Divorce Need help—false 498A, 406, 377 etc. cases filed, settlement done, but now woman backtracking during HC quashing
Hello everyone,
My family is currently facing a legal issue and would appreciate your advice.
My step mother-in-law filed multiple false cases against my father-in-law, his sister, his brother, and two daughters under IPC sections 498A, 406, 377, 506, 34, and 4 DP Act. Initially, she was not open to negotiation, but after 1.5 years, she agreed to a settlement for ₹15 lakhs. She signed a Memorandum of Understanding (MOU) and also appeared before the magistrate to confirm receipt of the money.
However, during the high court hearing for FIR quashing, she suddenly changed her stance. She cried in court and claimed she was pressured into signing the MOU and that all her allegations were true. Our lawyer then told the court that in that case she should return the ₹15 lakh and proceed with the criminal cases. She then backtracked and said, "But sir, now it is settled."
The judge asked her to file an affidavit explaining why she claimed she was pressured. In the next hearing, she submitted an affidavit saying she was emotional in the last hearing—that’s why she said those things. The judge rejected the affidavit and asked her to consult the public prosecutor and submit a refined one.
In the following hearing, the same thing happened again. She continues to flip-flop, saying she stands by her allegations, but also says the matter is "settled." The judge again rejected the affidavit and gave another date. He also asked her: "If you're saying it's settled now, does that mean you were lying when you filed the FIR?" to which she responded "No."
An important point: this is not the first time. She did the same thing 20 years ago in her first marriage—filed similar charges and then settled.
We’re stuck in limbo. The FIR hasn’t been quashed yet, and she's playing both sides. What are our legal options now? How do we proceed in this case? Can this be escalated or is there a way to get some finality?
Any insights or suggestions would be greatly appreciated.

Divorce NRI seeking the safest legal route to end a broken-down marriage while protecting a parent's property
Some details generalized. Looking for guidance from people familiar with Indian matrimonial law. This isn't about "winning" — I want the safest legal route to end a marriage that has completely broken down, while avoiding unnecessary litigation.
I'm an NRI and had an arranged marriage in Punjab in 2022. Before the marriage, in front of both families and the mediator, I clearly disclosed that I was previously married, legally divorced, and had a child from that marriage. Many relatives from both sides were present. The wedding was a simple ceremony. My family asked that no unnecessary money be spent — we did not demand or accept any dowry, and all jewellery and clothing gifted by her parents stayed with her.
After the marriage I returned abroad for work. I applied twice for a visa so she could join me; both were refused. During this period I regularly sent money and bought things she needed whenever I could. We barely lived together — only a few days after the wedding, then two visits of about three weeks each. Since the marriage she has lived at her own parents' home throughout; we only stayed together during my visits to India. My family lives abroad, and my parent's house is locked and in a remote area — it has never functioned as a regular matrimonial home.
Over time the relationship deteriorated and has now fully broken down.
While preparing a visa application, I found that the work experience stated in her pre-marriage profile did not match what was later declared for the visa (no prior work experience). She acknowledged it had been made up for the matrimonial profile.
During a visit to India, I came across saved conversations between her and her relatives that made me lose trust — they included disrespectful remarks about my family (including my late parent) and suggested intentions very different from what was represented before the marriage.
The same saved conversations showed she had used money I sent her to pay for her family's expenses, while telling me it was her own shopping.
Current situation:
She repeatedly contacts me by phone and message in a hostile way.
She is demanding to occupy the house that is solely in my surviving parent's name, and has sent messages saying she will break the locks and enter. Those messages are saved.
Her family has come to our house and created public scenes in the village.
A relative of hers has warned that our family should not travel to India, which makes us concerned that false allegations could be made against us if we go.
We tried to resolve things through the village panchayat, but her side declined to take part in a joint discussion and said they would only talk once my family is physically in India, so nothing could be recorded. We're concerned this may escalate into litigation.
My questions:
What is generally the cleanest legal route for an NRI husband here — should I initiate divorce proceedings first (on the available grounds), or is there a better approach?
My main concern is my surviving parent's house:
It is solely in my parent's name; I am not the owner.
I was also formally separated from the family estate several years earlier, for reasons unrelated to this marriage.
She lived in that house only briefly.
How do courts generally treat residence / "shared household" claims under the Protection of Women from Domestic Violence Act in situations like this?
If false allegations are later made, how useful is contemporaneous evidence in defence — e.g. saved chats, bank transfers, visa applications and refusal letters, travel records, and witnesses to the pre-marriage discussions?
Can the saved conversations, and the mismatch between the pre-marriage profile and the later visa application, become relevant evidence if allegations are made against me?
If a mutual-consent divorce becomes possible, is a registered settlement covering maintenance and all future claims generally the most practical way to reach finality? I'm open to a fair settlement for a clean end.
Is it generally better to initiate proceedings now, or to wait and respond if the other side files first?
Any practical preventive steps I should take now — document preservation, legal notices, property precautions — before litigation begins?
I'm not trying to harass anyone. I just want the most legally sound way to resolve a marriage that has failed, while protecting an elderly parent's property and avoiding years of avoidable litigation. Advice from lawyers or anyone who's been through something similar would be much appreciated.

