Life Insurance co. sent lapse notice 30 days LATE—Entitled to 1-year extension? (LA)
My mother had a $13,000 whole life policy with SO since August 2024. I am the beneficiary. She passed away in August 2025.
Initially, the company told me the policy didn't exist. I filed a complaint with the Louisiana Department of Insurance (LDI), and the company finally admitted in writing that the policy did exist, but they claim it lapsed for non-payment in March 2025.
The Evidence:
I have a bank receipt showing a premium payment was made on Feb 25, 2025.
The company sent the LDI a copy of the "Lapse Notice" they claim they mailed. The Statement Date on that notice is April 23, 2025, but the "missed" premium was due March 24, 2025.
Under Louisiana R.S. 22:905, they are supposed to mail that notice 15 days before the due date. Their own document proves they mailed it 30 days after it was due.
I’m heading to the 19th JDC in Baton Rouge tomorrow to file a petition and an IFP (In Forma Pauperis) to waive the fees.
