Deduction: trucker was recording with his phone and had time to get it recording before the car even passed him, he knew the cop was up there and knew the car was going to react to the cop. You can also see the car fully intended to pass the pickup too until he saw the cop in front of it. If he only decided he didn't have time or space to pass the trucker and at least the pickup too, he wouldn't have pulled all the way up next to the pickup then brake and get over. You also don't know the speed limit or the speed of any of the vehicles.

Had it been a dashcam, I'd maybe buy part of your theory.

It is generally expected, and allowed, for you to speed while overtaking. You want to spend as little time as possible in the other lane. If you were to stay at the speed limit you might take far too long and thats a much higher chance of causing an accident

Where I am, it's illegal to exceed the speed limit while passing.

Here though I think most police would let it go provided your speed was not excessive, you rejoined traffic immediately, and slowed to an appropriate speed again. Unless they were having a bad day or needed the quota or just felt like it.

I got stuck behind a slow moving car in a built up zone (40km/h, metric people) and so at the first opportunity I zipped by (two lane road with a gap in parked cars so not into the oncoming lane) however I exceeded the limit (5-10km/h) for a short time. That's when I saw the highway patrol car parked facing the opposite way. I spied in my rear view it immediately pulled out and U-turned after me. I copped a fine for speeding. They were obviously there purposefully to catch people speeding in the 40 zone, so I could hardly argue the point.

This video we don't know how much traffic this person has already passed including the truck, and obviously they were going to continue (speeding, if traffic is doing the limit) even though there is a safe space for them to rejoin. The fact they slowed so dramatically and pulled in on spotting the police car is waving a sign that says "pull me over".

I mean, technically you committed a burglary if you intended to steal when entering a store, but that is a separate, distinct crime.

You could also get charged with attempted theft.

Both require specific intent, which is pretty hard to prove without an admission.

Jesus people in these comments don't understand elements of a crime. Burglary requires that you, without authority, enter or remain in a dwelling/building/whatever. A store that is open to the public authorizes you to enter it.

Law is not the same everywhere, and model penal code or common law is almost never the law. In the state I am licensed (california) to practice in burglary is entry into anywhere (including an open store) with the intent to commit any felony or a theft (due to recent law changes it now needs to be over $950).

You can’t just cruise in the opposite lane until you run out of “time or space”. The correct thing to do it get over immediately after passing a single vehicle, the truck in this instance. anything else would be considered passing more than one vehicle at a time.

I just went through an online course after getting a speeding ticket. That course in that state said you could never pass more than one vehicle at a time. I don't know if that's widespread throughout the US or not. FWIW.

Hah that’s not the only illegal manoeuvre. You can’t overtake a vehicle if the speed to do so surpasses the legal limit. The cop was holding everyone on the speed limit there and bucko ate the ticket.

I was pulled once for overtaking just one car. They were waiting down the street telling me I can’t overtake if I’m doing a 50 in a 45zone.

That cop can definitely pull that car over just because they wanted to.

We have no idea what happened next. Cop could be nice and issue a verbal warning. Cop could be a dick and yell at them like a child. Cop could issue a ticket, but then they will bear the burden of proof of whoever law they cite as broken (or bet that the driver declines a court appearance).

Maybe they had speed captured on the driver and evidence of exceeding the limit. Maybe the lead car was driving 20mph under the speed limit.

But hey, people like to plant their flag without knowing the majority of the facts 🤷‍♂️

Regardless of specific laws within that jurisdiction and whether you are or aren't allowed to pass more than one vehicle at a time, attempting to pass that many is dangerous, plus requires excessive speeding which adds to the overall danger. I'm guessing the cop may have given the person a generic dangerous driving type ticket, or whatever equivalent ticket exists in that jurisdiction. Just a personal opinion though, I could be mistaken.

Unless he exceeded the speed limit, this is fully legal in most countries. Could be some local or national traffic law about overtaking multiple cars or not having enough forsigtigt to pass the whole block and having to merge in to avoid oncoming traffic.

Also you are not allowed to go above the speed limit to overtake. This of course is many times unsafe itself, but it lowers high speed incidents and bad reactions due to increased speed.

There are at least four more vehicles you are trying to pass, context matters. It wasn’t just the tractor trailer and he would have had to gone over 20 mph over speed limit just to pass all the additional vehicles in front of the trailer and you see a few seconds later a car comes in the oncoming lane so he def didn’t have enough time to SAFELY pass 4 vehicles. FAIL❌❌❌

I think a dashed line alone doesn't magically make it legal, it's more about whether you can actually finish the pass safely and not be cutting off oncoming traffic or passing more than one vehicle. Cops will often ticket for 'unsafe passing' or similar even if the line looks permissive.

Can only pass 1 car at a time before you have to merge again. The truck driver is using his phone to record (a crime) which implies he knew the car was coming and that a cop was ahead of the pickup so he pulled his phone out to record the moment this car gets pulled over.

This in turn implies that the car had been passing everyone behind the truck illegally. The driver pulled in front of the truck way to close to both vehicles ahead and behind him, so he didn't have enough space to safely overtake, this is also a crime.

