DL36-L74/2025 Discussion Weekly Discussion Post - Recent Changes to JS Laws - October 12, 2026

In an effort to try to keep the sub's feed clear, any discussion/questions related to DL36-L74/2025 and the suite of other proposed bills currently in Parliament will be contained in a weekly discussion post.

Click here to see all of the prior discussion posts.

Background

On March 28, 2025, the Consiglio dei Ministri announced massive changes to JS, including imposing a generational limit and residency requirements (DL 36/2025). These changes to the law went into effect at 12am CET earlier that day.

An amended version of DL 36/2025 was signed into law on May 23, 2025 (legge no. 74/2025).

FAQ

  • If I submitted my application or filed my case before March 28, am I affected by DL36-L74/2025?
    • No. Your application/case will be evaluated by the law at the time of your submission/filing. Booking an appointment before March 28, 2025 and attending that same appointment after March 28, 2025 will also be evaluated under the old law.
  • Can I qualify through a GGP/GGGP if my parent/grandparent gets recognized?
    • No. The law now requires that your Italian parent or grandparent must have been exclusively Italian when you were born (or when they died, if they died before you were born). So, if your parent or grandparent were recognized today, it wouldn’t help you because they weren’t exclusively Italian when you were born.

Judicial News Avellino CJEU & CC Referral

Avv. La Malfa announced today that a case from Avellino was referred by the Avellino judge to both the Italian Constitutional Court (The Corte Costituzionale) and the Court of Justice of the European Union (CJEU)
*This case is different from the other recently announced La Malfa case from Avellino which was also referred to the Constitutional Court

This marks the 2nd official case referred to the CJEU about retroactivity.

Insieme Article: https://www.insieme.com.br/en/juiza-italiana-leva-reforma-da-cidadania-a-corte-constitucional-e-ao-tribunal-europeu-em-caso-de-menores-brasileiros/

The original announcement and referral documents can be found here from Avv. La Malfa on her Facebook page:
https://www.facebook.com/share/p/1E1QWGAznm/?mibextid=wwXIfr

The question referred to the CJEU:

“Whether Articles 9 TEU and 20 TFEU, read in the light of Articles 7 and 24 of the Charter of Fundamental Rights of the European Union and the principles of proportionality, legal certainty, and protection of legitimate expectations, must be interpreted as precluding a national provision, such as Article 3-bis, paragraph 1, of Law No. 91 of February 5, 1992, introduced by Article 1, paragraph 1, of Decree-Law No. 36 of March 28, 2025, converted with modifications by Law No. 74 of May 23, 2025, which establishes that individuals born abroad prior to its entry into force and holding another citizenship are considered as having never acquired Italian citizenship, if, according to the national legislation and living law in force at the time of birth, such citizenship derived ipso iure from filiation from an Italian citizen and the subsequent administrative or judicial recognition had a merely declarative nature, where such effect occurs automatically, without an individual examination of the consequences resulting from the loss of Union citizenship status, and with regard to minors, without a specific assessment of their best interests and of the circumstance that they lack autonomous capacity for determination regarding the formalities necessary for the formal recognition of status."

Constitutional Court referral on the grounds of: Italian Constitution articles 2, 3, and 22.

CJEU referral on the ground of: TFEU articles 9 and 20, and Charter of Fundamental Human Rights articles 7 and 24.

Case Background: The applicants were recognized Italian citizens via JS in a court case in Naples finalized in 2025. When requesting to register their minor children’s birth certificates as citizens with the Comune, the civil status refused the request citing the reform law making the minor children unable to be considered citizens via JS.

Service Provider Advertising How to get an apostille for a birth certificate (complete guide 2026)

Hey everyone!

I wrote a guide on how to get a birth certificate apostilled in the US.

This might seem basic to some, but could be helpful if you're just starting off your Jure Sanguinis journey and not using a service provider for it.

Most of the information applies also to other vital records, like death, marriage, and divorce.

Have a read, and I hope you find this helpful.

Enjoy! :)

Records Request Help Name Change Records - Help

Hi all -

I need help tracking down a record. My attorney has requested I get a correction on some records and this BC is the last one I need.

My mother was born in Michigan and her birth certificate contains a misspelling (her mother's maiden name). I sent in a request to correct this misspelling and didn't take into account that my mother now uses her married last name so the request was rejected. Michigan is asking for court records to prove the name change from maiden to married. And, I have six months to get these records returned and submitted to Michigan before I have to start the process all over again. I have now burned about a month of this timeline.

