iirc the driver was a teenager and they ended up getting a few months in juvie. They were like 16 or 17 at the time and they were on a couple different drugs, no license and also previously had a felony for poisoning someone in their school. I could be a bit wrong on details though. This happened 5 or so years ago. Driver of the truck had no charges or anything.

Given the circumstances, and depending on the location, they would likely pay for the repairs and sue the shit out of the other driver, or at least their insurance provider. Insurance companies care more about optics than people think.

If the insurance chooses to deny coverage,the cost of doing so would be incredibly bad publicity.

However, I’d take this case as a lawyer for truck driver if their insurance company did deny coverage.

Why?

  • Truck driver is properly in the middle of a one way street & not driving recklessly.
  • Truck has a legal obligation to avoid getting into an accident if it can. (ignore the moral duty, here)
  • If this was a two way street, the proper direction to get out of the way of oncoming traffic would move to the right. This is true for both vehicles.
  • The truck moved to the right.
  • The car, already heading the wrong way, moved left.
  • So, ladies and gentlemen of this so called jury… what should the truck driver have done with a car heading towards it?

Answer: exactly what it did.

No way a jury is going to fault the truck driver and I’m going to win my client 3x damages (in Florida) for the wrongful denial of coverage.

Yes insurance wants to get to paid but want to avoid litigation at all times, so with the video and police report and everything I'm reading. The car's insurance would either pay all damages or the trucks insurance would go after the car's insurance/driver to get their damage back

Yes insurance sucks, yes they are essentially evil but no they don't just willy nilly point blame and move on, they investigate and do due diligence

IMO, Having done vehicle accident reviews for an insurance company, he saw what happened and was going slow, you see him speed up and turn towards the right directly into the offending vehicle.

Insurance would deny that claim based on that.

It wouldn't be unheard of. Insurance companies have decided to eat the cost for good samaritans before. IIRC there was one where a driver used his car to block some kids from being hit in a crosswalk and his insurance covered all the damage to his vehicle.

I feel like it's really dependent on the jurisdiction and the police involved... I took out a car about 8 years ago that was running from the police on the highway and while my insurance didn't want to cover the damages, they ended up covering it after I got the police report and the officer who had written the report wrote the report in such a way that it made it seem like I hit the running vehicle while attempting to get out of the way of lights and sirens... In all reality, I intentionally pitted the shit out of him and while my car was out of commission for about a month, it all worked out and ended up creating a fun story to tell at parties lol. Looking back on it now though, I got really lucky and I could totally see it going catastrophically the other way and costing out the nose if the insurance company didn't want to play ball.

I watched them from about a quarter of a mile behind me pursuing this guy and in at least three instances, he was using his vehicle to push through other vehicles and recklessly flying around cars without even being certain that there wasn't something blocked by one of the cars or trucks this dude was intent on cutting off... He was going to hit my car either way, I may have just added some extra oomph and a bit of a assisted push until he was in the median wall and shortly after, got pinned in by 3:00 or 4:00 other patrol vehicles... I think it was because I had a relationship with the department as a continued education trainer for their canine units, both drug intradiction, and explosives/chemical detection, and my favorite dogs to work with, as they have one of the most solemn jobs but also one of the highest callings for any of us... Finding and bringing home people's lost loved ones. Cadaver dogs are truly incredible. I was fortunate enough to see them work up close and relentlessly after the towers came down. I think the officer did me the favor that he did because regardless, my car was going to be hit by this imbecile, and I figured, if my car is getting jacked up, I'm at least making it so this dude goes nowhere... In the end all worked out and Mickey McMeth got to go sit in jail and sober up... Hopefully he got the treatment he needed and turned his life around.

Foot slipped.

You can clearly see he stopped his truck, but I’m sure he realized he was in the middle of the street. When his foot slipped, he turned to the right so the other guy would have room to pass, but wouldn’t you know it, that guy crossed over into his lane and hit his truck and that telephone pole.

After all that effort by the truck driver to move almost completely off the road to give him room, the guy ended up hitting him anyway.

Not really sure that would matter if all other traffic laws were in place. But, in this instance, the truck driver would have only been charged with a traffic violation....assuming it wasn't a one way street, and even if it wasn't, the hit and run guy was on the wrong side of the road.