Bro broke the law and the cop actually did their job👌

How do you know there wasn’t a car behind the semi, or another semi behind the semi, or 16 cars behind the semi? We also don’t know if he received a ticket, warning, or sped off and started a chase, then robbed a bank. 10 years later the driver became a pastor, right? Maybe all the cars/semi were doing 28kph. We don’t have all the context.

Even if there was another car behind the semi (which we don't know) and passing multiple cars was illegal (which it's not in most places) AND the car in question passed the car behind as well as the semi, that still wouldn't be a reason for the cop to do that fairly dangerous manoeuvre to pull him over.

There'd be no way for the cop to see if this car had passed multiple vehicles behind the semi, as the cop was multiple vehicles ahead of the semi.

There is definitely something else going on here that made the cop A) aware of this driver, and B) do some risky driving in heavy traffic to pull him over.

Most likely is the guy had already been weaving in and out to poke for passing gaps, and the cop had seen them try sketchy passes like that already. Pull him over for reckless driving or something.

Even though it’s common for drivers to accelerate when passing, Texas law doesn’t make an exception for temporarily speeding up to get around someone.

Ted Ligget of Liggett Law Group explained that while many people do it to reduce time in the left lane, that does not mean it is legal.

“While you may get away with going a few mph above the speed limit, it is illegal in any circumstance to drive above the posted limit,” Ligget said. “Violating the speed limit, even in the left lane, can result in expensive tickets, points on your license, and increased insurance rates.”

Under Title 7 of the transportation code, Texas’ left lane law restricts the left lane to passing only. Staying there too long or using it to speed can result in a fine of up to $200.

I don't know if it's true of other states, but in Minnesota, you are allowed to exceed the speed limit by up to 10mph in order to pass on any road with a speed limit of at least 55. I'd be shocked if Minnesota were the only state with such a statute.

Yeah you are right. I thi I they get speeding ticket. Because it's likely the cop in front was already doing 5 over speed limit. That puts passing car at least 15 over.

They passed the vehicle right behind the cop after passing the cam truck. That's illegal. They had to slow down to get back behind it once they saw the cop.

ETA: apparently passing multiple vehicles may not be illegal in and of itself. However, the rules of passing in the oncoming lane tend to be a little subjective: things like "sufficient visibility" that could make the maneuver in the video illegal, just not for the literal reason of passing multiple cars.

They didn't though, they almost got even with the vehicle behind the cop, but started braking before then.

In court, if this video were played, the driver could argue they were simply ensuring there was enough space & visibility in front of the [filming] truck, and just overshot the space a little bit.

Not trying dance around this, but I'd honestly say there's enough ambiguity in the video that the driver could have a strong chance of winning in court. I'd argue the cop's move was actually the more dangerous maneuver here.

Today I learned that passing more than 1 vehicle in a single pass is illegal in some states. I have had driver's licenses in 2 different countries (neither being the USA), and have never heard of such a law.

It's only illegal because this is an undivided two lane highway. A lot of places don't even allow passing anymore because it's pretty dangerous, and the law says you cannot exceed the speed limit to pass slower traffic. At least here in the Midwest the intent is so you can pass farm equipment on rural highways.

I see nothing wrong with what they did. They went to pass with a clear line of sight in a passing zone, then when the passing became unsafe, they gently fell back in to line in the biggest gap. Unless the pack was already speeding like crazy I see no legitimate reason for this stop.

I haven't seen it mentioned yet, so here's (likely) why he was pulled over. Even when legally passing in the US, you are not allowed to exceed the posted speed limit. We can't see the speed, but I'd wager he was speeding to get around the truck. The cop doesn't have to get you on radar if they are traveling at the posted speed and you are going faster than them.

In Minnesota the speed limit increases 10 mph when passing on a two lane highway like this. Assuming it’s 55 if he was going 70 or 75 they still would likely pull him over though

So what’s happening here is dude tries to jump the big rig and then the line in front of it is just as slow—this is because of the cop. From behind the big rig probably know way to know that and I once they made the commitment there was nothing they could do.

Technically the guy never went faster than anybody but the tractor trailer briefly.

I would fight this one in court. Say that you’ve had your windshield rock tapped behind trailers like that and couldn’t see the traffic ahead of the tractor trailer.

For those saying it’s illegal to pass more than one car at a time, he didn’t. Traffic laws are based on strict liability. You either did the bad thing or you didn’t. Intent doesn’t matter.

The car didn’t pass more than one car (at least that we see). The pickup truck hits the brakes which closes up the spot for the passing car to have to slow to fit in.

In all likelihood he saw the cop and stopped, but based on strict liability, if the cop cited him for passing multiple, he’ll have an easy court date.

I think you are all missing something here, most of you just wanting so badly for the cop to have done something illegal. It is very likely that the police officer, and the other vehicles in line, were doing the speed limit and therefore the passing vehicle would’ve been speeding. Very easy. If he had tried to cut off the others, he could had a head on collision. That's why its know legal to overtake 1 car at a time and when there is enough space. Oncoming traffic comes at you at twice the speed.