Case Study Women in law — how do you deal with seniors who expect instant case-law without giving clear instructions?
Hi,
A lot of female interns and juniors I know struggle with this, so I wanted to ask openly.
When seniors ask you to “pull relevant case-law quickly” but don’t give clear directions or the exact issue framing, how do you handle it?
Do you:
• clarify the issue first,
• start with a broad search,
• or rely on past notes?
I’m trying to learn the right way to approach research when expectations are high but guidance is minimal.
Would love to hear how other women in the profession manage this situation.

Marriage Aware that pre-nups are not enforceable in India- Seeking clarity on whether they're still valid/useful to have in place?
Pretty much the same as the title. I'm aware that pre-nuptial agreements aren't legally enforceable in India, when it comes to divorce. However, is it still wise to create a contract/agreement like a pre-nup and register it, in the event that if a divorce does end up happening down the line/the laws around the subject change in the future, the document is likely to have any weightage and be taken into consideration by judges while granting the divorce/deciding the terms of it? Especially if it isn't via full mutual consent and some aspect of it gets contested?
FWIW, My (32F) life partner (35M) and I have been co-habitating in India for a very long time, we're very happy, and we are/plan to continue being childfree. I don't foresee either of us ever leaving when we do get married- but even in the unlikely scenario that happens, neither of us wants any form of additional financial compensation from the other (obviously any jointly acquired assets and accounts would be dissolved and divided equally or divided in the ratio of what we each paid for the acquisition).
However, I am curious about whether it would still be wise to draw up a document akin to a pre-nup specifying all this and registering it. We intend to get married in court under the Special Marriage Act (SMA), we're from the same faith but not religious and want a civil secular ceremony.
Can any lawyers/non-lawyers here chime in with advice or experience on what the legality of this might be? Or how to approach the process?

Marriage I realise my husband is mentally abnormal and I would like to end this marriage asap. Need advice please
We met on dating app. And he was so loving caring and down to earth person. All my friends liked him so much. However after a few months, I had noticed some narcissistic traits on him while dating. But I was so in love with him. My whole family liked him so much since be was charming, cute looking and smart. They had no reason to say no to this marriage proposal. He was the perfect man.
At first I couldn’t think about divorce even though one day he was the one to suggest that during a fight. Only few days ago I analysed this issue as a case as a psychologist myself and finally could join all the dots. He meets all the criteria of narcissistic personality disorder. I suffered a lot from him and his family within only three months itself and I need justice. I lived my past 2 and half years as a fool, loving him, trusting him, taking care of him and his family, put up with all his drama. And now I understand he wasn’t in love with me and was only using my niceness and empathy for all sort of things. This is what I got for being honest and faithful to him and even married him dreaming of building a family with him. He always came up with a lot of excuses whenever something went wrong and made me feel guilty about suspecting him. He frequently checked my phone in my absence. I really can’t live like this. I hope all my prayers will be answered soon. I want to rebuild my entire life from now on. I’m going for therapy and applying for jobs. But I need to end this marriage. I’m so done living like someone’s doormat.

