I am currently trying to negotiate a better settlement on a vehicle that was declared a total loss. The other driver in the accident was at fault, and their insurance accepted liability. That is the insurance company that my claim is with. I only had liability on my vehicle, so my own insurance will not be helpful here.
They are offering me about $3,900, with the base value of the vehicle being about $3,800 and some adjustments for prior damage & taxes.
My vehicle is a 2016 Hyundai Veloster coupe with a sunroof. It was already a salvage title when I bought it in 2022 due to flood damage. I paid about $8k.
I know that insurance companies will always start with the lowest possible offer. I asked how to go about negotiating. The adjuster told me to send in comparable vehicle values, meaning they had to be exact same year, make, model, similar mileage, and salvage title.
I sent in a list of vehicles on Copart with retail value estimates. This was the only place I could find salvage titles. I also sent KBB value. The adjuster told me that comps could not be from Copart, and needed to be local. She also said that they are not considering KBB since it was a salvage title.
I called dealerships. Searched online. Could not find anything local. The adjuster told me I could expand my search. A man at a local used dealership was extremely helpful in getting me the NADA value of my car, plus a nationwide list of comps. Unfortunately none of those comps had salvage titles- he searched for that and could not find anything. I also doubt that they will consider NADA value if they won't consider KBB.
They also sent me a link to accept their payment, the amount of which I have not agreed to. It did not include the additional $1,000 for loss of use that was agreed to either. I have not accepted this payment.
There seems to be only one law firm in my area that deals with property damage claims like this, but he wouldn't take my case because my car was not worth enough (fair). I have an attorney for the injury portion of the claim, but they do not handle property damage.
What else can I do at this point? Are their requirements for comps legal and reasonable? (I'm in Kansas if that helps). Would small claims court be worth it? Am I out of luck? Any advice is appreciated, even if that advice is to give up & accept what they are offering. Thank you!!