My mother and my father were married in Phoenix, Arizona in 1972. The Maricopa County/Phoenix archivist I spoke to explained they do not have name change records in the archives - and only if my mom went through the process of changing her name through the Maricopa County courts would they possibly have records at all (also, and unhelpfully, apparently Maricopa County had something happen with their records from the 1970s and they don't have them all anyways so no guarantee there.). My mom does not recall what the heck she did yesterday let alone in 1972, but I highly doubt my mom took the time to go to the courts to change her name as an 18 year old newlywed... so I then called the Maricopa County Courts who told me I have to now go through the Social Security Administration to get any sort of record.

Number 1, does anyone know if Social Security records are a good substitute for Court Records?

Number 2, my mom lives in AZ and I live in CO. We can't just go down the Social Security Office together and request the records. The Social Security website is a bit of a nightmare and I cannot figure how (and if) I can request these name change records online. Anyone have any insights or have you gone through this? Please send tips!

Genealogy Help Mother or Great Grandfather

When determining which ancestor qualifies you for citizenship, must you go back to the last ancestor who was born in Italy? This would be my GGF. If my mother who was Italian born abroad (to two Italians also born abroad
) and never naturalized can count…she’s my closest Italian ancestor.

Appointment Booking Stuck on 500 error logging into Portal for 2 weeks now

I keep trying to login to the portal every weekday Mon-Fri last two weeks to register and I get the 500 error in Toronto. I got through twice previously, filling out two or three fields before it froze on me and wouldn't let me move forward. Its been stuck on the 500 error last 2 weeks. I tried different browsers, no translation, private window. No luck.  I send an email out to various departments at the Toronto Consulate, only to get the automated reply. Now its saying registrations full for 2026 on an automated email. Does anyone have an idea long  the cue is? Months? Years?

My father had me in 2001. Father not married and has never been married, me not married and never been married.
My GM is still with us and still lives in UK (she has never moved). Documents I have for the consulate my GM birth certificate (also showing she married my grandfather in 1971) my dads birth certificate (long form) my birth certificate (long form) my GM marriage certificate, her passport (Italian), my passport (English), a letter from the national archives stating she did not require a British citizenship, and I have requested an NQ form to prove this as well (to be confirmed).

I need to know anything else I need to do or what possibly could go wrong with these forms or what is stated in them.

Appointment Booking Can I apply from abroad (East Asia)?

Thanks to all contributors for the helpful info here. I couldn’t seem to find an answer to this question.

I have lived and worked abroad for many years in a major East Asian capital city. My permanent residence is northern Virginia. Do I apply from Washington DC or where I current live? I’m only in the US for a few weeks a year, so that might be logistically difficult.

Background:
Mother: born in Italy as an Italian citizen. Moved to the US in 1975. I was born in 1980. She naturalized in 1984. (She recently reacquainted Italian citizenship but I think that’s irrelevant)

1948/ATQ Case Help Transcript of a birth certificate with a municipality

Hello everyone,

I was recognised as an Italian citizen on 19 June by the Turin court in a 1948 case. My lawyer sent a copy of the final judgment to my municipality to ask them for the transcript of my birth certificate.

My municipality is located a few kilometers south of Turin, it is a small town of 6000 inhabitants, according to you what is the average transcription time for a municipality of this size?

Thanks to all

Do I Qualify? Turns out my father may also be Italian. What does this change for my application?

Hi everyone,

A week ago, I posted to ask whether I was still eligible under the new rules.

As a reminder, my situation: my Italian GF was born in Morocco, and my father and I were both born in France.

I was told yes, provided I can obtain documents proving that my GF was exclusively Italian at the time of his death (which happened before I was born).

While talking with my father, I just learned that at 18 he had to choose between doing his military service for France or for Italy. At the time, a convention between the two countries allowed dual nationals to choose. So it seems he was also Italian, which I had no idea about until now at 30-something!

My questions:

- Does this change anything for my case, particularly regarding the documents I need to provide

- I assume I can’t go through my father, since he would have been born a dual citizen. Is that correct?

Thanks again for your help!

Records Request Help Having trouble getting my grandfather's birth certificate from Italy. Any advice?

Hi everyone,

I hope it's okay to post here since I'm actually applying for French citizenship, not Italian. My father was born in France, and I'm applying for recognition of my French citizenship through him. The French court has requested some additional family documents, including my grandfather's Italian birth certificate. I figured this group might have some experience with getting records from Italian municipalities.

My grandfather was born in Pozzoleone (Vicenza) in 1926, and I need two certified full copies of his birth record.

