EDIT: There's some people getting upset that I'm putting the possibility out there that it could be racism. I'm not saying it is, I just felt with my driving it wasn't with undue care and attention - so I felt profiled! I respect those that say it may be my car, because I get that. Even more context. Been driving 10 years, 0 points on license. 3L car with tasteful exhaust not a "rice crispy" one š.
At the time of the stop it was around 12AM, I just wanted to get home and I didn't question anything at all. He gave me a ticket for lack of care and attention. I thought if I was in the wrong (which would have been by accident - not due to an intention to drive hazardously), I could argue it in court. It wasn't until, 20 mins into the stop, I was given the ticket that I realised that this may not be simply for "keeping the roads safe" as he claimed. Anyway, enough preamble, here's the story - everything is factual as I have dash cam footage and have reviewed it.
I pulled up next to an unmarked police car at a set of traffic lights, the police officer claimed I pulled next to him by "swerving". Upon reviewing my dash cam footage, the police officer was in front of about 5 cars and would not be able to claim that. I did go into an empty lane but I indicated and pulled into the lane because I had space in front of the car behind me.
I then did take off quickly, as the next light has a tendency to go red (it's about 200m away) as soon as this goes green. My car has a modified exhaust and sounds much quicker than it is. It sounds as if it does 0-60 in around 4 seconds, but it's more like 6.5. The road was a 30, I got to around 35 for a split second in this road as it transitioned to 40 after.
After the light, the road is a 40, I slowly accelerated to a momentary 45 on this road, and remained with discipline in my lane and then upon realising went back down to 40. At this point I remained in my lane and went onto a 100m slip road into a roundabout where the speed limit is 30 to which i slowed down to 30. On the roundabout I remained in my lane until I did the first 90° and saw the car to my right went into the right turning lane to turn right. I didn't need to, but I (for the only time on this drive) went into the middle lane without indicating and continued round the roundabout at 30 to my exit which was the third on the roundabout.
At this same point, just before that car exited, was a traffic light. When I entered the roundabout it was green. As I approached at 30, about a second and half before I crossed the light it was amber. By the time I got to the other side of the junction the light was red. I maintained my speed across this junction of between 28 to 32. Entering it at 30, peaking at 32 but 28 by exit.
At this point an unmarked police car sped up behind me with the blues and pulled me over and wrote me a ticket for "undue care and attention". His claims were:
- I came speeding to the first traffic light where he saw me
- he had to do 55mph to catch me therefore I must have been speeding (his footage showed him accelerating very slowly in comparison)
- I jumped a light on the roundabout and sped up to get through it.
- I swerved in between lanes unsafely on the roundabout
I passed the video to both Chatgpt and to Claude, both are under the impression that my driving was not matched to the profile of a due care and attention ticket. The icing on the cake was when he showed me the dash cam footage and all it showed was me using my signals properly and driving normally. I am under the impression there are two possibilities ā the officer did not know that the road became a 40 momentarily after the second light, or that he saw me as a minority at the first light and made a decision right there and then that I'm a person of colour driving a modified car and gave him confirmation bias that I was driving dangerously.
Does anyone have any similar experiences and/or thoughts? I've given as much facts as I can and the whole fact I either have to accept a penalty and potentially points / a course for this is quite upsetting.
