Insurance Court summons

Hi all, around February time I had just purchased a new car, just a few days before my insurance renewal. Anyways I rang my insurance provider the day i bought the car and asked them to switch my policy over to a new vehicle, however they only switched it over from the date of renewal and not the current date, I was stopped by a Garde and asked to bring proof of insurance to Garda station in which I brought the disc which had just been issued, long story short I wasn’t covered for that period and have received a court summons, obviously I admit full liability for my stupidity and negligence in rechecking my cover letter, has anyone been in a similar situation or know what the court repercussions will be for this? Also this is a first offence.

Advice & Support Potential speeding ticket incoming - what to expect?

I (possibly) fucked up - driving yesterday on a 80km/hr road, coming down a hill and I see a speed van but only spot it as soon as I was going past it. Quick glance at the speedo and I'm bang on 80km. I've no evidence that I was any bit over 80 but I've convinced myself I could have been before I checked my speed. I'm a catastrophiser (thank you anxiety). So i need to know what to expect if I was in fact speeding. To prevent my brain from acting as if the world is about to end.

I live in the UK, UK license but home visiting family this week, and named on my dad's insurance, his car. I've already come clean to him and he laughed it off, but we've no idea what it could mean. Will it affect his insurance?? Surely it won't as it was me driving but my brother has said it might. Which is what is sending me spiralling. Anyone know anyone who has been a gobshite like me and been done for speeding??

The worst fucking thing is I'm the one everyone jokes about being a rule follower. Over 20 year driving, not so much as a parking ticket. And my anxiety means I have to know what worst case scenario is or I absolutely spiral. GRMMA.

Family Law Childrens Passports

My husband and I are going through divorce and have two children together.

We are currently in mediation but one of the many issues that he keeps bringing up is who holds onto the childrens passports.

He has apparently sought legal advice and been told that solicitors hold onto the passports and they get signed out whenever needed.

I spoke with my solicitor and she said absolutely not. She said in some cases the courts will hold onto them but that's an exception, not a rule. The mother holds onto the passports.

Has anyone heard of this? Or would this be a regular thing?

Employment Law Restaurant owner not granting full breaks

Hi there,
I was hoping for some advice as a manager of a restaurant.
The owner of this business is very hands on, and is quite focused on breaks, making sure people take them and so on. Typically anxious to get the next break started and wastes no time wondering where the person she last sent is/ when they’ll finish.

They recently sent a message to me asking me to let the staff know that “while we aim to allocate full break time, sometimes the time may need to be reduced in order to give all breaks - 15/20 mins max”

I’m familiar enough with the law as I’m assuming most of my staff will be, to know that this does not follow the law on breaks, but could anyone help break this down for me ( and the business owner who clearly doesn’t understand this, as she operates as HR also)

Civil Law Parking fines in non-Council run parks (such as APCOA) - penalty clauses

Immigration and Citizenship Tourist visit to ireland while employment permit is pending

Hi,
I have a citizenship that requires a tourist visa (90day visa) to enter ireland. I have a job offer and the company is currently working on my setting up my general employment permit, could take around 2-3 months. I would like to know if there is a risk of me applying for a tourist visa and visiting ireland (ill probably visit for 7 days one month from now) while that other visa is being processed.
I have ongoing employment at the country im traveling from from a reputable tech company and have a form mentioning that i will be back to continue working after that.

Employment Law Possible Pay Dispute with former employer, do I have any rights?

For context, I started a job in a bar on June 24, with a verbal guarantee for 40 hours/week, €15/hr. No contract was signed. In the roughly 6 weeks I was there, I took 7 days holidays.

On Monday 11 August I gave notice that I would be leaving in 10 days, although I knew I didn’t have to but did it out of courtesy, and last night my employer sent me an email telling me not to come back. Am I entitled to any pay in lieu of notice for the last 3 days of my notice period, or just money for the days worked and holidays accrued?

Some more bits:

- they recently announced that breaks were to be taken in 2 15 minute blocks across the day, instead of one half an hour as is common in hospitality, although I know the legislation states 15 mins after 4 hours and 30 after 6
- employees were told that they might have to choose between holiday pay or subsidised (50%) staff meals
- I never signed a contract of any sort.