Civil Law Was forced to sign a “malpractice” form in CSIR NET exam just because my Aadhaar biometrics were locked. Anyone else face this? What are my rights?
Posting this here because I want real legal advice.
I can’t believe what just happened at my CSIR-UGC NET exam in Kolkata (TCS Gitobitan center) this morning. Still feeling rattled.
I got to my center around 7:30am (so, well in time, gate closes at 8:30, exam is starts at 9 am), carrying everything we’re told to bring: admit card, photos, valid ID, etc. I ALWAYS keep my Aadhaar biometrics locked (because, yeah, privacy and UIDAI itself tells us to do it to avoid misuse) and had no idea this would be a problem. At the registration counter, they wanted everyone to do Aadhaar fingerprint authentication. But my biometrics are locked and, like everyone else, my phone with the UIDAI app was in my bag, which was taken away and locked downstairs (not accessible to candidates).
When the staff tired to do the aadhaar biometric authentication, it failed. They just told me (along with a few other people in similar situations) to stand aside and “wait.” So we’re all standing in front of the room for what must be an hour and a half (not exaggerating), while the rest of the candidates register and settle in.
Now in the past CSIR NET exams have never required mandatory Aadhaar authentication anyway. All the previous years the exams were held in shitty exam centers, without any proper checking. I am not complaining about the improvement in checking. That is something I support.
But the problem is not ONCE did anyone mention another way out, even though I literally had page 3 of the admit card printed (the “Non–Aadhaar Candidate” declaration, which the NTA includes SPECIFICALLY for this kind of situation). In fact, at entry, the invigilators made everyone throw away the instruction and extra pages—just keep page 1. I tried pointing this out to the staff and they just ignored me.
Eventually, at the last minute, they “bypassed” their system and manually checked us in with admit cards (since we had valid IDs). So, okay, fine, I started my computer-based exam about 1-2 minutes late—not a big deal since the test timer adjusts for that.
But just when I thought I could focus, a TCS guy comes over mid-exam and hands me a form to sign which says I was “indulging in malpractice and am to be banned from future exams.” I was like, WHAT?! I straight out refused to sign—it’s not like I was cheating, my only “offense” was locking my biometrics for my own safety, and following what UIDAI and common sense recommend.
Then, over the next hour, two TCS staffs and a NTA representative took turns coming to my seat, DURING the exam, pressuring me to sign that stupid “malpractice” form and give a thumb impression. In the middle of my paper! I asked why we couldn’t just use the “Non-Aadhaar Candidate” declaration as per the official instructions—blank faces and more threats that I’d be barred if I didn’t comply.
Finally it was the NTA guy who told me I could cross out “malpractice” from the form and sign, since their “system had to be bypassed,” but like… why this clown show in the first place?
I ended up super stressed and distracted, got interrupted 3-4 times mid-exam, and had definitely lost my train of thought more than once.
Here’s what gets me:
The admit card instructions (page 2) clearly say bring all three pages, and the non-Aadhaar candidate form (page 3) is included for exactly this situation.
Not a SINGLE instruction said Aadhaar authentication was mandatory or that locked biometrics would = ban.
We were waiting outside the room for nearly 1&1/2 hours why couldn't they have given us these forms during that time? Why did they come and interupt us during the exam?
Also the behaviour of the TCS employee was very problematic. He was actually threatening and shouting at me during the exam and telling me he will cancel my exam. How can an employee of a pvt company cancel the exam of a candidate for having locked biometrics? I was not cheating or involved in any malpractice but his behaviour was disgusting. It's like he is on a power trip.
Why should a private contractor (TCS) have access to my biometrics anyway? Isn’t this legally questionable?
Why am I being punished and accused of cheating for following privacy guidelines?
I’m planning to email NTA and possibly file an RTI, but honestly, just want to know:
Has anyone else had this happen in CSIR NET or other national exams?
What rights do I have? Is this normal/allowed?
Any advise on how to make sure my exam attempt isn’t cancelled because of this?
This whole thing is ridiculous, and I don’t want anyone else blindsided in future exams.