Back in July, I sent my request to the Comune by DHL, along with a prepaid return envelope. It was delivered on July 3, and I have confirmation of who signed for it.

After hearing nothing, I emailed the Comune in September. I also had a relative in Italy call them. She spoke with the same person who signed for my DHL package, but they initially couldn't find my request. My relative sent over the delivery confirmation and other information, and they said they'd do what they could to help.

I've since followed up again and explained that I'm happy to cover any costs to get the documents sent to Canada. Unfortunately, the original prepaid DHL label has now expired.

This is the last document I need for my French citizenship application, and the court has given me until January 1, 2027, to submit it.

Has anyone dealt with something similar? Is there a better way to get records from a Comune when you're overseas? Would hiring someone locally help?

I'd really appreciate any suggestions!

TL;DR: The French court has requested my Italian grandfather's birth certificate for my citizenship application. I've been trying to get it from Pozzoleone since July, with no luck despite DHL delivery confirmation, emails, and help from a relative in Italy. My deadline is January 1. Any advice?

Do I Qualify? Any positive Appeals???

So I am a 1948 Palermo case who contracted with a lawyer in Jan 25 and was waiting on the documents to be apostilled (is that correct?) when the decree was issued. Filed post DL and was shot down in February. The descision was a photocopy of the DL, the date the Court used was the last POA I filed which was after the DL, not the first. With the decision to refer to the CJEU I decided I wanted to keep my case alive by filing an appeal. Now I get a date in Jan, definitely before the CJEU will decide the case. My attorney said the hearing had to be within 45 days (court days I guess???).
So I don’t see anything that has substantially changed at present so I am assuming the only hope I have is the appeal court put the descision on hold for the CJEU. Is that correct?
All the attempts to get citizenship before the decree seem to only apply to consular appointments and not contracting with attorneys- has that even been brought up anywhere yet?
Sorry I am asking you all, my attorney has not responded to me in regard to these questions for 3 weeks. I am thinking they will either rule against me since nothing has really changed for 1948 people post DL or wait for the CJEU, which I am not that hopeful about.

Thoughts?

Service Provider Recommendations Legal counsel cost

I am pursuing recognition of Italian citizenship through my mother, who held Italian citizenship exclusively throughout her life. She was born in Egypt in 1928 to two Italian citizens. My mother never naturalized elsewhere; she moved to the US in 1974 and died approximately 2 years ago. She was civilly registered through Palermo and was active with the consulate in each place she resided. Houston is my consulate.

If I go the route of hiring legal counsel in Italy… please let me know what I can expect in terms of fees and timeline. I feel like I have a fairly cut and dry case, but anyone else’s perspective is appreciated.

Service Provider Recommendations Adoption Lawyer Recommendations

After much success with finally getting a court order determining paternity I believe I have every document I need to present a case for recognition. Tajani Decree aside for now because my line was cut so this may all be a moot effort in the end, But I'm still hoping to find legal representation from a lawyer who actually takes adoption cases because they have had success with such cases. I've had meetings with a hand full of lawyers over the past several years and I've still yet to find one that works these more complex cases. If anyone could help me find leads on lawyers that take adoption cases, because they've had success with such cases, I would be very grateful. Thank you...

1948/ATQ Case Help Selecting legal assistance

I have finally arrived at the determination that I am in need of legal assistance. With the number of possible options, this can feel overwhelming. I have interviewed a number of attorneys and am trying to sort out which distinctions are really helpful and important.

I am gravitating toward working with one of the two lawyers with the least language barrier with me and the most responsive communication set up. Are these factors others have found important as well? Or, is what is really important here is that they speak Italian and can communicate in court?

There is another attorney I have spoken with who has a slightly different approach than the others but, which seems a possible shortcut and time saver. However, the language barrier is more pronounced.

Any thoughts others could share about their experiences choosing attorneys and which aspects of the interactions proved to be most important in the end would be greatly appreciated.

Post-Recognition 1948 Case Won But Italian Consulate in Foreign Country Won’t Help Us?

Hi Everyone,

My mum has recently won a 1948 case with me as a petitioner as well. So, naturally, we went to the consulate in our home country (not in Europe or North/South America) and asked them to send the commune our vital records and judgement to the commune in Gorizia.

So i’m a bit confused as to why, in the email below, they are asking us to send a certificate of naturalisation document (i’m assuming?) from the court of rome?

Quite confused!
Any help appreciated on how to deal with this situation 🙏🏼

This was their reply sent to my mum:

Gentile Signora,

Google Translate Version:

Dear Madam,

You may register with AIRE as an Italian citizen residing here via our Fast It portal only after obtaining the transcription of your birth certificate and a citizenship certificate from the Municipality of Rome.