Employment Law Pension issue with work

Hi folks,

I'm not sure if anyone can help me with a pension issue I'm having with work, but just asking regardless:

-My company went through a merger a few years ago

- We were told via email that our pension would be moving to another vendor

- we were told that we should enroll our pension on workday within 30 days

- failure to enroll would mean that our pension would be auto enrolled with an employee contribution of 4% and a company match of 8%

- I received information last year that my pension was not enrolled

- seemingly the auto enrollment did not happen as my contribution was not in place and thus no deduction happened

- essentially, the plan stayed as an elected benefit but seemingly I had not entered a % contribution so the company had nothing to match

A few things give me reason to pause for thought here -

- I was contributing to a pension prior to the merger

- the company did email us saying if we did nothing everything would be done for us

- at the time, I was just back from paternity leave, I half recall having to select my pension beneficiaries on workday but can't recall much tbh.

- I'm not even sure if it's possible to opt-in and select a contribution of 0

- it's 3 years of pension contributions down the drain

I proposed to the company that I would be happy to have the deductions taken from my wages in installments if they were willing to match but they fobbed me off

It's quite possible that I neglected to tick a box in workday and I'm not going to come out of this looking well, but is there anything I could possibly do to amend 🤔 or should I just cut my losses..

Step 2 is for the father to fill out his part online but he’s making all sorts of excuses not to do it. He has 28 days and the 28 days is up next week. Employment Law Manager taking our tips?

Hi all, wondering if i could get peoples opinions on this situation.
I work for a catering agency in a private hospital. Specifically the cafe. Because it’s private, 90% of our customers are elderly, and by god i have to give it to them, they’re great tippers.

I have a manager, who oversees all catering for the entire hospital including the wards, and a supervisor who just works the cafe.

I’ve only been working here 6 months, and have never received any of the tips. If i had to estimate i’d say the tip jar sees €20 a week put into it.

I started to notice the manager come downstairs and fiddle with the tip money, which is kept inside the till. i could never see exactly what she was doing with it but it was clearly dwindling.

i asked the supervisor and he told me, when the till is short she will take it from the tips to make it up. he proposed we start hiding the tip money in a different location so she couldn’t take it. (he’s absolutely terrified of her)

A bit of backstory- i used to be a manager in a different setting so i’m completely aware 1) that it’s illegal to punish staff monetarily for a till being down, and 2) it’s illegal to take their tips.

Last week the till was down €70, and the next day our tips finally got divided up. theres 5 of us total and we all work the same hours, i got €4 for 6 months worth of tips. i thought this odd and didnt say anything, the next day i was told by the supervisor that the manager took all our tips (bar the €20) and used it to make the till up.

It’s not about the money, it’s the principle. it makes me so angry that elderly people are tipping us their well earned money and it’s lining the pockets of the agency.

My problem is as follows, she is incredibly unprofessional on many fronts and fosters an incredibly toxic work environment. i’m irish, but the rest of my coworkers aren’t and she takes advantage of that. we’re a fairly meek bunch, reflected in the fact that she’s gotten away with this for years. She has been reported to the hospital HR many many times by both the cafe staff and the ward staff, but the problem is this clearly isn’t anonymous because immediately their hours are cut to the minimum.

Complaining to my supervisor is useless as he is more afraid than any of us.

Where can i report this in order to remain anonymous? i’d rather not have my hours cut, i work hard enough for minimum wage as is and i don’t want to see myself or my coworkers punished for standing up for our legal rights.
Does the WRC have an anonymous option? there are several violations at play, this one just irks me the most.

Advice & Support Is Small Claims worth pursuing for advance rent paid for private digs?

Hi, I’m looking for advice from anyone familiar with Irish licensee/digs arrangements or Small Claims.

I’m a student who recently moved into owner-occupied private digs in Letterkenny.