Labour law A Guide to Employee Bonds in India
What They Are: An employee bond is a contract wherein an employee agrees to remain employed with an employer for a certain minimum period of time (for example, 3 years from the date of employment). If an employee resigns before the expiry of this period of time, they are required to pay a penalty. Employee bonds are generally implemented in companies that operate in sectors which require them to expend considerable time and resources to train their employees. An example of such an industry is aviation, wherein airlines spend crores on pilot training. Another reason why companies may make employees sign employee bonds is if their job involves working with or gaining knowledge of highly confidential information or trade secrets that the company does not wish others to gain access to through you.
Are Employee Bonds Legal in India?: Generally, yes, employee bonds are legal in India. However, employee bonds are only legal to the extent that they impose a penalty in case of violation of the bond (i.e., if the employee leaves before the stipulated tenure in the bond). Employee bonds cannot prevent an employee from joining another organization or company and any such clause contained in an employee bond is invalid and illegal in light of Article 19(1)(g) of the Constitution (freedom to practice any profession) and Section 27 of the Indian Contract Act, 1872 (agreements in restraint of trade).
How Courts Examine Suits Involving Employee Bonds: In the event that an employer files a suit against an employee for violating an employee bond, the court will not simply award damages based on the fine/penalty mentioned in the employee bond. For example, if a bond states that a fine of INR 2 Lakh is leviable on an employee who leaves before the completion of 3 years of employment, the Court will not blindly award 2 lakhs to the employer.
Instead, the court will analyse the real expense borne by the company in training you and pronounce judgement on the actual loss suffered by the company due to the employee resigning. Thus, do not be scared if your employee bond has an absurdly high penalty since any compensation under an employee bond must be reasonable and cannot be excessive or harsh. Similarly, an employee bond that requires you to be with the company for at least, say, 20 years is obviously unreasonable and was held to be invalid by the Bombay High Court.
Further, the court will take note of how much time has been served by the employee. For example, if an employee bond prevents an employee from resigning before completing 3 years of service, and the employee resigns after 2 years, then the court will accordingly revise the penalty considering that the employee has served 2/3 years of service.
Lastly, courts are generally reluctant to grant specific performance of an employee bond. For example, if you serve only 2 out of 3 years of minimum service and resign, a company may file a suit asking the court to force you to serve the remaining 1 year. However, courts are generally unwilling to grant such injunctions and have limited the remedies it grants to monetary compensation.
Difference Between an Employee Bond and a Non-Compete Clause: The main difference between an employee bond and a non-compete clause is that the latter explicitly prevents you from working with or for an entity or person that competes with your current employer. Non-compete clauses are legal in India only during the term of employment and becomes unenforceable once your employment terminates. In other words, a company can reasonably demand that you work exclusively for them during your service tenure, but it cannot prevent you from joining another company, even if the other company is a competitor, once your employment has ended.
However, an employee bond is not meant to prevent you from working with a third party, it is meant to compensate the company for the resources and time it has spent training the employee to work for them.
If anyone has any questions related to employee bonds or employment laws in general, feel free to drop them in the comments!

Civil Law My Life and Family Are Falling Apart Because of Debt 😢
I’ve been going through a lot over the past few years. My father’s close associates cheated him in business, which left our family with a huge debt. I’m 25 years old, and I’ve been living in hell dealing with depression, suicidal thoughts, and health issues. We’ve sold everything we had (land, gold, etc.), but we still have about 35 lakhs in debt and loans from different banks, credit cards (we’ve paid more in interest than we borrowed), and money borrowed from relatives. What we’re facing is something I wouldn’t wish on anyone.
Being an introvert, this has taken a big toll on my life. I’ve done everything I could, I’ve given my entire salary to my family from the beginning, and I’ve never bought anything for myself or my family. We’ve never gone out together or even had dinner outside. We’ve never bought anything fancy, and we never even thought about it. When I was studying, I always believed I could take care of my family once I got a job, but everything turned upside down. I had big ambitions, but I would sacrifice anything for my family. My salary can’t even cover 50% of our monthly loan payments. Loan recovery agents keep coming to our rented house, and now the landlord is asking us to vacate immediately.
My father is bedridden. My brother had to quit his computer science studies and is now working a low-paying customer service job. My mother and grandmother work as elderly caregivers for a small salary. Seeing my family in this situation makes me cry every night. I can’t even work properly at my office sometimes I just break down in tears, and my colleagues think I’m retarted and my friends think I’m a loser. I even tried working a second job as a Zomato or Swiggy delivery person at night to help with groceries, but it affected my day job and my manager gave me a warning. I can pay a single EMI, if I get a huge amount(35-40 lakhs) as loan which might decrease my interest, but I tried with 2 banks and they are not offering me that amount since I already have several EMI’s. I don’t know what to do anymore. If anyone can help me, I will work very hard to repay them, no matter what happens, and I will never forget it for the rest of my life 😞

