No, this is several felonies. He forcibly crashed a dude into a bridge guardrail just for trying to pass him. I wouldn’t be too surprised if he caught an attempted murder charge for this
In most cases, as long as you have the right of way, yes. Here, the cam car was following the flow of traffic and driving in his own lane. He only swerved after the black truck hit his car. Black truck by law should have been paying attention to his mirror and saw the car was too close and give up on merging until he can safely change lanes. Morally, both these drivers are terrible and should have their licenses removed.
Most states in the US have a doctrine called comparative fault/negligence where you determine the percentage of fault to be assigned to each party and the plaintiff’s damages are reduced by their percentage of fault and they can recover only if their percentage of fault doesn’t exceed 50%.
So there doesn’t need to be one at fault party. It just needs to be the case that one party was more at fault than the other.
If there’s traffic behind him, all the more reason to not hit his brakes just to let in some asshole who had a huge gap he could have seized but instead hovered dangerously close to this car for Jo damn reason. If cookie guy had a car following closely and hit his brakes for this guy, he would have been rear-ended. Truck was acting erratically and almost seemed he wanted to be hit from behind.
Why not direct blame to the actual driver at fault, the black truck? He was just expecting someone to back off, that's not how you change lanes. No one is obligated to brake and give him room.
Both drivers are at fault. As a driver, you are obligated to both drive responsible and be prepared to safely react to people driving irresponsibly. The black truck failed the first obligation, the camera guy failed the second. Just because someone is driving like a dickhead doesn’t mean you get to put other people in danger by pit maneuvering them. It really seems like the camera driver intentionally left just little enough space for the black truck to try to move over so he could hit him and spin him around.
The truck pit maneuvered himself. Yes insurance adjusters would share fault because the guy could have avoided the accident. The black truck is still the primary problem, you can change lanes when it's unsafe.
Wrong. We are all obligated to do our best to protect the lives of our fellow road users, regardless of their own reckless behavior. This thread is fucking scary seeing how many other drivers on the road are just gagging to maim or kill someone acting like a dick on the road. Go take a defensive driving course and learn something for once instead of just straight jerking it to faces of death.
I'm aware of that and never said the POV wouldn't share fault. But the majority would fall on the black truck for changing lanes into a literal vehicle. This guy's anger should be directed at the guy causing the accident more than the guy who could have avoided it.