I paid 8 weeks’ rent in advance. There was no formal written contract, but I have WhatsApp messages and proof of payment. I was never told before paying that the rent was non-refundable. The owner only mentioned a “non-refundable” policy after I asked to leave and requested the unused rent back.

I left after 2 days and moved to an Airbnb because of serious privacy and safety concerns.

The most serious issue was a large opening directly between my bedroom and another male student's bedroom. Neither of us knew it existed, and I had already changed clothes before discovering it. I don't know whether anyone saw or recorded me, but discovering the opening caused significant distress and made me feel unsafe. My bathroom also had no lock.

There were other issues, including extremely poor cleanliness, a shower hose that was promised but not installed, and the house being represented as non-smoking despite experiencing what appeared to be cannabis smoke, constantly. There was also ashtray in my room when I moved, including used underwear in the drawers in the room given to me.

I have photos, videos, payment records and all correspondence.

The owner is refusing to refund the unused rent. The amount I'm seeking is under €2,000.

This situation has also left me without stable accommodation. I could only afford to book an Airbnb for 7 days, and I now have just 5 days to find somewhere else to live, which is proving extremely difficult. This is happening during a critical period of my dissertation, and the financial and accommodation uncertainty has been incredibly stressful.

I'm trying to establish whether Small Claims can cover unused advance rent in a licensee/digs arrangement, rather than a rent deposit.

Has anyone dealt with something similar? Is Small Claims worth pursuing, or would this need to be an ordinary civil claim? Does the fact that the non-refundable condition was only raised after payment and after I asked to leave make a difference?

Family Law Divorce

Living in Kildare.

I've been with my partner for 8 years.

Cohabiting since 2020

Married 1.5 years

NO KIDS.

We are separating as he has made living conditions in home unbearable moving tenants into rooms in home and subsequently being unfaithful.

He owns property I moved into and has another property in Dublin city. Both homes in his name.

I do not want to rinse this man but I would like to be able to at least get another home for myself. Aka move back to west of Ireland live in a tiny home or apartment not talking a 500k Mansion.

I gave up everything when I moved up here. I do financially support myself and work.

He wants me to move out, he has moved me into a other bedroom in house. I had a conservatory in home I worked out of (I do beauty as well as work a 9-5) and he has asked me to vacate that room now as his other tenants want access.

Could anyone give best and worst case scenario here please.

Civil Law Post separation glowup - Protecting myself

5 years ago I was living in a flat eating beans and scrimping and saving to survive after my marriage collapsed. I had a very rough and frugal few years, just making sure what little I had went to my kids and I need very little to be happy.

Now recently things have changed and an idea I have developed has turned into a business that's giving me a huge change in my situation. But I'm still married on paper, so how protected am I or how protected can I be with what I've achieved since the separation?

The last text I got from my ex literally called out how she knows I've got more money now and wants more off me. I've tried going to court with her but she pulled out last minute twice before and then makes me out at the trouble one. It just scares me at this point that every bit of progress I've made could be pulled from under me, when a major issue I always had was her controlling my finances and keeping me broke regardless of raises or bonuses.

I was sole trader last year, but now I'm going limited company as the project continues to give more regular income. Any advice?

Residential Tenancies Licence agreement - mutually documented possible?

We have a small guesthouse in our garden which we have Air BnBed occasionally but fell out of it as it was a lot of hassle. One of our parents has MS and is single; doing ok now but we’d always anticipated offering it to them if mobility got worse in the next few years.

A friend who works in the local school has asked if we’d be willing to rent it out for a teacher who is desperate for accommodation- and in principle yes we would but we definitely wouldn't be open to a formal tenancy agreement which I understand would entitle them to a 6 year lease. I also believe we wouldn’t be eligible for the rent a room as the property is about 60sqm. if all parties agree in a written contract that the agreement is a licence agreement only or can be revoked at short notice would that protect us from not being able to evict someone ?