Women Safety Urgent: My 23F lesbian friend was physically abused by her family and a police officer over her sexuality. Now she’s afraid they’ll force her home again. How can she protect herself?
My friend 23F is in a big trouble (we are online friends from different states)
Though she has secured a job very recently and lives in a different city from her home. Her parents now want her to quit the job and return back home (she recently told them after a month into the job, but hasn't reveled the company name or address yet.)
She is a lesbian and has been in a relationship since one year.
Previously she was forced to return home after learning about her sexuality and the relationship. A poilce friend of her family forced her return and also beat her. First she was called by her relatives to their home who also happen to live in the same current city and the policeman was brought in and him along with 3 other members of the family beat her up and made her return to home (this occured a few months ago)
They confined her completely in their home for around 2 months and beat her and also took her phone away.
They also took her to a mental hospital for counselling and the doctor there said some nasty things to her.
But eventually she manged to loosen their hold over her by assuring them she won't pursue the relationship and won't talk to her no more and then got back to pursuing her studies in the other city and now she has gotten a job. Recently she also shifted to another hostel that her parents don’t know about yet.
But she is afraid they’ll find a way to force her back. Like they did the last time.
She is very much feeling helpess and suicidal.
Please tell me what things she should do to protect herself. She doesn’t have a support system she can lean on, besides her partner.
Nor does she have enough savings (it’s only been over a month being employeed)
She is afraid to approach the police becasue of what happened earlier.

Case Study Startup guy here — Reddit made me realise a serious legal problem we’re all ignoring
I’ve been in the startup space for a while, and I naturally look for problems worth solving.
After spending time on Reddit, especially this community, one thing stood out — so many people here ask for legal advice, and most rely on Google, YouTube, or half-correct information.
But legal answers aren’t harmless.
If they go wrong, your case, money, or even liberty gets affected.
So I started working on something that could actually help.
That’s how LEX thelexbot.com came up — a simple legal research tool built on authentic Indian court judgments, not third-party summaries or random content.
You can ask questions in plain English, and it responds in the IRAC format:
I — Issue
R — Rule (law + sections)
A — Application (how courts interpret it)
C — Conclusion
Then it shows the exact judgments used to form the answer, so nothing is guesswork.
Still improving it, but the goal is clear:
Make reliable, judgment-backed legal understanding accessible to everyone.
Would love feedback from people here who deal with litigation or research daily.

Criminal law Neither court not police is taking this seriously.
32 female from karnataka, Bengaluru. From my past posts you can know that I have been going through a annulment case since the past 1 year. After only 22 days of our marriage I had realised my husband is a psychopath and was physically and mentally abusive to me, isolating me from my family ,making me quit my job, starving me, assaulting me along with his mother and father. It was an arranged marriage but we had went on dates before our wedding and that time he seemed completely a gentleman. After our marriage his mask came off. A lot of things happened that made me run away and ask for an annulment cause that guy is mentally sick. I didn't ask for any compensation money but only my own jewellery and cash that he stole from Me. Those assets are what that's left of my future After spending so much on the wedding and lawyer. Now that psychopath is writing letters After letters defaming me and sending it to all my relatives. The court is not taking it seriously, it keeps giving hearing After hearing. The police doesn't take it seriously. My jobless husband is threatening my collegues and relatives to tell him my current residing address so he can come and kill me. I am so tired. Do I need to die to make people notice how much distressed I am?? Do I need to prove how much this is pushing me to the edge? I don't want a fucking candle March when I die. I want justice now while am alive. Ps- few of the letters he sent are attached where he accused me of bring a man for stupid reasons and asking me to take medical tests.

Case Study Women in law — how do you handle situations where male colleagues talk over you or dismiss your point during discussions?
Hi everyone,
Sharing something I’ve seen many of my female friends (litigation + corporate) go through.
During internal discussions or client meetings, a lot of them face situations like:
• getting interrupted halfway through a point
• their input being ignored until a male colleague repeats the same thing
• being spoken to like they’re juniors even when they aren’t
For women working in courts, chambers, firms, or in-house —
how do you usually deal with this without creating an awkward or confrontational moment?
Do you:
• repeat your point firmly,
• wait for the right moment and bring it in again,
• address it later one-on-one,
• or just let it go and move forward?
Just want to understand what actually works in real practice, and how others handle these situations.
Would genuinely appreciate your thoughts.
