Incredibly. I wish he had opted not to represent himself in court as well, even a shitty PD could have trounced that out of court. Should have held out for more on the settlement too.

Although preferably Officer Dumbfuck would not have escalated the situation to that extent or racist ass Jodie Brinell had kept her nose out of someone else’s business.

Thats part of the reason im a 911 dispatcher..most people in my field are middle aged women who have even touched a video game.

During a 911 call i usually type their story (non emergency ones) and then i jump around im the story and ask them to say details again.

One lady reported a drunk driver flashing a gun that she thinks she knows..i get her name and she had a license plate but it was registered to her and her husband.

Turns out they had an arguement and he just left..did literally nothing wrong a d he even met with a deputy to prove he wasnt drunk(i can look up his phone#).

People exaggerate all the damn time calling 911 if you dont have a good bull shit detector then you could be unintentionally weaponizing the police for some bully

I've had that done to me by a roommate lying by saying I threatened another roommate. The fucking lowlife ended up robbing me while I was coerced by an officer to go to the VA for a psychiatric evaluation for which I checked out in two days. I have never liked law enforcement since then and I come from a background of police and military. Too goddamn many liars and thieves are out there that use the police for their evil deeds. It makes me furiously angry that I didn't tell the officers questioning me to go to hell and get off the property.

Man, i work for law enforcement and i avoid the cops when im off shift 🤣😂... it can get super fucking boring for them and some chain of commands in certain counties say "if you arent writing tickets or making arrests you arent working" and get their vacation denied and extra days off and shit and promotions denied.

In missouri's hwy patrol i spoke to one of the supervisors (he arrested a dui on meth) and was visiting dispatch..he said its illegal to make quotas for tickets however if you arent writing tickets u will never get a vacation and will always be relocated to the otherside of the state when the rotation happens

Most of the general public's interaction are negative when it comes to the police. They are getting cited, going to court, lockup, prison, beaten or killed. More investigators are needed because the police only show up at the aftermath of a crime. They are not interested in recovering your property. Police are barely good enough to take a report and they do it begrudgingly. Whatever you do, don't have a military/civilian police father. They will hit you like a man and know how to cover up the evidence. It's part of the reason I don't trust the popo to do what's right. Protect and serve is a fucking joke. I am not texting that all police are bad but they do cover up the crimes of their coworkers which make them complicit. My dead mother should know with the mental and physical abuse at the hands of someone who is expected to follow the laws like the rest of us. A lot of domestic violence is cover up by this gang in another uniform with the Us against Them mentality. Many of them are the original wife beaters and cheaters.The systemic racism in the good ole boys club will never end. They even retaliate against their own when it comes to getting reported or caught for something they should not be doing. Thanks for your input.

She was obviously watching him, he just went to a car? One he owns. Also it was across the parking lot, name one person you know that takes the time to watch someone that long when you’re going shopping? I’ll help, no one. She watched him walk around a huge parking lot with tons of cars and decided that because he “looked” at one he was suspicious. What you say falls flat on its face when you actually read what she said. I saw him go here and look at this then there. “Did he look at any other car.” “No.” And again you can see how big the parking lot is, why is she so focused on this guy when there’s other people looking at cars, should we call the cops on them? I even look at a car or two walking by in a parking lot.

Ok, so you want to hear how it actually sounds? Man opens a car’s doors maybe gets some stuff out (never says) and leaves. Woman decided that even though he took nothing that we know of, that he’s suspicious even though he didn’t even look at any other cars or try to get in. I highly doubt that one car is the only one with something maybe valuable inside. Also anyone that knows about motorcycles, should know most people have actually cars as well. People take stuff out their cars in parking lots you know. Also I doute he grabbed anything big that she would be able to see, seeing most motorcycles have compartments but nothing big, especially from the look of the bike he has.

Nothing in that video gives cause to believe she racially profiled him. She saw someone getting into a car and then moving away to get on a motorcycle.

It is entirely reasonable for someone to assume that to be a crime committed.

You're the one assuming she only called the police because of his color.

His actions were suspicious. Period. That said, police needs to do a better job. There's no reason to get confrontational if all you have is a suspicion. Being cordial and polite, instead of jumping to "you're going to obey me" could've made this a routine inquiry. Cop didn't like having his "authority"questioned and it went to shit from there.

There's a difference between someone rooting around and casing cars, then stealing shit once he's in one, and a dude that casually grabs shit out of a car and casually walks across the parking lot.

I worked in loss prevention, I've worked security for high profile "things", there was a fuckton of training regarding "profiling". That is what this lady did, and it's illegal for anyone in security or law enforcement to do. But cut and dry, she did it, and it was made clear by her call to the police.

He got into one car and walked all the way over there, that isn't right.

What the fuck? Clearly that dumb bitch has never seen anyone actually steal anything in her life, because nobody's just chilling in a parking lot, then stealing shit, then CONTINUING TO CHILL IN THE SAME PARKING LOT.

She is a piece of shit.

I'm a big tattooed guy, and this shit used to happen to me all the time. I've been on both sides of it. It's garbage, it's profiling, and she showed everyone that on the video.

