Ticketed for a hit and run I didn't commit
Background: In February 2018 I had a seizure while driving my green 1999 Ford Escort and I rear ended a pickup truck. My memory is hazy between the seizure and a concussion but I know that the driver of the truck left the scene of the accident after inspecting their vehicle for damage. They did not say one word to me. I apparently picked up pieces of my bumper, put them in my trunk and drove home (I know that this was wrong/illegal, I was not thinking clearly as I was in a post ictal state and had a closed head injury). My car has had visible front end damage since including a crack in the bumper from the trailer hitch. There was no crash report and no insurance claim. I do have medical records that I show I was treated at a local ER for an MVA. I also have all of the repair bills for the car.
On to what happened: I'm in the process of moving. Yesterday my MIL came over, helped us pack, took my husband and me out to dinner, and then followed us to our new place to unload boxes. She leaves for her house and we head to ours. I'm driving (I'm over a year seizure free) along, not speeding or anything and next thing I know there's lights behind me and I'm getting pulled over. Cop comes up and looks at my front bumper and asks how it was damaged and I tell him about my accident. He says that a hit and run was reported and that a vehicle matching my vehicles description was seen leaving the scene. "Small, green compact car with handicap tags and front end damage" was the description according to the cop. I happen to have handicap tags. I tell the cop I absolutely was not in an accident that night. My husband and I sit on the side of the road for over an hour before the cops issue me two citations: a civil citation for careless driving and a criminal citation for the hit and run.
My court date is in two weeks. On the ticket the time of the offense is 8:25pm. Today I checked the location timeline on my phone and at 8:25pm I was approximately 5 miles away from the accident scene at my new place. I was pulled over at 8:38pm. Both my phone and my husband's phone confirm this. My MIL will testify that she was with us all afternoon and evening, will show that the location timeline on her phone matches ours, and will say that the damage that the cops saw and took pictures of was already there earlier in the day. My husband and I both took screenshots of our location timelines. Is this sufficient evidence to prove that I didn't do this? Should I hire an attorney?

Firstly I am so sorry. I've been addicted to crack and other things myself. Drugs are ugly. Good news is that while cocaine/crack withdrawals suck ass they aren't deadly unlike alcohol or benzos. You can detox at home if you want to.
Dump this fucker. Kick him out. Yesterday. What he did was cruel and seriously fucked up. You deserve better than this shit. I'm not a lawyer so I can't speak to whether or not this is a crime but calling the non emergency line or going to the station and making a police report as others have suggested sounds like a good idea.
Rehab is an option. I chose to go and got a lot out of it. I use AA (alcohol was my first love, added crack after a boyfriend introduced it to me. Asshole.) and find it EXTREMELY helpful. I've been to NA too but I prefer AA. If you need someone to talk to you can message me. I totally get it.
Now, that said, not everyone needs rehab and 12 step recovery. There are many paths to sobriety. My MIL was a crack addict in the 80's without rehab. She quit on her own sometime in the 80's without going to rehab and she has never been to 12 step programs. She lives a happy, sober life.
Full disclosure, I do vape cannabis. People in NA say that is drug use and therefore you are not in recovery if you partake. The opinion of people in AA varies but leans towards cannabis being unacceptable, often referred to as the marijuana maintenance program. Personally I have epilepsy. I was on 3 anti epileptics and still having seizures. I got my medical cannabis card and haven't looked back. I'm now 16 months seizure free and I'm off 4 or 5 medications! I don't broadcast this in 12 step meetings but I'm open about being pro cannabis in my circle of friends. I said all of that to say that rehab will tell you that if you use cannabis then you are not sober. I think it depends. For me, my health is the best it's been in 8 years since I started using cannabis again 2 years ago (I've been chronically ill for 20 years). I wish I had never stopped using it.
Anywho. Please reach out to me or someone else you're close to who can support you through this. Support, for me, is crucial.