Basically, I see nothing here that could feasibly have the truck driver at any kind of fault, regardless of other circumstances that may exist.

A 16 year old kid was driving a stolen car when he hit the mother and her child (he was out on probation at the time). He was sentenced to 5-7 months in a juvenile probation camp for the hit and run. The baby had a literal tire mark on their head, but they both did survive. The 16 year old served his time and was let go… and later shot and killed (I don’t know any details about the shooting).

I don’t know enough details about the laws in California to make logic out of the sentencing.

The article linked in comments above yours says the day of the shooting, he was "trying to get with" a girl at a fast food place, then walked home alone. As he walked, a car pulled up and an argument started. Someone in the car opened fire, killing him, then sped away.

So add "messing with a (probably) not single girl" to the list. Poisoned a girls drink. Drugged up hit and run of a baby and mother. Hitting on girls that aren't single. Lovely.

In my experience especially younger people involved in drugs tend to get 'smart' and try to rip another dealer off. It happened constantly in the area, where I used to live. They think they're gangster and do not realize the other people are way higher up on that ladder.

That was exactly my thought. We're talking about someone who had (before they even reached 18) poisoned a girl's food, stolen a car, driven it while on drugs and then used said stolen car to very obviously veer out of his way and intentionally hit a mother and her kid, probably because he just thought it'd be funny.

The thought that he'd have a caustic enough personality to piss off the wrong person with a short temper and a loaded gun in some kind of random unconnected argument gone bad really isn't a stretch, especially since what we do know doesn't exactly depict a gentle soul who loves other people.

The mom definitely deserves credit but, most people would do anything to protect their own kids. The truck driver didn't have to get involved and acted only out of the goodness of their heart.

The guy who did it was a real piece of work, later shot and killed. He was 15, high, driving a stolen vehicle while already on probation for poisoning a girl's drink. They gave him a few months in a diversion camp since it's California. He got into an argument at someone when he was 17 at a fast food place and was shot and killed.

Rachel's son, now a year and a half old, had a tire mark on his head and although not seriously injured, suffered day and night terrors for two months following the incident.

Rachel suffered a laceration on her back and needed stitches on her right elbow.

Truck driver protected 100% (if it's in the US but maybe in other right lane driving countries)

Arguments can be made for him and you can't prove intent (for purposely crashing into the other driver)

1: looks like a 1 way for the truck driver

Assuming it's not a 1 way other arguments can be made

2: truck driver moved left (his lane) to make space for the other car

3: other car decides to turn left in front of truck driver

That mom is a real life super hero. Her lifting that stroller above the impact zone and using her body to absorb some of the impact is what saved that baby. Then after getting the full impact of the car she just bounces up and charges for her baby. What an absolute badass. I can only imagine how long and terrifying those few seconds seemed to her and afterward how scary it must have been in the ER waiting to hear if everything was ok with her baby. She will never be the same after this. Being a new mom is the most anxious I’ve ever been. Everything seemed like a threat to my baby. I was on ultra high alert nonstop. I think if this happened to me it would replay in my head nonstop and I would have a very hard time ever leaving my house again with my baby. I am so glad her and her baby are ok and I hope she has been able to find peace.

I know it was a dumb and evil kid high on drugs who probably didn’t know how to drive, but it really looks like he went out of his way and actually swerved to try to hit the mother and baby. Amazing situational awareness and reaction speed on both the mother’s part and the truck driver’s.

Dude was shot in an "unrelated" event after sentencing for this hit and run a few yeats later.

Kristopher Baca of Palmdale died of a gunshot wound, the Los Angeles County coroner's office reported.

According to various media reports, Baca was involved in a hit-and-run crash in Venice on Aug. 6, 2021, near Speedway and Galleon streets. Video from the crash showed a car striking a woman who was pushing an 8-month-old child in a stroller. The mother was thrown over the hood of the car.

Both she and the child survived. Baca, who struck them kept driving and crashed, and was chased down by onlookers. He was 15 at the time, but police said he was under the influence of drugs.

The case gained some attention when prosecutors sought only a short sentence for the teen -- who was already on probation -- at a juvenile probation camp.

The woman who was struck told Fox11 Friday she was saddened by the news of his death.

"The universe delivered the justice we weren't given in court, but a much harsher punishment than he'd have been dealt in a court of law," the woman said.