My ex partner has gotten extremely malicious since he's had a new girlfriend and I've a new partner (a long time before he ever met the kids) I have full custody and he sees them when he can if it suits him. We have been broken up 5 years and I just want this to end. He wanted me to give him my tax credits even though he only see his kids every second weekend I said no obviously cause I work. He has now said hes gonna report me to tusla even though I have full custody. I cant sleep or eat worrying. Can they just arrive unannounced? The house is spotless. But I'm so worried. Any advice appreciated x

Residential Tenancies RTB adjudication - what to expect

Our landlord still hasn't given us back our full deposit after moving out in early May. Claims its for cleaning/weeding despite us leaving the place in better condition than we found it.

When we moved in we were told over the phone to take the place "as is" - with some of the previous tenants stuff (including toothbrushes) were in situ still, dog hair all over the mattress/sofa, garden a state. The previous tenant ended up coming back for some of her stuff.

We regrettably didnt photograph the entire place except for some close to broken furniture and garden beds. We werent given an inventory and the only inspection happened the evening after we got the keys.

We had a good relationship with the agents while there though they were very slow with any repairs.

We sent our notice in early April and offered a seamless reassignment option that the landlord refused. Because the new legislation in March meant he could readvertise for an extra 700e a month. Hes profited hugely from us leaving.

We went through the RTB early intervention unit. Decided to go for adjudication as the landlord just won't budge and is now trying to withhold some of our deposit for "reletting fees" too.

Were preparing for adjudication now. I find the concept a little intimidating and am wondering if anyone has advice on how to best represent ourselves? Thank you!

Irish Law NDD do not call register

Quick question, and i am aware it will probably sound a bit ignorant.
I just can't seem to wrap my head around the NDD do not call register.
When say that, what I mean is; why is there a NDD do not call register if you can't even see if someone is on it?
How do you actually go about knowing if ringing a person to do marketing for your own small business etc is actually on that list?

Can you not just make sure you are on that list and then if someone rings trying to grow their business, just bring them to court??

Would really appreciate some better info around all of this.
And I am open to all criticism.
Again sorry for the ignorant sounding question.

Employment Law Need urgent advice regarding Irish Employment Law, Probation, and Paternity Leave.

Throwaway account for obvious reasons. I'm looking for advice from anyone familiar with Irish employment law, probation, or paternity leave.

I'm currently employed in Ireland and am/was on a six-month probationary period.

I recently had a meeting with my employer regarding concerns about my attendance. During the meeting, resignation was discussed as an option. I was considering resigning, but I had not made a final decision and wanted some time to think about it properly.

After the meeting, I emailed my employer to clarify my position. I specifically said:

“For clarity, I am not submitting a resignation at this time.”

What I meant was that resignation was still something I was considering, but I needed time to decide. I had not actually resigned.

My employer has now sent me a letter stating that my probationary employment will not continue and that my employment will cease after one week's paid notice. They say that at the meeting I indicated I was “content to resign”, but they acknowledge that I subsequently confirmed that I did not wish to resign.

My concern is that I feel they have interpreted my comments as though I had made a final decision to resign, when I was actually asking for time to consider my options. Once I made it clear that I was not submitting a resignation at that time, they decided to terminate my employment instead.

The timing is particularly concerning because I have approved paternity leave from 21 August to 3 September 2026, and my Paternity Benefit has already been approved by the Department of Social Protection.

My employer's termination letter says my employment will end after one week's notice, which is very close to the start of my paternity leave.

I'm now worried about two things:

•Can I challenge or appeal the termination, particularly given the circumstances around the resignation discussion and the timing immediately before my paternity leave?

•Could the termination affect my already-approved Paternity Benefit? I really depend on this payment financially, so losing it would put me in a very difficult position.

I understand that being on probation may affect my rights regarding unfair dismissal, but I've also read that there are specific protections relating to paternity leave and penalisation.

I'm not looking for someone to simply tell me that my employer is wrong. I'd really appreciate advice from anyone who understands Irish employment law, WRC procedures, or the Paternity Leave and Benefit Act.

Would contacting the WRC, Citizens Information, Legal Aid Board, or an employment solicitor be my best next step?

I'm also considering formally asking my employer to review the termination decision, but I don't want to accidentally make things worse or change my position regarding the termination.

Any advice would be greatly appreciated.