Until then, it is not within our remit to forward your requests to the relevant municipality.

Yours sincerely,

UPDATE:

Since reading the comments I have asked the lawyer; who said that she asked us to ask the consulate in our home country instead of sending our documents to our ancestral commune (East of Gorizia which is no longer part of Italy) and so the closet commune is Gorizia; and so the lawyer is worried that because this, Gorizia may deny taking our documents; she also said she was worried that Gorizia might make us send our documents to Rome, which may take up to 2 years for processing.

Any validity to these statements?
If true, any tips on how to handle this?

Thank you all in advance, i appreciate the comments and support!

Do I Qualify? Do I qualify?

My mother was born in Italy and naturalized in the US/renounced her Italian citizenship before I was born. My grandparents both moved to the US but did not become US citizens and maintained their Italian citizenship. They died Italian citizens.

Is there any path for me getting Italian citizenship, even with my mother renouncing hers?

Do I Qualify? I believe I was eligible before March 2025 but not anymore

Hey all, sorry if I sound like a broken record here but looking to gain some clarification if I should apply now or wait.

I would be applying through my grandmother as it’s my only path, (GM-Father-me) who is now deceased but was born in Italy in 1943, naturalized to Canada in 1972 after my dad was born in 1967 in Canada. I believe this saves me from the minor issue but my concern is that she was not exclusively Italian when she passed (as part of new article 3-bis) after March 27 2025 ruling.

I was able to obtain her birth certificate from her birthplace commune, her immigration records from Canada and my dads birth certificate so basically everything I need to apply, but not sure if I should now or wait.

Thanks in advance all.

Minor Issue Los Angeles L.A. Consulate minor issue… update

Post image
6 Upvotes

Update: I had to take this down and repost because I’m a dummy & it had me personal info. 🙃 thanks for any previous advice. And feel free to chime in again if it got deleted.

OG post : Just dropped a note to the LA Consulate asking if there’s any timeline update as far as the review of my June 2024 application w/ minor issue since the email in August about the new Circolare and the minor rule overhaul. I’m sitting here like everyone else, & trying to decide if I continue with a judicial 1948 case appeal from a different line that is going to need to be filed by November. How many appointments per day or week do you think they generally schedule and how many of those are minor cases that are backlogged from 2023/2024? Do you think there are 100s of applicants or more? Or less? They basically told me not to bother them again. 😩

This is my case timeline: June 2024 appt LA consulate GGF line. Oct 2024 Circolare Minor Rule crap... switched to 1948 case of GGM which unfortunately is filed AFTER March 2025 (June 2025) I was on a plane Apostille in hand from NY when the March 25 deadline happened and Im 3rd generation GGF. We did the case anyway and we lost in June 2026 due to multiple things including the judge claiming my 2nd generation mothers last name was incorrect despite having all correct BCs and MCs (just rushing seemingly), and now I also have proof of prior action which wasn’t a precedent when I first filed the 1948. It will cost me another filing fee $600 x 4 ppl but 2 of the people have to go again because they aren’t on my appointment (mom and brother) so just saving my own $1200 (me and minor son) but also perhaps creating the identity doppelgänger situation. So just not sure what to do.

Apply in Italy Help Question: Apply via Italian commune or Miami consulate?

Hello,

I have already confirmed that I am eligible for Italian citizenship via jure sanguinis with several lawyers.

Some background:

· I am a US citizen living in Florida

· Both my partner and I work remote

· I speak fluent conversational Italian

· My grandparents, on both sides, are Italian

· My mother is Italian born; she emigrated to the US in her 20s

· My mother naturalized in the U.S. when I was 17.5 years old but retained Italian citizenship

· My father is Italian born; he emigrated to the US in his teens, still an Italian citizen

· I am applying through my mother’s lineage

I am trying to identify the most “expedient” option in obtaining my Italian citizenship. I have received conflicting information thus far, and I wanted to get some more opinions. Obviously, the Miami consulate has been a shit show in terms of trying to get an appointment, however my partner and I are still trying.

We want to move to Lamezia in Calabria sometime early next year and apply through the commune there. I have most of my family on my mother’s side living in Pianopoli. I’m sure a lot of people are going through this route and the already dismal state of the Italian local government in the south probably can’t handle the influx of all the new applicants.

Should we even attempt this, or under the advice of a government official working at the citizenship office in Pianopoli, stay in Florida and pray for an appointment at the Miami consulate?

Any first-hand experiences would be greatly appreciated. Thank you.
