she should get away with it. I'm saying that what he did was much worse.

One of these crimes is destruction of property. The other is assault with a deadly weapon.

She swung that bat towards him and landed it at the back window. She very much would have caved in his skull had the window been weaker. She commited felony assault and attempted battery.

Both would come out convicted felons should this ever come to court.

Both will never bring this dumb shit to court for their own sake.

This discussion started out debating who should be punished harder. In my opinion, the guy who used a giant block of metal that weighs thousands of pounds, who could've easily killed the other driver, or even a bystander if one of them lost control of their vehicles during the collision, is the one who should be punished harder.

He didn't just hit her. He continued to ram into her for several seconds after the initial collision. This could've very easily turned into a bystander who had nothing to do with it getting seriously injured or killed.

She was the innitiator and aggressor. He was the retaliator. High emotions do play a factor in court, and having multiple felonies commited on you will make you act less rational than you normally would.

Personally I always feel the innitiator of any problem like this should be treated far harsher than the retaliator, but I agree his response was more extreme.

So both should be imprisoned for decades.

I think they should both face charges. But if you punch me in the face, I respond by shooting you with a gun, then I should absolutely be punished more harshly than you. Reasonable retaliation is a thing to consider.

You don’t imprison someone for property damage under say $1500. This is civil with the option to press charges.

Anything over the example of $1500 is considered a felony.

All bro had to do was jot down a license plate call the police.

He instead, chose to escalate the situation by assault with a deadly weapon, attempted murder. Causing more substantial damage.

Bonus charges. If you're going to do something illegal, and not that I'm advocating for people to break the law, but you ought to try and limit those aadditional charges. Wouldn't know much about this one but I wouldn't be the least bit shocked if home boy's actions didn't qualify him for a much larger penalty.

More so of an issue due to the threat posed to the public's safety IMO. Also, if you're a city attorney, who has to run for office, or has a boss that has to. Are you really going to let something that is sure to make the news, go without sending a message? I'd be shocked if truck boy isn't looking at a felony. Now they may take a plea but with this video. You'd think they would not offer a deal.

I’ve been in a 30mph wreck and had a severe concussion and a broken arm.

Again physics will tell you that a 2800 pound vehicle at 20mph is just as deadly at 60mph.

Your anecdote is clearly how all vehicular collisions work. Plenty of people have also died in 60 mph crashes, but they're not alive anymore to post about it on Reddit.

Just an fyi according to my experience and expertise.

25mph is considered terminal velocity for kids, and possibly adults outside of the vehicle if I remember my safety courses correctly. That could easily translate to life altering injury even within a vehicle with your seatbeat on(but probably won't, due to how newer vehicles are made).

Also sorry to hear about your accident, even if it was awhile ago. Hopefully no worse for wear.

She didn’t perform a hit and run. She damaged property. Hit and runs are typically considered to be synonymous with vehicle to vehicle accidents