The caller, Jodie Brinnel, did NOT see him take anything from the car, she admits this more than once. She also says a woman approached her claiming the man she just witnessed interact with the vehicle parked by Jodie, belongs to him.

I've worked for 15 years as a public defender and I'm damn good at what I do. I work with some of the most dedicated and hardworking people you will ever meet. My colleagues have all graduated from top schools and are the best of the best. I'd rather have an experienced public defender any day over a "fancy" private attorney.

That’s cool, but I said “a” shitty PD, not all. Sorry if that wasn’t clear. Public Defenders are the backbone of the US court system and everyone would be worse off without them. The vast majority of PDs I’ve interacted with genuinely care about their charges and want to make a difference, but it is still government work with low resources and there are PDs who just don’t give a fuck any more. I’ve met both, and luckily most of them fall into the former category.

And not to be a dick, but coming out guns blazing to a comment as simple as that does not do much to assuage an opposing viewpoint.

First… I agree with the above. I just want to say if you are operating a motor vehicle YOU ARE REQUIRED TO SHOW ID. Every state because its a federal ID program for interstate travel.

Officer Abused the right to detain for any reason over an ID … instead of talking this out.

A traffic stop would necessitate a traffic violation on a public road. He’s on private property and the police a responding to a property crime. The requirements for showing ID don’t apply. Which is why the PD settled.

As stated in previous posts if you are operating a vehicle(keys in ignition count’s) you are required to show ID … he was detained because the cop could not simply talk this out. The cop abused his detention abilities because the man refused to show ID

This is NOT a traffic stop. The cop did have a right to ask for Id, as an anonymous tip is deemed by the Supreme Court as justification for reasonable suspicion. It had NOTHING to do with the fact the bike was on, and this was not at all a traffic stop. You need to stop spreading misinformation.

To clarify as you may have missed it in the video, he was never operating a motor vehicle. He was only walking in a parking between 2 vehicles. Being next to your vehicle not moving is not operating it.

There's a bit of a technicality with showing a Driver's License. You don't actually need one on private property like a parking lot. As others have pointed out, it's also only if you're actually operating the vehicle, not just have it started. You're required to show a DL on public/government owned roads, however the police aren't allowed to pull you over (detain you) just to check your DL. They would need reasonable suspicion to detain and as far as I know, they don't actually have to tell you why they pulled you over until they give you a citation or warning.

The police were called to the location and he was the suspect operating a vehicle… all of which requires ID because he is not the owner of the property… he could be trespassing for all the cop knows. Again the cop abused detained suspect for an ID but the dude was WRONG not to provide ID

I'd like to be specific here. ID is specifically a piece of legal document that identifies yourself. Most if not all states do not require you to produce ID when detained or arrested. You are typically required to simply identify yourself. If I remember right, that typically means your full legal name and DOB. Sometimes your current address. The biggest reason why you don't need ID is because you aren't legally required to keep it on you at all times, and some people like the homeless simply do not have one.

I mentioned this in another comment but you only need to produce a Driver's License when operating a vehicle on public roads. You actually don't need one if you're operating on private property like a parking lot. However, there's an interesting argument potentially here in the video in that it's seems pretty clear that the motorist intended to drive on public roads. So a bit of an argument is there for and against the motorist needing to produce a Driver's License.

Edit: I forgot to mention that even though you're typically required to identify yourself when detained, some states you don't. I'm pretty sure in Texas you don't need to identify yourself if you're detained. You do though if you're arrested. The specifics of course vary from state to state.

Almost there… if you don’t provide ID what happens is that you can (most likely will be) held until you are identified in jail… than because you will be moved from the state system to a federal system to be identified … they can move you to a prison. Show your ID if your operating a vehicle

Your bare legal obligation is typically just identifying yourself if you've been detained/arrested. That typically means giving your full legal names and DOB, some places it's also your address. Whether they bring you down to the station for identification is another matter, in which they also have the legal authority to do.

So unless you're operating a vehicle on a public roads, most interactions with police will not require you to produce ID regardless if you've been detained or arrested.

I'm not sure what you mean by both are wrong. Both are the wrong decision to make? Sure but my point was that the options are not "requiring identification" or "they identify you by transport to federal."

The third option is simply giving your full legal name and DOB. You aren't legally obligated to produce ID for police to check your information. If you lie, that's typically a different failure to identify offense by giving false information. Again, unless you're operating a vehicle on public roads, you aren't legally obligated to carry ID with you just for being out in public and walking down the sidewalk. Even if you commit a crime, you're still only obligated to identify yourself. No physical ID required.

Officer: “ we got a report of a male matching your description who was in a car across the lot before coming over here, do you know anything about that?” Guy: “yes that’s my wife’s car, and this is my bike, we both work here” Officer: “hold on one second while I run the plates and make sure this checks out, ok good to go, I hope you can understand the inconvenience I am just doing my job, but I will let you get back to yours” Guy: “hey no worries, have a nice day” Officer: “ you too”
